By • Olalekan Fagbade Lawyers, others decry Prison congestion, wonder why State Governors are not signing death warrants Lawyers and other stakeholders have chided state governors for their failures to sign death warrants, thereby contributing to the congestion in the correctional centres across the country. In a survey conducted by the News Agency of Nigeria (NAN) in Osun, Ondo and Ekiti states on the congestion of correctional centres in the country, the lawyers and others decried the high population of prisoners on death row being fed by the government. The respondents noted that the death penalty remained a provision of the law in Nigeria and since the governors had sworn to uphold the constitution, they had an obligation to sign death warrants on their table. Dr Oreoluwa Odunniyi, a lecturer in the Department of Public Law, Faculty of Law, Obafemi Awolowo University(OAU), called for accelerated hearing of inmates as a means of decongesting the correctional centres across the country. Odunniyi, in an interview with NAN in Ile-Ife, said that majority of inmates in the correctional centres had been there for years without trial. He said this posed serious challenge to the criminal justice system in the country. The don, who commended the ongoing renovation of the correctional centres in the country, said that more still needed to be done for welfare of the inmates as well the decongestion of the prison. According to him, the process of criminal prosecution in the country is quite cumbersome, and a lot of problem is attached to it. “We should encourage and work towards having state police and engage more judicial officials – justices and magistrates. “This is necessary because of the population explosion, which has resulted in increased crime rate across the country. “Regarding the condition of inmates at correctional centres, money is allocated to the correctional centres yearly by the federal government for their welfare. “There is, however, need to increase this amount to be in line with the present economic situation. “There should also be periodic monitoring and checking of inmates across the country to ensure the facilities are decongested and the inmates are well taken care of”, he said. Speaking on the refusal of state governors to sign death warrant for persons convicted of capital offences, Odunniyi attributed this to political, religious and personal reasons. “And it is quite unfortunate because the refusal to sign the death warrant is also contributing to the crowded correctional centres. ” Presently, there is no governor in the South-West region that has signed death warrant of hangmen”, he said. The don appealed to the federal government to ensure total transformation of the Nigerian correctional service to a modern reformatory institution to enable it operate in line with international best practice. Also, Mr Saheed Abiona , the Chairman of the Nigerian Bar Association (NBA), Osogbo Branch, said more than 3, 298 condemned inmates were on death row in the country due to the refusal of state governors signing their execution. Abiona said that prompt and diligent prosecution of awaiting trial inmates would help in reducing prison congestion in the country. He said that the Ministries of Justice and the Judiciary need to expedite trials of inmates languishing in prison to decongest the correctional centres. ” If this is encourage, it will greatly reduce the number of inmates in our correctional centres. ” Also, pardon for inmates convicted for minor offences and non custodian sentences for minors will help decongest the prison”, he said . According to him, many death row inmates whose death sentences had been confirmed by the Supreme Court continue to take space in the correctional centres for years, waiting to be executed. Abiona said only few governors had signed death warrants for execution of death row inmates in the country since 1999.
