New challenges to a law banning gay sex were put before a Singapore court on Wednesday, November 13, the latest bid to overturn the statute and score another victory for LGBT rights in Asia.
Inherited from the British colonial era, the law is rarely enforced but campaigners say it nevertheless jars with the affluent city-state's increasingly modern and vibrant culture.
Still, opponents argue that Singapore remains at heart conservative and is not ready for change while officials also believe most would not be in favor of repealing the legislation.
A first attempt to overturn it was rejected in 2014 but now 3 people – a retired doctor, a DJ and an LGBT rights advocate – have lodged fresh challenges aiming to prove the law is unconstitutional.
Lawyers representing the plaintiffs confirmed the civil suits had started behind closed doors at the High Court on Wednesday.
The 3 challenges will be heard one after another until November 22, and the judge will make a ruling at a later date.
"I think we have strong points and we are hopeful," Eugene Thuraisingam, a lawyer for DJ Johnson Ong, told AFP.
The retired doctor challenging the statute, 61-year-old Roy Tan, has criticized the "anachronistic law" – Section 377A of the penal code – for adversely affecting the lives of gay men.
"By institutionalizing discrimination, it alienates them from having a sense of belonging and purposeful place in our society, and prevents them from taking pride in Singapore's achievements," he said in a statement when he announced his intention to challenge the law.
If the legislation is overturned, it will mark another step forward for lesbian, gay, bisexual and transgender (LGBT) rights in the region.
Last year, India's Supreme Court decriminalized gay sex by overturning legislation from its own period under British rule – a decision that spurred campaigners in Singapore to renew their efforts to challenge Section 377A.
And in Taiwan, lawmakers took the unprecedented decision in May to legalise same-sex marriage, becoming the first place in Asia to do so. Over 2,000 couples have since wed on the island.
Singapore's ban, first introduced in 1938 by British colonial administrators, carries a maximum penalty of two years in jail for homosexual acts.

Then, after a moment: “Lovely blue flowers there a while back. I don’t suppose you noticed.” “I noticed,” said Mr. Bellows. “I picked a bunch.” “Did you, now. Where are they at?” “I give um to someone,” Mr. Bellows said. “Someone. Ignatius Loyola XVIII, with a band of hard-riding fanatical Jesuits under his command, has sworn to capture the herd and release the girls from the toils so-called of the Traffic, in which Daumier, Mr. Hawkins, and Mr. Bellows are prominent executives of long standing. Daumier meanwhile has been distracted from his proper business by a threat to the queen, the matter of the necklace (see Dumas, The Queen’s Necklace, pp 76-105).

She would not have it in a braid, with the exception of one on her side or most of her hair swept away from her face.
USUAL  FACE  LOOK :  Thick painted eye-makeup, whether blue (for her tribe) or red (for herself), lips tinted red. Besides that, she has no other make up on her whatsoever. It is rare to see her without her tribal paint unless she’s at home, relaxing.

