On this day July 21, 2007: Harry Potter and the Deathly Hallows, the seventh and final Harry Potter novel, is released on July 21, 2007, with an initial print run of 12 million copies in the United States alone. Deathly Hallows, like the previous Harry Potter novels, was slated to be adapted into a major Hollywood film. Harry Potter, the bespectacled boy wizard, is the creation of British author J.K. Rowling, who was born on July 31, 1965. Rowling's first novel, Harry Potter and the Philosopher's Stone, was published in the United Kingdom in 1997 (it was renamed Harry Potter and the Sorcerer's Stone when it was released in America the following year) and went on to become an international bestseller. Harry Potter, his friends Ron Weasley and Hermione Granger, and their adventures at Hogwarts School of Witchcraft and Wizardry captivated both children and adults. The books, which chronicled Harry's battles with his adversary, the evil Lord Voldemort, have sold over 400 million copies and have been translated into over 60 languages.The series is also credited with increasing global childhood literacy. The Harry Potter series, which spawned a slew of blockbuster films, video games, and other merchandise, catapulted J.K. Rowling, a broke single mother when she wrote the first book, into the highest-earning author in history. Harry Potter and the Sorcerer's Stone, the first film in the series, was released in the United States on November 16, 2001. Absentee Application and Certificate The form has been updated since the 2016 North Carolina Notary Public Manual publication. The things to remember: The absentee voter application and certificate represent a new notarial act distinctly different from an acknowledgment, oath, or verification. You must have 2 witnesses. In executing this act, the notary must take the following steps: Require the personal appearance of the voter. Positively identify the voter. Witness the voter mark his or her ballot. Witness the voter seal his or her ballot in the provided envelope. Witness the voter sign the voter’s certification. Complete the notary witness certification section of the application including the venue and the certificate wording. Sign the certificate and affix the official notary seal directly onto the sealed envelope where the “Alternative Notary-Witness Certification” appears. G.S. 163-231(a). The Notary-Witness may also be required to assist the voter in marking the ballot if the voter is not physically able to do so on his or her own. In such a case, the notary would need to complete the “Certification of Assisting Voter” section in addition to the notary witness certification described above. The absentee voter application and certificate come with a detailed instruction sheet for the voter and provide minimal instructions for the notary. Inventory of Abandoned Safe Deposit Box [N.C.G.S. 53C-6-13(a)] A bank may have an abandoned safe deposit box inventoried by a notary if payment is overdue and 30-days have passed since notice was given to the owner. The inventory shall be taken by a Notary WHO IS NOT A DIRECTOR, OFFICER, EMPLOYEE, or STOCKHOLDER of the bank while in the presence of a bank official. PREVENT MISUSE OF LOOSE FORMS: When stapling a “loose” Notary certificate to a document, it’s smart to take a few precautions to prevent its removal and fraudulent reattachment. In the certificate’s margin, write a brief description of the document, such as, “This certificate is attached to a grant deed dated 7/11/2010 and cosigned by Mary Smith.” In your journal as an extra CYA…note that you’ve added a loose certificate and the way it was attached to the document. APPROVED SEAL TYPES: A notary shall affix the notary’s official seal near the notary’s official signature on the notarial certificate of a record. A notary’s official seal shall include all of the following elements: The notary’s name exactly as commissioned. The words “Notary Public”. The county of commissioning, including the word “County” or the abbreviation “Co.”. The words “North Carolina” or the abbreviation “N.C.” or “NC”. The notary seal may be either circular or rectangular in shape. Upon receiving a commission or a recommission on or after October 1, 2006, a notary shall not use a circular seal that is less than 1 ½ inches, nor more than 2 inches in diameter. The rectangular seal shall not be over 1 inch high and 2 ½ inches long. The perimeter of the seal shall contain a border that is visible when impressed. (Alterations to any information contained within the seal as embossed or stamped on the record are prohibited. A notarial seal, as it appears on a record, may contain the permanently imprinted, handwritten, or typed date the notary’s commission expires. Any reference in the General Statutes to the seal of a notary shall include the stamp of a notary, and any reference to the stamp of a notary shall include the seal of the notary. The failure of a notarial seal to comply with the requirements of this section shall not affect the sufficiency, validity, or enforceability of the notarial certificate, but shall constitute a violation of the notary’s duties. CONFLICT OF INTEREST: If you,the notary, is a signer of, or an interested party to, or a beneficiary, or a grantor, or otherwise named in some other capacity in the document, cannot notarize the document. This also includes: Is serving as a the trustee in a deed of trust Is the drafter of the record Is the person to whom the document will be sent after recording, or Is the attorney of record to a party of the document as long ad the attorney who is acting as the notary is not also a party to the record individually or in some other representative or fiduciary capacity. Also in some cases, it may be possible for one person to sign before a Notary on behalf of another (the principal) as a subscribing witness, as an attorney in fact or in another representative capacity. A Notary would be unwise, to notarize a power of attorney aka POA for a subscribing witness when the witness is the very person who would thereby be appointed attorney in fact. The witness has an obvious self-interest in the document and a possible motive for lying about the genuineness of the signature. Likewise, a Notary would be unwise to notarize a deed for an attorney in fact acting on behalf of an absent person when the attorney in fact would thereby be granted the property. With all such conflicts of interest, the conscientious Notary should decline to perform the notarization. NOTARIZING FOR AN ABSENT SIGNER: If someone asks you, the Notary, to notarize a signature of a person who is not present, they are requesting a criminal act. Both you, the notary, and the person you notarizing for could go to jail, be fined or both. Society trusts you, the Notary, to personally screen each signer for identity, willingness and awareness. This is impossible if the signer is not face to face before you at the time of the notarization. Under law, their word alone is not good enough. It’s just an unlawful act for you, the Notary, to base a notarization on a telephone call or on mere familiarity with someone’s signature. To repeat, the document signer must appear face to face before you at the time of notarization - not before, not later. It is a criminal act to be persuaded by anyone to violate this rule. CORRECTING VENUES: The venue portion of the notarial certificate is almost always filled in long before the notarization. In fact, many pre printed certificates already have the venue locations typed in the blanks. Much of the time, this isn’t a problem, because the agency drafting the document knows (more or less) where the notarization will be performed. In the case of “less,” you may need to correct the venue. If the state and county do not match where you are actually performing the notarization, line through the incorrect information, write in the correct state and county, and initial and date the correction. ALTERATIONS & CORRECTIONS: Improperly made corrections on the document or Notary certificate frequently cause rejection of a document. In general, correction fluid, nontransparent tape or any material that would cover up wording should NOT be used on a recordable document or its Notary certificate, since recorders may be suspicious about what was covered. Whenever a Notary corrects any wording in a certificate (such as the wrong venue) or a signer corrects any wording in a document, the following steps should be taken, using dark ink: Line or type through the incorrect wording; Print or type the correct wording above the line-out: and Initial and date the correction. If excessive corrections or changes are necessary on a certificate, the Notary should consider starting over with a brand new certificate. ATTORNEY IN FACT:
A person who is appointed as “attorney in fact” for another individual (the principal) has authority to sign the
principal’s name and have this signature notarized without the principal being present before the Notary.
Typically, the signature format might be like the sample picture.
In the two examples, Michelle R. Gold is the “attorney in fact” signing on behalf of Michael J. Smith, the
principal named in the document. The conscientious Notary would ask to see the power of attorney document
that designates Michelle R. Gold as “attorney in fact” and verify that it authorizes the signer to act on behalf of
the principal.
With notarization through an “attorney in fact,” the NOTARY actually is notarizing the signature of the “attorney
