Stepping outside helps somewhat, the slight breeze is a welcome change from the stuffy air of his room. Regulus walk softly along the balcony, all the way to the end of the block and down the rickety metal stairs to the car park. It's so quiet - save for the buzzing of the neon vacancy sign and the occasional truck steaming down the adjacent highway.

The peace and quiet is a welcome relief - a blissful moment of escape to be alone with his thoughts. They’ve been on the road for weeks, leapfrogging down through California and across the South West, hitting as many tourist hotspots as they can. Out here, under a million twinkling stars, everything seems so inconsequential. It’s second nature to him, to search out the two of them whenever the sky is clear enough - a habit long built up from obsessing over astrology books and sneaking into the back garden with Sirius at night when they were children.

He wonders if James has found the stars as well, if Sirius ever took him stargazing and taught him how to find them. He contemplates joining James now, striking up a conversation about it, but with everything that’s going on the situation feels too heavy for lighthearted anecdotes about the stars and their mythological backstories. It hangs so heavy in the air that to talk about anything else seems impossible.

For the first time, it really hits him. That is his husband - in the eyes of the law, they are legally bound and dependent on each other. It comes like a sudden wave of loneliness. James is no further than a few feet away, Remus and Sirius in their room within shouting distance, but Regulus feels a million miles away from everyone - as far away as his namesake. He can’t talk to anyone about this. Sirius is oblivious. Remus suspects something - has made the odd remark here and there, scratched at the surface but Regulus can’t let on any more. And James, well, where to even start with that? Regulus can’t even articulate the words in his mind, let alone speak them aloud. And besides, the only thing they’ve said to each other was to confirm their legal separation at the very first chance they get, it feels too weird to open up on such a deep emotional level now.

It catches in the back of his throat, choking him up slightly and he turns his attention back to the night sky. In a moment of inspired bravery, Regulus moves silently to join James. He leans up against the motel wall and lets himself slide down so he’s sat on the rough ground, knees knocking James in lieu of a greeting. 

Neither of them say anything right away. James is drinking a beer and he silently offers Regulus a slip which he willingly accepts. 

“I hate this,” James says finally after another swig. He sounds so defeated that it pierces Regulus and buries itself in his chest.

“I’m sorry.” The words fall from Regulus quieter than a whisper.

James' eyes flicker to him, Regulus can feel them burning on his skin. “It’s not your fault,” he says with such soft earnestness, but Regulus can’t bring himself to believe him.

A minute passes, maybe two or three, it’s impossible to judge the passing of time with nothing but the constellations. There are words Regulus wants to say but he doesn’t trust himself to formulate them in an articulate manner.

Like he can read Regulus’ mind, James speaks up again. “I don’t hate this whole marriage thing, it is what it is,” he clarifies. “I hate how it’s made things weird before us and I hate the guilt and I hate not being able to talk to Pads about this.”

Of course, the worst part about this for James is Sirius - that he has been lumped together with the worse brother, the fact there’s something they can’t talk to each other about, that for the first time since they were twelve, there is a wedge being driven into their friendship. 

“If that is meant to make me feel better,” Regulus speaks slowly, carefully enunciating each word and trying to mask any emotion in his tone. “It doesn’t. I’m sorry that I caused such a drag in your life, but as soon as we get this annulled, I’ll get out of your way and you can go back to normal and forget all about this.”

James stares at him in confusion, “I didn’t - I don’t think you’re a drag.”

Regulus just shakes his head, pushes himself to his feet. “No, it’s fine, sorry for getting in the way of you and Sirius.”

James' feet beat on the ground as he jogs to catch up with Regulus. He whisper-shouts his name, quiet enough not to disturb the other motel patrons, but loud enough that it's obvious Regulus is intentionally ignoring him.

He catches Regulus outside his room, grabbing his wrist and forcing Regulus to turn and look at him. His throat is tight but he refuses to look James in the eye, pointedly looking past his shoulder instead. Maybe it’s an attempt to throw James off or maybe it's just to avoid the submissive undertones when he's inevitably unable to hold James’ gaze longer than a few seconds.

“You’re not getting in the way of anything,” James says but the words don’t mean anything to Regulus.

He shrugs off James’ gasp. “No it’s fine, I get it. It’s weird, you hate it.”

"I don’t hate this.” Although the words come more like a question and the uncertainty makes Regulus want to simultaneously strangle him and run away from this forever.  

