Shawnâs life was marked by a series of heartbreaking events that shaped him into the resilient yet haunted man he is today.
His story start with his mother, Mary, who discovered a chilling prophecy from her brother Robert Rowan. He told her that Shawnâs life will be cut short. By that time, he had seen many of the boyâs deaths and felt an obligation to tell Mary the truth of what he had seen many times. Shawnâs death before he would reach the age of ten. Mary knew of her brotherâs skill and also knew that he wouldnât lie to her.
Mary told her husband, Cillian, about the prophecy. He refused to believe such nonsense and waved the warning away. Despite her husbandâs scepticism, Mary went on a mission to save her son. She came across a supernatural relic that might save her sonâs life. It came in a form of a charm. This charm she kept around her neck from then on out, keeping it close.
She tried to keep her son safe, but one fateful event had them involved in a huge collision with multiple cars and they were stuck in the middle. Shawn died as he had hit his head against the glass next to him, among other injuries. Mary used the charm as was instructed, well aware of the price. Her life to save his.
Shawn woke up in the hospital two weeks later. Confused about what had happened and why his uncle was there and not his father. Robert told him he and his mother had been in a car accident and that she didnât make it. When Shawn asked about his father, Robert couldnât answer. How was someone going to tell a young boy that their father didnât want to see them?
When Shawn regained his strength, he returned home and expected a warm welcome from his father, as young boys do. Instead, he received the cold shoulder from a scarcely sober man. Cillian drowned his pain with alcohol and shared his sharp words and opinions with his son. How he was the reason that she was dead and it didnât take long for him to believe them.
As Shawn grew older and Cillianâs addiction was more severe. The verbal abuse moved to physical abuse. It started with smacks and taps, but with each passing week, it grew more and more severe.
Shawn still saw his uncle from time to time, sleeping at his place to get away from the sorrow filled home. Dreading to head back home each time.
Even through all the pains of his home life. Shawn kept his grates up. He knew his father would never pay for college, unlikely to do so either, as coming by was already difficult to keep up with his addiction. He worked in a supermarket to help pay with the rent and other bills. When he was old enough to work in a bar, he did and loved the job too. It was at that place where he discovered a deep appreciation for whiskey, discovering the art of responsible consumption rather than indulging in excessive drinking commonly seen in bars. There, he could forget about his own life and focus on others.
Itâs also where he met Luca, who was visiting with a group of friends. Their relationship grew fast, but not uncomfortably. Shawn tried to keep his family life out of their relationship, but eventually had to tell about his situation. Shawn couldnât stay away from home too long. He had to take care of his father, who by that time had grown ill through his alcohol abuse. He needed to stock up on groceries, keep the house clean, fix everything that broke down. This eventually led to Shawn dropping out of college to take better care of his father when he wasnât working.
At a fair he and Luca went to together, Luca saw a fortune-teller. Shawn refused to walk with him as he didnât believe in that stuff and it made him uncomfortable. When he walked out, Luca wore the warmest and biggest of smiles Shawn had ever seen and when he asked about it, all he got was âitâs a surpriseâ. It turns out Luca was given a marble that could grand one wish, though that there was a price to be paid. The price, however, was vague and Luca thought little of it when he made the wish for a better life for his boyfriend.
That wish came true the day after, little by little. Shawn found his father clearing up his collection of beer and other boozes. Cillian cleaned up his act and as days passed by, he became a better father than Shawn ever remembered him to be. Cillian might have looked better over the days, but his boyfriend looked worse and worse. He became skittish and frightful. One night when Shawn slept over at Lucaâs, he was awoken by a thrashing Luca and it was then that Shawn pulled out the information about what Luca had done for him. Initially, he doubted it, but it made sense how things had changed rapidly. Together they went back to the fortune-teller to undo the wish, as the price was not worth his boyfriendâs sanity. It was said that if you break the marble, the wish will become undone, leaving out some crucial details.
