Bocah Tiga Tahun Diculik Saat Bermain di Masjid Terekam CCTV

Inanews – Bocah berusia tiga tahun sedang bermain di masjid diculik seorang wanita paruh baya, di Jalan Bintara III , Kelurahan Binrtara Jaya, Bekasi Barat, Jawa Barat . Kasus ini baru dilaporkan setelah 24 jam, Nisa, dinyatakan hilang. Padahal peristiwa penculikan itu terekam CCTV yang ada di Masjid Al Amin, tempat kejadian. “Kami masih memburu tersangka, setelah mempelajari ciri-cirinya dari CCTV,” ujar Kompol Erna Ruswing, Kasubag Humas Polres Metro Bekasi Rabu (10/4), sambil mengatakan polisi juga masih meminta keterangan dari saksi-saksi yang melihat kejadian tersebut. Erna membenarkan orang tua korban, Lina , 18, ibu korban telah melapor ke Polres Metro Bekasi Kota atas tindak penculikan terhadap anaknya. Laporannya tertera dalam LP/853/K/IV/2019/SPKT/Restro Bekasi Kota, “Karena laporannya baru kemarin, jadi masih dalam penyelidikan,” jelas Erna. Dalam rekaman terlihat pukul 09:40-10:05, saat itu, Nisa sedang bermain di Masjid Al-Amin, Jalan Bintara III. Tak lama, datang seorang nenek-nenek memanggil bocah berusia tiga tahun itu . Menurut Sri Wahyuni, 34, orang tua Lina , yang juga nenek korban, cucunya dipanggil dan sang bocah lugu itu menghampiri, “Tadinya cuma ngintip-ngintip , tapi langsung maranin (menghampiri), terus ngobrol sama dia,” ujar Sri Wahyuni. Setelah itu wanita berpakaian gamis dan berhijab itu mengajak Nisa jajan di warung. Seperti akrab Nisa mengikuti pelaku, “Sempat digendong dan setelah jajan balik lagi ke mesjid dan makan bersama,” jelas Sri Wahyuni, yang mengetahui dari CCTV. Setelah makan dan berbincang, tersangka menggendong Nisa, lalu membawanya. Orang tua korban, baru mengetahui gadis cilik itu tidak ada saat mau diberi makan dan diberitahu marbot mesjid kalau ada anak berusia tiga tahun digendong seorang wanita setengah tua, “Saya, tanya marbot dia bilang tadi digendong nenek-nenek,” ujar Lina, yang nampak sedih. Lina kemudian meminta pengurus mesjid memeriksa CCTV . Dalam rekaman CCTV, terlihat pelaku berjilbab hitam mengajak ngobrol Nisa di selasar masjid. Saat itu, Nisa memakai pakaian berwarna merah muda, celana legging, dan sandal bewarna merah muda. “Orangnya berpakaian muslim, kerudungan merah, baju warna biru kembang-kembang, wajahnya nggak kelihatan,” ujar Sri. Karuan saja kejadian itu membuat geger warga dan sejumlah tukang ojek ikut mencari, namun hingga malam tidak ketemu. Baru keesokan harinya ibu korban melapor ke Polrestro Bekasi Kota. [Eugene Volokh] Non-First-Amendment Objections to Anti-Libel Injunctions

In last week's post on Why Properly Crafted Injunctions Against Libel Are Constitutional, I put up a draft amicus brief that I plan to file tomorrow (on my own behalf) in the First Circuit, and asked for reader feedback. I got plenty of feedback, which I much appreciate; and some comments led me to add some further material, which ultimately cuts in favor of rejecting the injunction. (I had at first suggested remanding to the trial court to modify the injunction.) I still think that properly crafted anti-libel injunctions are consistent with the First Amendment, for reasons I mention in that post; but here are some extra thoughts that I'm adding to the brief -- and I'd love to have comments on these, too:

Properly crafted anti-libel injunctions thus do not violate the First Amendment. If a legislature chose to authorize them, that would be constitutional. And if a state has a criminal libel statute (say, New Hampshire), then anti-libel injunctions in that state would simply be narrower, less chilling versions of criminal libel law, see supra p. 24—though, unlike with criminal libel law, their enforcement would not be left to the discretion of prosecutors.

On the other hand, consider a state in which the legislature has repealed its criminal libel statute (say, Maine, see 17 Me. Rev. Stat. Ann. § 2201 (repealed 1975)). There, if a court allows anti-libel injunctions, it would be criminalizing behavior that the state legislature has deliberately decriminalized. A broad injunction, such as "defendant shall not make any libelous statements against plaintiff," would thus likely be improper. Whether a court can properly issue a narrow injunction, such as "defendant shall not libelously state that plaintiff embezzled money from her employer," is a harder question. The answer may depend on whether the court understands the repeal of the criminal libel law as reflecting a decision that libel should not lead to criminal punishment, or just a decision that criminal libel laws have too broad a chilling effect (in which case narrower injunctions that focus on specific statements and thus chill less speech might not be inconsistent with that decision).