He said that many death warrants were on the tables of state governors, who refuse to sign, due to humanitarian, political, religious, emotional and cultural sentiments. ” Some of the sentiments raised by some governors to justify refusal to sign execution warrants for inmates is the fear that after the execution of the inmate, it might be after all discovered that such person is innocent. ” Also, another reason for deliberate refusal to sign execution of death sentence is the global agitation against death penalty, which has made many countries in the world to remove death penalty from their laws”, he said. The NBA chairman, however, said that death penalty remained legal in Nigeria and still part of the laws, until same was removed totally from the constitution. Abiona further said that governments should set time limits for execution or inmates should be committed to life imprisonment or a lesser punishment should be given to decongest the prison. Also, an Akure based lawyer, Mr Yunusa Aliyu, decried prison congestion in the country and urged the Federal and state Governments to, as a matter of urgency, synergise with the judiciary to decongest the centers. Aliyu, who used Olokuta Correctional centre in Ondo State as an example, said that while the facility has accommodation for 272 inmates, it currently contains not less than 927 inmates. “This is so bad. There needs to be a strategy to decongest the correction centres. Let the Chief Judges visit the prisons monthly in order to re-evaluate the cases of inmates with a view to release those with minor offences. “Even those that have spent more than the time that they would have received for their offences if convicted, should be released. “There should also be more amicable resolution of issues. It is not all issues that should come to court except the serious offences that could not be settled at Police stations. “Cases should also be screened properly before being taken to the court by the law enforcement agencies because some are done without proper investigation,” he said. In his view, Mr Festus Ajetunmobi, the Coordinator of Justice Light Movement, a Non-Governmental Organisation, said that the best way to decongest the correctional facilities was to expedite the trials of inmates. Ajetunmobi said that 40 per cent of inmates in the Nigerian Correctional Centres were awaiting trial in courts. He said that another reason why prisons were congested was due to the fact that some inmates who had been on death row for a long time were occupying space, instead of being executed. He said that governors, who were to sign the death warrant of the hangmen, have refused to do so, “forgetting that signing of death warrants is part of their constitutional roles.” “If this two factor can be looked into, it will seriously help in reducing the number of inmates in the Nigeria Correctional Centres”, he said. Ajetunmobi also said that crime rate was increasing in the country and a lot of youths were indulging in misdemeanours, which had also led to population increase in prison (NAN)

Oreoluwa Aina, a National Youth Service Corps member, was one of those who died on Thursday when a Lagos State Government staff bus collided with a train in the PWD area of the state. In this interview with DAYO OYEWO, her father, Femi Aina, speaks on her daughter’s plans after the service year How did you receive the news of your daughter’s death? I was in Abuja watching the television around 9 am when I saw the incident. An hour after that, I got a call that my daughter was involved in it. That was when I knew what I saw on TV was actually happening to me. Then I immediately called my younger brother and sister in Lagos. I later received two more calls in another 10 minutes and by then, she was already in the ICU (intensive care unit). They were attending to her and at the same time calling me from there. I even heard some of the staff members praying for her. So, I rushed to the airport to get any available flight back to Lagos but when my plane was ready to take off by 4 pm, I was told that she had passed away. When was the last time you communicated with her? On Wednesday, my younger brother’s wife celebrated her birthday. She recorded the birthday and sent it to us. We all laughed at the video and the following morning (Thursday) she sent a WhatsApp message to me saying, “Daddy how was your night? Hope you slept well,” and I replied, “All is well” and there was no response after then. I even thought she did not respond because she ran out of data, not knowing that she was already involved in an accident. Were you aware that she used to board the staff bus? I know she boarded the staff bus, but not every day. If not for this cashless nonsense policy, she would not have followed that bus. But she did not have cash, so she had to follow the bus. She had just N200. They just kill people anyhow in this country. What can you tell us about Oreoluwa? Oreoluwa was very dear to me. She was a gift from God to me and that is what her name implies. She feared God and she was hard-working. I used to tell her that she took the job like she was already a staff member of the state government. She was a very nice girl with visions and ambitions. She was preparing to go to the United Kingdom for her Master’s programme after her youth service ends in May, but unfortunately, all her plans had been dashed. She happened to be the first grandchild of my parents and she stayed with my mum here in Lagos because our dad passed away last year, so she had always been with her grandmother. She was dear to everyone around including church, school and at work. Her death is a great loss. How old was she? She was 28 years and was supposed to be 29 in October this year. What about her mother? She stays in Ogun state, but her family came for her burial. She is just trying to cope. Were you checking to know her condition? Yes, we have been talking, including her family. We are just trying to cope and calm ourselves down to survive these few days and then we move ahead. Can you tell us about her education? She graduated from a primary school here in Egbe, then she proceeded to a secondary school also in this area before she went to study Pure and Applied Chemistry at Osun State University. Although, there