They broke the marble together and, just like the fortune-teller told them, things turned back to normal. His father became the alcoholic he always knew him to be and peace returned to Lucaâs mind, most of it anyway. Shadows followed him wherever he went, and that shadow materialized when Luca went to Shawnâs home to pick him up. He heard them arguing about something and went inside to help. Cillian attacked Luca in an alcohol-fuelled rage and killed Luca. Then Cillian tried to kill his son and when he failed to do so, he killed himself.
Shawn lost everything that day and was forced to believe that cursed objects were a thing. He talked with his uncle about it, and it was then that Robert told him how Shawn was alive and his mother dead. That Shawn was dead for a few minutes before he was brought back. It wasnât the work of medical care, but of some supernatural force. Robert also told him that such events brands a soul, meaning that Shawn might have gifts he suppressed through the years.
He asked his uncle to help him develop those skills so he could help others with situations such as his own. Learn about it, prevent it from happening or find a better solution than the end he had gotten with Luca and his father.
Shawn feels the energy of supernatural artifacts and locations, which are helpful on his hunt for them.
He can see the dead, not in detail, but as a silhouette.
Somewhat resilient to the effect of supernatural objects.

Femicides in El Paso Mexico
Below are a few random excerpts from news articles. They are themed on femicides and violence. These atrocities occur regularly in the border communities of Mexico where The Free Trade Agreement was put into effect. Thousands of female immigrants and local Mexicans flock to work long hours with little pay and little humanitarian protection at these locations.

Violence made itself known during Halloween. This placed police on alert as killings surged with more than 50 murders in the first two weeks of November. This included 10 deaths on Nov. 3. This information was reported by authorities and local news teams.
Juårez has already surpassed 1,000 homicides in 2023, including 94 in October. The killings include street shootings, victims gunned down at home and encobijados, or bodies dumped in public wrapped in blankets.
"The spikes in violence during these three days (Nov. 1-3) were something atypical," said Gilberto Loya (a Chihuahua State Public Safety Secretary) at a news conference last week. He added that murders had generally been trending downward. * * *
Politicians like President AndrĂ©s Manuel LĂłpez Obrador like to blame drug cartels for violence against women. They promise to help solve cases but ignore the fact that femicides occur wherever police or military are deployed, says journalist Romero. There have never been as many femicides in JuĂĄrez as there were in 2010, when the city was controlled by the military at the height of CalderĂłnâs war on drugs. The security forces are untouchable here, he said.
The illegal trading of organs is of great concern among the border communities of Mexico where these femicide murders take place.

âIn the case of Afghanistan, Americaâs refusal to countenance the return of Zahir Shah may well have proved to be their greatest failure of imagination yet.

We were ushered into the garden room, there, on cane furniture, sat two old men. One, slightly-sunken of face but alert and with a smile waltzing over his lips, the other of a more military bearing. Dust eddied in the shafts of light as we passed, then settled as we did. We were visiting the 86 year old Zahir Shah, King of Afghanistan for 40 years between 1933 and 1973. With him was Lieutenant-General Sardar Abdul Wali Khan, who acted as an interpreter, it was entirely unnecessary as the King would answer in accurate though halting English.
We were there to discover if the old man was interested, or even able, to take up the reins again. His time as monarch (ended in a palace coup by his cousin, Mohamed Daud) had been one of unprecedented peace and prosperity for the mountain kingdom. In the late 1960s he introduced a new democratic constitution. Amongst other things, it guaranteed womenâs rights and elections. He was also someone who was able to garner loyalty not just from his native Pashtun people, but from the Hazara, Tajik and Uzbeck minorities and the confidence of many of the regional powers.
The exiled king spoke of his visceral love for the country. That and his deep sadness. How, from his Roman exile he had seen his land first became a dictatorship after a palace coup, then a Soviet satellite state, ending in a Soviet inspired coup, the Soviet invasion of 1979 and the civil war that saw the death of 400,000 of its citizens between 1979 and the fall of the Taliban. Estimates suggest upwards of 10 per cent of the entire population were killed during that period, a salutary realisation that even 20 years ago Afghanistan had been a killing field for the previous 20 years.

