on January 18, 2016, Mesa Police in Mesa, Arizona, responded to an incident at a La Quinta Inn after reports of a man pointing a hunting rifle out of his hotel room window.
the man, later identified as Daniel Shaver, 26 years old from Granbury, Texas, was seen aiming a gun towards the pool area. Shaver worked as a pest control specialist in Texas with his wife and two daughters and was in Mesa, Arizona, for a business trip.
when police arrived, they encountered Shaver and a woman in a hotel hallway. officers instructed them to kneel on the ground and crawl towards them. the woman complied and was not harmed.
however, as he was sobbing and begging for his life, crawling and complying with instructions, Shaver was shot and killed by then-officer 27-year-old Philip Brailsford (obvious content warning).
the situation escalated when Shaver, whose shorts were falling down, reached towards his waistband, leading Brailsford to shoot him five times.
it was later determined that Shaver was unarmed at the time of the shooting, and the rifle he had been seen with was a pellet gun he used for his job in pest control. additionally, he was likely intoxicated, as his blood alcohol level was later found to be 0.27.
following the incident, Brailsford was charged with second-degree murder but was acquitted after a six-week trial. the jury's decision was based on the belief that Brailsford had acted according to protocol, fearing Shaver was reaching for a weapon. this verdict, however, was met with controversy.
despite his acquittal, Brailsford's previous conduct had also raised concerns. he had been involved in a prior incident where he was recorded on video using force against teenagers during an arrest at a store. although investigated, this incident did not lead to any disciplinary action against Brailsford. this lack of accountability serves only to encourage bully cops like this one in his deadly encounter with Daniel Shaver. additionally, his service weapon had "you're fucked" engraved on the side. which should tell you a lot about his mentality toward policing.
Daniel Shaver’s family ultimately settled with the City of Mesa for eight million dollars. this, obviously, does nothing to mitigate the underlying damage to the public's trust. Shaver's widow has expressed dissatisfaction with the outcome, highlighting a perceived failure of the criminal justice system to hold the officers accountable.
after eight years, since the death of Daniel Shaver in 2016, police have killed an additional 3,373 people, including a staggering record 964 in 2023. despite the murder rate falling - 2023 was a year that saw a significant decrease in homicides - us police violence is increasing.
let January 18th be a day we remember both Daniel Shaver and all other victims of police violence. no entity should be capable of bearing themselves the right to be play judge, jury and executioner of another human being.

December 7 2016 - Mesa police officer Philip Brailsford was found not guilty of the second-degree murder and reckless manslaughter of Daniel Shaver.
Daniel Shaver, a pest-control worker, was murdered by Brailsford in 2016 while unarmed and crawling on his hands and knees as he was ordered, begging to not be killed. The police were called when a guest mistook Shaver's exterminating pellet gun for an actual weapon.

Why didn't I hear the White Lives Matter people protest the murder of Daniel Shaver? He was compliant. He was shot by an AR-15 by Philip Brailsford. An AR-15 that had the words "Get Fucked" engraved on it that he was allowed to use on the job.
He was acquitted of second degree murder and later hired back so he could connect disability claiming that murdering Daniel Shaver gave him PTSD.

An Arizona cop acquitted of murder in 2017 for killing a man crawling on his knees, begging for his life, in a hotel hallway, was temporarily rehired by the city he worked for so that he could claim a disability pension and file for a medical retirement that will pay him more than $2,500 a month for the rest of his life.
Former Mesa Police Officer Philip Mitchell Brailsford drew national attention and outrage in December 2017 when a jury found him not guilty of second-degree murder in the fatal shooting of Daniel Shaver. Brailsford shot Shaver in a confrontation in a hotel hallway in 2016 after police were called there by somebody who had seen Shaver holding a gun in his room.
The gun turned out to be a pellet gun, but police apparently didn't know that. During the response, police ordered Shaver, who was unarmed, out into the hallway on his knees and ordered him to crawl in their direction while keeping his hands up, and they continued to bark confusing orders at him. As Shaver, clearly terrified, attempted to comply, at one point he gestured behind himself, possibly to pull up his pants, and Brailsford immediately opened fire, killing him.
The shooting was captured on police body camera footage, but it wasn't released to the public until after the jury acquitted Brailsford. (You can watch the footage here.)
A jury might have decided not to convict Brailsford, but the Mesa Police Department fired him after the shooting for violations of department policy. That turned out not to be the end of Brailsford's career in Mesa. ABC15 in Arizona reports that Brailsford appealed his termination and arranged for a special deal with the city to be rehired temporarily so that he could apply for a disability pension and retire for medical reasons.
Here's the kicker: The justification for Brailsford's medical disability and retirement is a claim that he has Post-Traumatic Stress Disorder (PTSD) from shooting and killing Shaver and the resulting prosecution, one of Brailsford's lawyers told ABC15. This medical condition qualifies him for a monthly pension check of $2,569.21 for the rest of his life, which the taxpayers of Mesa are on the hook for. Brailsford is currently 28 years old. Furthermore, the City of Mesa agreed to spend up to $3 million to help Brailsford defend himself and pay lawsuit settlements.
The city has also agreed to give Brailsford a "neutral recommendation" for future employment references. Thank heavens for Google searches, right?