The matter may be harder still in a state such as Massachusetts. Massachusetts has historically recognized the common-law offense of criminal libel, see Mass. Const. pt. II, art. VI, § 6 (adopting the common law generally); Commonwealth v. Marsh, Thach. Cr. Cas. 441 (Mass. Bos. Mun. Ct. 1836) (concluding that the common law of criminal libel was thus adopted), and the legislature has never abrogated that offense. But there seems to be no evidence of continuing prosecutions for criminal libel; the most recent published case dealing with a criminal libel prosecution is Commonwealth v. Canter, 269 Mass. 359, 168 N.E. 790 (1929). Moreover, Ashton v. Kentucky, 384 U.S. 195, 198 (1966), concluded that, when no state case has redefined common-law criminal libel in terms that are clear and consistent with First Amendment rules, "the elements of the crime are so indefinite and uncertain" that the common-law rule is unconstitutional. Yet Massachusetts courts could also in principle revive the common-law crime just by redefining it consistently with New York Times Co. v. Sullivan, 376 U.S. 254 (1964), and its progeny.

Whether to allow anti-libel injunctions is thus a difficult judgment about state law and the relationship between judge-made law and legislation. But it is a judgment about state institutions, which should generally be made by state courts. There is no federal law of criminal libel. United States v. Hudson & Goodwin, 11 U.S. 32 (1812). There is no federal law expressly authorizing anti-libel injunctions. The only justification for an injunction that would threaten the defendants in this case with criminal punishment for libel stems from the federal courts' power to adjudicate certain cases arising under state law. Federal courts should thus be cautious about using this limited power as a means of criminalizing behavior that state institutions may choose not to criminalize.

Indeed, under the Erie doctrine, federal courts deciding state libel cases should look to state law to determine whether injunctions are allowed. "[S]tate remedies are available in federal diversity actions." Titan Holdings Syndicate v. City of Keene, 898 F.2d 265, 273 (1st Cir. 1990). Likewise, if state law chooses not to allow injunctions, federal courts should not allow them, either: "Erie doctrine requires courts to apply state substantive law to a request for permanent injunctive relief in diversity cases." Lord & Taylor, LLC v. White Flint, LP, 780 F.3d 211 (4th Cir. 2015). "Allowing different remedies in state law cases heard in federal courts on pendent jurisdiction would undermine the 'twin aims of the Erie rule: discouragement of forum-shopping and avoidance of inequitable administration of the laws.'" LaShawn A. by Moore v. Barry, 144 F.3d 847, 853 (D.C. Cir. 1998) (quoting Hanna v. Plumer, 380 U.S. 460, 468 (1965)). (The matter is uncertain in some circuits, see, e.g., Peterson v. Bell Helicopter Textron, Inc., 806 F.3d 335, 341 n.7 (5th Cir. 2015) (so noting), but this Circuit's view appears to be settled by Titan Holdings, 898 F.2d at 273.)

And Massachusetts law forbids anti-libel injunctions. "[E]ven allegedly false and defamatory statements are protected from prior injunctive restraint by the First Amendment and art. 16 [of the Massachusetts Constitution." Nyer v. Munoz-Mendoza, 385 Mass. 184, 188, 430 N.E.2d 1214, 1217 (Mass. 1985). What Massachusetts courts are forbidden to do in Massachusetts libel cases, federal courts must be forbidden to do as well.

To be sure, it is possible that the El-Moslimanys may not have raised the Erie objection to the injunction in this case. But it may be prudent for this Court to consider the matter sua sponte. For the reasons given above, this is the very sort of case in which federal courts should be deferring to state courts' judgment, rather than developing new remedies that state courts appear to have rejected.

Conclusion

This Court should avoid categorically rejecting anti-libel injunctions on First Amendment grounds. Criminal libel law is constitutional; injunctions against specific statements that have been found libelous have a narrower chilling effect than criminal libel law does, and thus can be constitutional as well.

This Court should also avoid categorically endorsing such injunctions. Unless properly written, anti-libel injunctions omit some important procedural protections that criminal libel law would provide—chiefly, a finding by a jury beyond a reasonable doubt that the statements are indeed libelous, following an adversary presentation in which poor speakers are entitled to court-appointed lawyers.

But this Court also need not reach the First Amendment question, because under Erie this Court should follow Massachusetts law, which forbids anti-libel injunctions.

Clima faz agricultura mineira se concentrar em quatro regiões

O mapa da produção agrícola mineira mudou e se concentrou na última década. As mudanças climáticas e a necessidade de mecanização da produção para controle de custos foram os principais fatores que atuaram nesse processo, que culminou em 82,7% da produção de grãos do Estado em 2016 estar em apenas quatro regiões: Triângulo, Alto Paranaíba, Noroeste e Sul. Em 2006, elas já eram significativas, com 78,5% da produção de grãos, mas o volume era menor. Em 2006 foram 7,37 milhões de toneladas de grãos, de um total de 9,4 milhões. Dez anos depois, as quatro regiões foram responsáveis por 9,67 milhões de toneladas, do total de 11,7 milhões.