These events had not dimmed the kingâs desire to do what he could for the nation. He had told us he would do anything to secure peace. As he went on to do. Within a week of our meeting, he had made an informal agreement with the anti-Taliban Mujahedeen of the Northern Alliance.

At this point things were looking promising for a return of the king. But Pakistani Intelligence, the ISI, was uncomfortable with the prospect of a moderate in power in Afghanistan, and was even less happy by the combination of a Pashtun king, with the support of the Tajik, Uzbek and Hazara dominated Northern Alliance having political power.
Zahir at no time demanded the throne â indeed the Tajik, former President and leader of the Jamiat-e Islami rejected the idea out of hand â his offer was to convene a Loya Jorga, a gathering of all the tribal notables to create a new constitution. In November of that year the Bonn conference, which included all Afghan factions barring the Taliban, supported him as the interim leader.
And yet, by the time Zahir returned to Kabul with Hamed Karzi, the US had gone completely cold on the idea. Now their chosen man was Karzai, soon after American-led forces had driven the Taliban out of Kabul in 2002. It is clear that the USâs retreat from supporting the monarchical option was in part driven by their ties with the Pakistani ISI, for years they had starved the moderate Afghan nationalist Haq of support whilst feeding the Islamist factions of the Northern alliance.

The US, though it was aware of the possibilities of an Afghan solution to an Afghan problem, and a solution that could have utilised the residual loyalty of the Afghan peoples, decided against. The rest is dour, bloody history.â
âAll empires die. The end is usually unpleasant. The American empire, humiliated in Afghanistan, as it was in Syria, Iraq, and Libya, as it was at the Bay of Pigs and in Vietnam, is blind to its own declining strength, ineptitude, and savagery. Its entire economy, a âmilitary Keynesianism,â revolves around the war industry. Military spending and war are the engine behind the nationâs economic survival and identity. It does not matter that with each new debacle the United States turns larger and larger parts of the globe against it and all it claims to represent. It has no mechanism to stop itself, despite its numerous defeats, fiascos, blunders and diminishing power, from striking out irrationally like a wounded animal. The mandarins who oversee our collective suicide, despite repeated failure, doggedly insist we can reshape the world in our own image. This myopia creates the very conditions that accelerate the empireâs demise.
The Soviet Union collapsed, like all empires, because of its ossified, out-of-touch rulers, its imperial overreach, and its inability to critique and reform itself. We are not immune from these fatal diseases. We silence our most prescient critics of empire, such as Noam Chomsky, Angela Davis, Andrew Bacevich, Alfred McCoy, and Ralph Nader, and persecute those who expose the truths about empire, including Julian Assange, Edward Snowden, Daniel Hale, and John Kiriakou. At the same time a bankrupt media, whether on MSNBC, CNN or FOX, lionizes and amplifies the voices of the inept and corrupt political, military and intelligence class including John Bolton, Leon Panetta, Karl Rove, H.R. McMaster and David Petraeus, which blindly drives the nation into the morass.