“It's fine, James," Regulus repeats. "I know I’m the last person you’d want to get stuck with and I know you hate this and that’s fine as well, but you don’t need to lie about it.” 

James takes his hands, holding them gently in his own. He looks at him so softly, something shifting in expression that makes Regulus’ stomach twist. “I don’t hate you Reg. I know it’s weird  but I don’t - I don’t hate this.”

Reg breath hitches. “You don’t?”

James steps closer, reaches up cautiously to rest his hand on Regulus’ cheek. Regulus doesn’t pull away, just looks up at James through thick lashes and focuses on the sensation of those calloused hands on his skin. He feels a little light-headed - lost in dark eyes and the touch of those big, strong hands. Regulus swallows. He wants those hands on his chest, gripping his thighs, around his neck. James is intoxicating, it’s the only way Regulus can describe it, and as much as he would like to blame it on the alcohol, the buzz he’d built up when they were all drinking at the bar early that evening has long worn off. 

In a moment of sudden bravery, Regulus lurches forward - grabbing James by the collar and crashing their lips together. There's a faltering moment when he thinks James is going to push him away, but then James is pushing him back against the door of his motel room and Regulus is fumbling with the handle.

They stumble into the room, James wrapping one arm around Regulus' waist, pulling him impossibly closer as he kisses him back and he tangles his other hand in Regulus’ hair. Regulus snakes his arms around James' neck, lets out a stifled moan as James leans down, almost dipping Regulus as he arches his back to meet James’ chest.

“Fuck, Regulus,” James mutterers against his lips. ‘“What made you think I could ever hate you?”  

Regulus shifts, cranes his neck as James moves to kiss the corner of his mouth, his jaw, and down to his neck. His touch is exhilarating as Regulus lets his eyes flutter closed. “You’re the one who’s been avoiding me,” he mutters.

“Not because I don’t like you,” James retorts. “Quite the opposite.”

Regulus blinks a moment, cups James' face with his hands and forces him to look up at him. His cheeks are flushed, lips parted and panting slightly and Regulus searches futilely for a hint of a lie. “You’re not just saying that?”

James just grins at him with that dazzling smile that makes Regulus giddy. “Cross my heart.”

Speaking ill of the Dead

Okay, let’s have this conversation. The tragedy on the Titan Sub is an incredibly complicated topic, less so because of the actual technical issues of the submarine but for the actions of the company and crew. Perhaps by calling it a tragedy I have already made my opinion somewhat clear, but let me lament about the topic a bit further. 

Clearly the company did not take well enough actions prior to the dive of the submarine. It has had no peer review, not certification, and every attempt to express concern on the Submarines integrity was ignored in favor of a quicker time tune over and a profit. This is an inherent problem in the Adventure industry, where something that is meant to be undertaken slowly, carefully, and by well prepared experts is done by people who want an adrenaline rush and an experience. This leads to a lot of tragedy in the Industry. 

Secondly, the crew aboard has made some questionable designs in their life. I believe one report I saw claimed the co-founder of OceanGate and pilot of the Submarine was previously a private jet owner and flyer and thus according the account responsible for heavy air pollution and in passion of already great wealth. I believe they (the author of the account) found this to be abhorrent, and anybody who respects this earth would react to pollution, and found him to be  a terrible human being. 

There is also the issue of whether or not the site of tragedy should be a tourist destination, and also the waver the crew signed when entering the vessel. The waver clearly stated it was an experimental vessel and an uncertified one at that. 

Now none of these are what I have an issue with, seeing as I honestly think many mistake were made, that’s what makes it a tragedy and not a horror. What I have issue with it going around saying they deserved death, as though we should let people make their beds and lie in them, as though we should look death in the face and call it humane and right, as though I am supposed to speak ill of dead men for their money. 

So I’m going to go into these issues, from the point of view of a Sailors child. My parent is a sailor, and a Submariner at that. We’ve had extensive talks about the issues here, and I’d like to poke a few holes, a patch a few others, and make some conversation while I’m at it. 

I would like to ask you dear readers, what in the world do you actually know about Submarines? Had you read that waver, would you honestly believe there would better options? Would you know about the three to five organizations that certify Submarines or would you assume uncertified meant non-military? Would you not assume this new and amazing technologically was of course experimental? For what else could innovation in adventure be? 

