Selon notre décompte – issu de notre base de données comptabilisant les personnes décédées en lien avec une intervention des forces de l’ordre –, depuis 1977 au moins 70 personnes sont officiellement décédées d’un arrêt cardiaque ou respiratoire lors d’une arrestation sur la voie publique, dans un véhicule de police ou en détention dans un commissariat ou une gendarmerie. Une trentaine de ces cas se sont produits sur la dernière décennie. Rares sont ces « étranges malaises » qui ne sont pas émaillées de traces de violences, de zones d’ombres, de version contradictoires ou de rétention d’information... La plupart sont consécutifs à une arrestation musclée. La plupart n’ont donné lieu à aucune sanction.

En 2004, quinze ans avant l’interpellation filmée de Cédric Chouviat, Abou Bakari Tandia (38 ans), est interpellé lors d’un contrôle à Courbevoie. Il tombe dans le coma. Hospitalisé, il décède le 25 janvier 2005, un mois et demi plus tard. Sa famille va être confrontée pendant plusieurs années à une version policière affirmant qu’il s’est tapé la tête contre les murs de sa cellule. L’affaire est d’abord classée sans suite. Finalement, un policier reconnaît lui avoir fait une clef d’étranglement. Une nouvelle expertise médicale conclut en 2011 – six ans après les faits ! – à une mort « par privation d’oxygène due à des contentions répétées », invalidant la version des policiers. La plainte de la famille pour « actes de torture et de barbarie ayant entraîné la mort » se solde cependant par un non-lieu.

En juin 2009 à Argenteuil, Ali Ziri (69 ans) meurt lui aussi par suffocation après un contrôle de police. Transporté avec un ami dans un véhicule de police, le vieil homme est maintenu plié en deux puis laissé au commissariat à terre dans son vomi, mains menotté dans le dos. Selon la version initiale donnée par les autorités, son état de santé – une « cardiomyopathie méconnue » – en serait la cause. Une seconde autopsie indique cependant un manque d’oxygène et la présence de multiples hématomes sur son corps. Deux autres expertises mettent en cause la technique du pliage. Dans son avis, la Commission nationale de déontologie de la sécurité (CNDS, supprimée sous la présidence Sarkozy) évoque même un « traitement inhumain ». Pourtant, la juge d’instruction ne procède ni à une reconstitution, ni au visionnage de la vidéo montrant l’arrivée au commissariat.

Autre exemple : en mars 2015, dans un bar de la capitale, des témoins voient un homme qui pousse « des cris d’agonie et d’étouffement », alors qu’un policier de la BAC lui applique une clef d’étranglement. Il s’appelle Amadou Koumé. Emmené au commissariat, il est plus tard découvert inanimé dans sa cellule. Son décès est constaté à 2h30 du matin. D’après l’autopsie, il est mort d’un « œdème pulmonaire survenu dans un contexte d’asphyxie et de traumatismes facial et cervical ». Informée trois jours plus tard, la famille porte plainte contre X pour « violences volontaires ayant entraîné la mort sans intention de la donner », et se constitue partie civile. En avril 2017, l’un des policiers de la BAC est mis en examen. L’affaire est toujours en cours.
