Wallet provider o exchanger sono un'attività finanziaria

Criptovalute, al via il nuovo regolamento: così controlli e sanzioni. Nella nuova normativa Ue sono previsti degli specifici requisiti per la tutela dei possessori di cripto-attività nell’emissione, nell’offerta al pubblico e nell’ammissione alla negoziazione di cripto-attività. Il 2023 è l’anno della svolta regolatoria e compliance degli asset virtuali. Pubblicato sulla Gazzetta dell’Unione Europea del 9 giugno il MiCAR (Markets-in-Crypto-Assets Regulation) il Regolamento (Ue) 2023/1114 del Parlamento Europeo e del Consiglio del 31 maggio 2023 relativo ai mercati delle cripto-attività e che modifica i regolamenti 1093/2010 e 1095/2010 e le direttive 2013/36/UE e 2019/1937. Il Regolamento è una fonte primaria normativa dell’Unione a efficacia diretta e vincolante per tutti i cittadini e gli Stati membri. MiCAR stabilisce requisiti uniformi per l’offerta al pubblico e l’ammissione alla negoziazione su una piattaforma di negoziazione di cripto-attività diverse dai token collegati ad attività e dai token di moneta elettronica, di token collegati ad attività e di token di moneta elettronica, nonché i requisiti per i prestatori di servizi per le cripto-attività.

Nello specifico, il regolamento stabilisce gli obblighi di trasparenza e informativa per l’emissione, l’offerta al pubblico e l’ammissione di cripto-attività alla negoziazione su una piattaforma di negoziazione per cripto-attività («ammissione alla negoziazione»)i requisiti per l’autorizzazione e la vigilanza dei prestatori di servizi per le cripto-attività, degli emittenti di token collegati ad attività e degli emittenti di token di moneta elettronica, nonché per il loro funzionamento, la loro organizzazione e la loro governance. I requisiti che rispondono alla normativa Ue Nella nuova normativa Ue sono previsti degli specifici requisiti per la tutela dei possessori di cripto-attività nell’emissione, nell’offerta al pubblico e nell’ammissione alla negoziazione di cripto-attività. Sono previste misure per la tutela dei clienti di prestatori di servizi per le cripto-attività. Tali misure sono volte a prevenire l’abuso di informazioni privilegiate, la comunicazione illecita di informazioni privilegiate e la manipolazione del mercato in relazione alle cripto-attività, al fine di garantire l’integrità dei mercati delle cripto-attività. La nuova normativa oltre a prevedere in generale uno spazio regolamentato introdurrà regole per prevenire gli abusi sui mercati delle criptovalute, come la manipolazione del mercato, facendo rientrare i fornitori di servizi di cripto-asset nell’ambito di applicazione delle norme antiriciclaggio. Inoltre sempre secondo il MiCAR, i fornitori di servizi di cripto-asset Denominati Casp (acronimo di Cripto Asset Service Provider) – come i fornitori di portafogli (wallet provider o exchanger) – che servono i clienti dell’Ue avranno un obbligo di sede nell’Unione, dovranno essere autorizzati e pertanto sottoposti alle autorità di vigilanza nazionali ed europee. I Casp dovranno altresì essere registrati nel registro centrale gestito dall’Esma e, solo se autorizzati, potranno fornire servizi di cripto-asset in tutti gli Stati membri dell’Ue sulla base di una procedura di portabilità. Sono previste regole dedicate ai token di moneta elettronica (Emt), che potranno essere trattati solo da Banche o Imel (istituti di moneta elettronica) autorizzazione e passaporto dell’Unione europea. La prevenzione degli abusi di mercato Infine Il MiCAR appena approvato introduce anche norme sulla prevenzione degli abusi di mercato con la finalità di traghettare i mercati dei cripto-asset al medesimo livello degli strumenti finanziari quotati. Sono previste pesanti sanzioni afflittive per il mancato rispetto della normativa. Fatte salve le sanzioni penali eventualmente applicate dagli Stati che possono riguardare l’esercizio abusivo di attività finanziarie, per le persone fisiche sono previste sanzioni amministrative sino a 700.000 euro, per le persone giuridiche fino 5.000.000 ed in alcuni casi dal 3% al 12.5% del fatturato annuo determinato sulla base dell’ultimo bilancio approvato. L’entrata in vigore di tutto il Regolamento è prevista dal 30 dicembre 2024 tuttavia i titoli III (Token collegati ad attività) e IV (Token di moneta elettronica) si applicano dal 30 giugno 2024. Drow Name Tables