There has been some outrage about the fact that the submarine was piloted by a game controller, well guess what, Navy Submarines have them too. Until very recently most Periscopes on Submarines were made to function through a highly calibrated set of mirrors. Quite literally mirrors. The submarine scene from the Fast and Furious 8 movie made me so mad, because there is not enough technology in an older submarine for Cipher to hack if she tried. Now, the most recent submarines use digital cameras in their periscopes. Want to know how they maneuver that? With an Xbox game controller. One of the Sailors pointed out that the technology for game control, meant to be intuitive to the user, could be very useful on the submarine and thus the engineers made it happen. Do not pretend the wireless, intuitive controller is not amazing technology because it helps you play video games. 

Another thing about Submarines, did you know that worldwide, during peace time, many nations have a specific system set up with each other to do search and rescue for submarines? Look up the disappearance of the ARA San Juan, an Argentina sub that also imploded and was only located with national help. The Hulk wasn’t too far off when he talked about being in a pressurized can being a bad idea. Submarines are some of the most deadly machines we have, in their military use and how much danger there is to operate them. As such, the international community reacts to them according. The US Navy specifically has a policy of being able to launch search and recovery equipment to the needed location or at least en route to within 24 hours of notification. This includes sonar and deep sea ROVs. Based on previous precedence set by Submarine emergencies, the international community is more likely to respond to Submarine disasters quicker, they have less time. 

So Yes, the tragedy of the refugee ship of Greece is a politically fueled tragedy and loss of life, but it is not the same as the Titan. The Titan didn’t get more attention because it has billionaires on board, it got more attention because it was a Submarine. Submarines have the benefit of being a recent dilemma for the world theaters, so they have more modern solutions while Refugees and Sailing ships have had centuries of existence to be wrangled into political machinations that make it complicated to rescue too retrieve. 

What is more likely to be a problem is the retrieval or lack there of the bodies, as those bodies are usually mounted over, but bodies lost at sea rarely get returned. The Navy has always held that the ocean is a fit and final resting place for those lost at sea, and while due respect is paid to their loss, retrieving the bodies and wreckage is harrowing and expensive. If you truly want to rage against those with a lot of a money, start asking who’s going to be paying for the retrieval operation and all that time spent searching. I would argue it should be OceanGate, for their negligence in the integrity of their Submarine lead to a loss of life. 

I will also honestly say this, I hate to speak ill of the dead even when it must be done. Yes, some of these people lost did terrible things, but they did not only do evil in their life and their story should not just be “They did this but they also did this!” it should be instead “They did this and this.” Was the french diver not also one of the only certified people to take wreckage from the Titanic to surface for study, posterity, and for museums? Was the British explorer not also a history enthusiast who was excited to see a piece of history he studied so fondly? Was the Son not also a student? Perhaps the pilot did pollute the earth, you’d be hard pressed to find someone who hadn’t, his crime is perhaps instead doing nothing to fix pollution. 

I believe a lot of us apply Spiderman's “With Great Power comes Great Responsibility” to those with Wealth, and while not wrong we get too disappointed when they fail to meet our standards. They are not obligated to help the world, as much as we need them to be. We want them to be better people, but they won’t always be. It is not wealth that made them bad, but their actions or lack thereof with it that did. 

The Navy hosts something called the Submarine ball, to celebrate the creation of the Submarine force. And every Submarine ball, they will list the submarines sunk and the life lost on them. I have gone too many times, heard that speech and list too many times to call the death by horrific pressure and cold and drowning something somebody has to have had deserved. 

Look up the specifics of implosion, of death, of how your blood boils if you rise to fast, of the cold seeping in so fast you feel like ice, to the lack of hair, and tell me you wish that on people. Tell me you have enough in you to wish somebody to die by the sea, lost and scared, and tell me how that makes you a righteous and good person. By all means rage an injustice, rage at the unfair, but do not turn that into a right to murder, to kill, and wish death on others.

3-Your air, water, and food are poisoned intentionally by the above said groups because they don't want you to live long enough to be strong enough to change any of the above. And they're doing the same with your brain via mainstream media. Bombarded with lies that keep billionaires in power. You don't know what the truth is, and you're working too much to have time to search for it! All intentional!

What to do? 3 steps.

1-Every business, every single one, is owned by the workers. This not only stops foreign interests from gaining from YOUR labor and YOUR resources, pays workers better, BUT, it also holds these businesses more accountable for their negative actions. Yeah, you're a rich oil worker now, but you have to pay for damages for all those future spills...oh your food is killing people? You're god damn closed down. Sure, profits will go way down, but so will fucking pollution.