were so many strikes while she was studying in school and I thought she would even give up on going back to school but she went through the storm. She did well and her report was always good. Even those she worked with in the ministry said the same about her and the church. She was chubby but very energetic. She was also industrious, she did so many things as a young lady and was very focused. She must have gone through some difficulties at the university. Can you tell us more about this? Yes. There was a time she had challenges with some of the courses she had to take over again. She was like, ‘Dad, this cannot be my result,’ but I encouraged her and she withstood the stress of going through the challenges. The course was for four years but she spent close to seven years in school before she finally graduated last year. That was why I said she went through hurdles. For someone who had gone through such rough paths, how did she feel after she eventually graduated and thereafter mobilised for NYSC? She was happy. When she eventually came out, I told her that she was already a success after going through all the stress. I did not know that would be the end of it all. When she started serving with the state government, we discussed and planned how she was going to get a meritorious award after her service year. I told her to serve very well so that the state could give her an award. I was expecting the meritorious award but it was a death certificate that I got (breaks down in tears). I was just too eager for her to finish. She was my first daughter. Her death is painful because I have invested so much in her. This world is cruel. A girl that was full of life when she left home was now brought back dead. Was she deployed directly to Lagos? Yes, she was deployed directly to Lagos. I have a copy of her deployment letter. She did not redeploy from any state. And she was so happy that her prayers about the posting were answered. How do you feel losing a child? The feeling can’t be described. Normally, when you hear the news that somebody is dead or people have an accident, there are personalities attached to those people. She is my daughter; I can show you some of her text messages on my phone. When I went through them again, I felt so bad. She called me names like, “O.G, Nigga, Daddy, how far?” We have tried, we have planned and just for her to finish and then, we go from there. Did she share any of her aspirations with you? Yes, many of them. She planned to travel to the UK for her Master’s programme, and she was already into catering. She was part of a thrift society and they even called me from there yesterday to inform me about it. She was saving money to start a mobile food business. Even though she had plans to study more, she was just trying to do things. She was also into music and she recorded in the studio. We are a member of The Apostolic Church and she was a staunch member. I learnt she was even the one that led the song last Sunday. She had so many plans and she was just about to fly. It was just this youth service which is mandatory that she wanted to complete and then fly. What is your assessment of the response of the state government to the incident? Sincerely, I was impressed. When I arrived in Lagos, I went straight to LASUTH and I saw how the victims were being attended to. I saw different injuries with different segments and how they were trying to help everybody. They tried their approach to that level of emergency. They were trying to salvage whatever they could. What is your take on the driver? I am not happy with the driver at all. The driver had caused a lot of damage. I learnt they want to do a mental test for him. Let the law just take its course. I can’t say what is on my mind. What do you expect the state government to do following this incident? The governor was here yesterday and we spoke at length. The government needs to carry out a re-evaluation of our drivers, especially those who carry such a large number of people. A lot can be done to evaluate people so that we keep our lives in their hands. Possibly, the way they do for pilots, if we can value our lives like that, this thing could have been averted because my thinking is that the driver must have been doing something like that before now. This cannot be the first time. When they are doing roadworthiness, they should also do mental worthiness or whatever they can call it. We hear tankers falling on cars in this same Lagos, things that are not meant to happen normally. We can take them seriously as doctors who spend seven to ten years in school because they want to treat a human being. But we just give a driver a license to convey close to 95 people in a bus at a time and we don’t know the health or the mental state of such a person. We take them as just drivers but our lives are in their hands. So, if there is anything the governor can do to evaluate them if possible – constantly. Read the full article

Conclusion
Being a student in AFS 363 has opened my eyes to many more issues in media. Black people are constantly abused and misrepresented in the media, and because of this the same happens in real life. Often times we are stereotyped and only allowed to have a certain role in places like classrooms, work, or teams.
Although, I obviously think that the 90s were a time that Black people thrived, there were still issues, that included the stagnancy of role. Some actors were constantly casted as the “baby momma” or the “gang member”, not allowing any range for these individuals. This leads to Black people being forced to fit into a role that they most likely do not want to play, but have to because of money, living, or academic situations.
I would like to thank Professor Miletsky because he allowed for an open discussion classroom. I felt very comfortable expressing my opinions and thoughts, and it was to my pleasant surprise that I had a class full of people who agreed. I appreciated the fact that Professor Miletsky was not hesitant to correct the thinking of others, but always in a compassionate way. I learned a lot in this class and I never lost interest for a second. We were always encouraged to speak up and hearing the experiences of other and relating them to some of my own really built a sense of solidarity.