Chalmers Johnson in his trilogy on the fall of the American empire â âBlowback,â âThe Sorrows of Empireâ and âNemesisâ â reminds readers that the Greek goddess Nemesis is âthe spirit of retribution, a corrective to the greed and stupidity that sometimes governs relations among people.â She stands for ârighteous anger,â a deity who âpunishes human transgression of the natural, right order of things and the arrogance that causes it.â He warns that if we continue to cling to our empire, as the Roman Republic did, âwe will certainly lose our democracy and grimly await the eventual blowback that imperialism generates.â
âI believe that to maintain our empire abroad requires resources and commitments that will inevitably undercut our domestic democracy and, in the end, produce a military dictatorship or its civilian equivalent,â Johnson writes. âThe founders of our nation understood this well and tried to create a form of government â a republic â that would prevent this from occurring. But the combination of huge standing armies, almost continuous wars, military Keynesianism, and ruinous military expenses have destroyed our republican structure in favor of an imperial presidency. We are on the cusp of losing our democracy for the sake of keeping our empire. Once a nation is started down that path, the dynamics that apply to all empires come into play â isolation, overstretch, the uniting of forces opposed to imperialism, and bankruptcy. Nemesis stalks our life as a free nation.â
If the empire was capable of introspection and forgiveness, it could free itself from its death spiral. If the empire disbanded, much as the British empire did, and retreated to focus on the ills that beset the United States it could free itself from its death spiral. But those who manipulate the levers of empire are unaccountable. They are hidden from public view and beyond public scrutiny. They are determined to keep playing the great game, rolling the dice with lives and national treasure. They will, I expect, preside gleefully over the deaths of even more Afghans, assuring themselves it is worth it, without realizing that the gallows they erect are for themselves.â
âWe waged war in Afghanistan - twenty years of war, thousands of American lives lost, tens of thousands of Afghan lives lost, over 2 trillion dollars spent - but we did not wage peace. We went, we fought, we supported a corrupt Afghan government almost as abusive to the people there as the Taliban had been, we droned, we bombed, we tried to build an army of some of the historically best fighters in the world in the image of the American armed forces (so arrogant are we), we tried to build an Afghanistan in the image of our own country (so delusional are we) - and yeah, we did some good things too. In the end, we arenât just the last in a long line of empires defeated in Afghanistan. Even worse, weâre the last in a long line of empires that raped and plundered it before we left.
God help us, if we donât learn from this.â

Riot declared as fire burns in Portland police union offices (AP) A fire inside a police union building led authorities in Portland, Oregon, to declare a riot and force protesters away from the offices as violent demonstrations continue in the city that had hoped for calm after federal agents withdrew more than a week ago. A group of demonstrators broke into the Portland Police Association building, set the fire and were adding to it when officers made the riot declaration late Saturday, police tweeted. Video shot by a journalist shows smoke and flames arising from inside the building. Several hundred people had gathered outside the offices, which are located about 5 miles (8 kilometers) north of the federal courthouse that had been the target of nightly violence earlier this summer. The Portland Police Association is a labor union that represents members of the Portland Police Bureau.
For pandemic jobless, the only real certainty is uncertainty (AP) For three decades, Kelly Flint flourished as a corporate travel agent, sending everyone from business titans to oil riggers around the planet. Then came the worst pandemic in a century, leaving her jobless and marooned in an uncertain economy. Furloughed since March, Flint has dipped into her retirement account to pay her bills, frustrated that her $600 weekly emergency federal aid payments have expired. Bolivia Under Blockade as Protesters Choke Access to Cities (NYT) Antigovernment protesters in Bolivia blockaded some of the countryâs main roads this past week to challenge the delay of general elections and rebuke the governmentâs poor response to the coronavirus pandemic. The protestersâwho support Boliviaâs former president, Evo Moralesâsay they have set up 70 roadblocks, marooning about six million residents of three highland regions, including Boliviaâs most important metropolis, La Paz. Already, the blockade has raised fears of food and gasoline shortages, pushing throngs of La Paz residents into the streets to line up outside food markets and gasoline stations. Boliviaâs unrest could be a harbinger of whatâs to come elsewhere in Latin America, where citizens are losing faith in their countriesâ ability to contain the pandemic, and to mitigate the economic crisis brought on by measures to combat the virus. The pandemic has killed more than 210,000 people in Latin America and plunged its economy into the deepest recession in at least a century, according to the United Nations. Bolivia is suffering one of the biggest outbreaks in the region, when adjusted for population; the virus has killed 3,000, sickened top government officials and overwhelmed hospitals.