Q1 :  If you could write your character your way in their own movie,  what would it be called,  what style would it be filmed in, and what would it be about?          
—The Lost Crucible, it would be filmed like a documentary, so to speak, switching from third POV [narrator] to first POV [dumb catgirl] that would be finding out about her tribe, and the trial young warriors go through. 
Q2 :  What would their soundtrack/score sound like?          
— Songs that remind you of a time when you’re one in nature; drums that give you that itch to move and dance to the beat, to appease the old and new gods, whatever you believe in. It would be of her home — where the village barely touches the heavens itself.
Q3 :  Why did you start writing this character?          
— I did it in a way to sort of make a new oc from an old oc, so to speak. The OG version, as you could call it, is vastly different and I kept making lots of jokes with her when I name changed and eventually she just started to slowly build up.
Q4 :   What first attracted you to this character?          
— It’s a mixture of self insert, so finding a way to incorporate stuff into my own character is what sort of ... made her my lovable daughter. She’s not all self-insert, her attitude, her anger, her sorrow, her accomplishments and failures and imagines on how she would deal with X and Y is just absolutely fascinating for me and having a fierce miqo’te hailing from the snowy mountain tops of Abalathia’s Spine who’s tiny with a big axe is my aesthetic okay.
Q5 :  Describe the biggest thing you dislike about your muse.
— Her desire to keep things quiet until the last second—mostly when it’s about her. Anything related to her life, her health, her problems, she’d rather deal with them alone. Even if there’s been major character improvement, there are some things she does not feel comfortable sharing, or letting people in. Her desire for more power so she can finally be at peace.
Q6 :  What do you have in common with your muse?          
— We are both stubborn bitches. However, she deals with things far better than I ever could, as I am baby. Similar in arrogance, and in anger — to a point.
Q7 :   How does  your muse feel about  you?          
— She’d fucking kick my ass. I think she would appreciate me, and not be as bully as with others — not because I am her mun, but more so as I think we’d clash a lot but get along quite well, too.
Q8 :  What characters does your muse have interesting interactions with ?        
— I, unfortunately haven’t had a lot of interactions with Li trying to be nice, or fight somebody but— people like her, who are broken yet continue on. Who carry a mantle too big to carry and they do it anyways. Fighters that only know how to fight, when she eventually wants peace, but that will never leave her soul. People so nice that it makes her want to protect them; to view the world the way they see it. Warriors, even if they are not from the same village, are all brethren to one another and the desire to meet and see how they live out their lives — just a handful of stuff in my head I’d like to see.
That and a bar fight, she really is the one who would start a bar fight drunk or angry okay. Also nobles. She sort of hates them cause of her mom but then eventually doesn’t and it’s awkward asf.
Q9 :  What gives  you inspiration  to write  your muse ?        
—Vikings, Game of Thrones aesthetics of the Dothraki tribe, anything tribal honestly. The existential dread that is Nier: Automata, some Fire Emblem aesthetics, a lot of stuff honestly.

— I STARTED YESTERDAY. I finished late today cause my last two braincells hate everything

you worked at a huge corporation and your boss was a HUGE dick

the only reason all of you stayed there was the pay was extremely good

one day he asked you to stay late and help him out
you were in his office, sorting out papers when you feel this presence behind you
you turn around slowly and he is looming over you like a complete creep

he walked over to you, grabbing your arms forcefully

he pushed you down on his desk, lips trailing your neck and jawline
you tried to push him away but he was pinning you down with such force you physically couldnt
you panicked obviously and grabbed the nearest thing to you and smashed it over his head repeatedly until he fell off of you
it was one of those letter openers
you hit him in the head repeatedly with a letter opener
he was dead 
like no question about it
you were obviously shaken up about liTERALLY EVERYTHING THAT JUST HAPPENED
so it was extra shook when a demon popped up behind you
“hey, you just killed that dude”
you scream, swinging the letter opener over your shoulder
but before it hits the dude behind you, a large hand was grabbing your wrist
“just because you killed that old, dirty bastard doesnt mean you can try and kill me”
you turn around to face him and oh wow
he was pretty attractive
“listen,” he starts out, licking his lips, “i know you just got violated and that’s terrible but you just murdered a man.... i was sent from god to torture you”
you gasp, mouth flying open
“o-oh god” your hand flies to your hair as you look at your bleeding boss on the ground
“i know....don't feel bad about it.... he was going to hell anyway”
you snap your head over to him
“he was???”
your demon scoffs loudly, “of course he was. all he did was violate and abuse woman and children. he was destined for hell at the age of 13.”
you smirk to yourself because hey
even though you killed him, he was still going to have to live out the rest of his life in the fiery pits of hell
your demon scoffs at your smirking expression
“dont get too excited, sweetheart. you're destined for hell too”

you figured out your demons name was “ong seongwoo” and he was a demon because he killed someone too
he wont say who or why but he did
all he would say was, “just dont worry about it, sweetheart”
your demon was supposed to torture you and make you think about your sins but honestly, your time with seongwoo has been the best time of your life
he would force you to watch old movies from the 50s (when he died) and he would teach you the slang from back then
it was an enlightening period of your life
you found out that you actually highly enjoyed doo-wap music and you loved the old cheesy movies
seongwoo was amazed by today's technology btw
“what the hell is that?!”
“it’s a microwave, seongwoo”
“microwaves did NOT look like that when i was around”
he was such a clown too
there wasnt a moment of your time spent with seongwoo where it wasnt filled with laughter
you slowly fell more and more in love with him
it was a weird feeling