2-Same with utilities. Locally owned and controlled. No exception.

3-Same with BANKS and currencies. There is (I believe) a popular truck stop franchise doing this; they're making gift certificates with REAL resources so they're valuable just beyond the actual use in store. It IS as simple as that. And don't fucking say credit unions. They don't come to you to ask if they can build a brand new building. They don't give you a cut of their profits. They don't give loans to people who need them the most. Credit unions are the lesser of two evils, but STILL FUCKING EVIL.

In other words, make everything locally and publicly owned on every scale. It is that simple!

The story I am telling you could be fictional or actual events. I won't impose a personal view on those who will find themselves listening to it, and I will narrate it with the appropriate filters, albeit taking the liberty of not telling you when and how I'll use them. For those who are listening to this podcast for the first time: my name is Alika Diamandis. For the past two years, I have been traveling around the United States following the wave of urban legends. My latest research has taken me all the way to StrangerVille. A charming town where citizens are slowly losing their minds. Local news reports are talking about polluted water and a micro pandemic coming from horses. Could this really be the case? As always, nothing will stop me from finding out.

I. Something Strange Happened.

In just one month, ten people lost control. No medication had had any effect. Somewhat problematic given that the symptoms everyone indiscriminately had experienced up to that point was characterized by bursts of blind violence and muteness. The local police always intervened promptly but not enough to prevent photos and whispers among the citizens.

Chatting with the person behind the Instagram post, they assured me several times that the news reports were covering up everything. Words that had the flavor of conspiracy but which, for some reason, I decided not to ignore. The "pandemic" made it incredibly cumbersome to be able to set foot in the city. At the entrance, I had to present a certificate with all my vaccines and sign a very annoying sheet full of stipulations in which, in case of illness, I would have to accept hospitalization. Bureaucratic idiocies to season media idiocies. Having passed this initial hurdle, I cannot say my first day in Strangerville was kissed by lady luck. Not that I expected otherwise given the situation.

Arriving at my new temporary home, a downtown motel visible all the way to Mars thanks to the gargantuan neon flamingos on the roof, I took a few hours to rest from the journey to StrangerVille. The very moment I left the room, was also the moment I slammed my face against the reality of the city. Right in front of my door, lit by the early morning light, was a motionless young woman. The smile she gave me was distorted and painful to look at, her eyes wide and lifeless. «G-good morning.» Over the years, I had been confronted with the most unusual oddities, but I must admit that this was one of those times when my blood froze. Oppressive and dangerous vibrations were coming from the woman. Rarely has my sixth sense gone on alert so suddenly and so vehemently. Even more disturbing, no response came from the woman. She stood watching me like I didn't talk; I wasn't even sure she was breathing. «I'm- Uhm… I'm going. Okay?» I said in a feeble, deliberately soft voice, closing the door behind me. I tried to walk around her to leave, but in a blink, I felt my wrist clenched between five icy fingers that were definitely stronger than I would have expected. «e҉҉m҉҉b҉҉r҉҉a҉҉c҉҉e҉҉ ҉҉h҉҉e҉҉r҉҉ ҉҉b҉҉e҉҉a҉҉u҉҉t҉҉y҉҉."» Her voice was eerie and atonal. Terrifying. «Maybe another time, how about that? Now I'm really, really in a hurry you know…» As useless as I supposed speaking was, I still tried to slip away with words. The grip on her wrist was so firm that I thought I would have to dislodge her fingers to free me.

However, luck was on my side. For no reason at all, the woman let me go. She did not stop staring at me, and her presence became so oppressive that it made me nauseous, but she left me time to run down the fire escape and head to the historic part of town.

My first stop was the Strangerville Information Center. Over time I learned that the smaller the town, the more accurate the information available about its history. It is easier to find an article dating back to the 1920s in a small town than in Los Angeles. Getting myself a library card was relatively easy, and the woman at the counter proved to be incredibly polite despite my out-of-town appearance. A lady in her 40s, more than happy to see how not all young people rely on the Internet for their research. I deliberately avoided saying that this research is to construct a case to be featured on my internet podcast, but I think it is one of those cases where it can be called a white omission. After several hours of sifting through old newspaper articles, I discovered that one of the possible leads was much more recent than I could have imagined.