When Covid-19 Hit, Many Elderly Were Left to Die (NYT) Of all the missteps by governments during the coronavirus pandemic, few have had such an immediate and devastating impact as the failure to protect nursing homes. Tens of thousands of older people diedâcasualties not only of the virus, but of more than a decade of ignored warnings that nursing homes were vulnerable. In recent months, the coronavirus outbreak in the United States has dominated global attention, as the worldâs richest nation blundered its way into the worldâs largest death toll. Some 40 percent of those fatalities have been linked to long-term-care facilities. But even now, European countries lead the world in per capita deaths, in part because of what happened inside their nursing homes. Spanish prosecutors are investigating cases in which residents were abandoned to die. In Sweden, overwhelmed emergency doctors have acknowledged turning away elderly patients. In Britain, the government ordered thousands of older hospital patientsâincluding some with Covid-19âsent back to nursing homes to make room for an expected crush of virus cases. Paris makes masks mandatory as virus toll crosses 722,000 (AFP) Paris on Saturday made face masks compulsory outdoors in crowded areas and tourist hotspots, as infections in and around the French capital rose and the global death toll crept past 722,000. The mask will be obligatory for all those aged 11 and over âin certain very crowded zonesâ, said a police statement. Several French towns and cities have already introduced similar measures, as well as parts of Belgium, the Netherlands, Romania and Spain.

Not only does he have such knowledge, but he is capable of understanding and translating into Common Eorzean, Doman, Hingan, the language of the steppes, Garlean, and Ancient Allagan. He is shotty with the Seawolf language and a hit/miss with dragonic. While there are some things impossible for him to know or find out, he gets by. With enough coin, material, information, or persuasion you too can get information out of catman!

Ightirab (Doubled Separation)
Ightirab (doubled separation) is a feeling resembling that which arises from falling into error after reform, or night following day, or the darkness of distress that surrounds the heart after exhilaration. Those whom the Messenger praised in His saying, Glad tidings to the outsiders, have always had a dread of such a feeling.
Resembling the separation described above in many ways, doubled separation may arise either from a physical condition or from oneâs spiritual state, or from oneâs spiritual profundity and knowledge of God. In the third case, it is felt more deeply.
Doubled separation which arises from a physical condition is homesickness, separation from oneâs family, relatives, and friends. Particularly when all the means for reunion no longer remain, the spirit sinks into an unbearable feeling of separation. If such a separation is not balanced with a belief in God and the Resurrection, it becomes very difficult to endure. If one bears it with belief, one will die a martyr, as stated in the Prophetic Tradition, The death of one away from his home is martyrdom. If it is not accompanied by heresy and unbelief, according to Every misfortune brings a reward, then it is a gift from God that is beneficial, as it leads to God. According to some, such separation, the pain of which has been softened by belief, is such a sweet suffering that it brings as great a reward as one has the strength to bear. Even though a person may sigh and moan when faced with this pain, the human conscience welcomes it. The following couplets of a poet express this well:
Those away from home and who see me in this state, Let them sit by my grave when the time is due. For only those suffering separation know each otherâs state; They are keepsakes entrusted to one another. O my Lord! You are One Who provides means for those without means; It is only You Who will provide means for both me and others. As out of night You bring forth day, You are also able To bring forth joy and happiness out of my sorrows.
The feeling of separation arising from oneâs spiritual state is appreciated and honored in the Prophetic saying, Glad tidings to the outsiders. Such people are righteous people struggling with what a corrupt age brings; a scholar devoted to truth lost in a community drowned in ignorance; a faithful one dedicated to truth in a world permeated by hypocrisyâall those suffer separation within separation. When such people witness the great waves of corruption spreading over the land, the ruination of the ignorant masses, and the regard paid to hypocrisy and hypocrites they find themselves in increasing loneliness and become possessed of a great desire to tell the truth to others in order to guide them.