and you knew seongwoo felt the same way with you

he would cook you dinner

but he couldnt stop his feelings

seongwoo bites his lower lip before smiling at you, “why would i make you think about you ‘sin’? you did a good thing –– killing that dirty old man. he did nothing but terrorize you –– jesus” he hits the table before leaning back on the couch
you look over at seongwoo with concerned eyes
seongwoo was always calm and collected
he only showed happy feelings so this was something new
“seongwoo? what’s wrong?” you put your hand on his thigh gently
he makes eye contact, “the dude i killed, he, uh, he r-ra-raped my sister... i can’t stand men who are like that. i dont know how someone could live with knowing they tortured and broke down a little girl like that” seongwoo’s voice cracks as tears start to form in his eyes
you scoot closer to him, pulling him into your small frame
he starts to sob into the crook of your neck as you calmly pet his hair
“shhh, it’s okay... it’s okay....” you coo, trying to calm him down
your heart was breaking by hearing his pitiful whimpers and sobs
even the happiest of people break down sometimes
it took him a couple of minutes but when he finally did calm down, he put his large hands on your cheeks
“i- i love you, ______... i know it’s weird for a demon to admit that but i do. i love you so much”
he leans in, capturing your lips in a very soft, sweet kiss
he pulls away after a couple more seconds, looking at you with such tender, sweet eyes
“i love you too, seongwoo”

you wake up the next morning and it is noticeably different in your house
usually, it was freezing due to seongwoo;s presence 
every other morning you could smell seongwoo cooking bacon and pancakes for you
usually, seongwoo would be singing along to frank sinatra or the skyliners
but this morning, there was nothing
you stood up from your bed, knees and legs shaking
a bad feeling was in your chest as you pulled yourself towards the kitchen
you heard the skyliners “since i dont have you” playing on your record player, giving you the chills
it was indeed creepy
“seongwoo??” you called out but there was no answer
you walk over to the counter and see a piece of paper laying on you counter
you noticed the scribble was definitely seongwoo’s handwriting
“i’ll see you in hell, sweetheart ;)”

GAY RIGHTS APPLICATIONS DENIED (ONCE MORE) IN SINGAPORE

A. OPENER

B. INTRODUCTION
This post underscores the on-going struggle and dilemma concerning the status and scope relating to the freedom of expression in general, and of the rights or lack thereof, in particular, of the LGBTQI community in Singapore. The following links to reports by U.S. Government and international human rights organizations are informative in so far as they offer a glimpse of the state of civil rights, and the level of respect accorded towards the dignity of our fellow human being in Singapore :