So I guess to sum it up, do not suffer in silence because someone is there to listen, take a class with Professor Miletsky, fight for representation in the Black community and for the preservation of Black lives. And if you haven’t figured it out already, the 90s were All That!

By • Olalekan Fagbade JUST IN; CP advises Nigerians what to do when hiring domestic workers The Lagos State Commissioner of Police, Mr Idowu Owohunwa, has advised intending employers to carry out a thorough background check before employing unknown persons as domestic helps. Owohunwa, who spoke on the sidelines of a recent parade of some suspects in Lagos, said that it was necessary to carry out complete investigation of prospective employees to prevent harm and crime in the home. The News Agency of Nigeria (NAN) reports that there had been reported cases of domestic staff robbing and killing their employers in the state. For instance, the case of Joseph Ogbu, who was sentenced to death on March 27, 2023 by a Lagos State High Court, Ikeja, for killing his employer, Oreoluwa John, 38 and her mother, Adejoke, 89. Ogbu stabbed Oreoluwa to death with a sharp object and strangled her mother to death two days after he was employed. He robbed them of a Toyota Camry Saloon car, LG plasma TV, Motorway handset, one Gionee handset, one Nokia phone, one i-Tel Phone, and a power bank but was arrested by police on patrol while trying to escape. Similarly on March 18, a driver murdered his employer, an ex-Permanent Secretary with the Ogun State Government, Mr Femi Egbeoluwa and his wife, Funmi, at their residence in Ikeja, Lagos. Preliminary investigation by the Police, however, revealed that £5,000 (N2.8 million) meant for late Egbeoluwa’s medical expenses abroad was stolen by the suspect. Also, in the month of August 2023, the Police in Lagos arrested a driver, who stole his madam’s vehicle few weeks after employment and sold it. Through intelligence investigation, the police were able to trace and arrest him, only to discover that he was a major armed robber and an English pistol was recovered from him in his room where he stayed with his madam. In the same August, the police arrested a “maiguard” (someone who guards the gate and building), who also stole his principal’s Mercedes Benz, took it to Owode, Ogun and sold it. Also, through intelligence network, the police traced him, arrested him and recovered the vehicle. Owohunwa said: “This is a pointer that there is need to undertake full vetting of the personal aides we engage. “The closer they get to you, the more they know your secret and routine, the more vulnerable you become”. According to him, the police can help in the investigation. “If you are unsure, we always encourage citizens to partner with the police. we can assist in the vetting process,” he said. In the same vein, a security expert, Mr Adebayo Daniel of Premierguard Security Ltd, said that there was need for serious profiling to know the background of the person to hire as that would save employers of trouble. “Do not rush into hiring a helper, there is need to verify if the person who he or she really claimed to be and the check should also reveal whether the person has records of criminal offences or had been jailed,” he said. According to him, some helpers have no motive of working but only came into the house with an intention to steal or kill, some even molest or assault the children in their care. Daniel said that issues concerning cash transactions and family achievement should never be discussed in the presence of housekeepers as such information could be used to rob or harm them. He said that security gadgets such as Closed-Circuit Television (CCTV) could be installed to monitor the activities of servants, adding that footages from such cameras had exposed many who did unimaginable and irrational things. A Magistrate Court II sitting in Abeokuta, the Ogun State capital, has remanded the suspected killers of Mr and Mrs Kehinde Fatinoye and their son, Oreoluwa on New Year’s day. Chief Magistrate Esther Idowu on Wednesday ruled that the suspects be kept in prison for 60 days, pending legal advice from the Department of Public Prosecution (DPP). The suspected killers, Lekan Adekanbi, Ahmed Odetola and Waheed Adeniyi would be locked up at the Oba Correctional Centre while their accomplices, Temitope Fadairo Temitope and Adenike Adekanbi Adenike, were sent to the Ibara Correctional Centre. Also, buyers of the slain couple’s car, Owolaja Anuoluwapo and Usman Azeez were also remanded at the Oba prison for the same period of 60 days DAILY POST reports that the suspects were brought before the court on an 11-count charge bordering on murder, conspiracy to commit a felony, arson, stealing, and escape from lawful authority, among others.