Something I did as a special favor to @kimmurielsscryingmirror (@eldritchmist ) who showed interest. Because it’s...pretty big I decided to make it into it’s own post.

These are a few Drow naming tables that were originally found in an issue of Dragon Magazine. It’s two d100 tables of prefixes and suffixes commonly used in first names. The second couple of tables is a list of common house name prefixes and suffixes.

EDIT: Just a little something for those who care which I didn’t add before because it took me so long to finish the transcription I just wanted to post it lol. The gender difference is noted in the related Dragon Magazine article as being significant. Non Drow may not notice but a Drow will notice the difference. Female names sometimes borrow parts that are normally only considered male and this is considered fine...but a male with a name that borrows a typically only female part would be seen as extremely taboo.

Okay changed the drow couple’s designs slightly. Zabrinxa got V bangs and shorter hair, and Rhyl/Micar is practically the same except his post lolth design changed (he wears his hair naturally instead of slicking it back smooth, and wears more normal fancy clothes).

ALSO Zab’s hair got turned more brown, she’s quite a bit taller than normal drow, hot freckles, and has green eyes, because she is half wood elf and I want to show that beyond her being really fast.

The MiCAR Era is Here? DGQEX Analyzes New Trends of Cryptocurrency Regulation in Germany

The German Parliament (Bundestag) recently passed the highly anticipated the Digitalization of Financial Markets Act (Finanzmarktdigitalisierungsgesetz or FinmadiG). This landmark legislation represents a significant step forward in the German approach to cryptocurrency regulation. The act not only covers cryptocurrencies but also impacts several EU laws, creating new growth opportunities for global leading cryptocurrency exchanges like DGQEX.

MiCAR: A New Chapter in German Cryptocurrency Regulation

The Supervision of Crypto Markets Act (KMAG) within the FinmadiG replaces the previous cryptocurrency rules in Germany with MiCAR (Markets in Crypto-Assets Regulation). The introduction of MiCAR provides a clear legal framework for cryptocurrency trading while ensuring consistency between German and EU laws. DGQEX, always attuned to global regulatory developments, sees MiCAR as a step toward conducting cryptocurrency transactions in a more transparent and regulated environment. This change is expected to boost investor confidence and promote healthy market growth.

From a technical standpoint, MiCAR, as an EU regulation, does not require additional local legislation to take effect. However, the designation of BaFin (Federal Financial Supervisory Authority in Germany) as the regulatory body is crucial for its implementation. BaFin will oversee the issuance of cryptocurrency-related licenses, allowing EU companies with licenses from other member states to operate in Germany. However, it is worth noting that operations of German companies in other EU countries will face restrictions. While this provision limits the international expansion of German companies to some extent, it opens up more collaboration opportunities for globally oriented exchanges like DGQEX.

Transition Period: Flexible Response by DGQEX

MiCAR allows companies holding existing licenses to continue operations for up to 18 months, with the transition period determined by individual jurisdictions. The new legislation of Germany sets this period at one year. This arrangement provides existing businesses with a buffer to adapt to the new regulatory requirements. Leveraging its global compliance expertise and robust technical capabilities, DGQEX will flexibly navigate this transition period to ensure all business activities comply with the new standards.

During the transition period, DGQEX will further strengthen its internal compliance management, enhance technical security measures, and ensure the safety of user assets and the stability of transactions in the respective regions. Simultaneously, DGQEX will closely monitor regulatory developments in other EU countries, seeking additional international collaboration opportunities to expand its global footprint.