As for the separation that arises from spiritual profundity and a knowledge of God, those suffering from this feel and expect that which exists in the purely Divine Realm, and find themselves in the depths of spiritual pleasures. Nevertheless, until they meet with the Almighty, they feel in their souls the separation of those who are closed to the Truth around them, never being able to free themselves from feelings of separation that arise while journeying toward God. Although they always yearn for nearness to God and to meet with Him in the warmth of His friendship, they are sometimes under the influence of the fear, worry, and sensitivity that they feel during the journey; sometimes the eyes of their hearts are veiled by some evil thoughts and imaginations occurring to them unintentionally. Such people suffer separation, each according to their particular degree. Though the separation of some may be substantial, the separation that most suffer is only imagined or of the kind that arises from worry and excessive sensitivity. They tremble with the fear that this separation, which arises during their relations with the Almighty in different wavelengths, may affect their faithfulness, loyalty and nearness to God, and wound them spiritually. Since initiates view such separation as a sign of loss while they are striving and advancing toward gain, they feel helpless. In the worries or thought of being abandoned or left alone, they sigh in great pain and may cry out: âI wish my mother had not given birth to me.â
While those who suffer separation from home console themselves with the thought of the eternal union in the hereafter, and those whose separation arises from their spiritual states can find comfort in their renewed pursuit and in glimpses of knowledge and love of God, the separation felt by those who have reached contentment in the knowledge of God is absolutely unbearable. The worldly people, who neither see nor know what is beyond the material world, are unaware of what state such people are in. Nor can those known for their regular worship of God or those renowned for their asceticism recognize them or understand their condition, because they cannot get beyond their worship and asceticism. But the horizons and aims of those endowed with the knowledge of God and the efforts that such make to reach their horizons and realize their aims, are as deep and high as the greatness of their relationship with the One Whom they adore.
O God! Show us the truth as the truth and enable us to abide by it, and show us falsehood as falsehood and enable us to avoid it. May Godâs blessings and peace be upon our master Muhammad and his family and Companions. Amen, O All-Aiding One!

SC rules out fresh probe in Sohrabuddin case judge Loya's death: 10 points

The Supreme Court on Thursday dismissed a batch of pleas seeking an independent probe into the mysterious death of special Central Bureau of Investigation (CBI) judge B H Loya, who was hearing the high-profile Sohrabuddin Sheikh fake encounter case involving Bharatiya Janata Party (BJP) Amit Shah. Loya had on December 1, 2014 died of cardiac arrest in Nagpur, where he had gone to attend the wedding of a colleague's daughter.
Further, the apex court said that the submissions of the petitioners prima facie amounted to criminal contempt of court but that it was not initiating contempt proceedings.
Attempts were made to scandalise the judiciary by levelling serious allegations against judges and judicial officers of the Bombay High Court, said a Bench comprising Chief Justice Dipak Misra and judges A M Khanwilkar and D Y Chandrachud. Further, dismissing the pleas for an independent probe, the Bench said there was no reason to doubt the statements of four judges on the circumstances leading to the death of judge Loya. The apex court said that the documents placed on record and their scrutiny established that the CBI judge's death was due to a natural cause.
The apex court had earlier asked the Maharashtra government to submit the post-mortem report of the CBI judge, who had died under suspicious circumstances in 2014, citing that the "matter was very serious". Maharashtra-based journalist B S Lone and activist Tehseen Poonavala had filed independent pleas seeking a fair probe into the death of Justice Loya.
The issue of Justice Loya's death had come under the spotlight in November last year after media reports quoting his sister fuelled suspicion about the circumstances surrounding his demise and its possible links with the Sohrabuddin Sheikh fake encounter case. However, Justice Loya's son had on January 14 said in Mumbai that his father had died of natural causes.
In the Sohrabuddin Sheikh fake encounter case, BJP President Amit Shah, Rajasthan Home Minister Gulabchand Kataria, Rajasthan-based businessman Vimal Patni, former Gujarat police chief P C Pande, Additional Director General of Police Geeta Johri and Gujarat police officers Abhay Chudasama and N K Amin, have already been discharged.

Indian Judiciary: Judges â Are they debilitating Justice?
This article is written by Sara Suresh, pursuing B.A.LL.B from Symbiosis Law School,Pune. The article discusses and analyses Justice loya death, Sexual Harassment case against former CJI Ranjan Gogoi and the retired Judges as MPâS where Judges had used their power and discretion in extreme level and had failed to deliver Justice.