“The Military arrives in StrangerVille! Residents rejoice as a new base opens after the one near the crater was suddenly shut down. The City Council welcomes the opportunity of new jobs for the struggling town.”

Before looking for new leads, it was time for me to chat with Strangerville residents about the sudden closure of the old military base. This could be a blunder, but my sixth sense dictates that I give this sinister turn of events a chance.

Kerala Micro Small Medium Enterprises Act 2019 has overriding effect over The Kerala Panchayat Raj Act, 1994.

Civil Appeal Jolly George & Anr. v. George Elias And Associates & Ors.

The appeal is filed by the people of the locality.

Facts:

George Elias and Associates, the original writ petitioners, were engaged in undertaking road works in different parts of the State of Kerala.

They purchased Hot Mix Plants for carrying out the road works for which they bagged contracts for road work in Cherthala Aroorkutty.

Within a few months, the Kerala MSME Act came into force and hence the writ petitioners obtained an Acknowledgement Certificate.

Writ Petitioners submitted an application on 05.02.20 to the Kalloorkad Panchayat for the grant of a license, for installation of the Hot Mix Plant.

On 04.03.20 Kerala State Pollution Control Board granted “Consent to Establish”.

No response was received from the Panchayat so the Writ Petitioners claimed the benefit of deemed provision as provided in the Rules of Kerala Panchayat Raj.

Objections were raised by the members of locality.

Kalloorkad Panchayat rejected the application of the Writ petitioners for establishing Hot Mix Plant vide its order dt.12.05.20.

Rejection order was challenged before the Kerala High Court. Interim Stay was granted against the order of Panchayat.

A second Writ Petition was filed for declaration that when Acknowledge Certificate id obtained under Kerala Micro Small and Medium Enterprises Facilitation Act, 2019 than license under the Kerala Panchayat Raj Act, 19943 is not necessary.

Decision of Single judge of Kerala High Court:

The Hot Mix Plant of the writ petitioners was a portable equipment and that it does not fall within the definition of the word “building” under the Rules of 2019.

 The learned Single Judge also held that after the grant of “Consent to Establish” by the Pollution Control Board, permission of the Panchayat was only formal.

Order of Single Judge affirmed by Division Bench: This view was also confirmed by the Division Bench of the High Court.

Contention of the objectors:

Panchayat has a public duty to safeguard the areas and persons within its jurisdiction against environmental pollution and that the precautionary principle requires to be applied.

Rule 3 of the Kerala Micro Small Medium Enterprises Facilitation Rules, 2020, requires all persons seeking Acknowledgment Certificate under Section 5(3) to furnish a duly filled self-certification in Form-I.

This form contains an undertaking from the applicant to comply with the Kerala Panchayat Building Rules, 2019 and hence it is contended that the writ petitioners cannot avoid the requirement of permission from the local Panchayat.

Observation of the Apex Court

Neither Single Judge nor Division Bench of the Kerala High Court had gone into the overriding effect of Kerala Micro Small Medium Enterprises Act, 2019.

Section 10(2) of the Kerala MSME Act makes it clear that the provisions of the Kerala Panchayat Raj Act, 1994 shall be read as amended to be in conformity with the provisions of the Kerala MSME Act. Therefore, the Rules framed under Kerala Panchayat Building Rules, 2019 cannot annul the effect of the statutory provisions.

Section 10 of the Kerala MSME Act does not override the provisions of any of the pollution control laws such as Environment (Protection) Act, 1986, Air (Prevention and Control of Pollution) Act, 1981, Water (Prevention and Control of Pollution) Act, 1974. The Kerala MSME Act overrides the 1994 Act and a few other local enactments.

Writ Petitioners have taken “consent” from the Pollution Control Board. Once consent is taken from the Pollution Control Board, the necessity for reading down Section 10 of the Kerala MSME Act, for the purpose of protecting the environment, does not arise.

The argument that Panchayat being the grassroot institution, has the right of participation in decision making, is again misconceived. All Panchayats want motorable roads

But if they do not want road construction materials to be manufactured within their Panchayat, we do not know where from these materials can be imported.

Decision: The Division Bench of the Apex Court comprising Hon’ble Mr. Justice V Ramasubramanian J Hon’ble Mr. Justice Pankaj Mithal J vide their order dt.12.04.2023 dismissed the appeal of the objectors and allowed the Writ Petition of the Respondents.