On Mar 30th, 2020, the high court of singapore ruled in favour of staying a colonial-era law criminalizing consensual sex between men. (2) The law in question, dating to 1938, specifically states  : 
“Outrages on decency
377A : Any male person who, in public or private, commits, or abets the commission of, or procures or attempts to procure the commission by any male person of, any act of gross decency with another male person, shall be punished with imprisonment for a term which may extend to 2 years.” (3)
There were three applications to the court to re-instate personal and constitutional rights, which were legally denied or removed since 1938 at least, from a specific group or community of individuals – homosexual men. (4), (5)
The high court’s opinion regretfully and clearly goes against natural law, which may be defined as follows :
“Natural law can be discovered by reason alone and applies to all people, while divine law can be discovered only through God’s special revelation and applies only to those to whom it is revealed and whom God specifically indicates are to be bound.” (6)
C. CONCLUSIONS OF THE COURT
It appears the court addressed the challenges by the plaintiffs from a standpoint of the supreme rights of society or a seeming majority, against the mores, behaviour and or expressions of a minority community or individual. It is as simple as that, if we discarded all the obfuscating legal jargon. The rights of the individual to life, liberty, freedom, expression and beliefs were unfortunately not exhaustively explored to evince an outcome which is both judicious and acceptable to our conscience.  
Here are excerpts of the court’s conclusions on case histories from India, United States and Hong Kong. International or universal law in this matter, seems to have little relevance in the Singaporean context :
“As I have suggested earlier, this conception of proportionality should be viewed as distinct from traditional principles of judicial review. While the Indian courts may have adopted such an approach, the Singaporean courts have made clear that we continue to subscribe to the traditional principles of judicial review.” (7)
“The willingness of the US courts to review the legitimacy of a statute, as well as its implications, would again be at odds with the reluctance of the Singapore judiciary to address extra-legal arguments.” (8)
“Singapore, however, has not adopted the ICCPR. (9) As such the decision in Yau Yuk Lung is less relevant to our context.” (10)
“A similar point may be made in addressing Navtej, where the Supreme Court of India ruled that the criminalisation of male homosexual conduct violates, among other rights, the right to freedom of expression. (11) I am unable to agree with the reasoning of the Indian Supreme Court given that the court appeared to have accepted a wider meaning of what constitutes “expression”, extending beyond verbal communication of ideas, opinions or beliefs.” (12)
Here’s a conclusion of the court, which in this writer’s opinion, is a Catch-22, really :  
“As a starting point, it must be emphasised that Dr. Tan was taking issue with the enforcement of s377A, as opposed to the constitutionality of s377A itself. These issues are separate and distinct. The manner in which a provision is enforced, even if arbitrary, cannot, without more, result in the provision itself being rendered unconstitutional. The appropriate recourse in such a situation would be to seek administrative review, not constitutional review.” (13)
D. INDIVIDUAL vs SOCIETAL RIGHTS
Individual rights long preceded societal rights. The latter, are in most cases, gained through the diminution of individual rights, or through the theory and practice of the “common good.” That being said, the theory also holds that when a bill or provision is to be considered by the legislature, its adoption, if ever, should be proportional to that which it is intended to regulate (14). This was addressed by the Indian, U.S. and HK examples cited in the foregoing. The law must never be onerously discriminating, harmful or disadvantageous to the society, community or individual. The Singaporean court however, relied disproportionately on what it deemed to be overriding local societal mores, which it apparently equated with supreme rights, a conflation which goes against the grain of justice. Hence, its decision against the applications of the plaintiffs. Without the benefit of a city-wide referendum on s377A, how confident are we really about this societal justification for upholding an unjust law as s377A? And speaking of this unjust law, our words to the Archbishop may help us to differentiate how particularly unjust it  truly is :
“Any law which wilfully discriminates, isolates, targets, inflicts pain or injury upon, suppresses, denies or eliminates the natural and or individual rights of anyone or group is inherently and morally reprehensible. Such law has no place in our home, school, religious institution and society. It is a law of abuse and FEAR. An abuse and fear of a defenceless individual or minority group. An abuse and fear of a community of citizens.”

Finally, to get back to the missing piece – nowhere in the court’s judgement did natural law make an appearance. Or if it did, I for one, missed it. It is as if its applicability is inconsistent with Singaporean jurisprudence. This method evokes, for me at least, a poem by John Donne (1572-1631). (15)  It has relevance to the matter at hand as we shall see :

The title of the poem, “For Whom the Bell Tolls”, was adopted by Ernest Hemingway (1899-1961) for his novel, centring on the Spanish Civil War (1936-39) and the rise of fascism. Hemingway was awarded the Nobel Prize for Literature in 1954. (17)

E. CONCLUSION
Human rights are sacred, as John Donne alludes in his poem about the universality of humanity. We cannot and should not, deny to others, that which has been our collective and shared inheritance. Compassion is never a dirty word. 
The Singaporean court has, despite its most learned applications, failed in this  sacred duty to right a gross injustice to a law-abiding and respectable community of citizens. For this, the bell continues to toll for everyone in Singapore, and the world.
“You accept it. You accept that you cannot have everything your way. And perhaps, that’s just what makes life worth living, perhaps, that’s its beauty. Everyone has a culture. Everyone has a tradition. It’s just not always clear.”