Por outro lado, Norte, vales do Jequitinhonha e do Mucuri, região do Rio Doce e Zona da Mata viram sua relevância agrícola diminuir no mesmo período. A produção de grãos na região do Rio Doce caiu 53,3% nesses dez anos, enquanto a queda nos vales do Jequitinhonha e do Mucuri foi de 46,6%, e de 12,8% no Norte. A Zona da Mata perdeu 30% da produção de grãos em 2016 frente 2006.

“A questão climática é significativa principalmente no Norte do Estado, onde a seca tem afetado a produção. Outras regiões, como a Zona da Mata e região do Rio Doce, sofrem com uma topografia que dificulta a mecanização das lavouras. Hoje, a mecanização é necessária para manter os custos competitivos e é facilitada no Noroeste e no Alto Paranaíba”, diz o superintendente de Política e Economia Agrícola da Secretaria da Agricultura, Pecuária e Abastecimento (Seapa), João Ricardo Albanez.

Segundo o coordenador técnico da Emater-MG em Janaúba, no Norte do Estado, André Mendes Caxito, além da seca, a agricultura local enfrenta longas estiagens e um aumento na temperatura média que também é prejudicial. “Hoje, a região investe em produtos que consigam superar até 31 dias sem nenhuma precipitação, como o milheto e a palma forrageira. Milho e feijão não aguentam; produção desses produtos aqui só em áreas irrigadas”, conta.

A alta da temperatura no Estado também é vista como um alerta para produtores de café, na avaliação da analista de agronegócios da Federação da Agricultura e Pecuária do Estado de Minas Gerais (Faemg) Ana Carolina Gomes, mesmo com significativo crescimento da produção de café no Estado. Segundo a Fundação Procafé, a temperatura média na região cafeeira do Sul de Minas, em 2014 e 2015, ficou 2ºC acima da média histórica (22ºC). Já em 2016, as temperaturas médias da região se aproximaram da média histórica.

Emprego

Respiro. A agropecuária foi um dos poucos setores que não teve um saldo negativo de emprego na comparação entre os meses de dezembro de 2016 e 2015, criando 1.730 vagas nesse período, segundo o Caged.

Pecuária é alternativa onde agricultura vai mal

Se a produção de grãos na região do Rio Doce caiu 53,3% entre 2006 e 2016, a de leite cresceu 62% na região em 2015 frente 2005, segundo a Federação da Agricultura e Pecuária do Estado de Minas Gerais (Faemg).

“Isso se explica justamente porque, nas regiões onde a agricultura está em declínio, os produtores passam a investir na criação de gado, em função das pastagens”, afirma o analista de agronegócio da Faemg Wallisson Fonseca.

A produção de leite no Estado cresceu 32,4% entre 2005 e 2015. A concentração da produção em 2015 também é menor no caso do leite, com destaque para Triângulo e Alto Paranaíba, com 26,3%, e Sul, com 15,9%. “A criação de gado está presente nos 853 municípios do Estado”, diz Fonseca, <CF30>(LP)

Sul respondeu por metade do café

A safra recorde de café em 2016 no Estado, de 30,7 milhões de sacas, foi produzida em sua maioria na região Sul e no Cerrado mineiro, que abrange o Alto Paranaíba e parte do Triângulo e do sudoeste de Minas. Em 2015, 70% da produção cafeeira, que foi de 22,4 milhões de sacas, já vinha dessas áreas, segundo a Federação da Agricultura e Pecuária do Estado de Minas Gerais (Faemg). Só o Sul foi responsável por metade dessa produção. Os dados regionalizados de 2016 ainda não foram divulgados.

A falta de chuvas afetou a produção do café em outras áreas do Estado, assim como ocorreu com a produção de grãos. “Na área que chamamos de Chapada de Minas, que fica na região dos vales do Mucuri e do Jequitinhonha, a seca afetou a produção de café. O próprio Sul de Minas sofreu com a estiagem em 2014 e 2015, se recuperando no ano passado”, explica a analista de agronegócios da Faemg Ana Carolina Gomes. Ela também aponta as geadas como um risco climático ao café. “Foram mais de 20 anos sem acontecer, mas tivemos geada em 2016.” (LP)

Resistência à seca

Norte deve investir em ração para gado

O Norte do Estado está abandonando a produção de grãos e investindo em produtos agrícolas, como o milheto e a palma forrageira, dirigidos para alimentação de gado e mais resistentes a longos períodos de estiagem.

“O milheto e a palma forrageira são mais resistentes que o sorgo, que é uma cultura mais difundida na região. Com mais de 30 dias sem chuva, o sorgo pode até resistir, mas a perda pode chegar a 50% do investimento”, afirma o coordenador técnico da Emater-MG em Janaúba, no Norte do Estado, André Mendes Caxito.

Para o analista de agronegócios da Faemg, Caio Coimbra, o investimento em produtos mais resistentes é uma adaptação à realidade. “Os produtores devem entender qual é a realidade da região, que hoje se aproxima muito mais ao semiárido do Nordeste, e investir em novas culturas”, afirma Coimbra, que também defende o investimento na palha forrageira. O milheto e a palha forrageira já são comuns no Nordeste do país. São origináros da África e do México, respectivamente. (LP)