Introduction
The Indian Judiciary is conferred with an enormous role and power of interpreting statutes and adjudicating upon controversies between citizens or states or between a citizen and the state. The Supreme Court is even called the Guardian of our Constitution. The main function of Indian Judiciary is to maintain the rule of law in the country. In a country like India, with a written Constitution, Courts have an additional duty of protecting the Supremacy of the Constitution.Â
But, Whether the Judiciary as an institution has earned Public Trust? Whether the vast number of pending cases is the only Gordian knot the Judiciary is facing? The answer for both these questions would be a big âNoâ! There are several instances where the Judiciary has abstained from administering Justice. Some of the very important cases are discussed below.
Justice B.H. Loya Death
The Court in Tehseen Poonawalla v. Union of India and Others has weakened the bedrock of Justice. The death of Justice B.H. Loya was questioned in the case and an independent enquiry into his death was requested. The Supreme Court dismissed the petition on the ground that the documentary evidence indicates that his death was under natural circumstances. On analysing this case legally, it gives rise to many speculations.
Firstly, there exist several inconsistencies in the case such as the time of his death, the manner in which he was taken to the hospital and to his home with blood on his shirts and without being accompanied by any security. He had a sound medical history and was even offered a bribe in order to deliver a favourable Judgement. The Court after hearing the statements of the four judges who were with Justice B.H. Loya stated that there is no ground for reasonable suspicion of his death. The evidence submitted by both the petitioner and respondent are documentary in nature and the Court arbitrarily passed its judgement on the statement of the Judges claiming that it has a ring of truth.
Justice Y Chandrachud in an earlier Judgement stated that Judges are not above the law in a constitutional democracy which is dedicated to Rule of Law and Equality for its citizens. Rule of law indicates some higher kind of law which is just, reasonable and non-discriminatory. One of the main facets of the Rule of Law is âEquality before Lawâ. Every man, irrespective of his rank or condition, is subject to the ordinary law of the country. But, however in the present case the statement of the Judges were not subject to oath or cross examination. As the Supreme Court has earlier observed even procedural inequities amount to arbitrariness. How can the court come to a definite conclusion about the death of Justice B.H.Loya without going through the legal process that is envisaged by the law?Â
Secondly, B.H.Loya was dealing with the Sohrabuddin Sheikh Fake Encounter Case at the time of his death which carries grave inconsistencies. Justice J.T. Utpat was the predecessor of Justice Loya and he was transferred overnight. Both the Judges had reprimanded Amit Shah, the current BJP-President and one of the accused for not appearing in the Court. Justice M.V.Gosavi presided over the case after his death and discharged it after two weeks of hearing. These facts were not contemplated by the Court.
The Supreme Court in Central Bureau of Investigation v. Amitbhai AnilChandra Shah transferred the Encounter case to Mumbai and directed that the trial should be conducted by the same officer from its inception to the end. But the Mumbai High Court didnât adhere to the order of the Apex Court. How can other organs of the Government be questioned of implementation when a part of Judiciary itself makes a mockery of the Apex Courtâs Orders? The Supreme Court has held that wilful non compliance of courtâs order amounts of contempt of court. However, in the Encounter case, neither the Supreme Court nor any other authority has taken cognisance of such contempt in spite of their power to do so.

Sexual Harassment Allegation against Former Chief Justice of India Ranjan Gogoi
The Supreme Court in âIn Re: Matter of Great Public importance touching upon the independence of Judiciaryâ murdered the Constitutional values. In this case a junior court staff submitted an affidavit stating that she was sexually harassed by the (Former) Chief Justice of India Ranjan Gogoi and the Court initiated suo-moto proceedings in order to determine whether the allegations are fabricated. There are several procedural irregularities in this case and it gives rise to many doubts.
Firstly, the allegation was made against the Chief Justice of India and not against the Judiciary. Why a sexual harassment allegation against the CJI was made into a case dealing with the Independence of Judiciary?
Secondly, the CJI (against whom the allegations were made) convened an urgent hearing immediately after the allegations were made by constituting a special Bench headed by him. It was reiterated by the Supreme Court in many cases that âNo one can be a judge in his own caseâ. All citizens in India are bound by Rule of Law. Does the CJI have the power to override the Principal of Natural Justice at his discretion?
Thirdly, an In-House enquiry Committee was established with three Judges as its members who were junior to the accused Chief Justice of India. In the earlier sexual harassment cases against the Judges, an In house panel was constituted with Judges who has not worked with the accused Judges. This procedure was not followed in the present case. Whether the Chief Justice of India is not considered to be equal to other citizens of the country? Why was this special treatment given to him when the constitution doesnât confer him any exceptional status?
Fourthly, the In-House Committee passed an order stating that there is no substance in the allegations made by the Complainant and the final report was submitted to the Chief Justice of India. It was held in Indira Jaisingh v. Supreme Court of India and Another that the report of the In house Committee is not enforceable to be made public. But the inquiry in the present case is an informal one and the precedent states that committee proceedings cannot be disclosed to the Public. But why wasnât the report submitted to the complainant? Fifthly, the complainant and her family were fired from their job and were subject to persecution without stating any reasons. Did the court find any substance in it? If it had found any reasonable grounds for their dismissal, then why the complainantâs termination was withdrawn with payment of full wages by the Present Chief Justice of India S.A.Bobde. Why was the complainant not given any legal assistance in spite of her hearing disability? Above all why werenât these questions raised by the legal luminaries of India?
In the present case, the complainant later withdrew from the in-house committee inquiry citing various reasons that:
In spite of her hearing disability, she was not assisted and allowed the presence of a lawyer during the proceedings.
Neither video nor audio recordings were allowed during the course of the proceedings.
The In-House committeeâs reports and procedures were not provided and informed to the complainant.
Retired Judges as MPâs
Within five months of retirement, Former Chief Justice of India Justice Ranjan Gogoi was sworn in as a member of Rajya Sabha. Erstwhile, Former Chief justice Ranganath Misra and Justice Baharul Islam were admitted to Rajya Sabha There are two commonalities that exist between all three Judges.Â
First and foremost, according to our Constitution, only those who have special knowledge or practical experience of matters such as literature, science, art and social services should be nominated to Rajya Sabha. But all the three Judges do not satisfy this criterion. Furthermore, all the three Judges have presided and disposed of several political cases during their Office tenure.Â
Judges are provided with reasonable security to keep them immune from the strains of contemporary politics and enable them to work in an independent atmosphere. It was held in Nixon M Joseph v. Union of India that independence of Judiciary refers to be free from executive (Bureaucracy), political interference and interference of any such type. The independence of Judiciary is one of the salient features of the Constitution. The Judges of the Supreme Court has observed that it is the bulwark of democracy.Â
Both the concepts, âSeparation of powers between the legislative, the executive and the Judiciaryâ and the âIndependence of the Judiciaryâ is considered to be the very heart of constitutional scheme. If any decision of the Government or Court undermines such independence, it would impinge upon the basic structure of Constitution as held in the case Brij Mohan Lal v. Union of India.Â
Judicial independence gets eroded by the practise of employing retired Supreme Court Judges in various Government and ministerial capacities. The Law Commission criticized the practice stating that it is undesirable for the retired Supreme Court Judges to look forward to such employment as it interferes with the Independence of Judiciary and it shouldnât be continued.
The Commission also stated that any average citizen may well get the impression that a Judge who is employed by the Government post his retirement would have compromised his position as a Judge.
Dr.B.R.Ambedkar in the Constituent Assembly stated that the chances of Government influencing the Judiciary are very remote as the Judiciary adjudicates the issues between citizens and very rarely between citizens and the Government.Â
But today a large chunk of Supreme Court cases have the Government as a party. The father of the Indian Constitution also stated in the assembly that the relations between Executive and Judiciary are so separate and distinct that the Executive hardly has any chance of influencing the decisions of the Judiciary. Many a time, retired Judges are even appointed to pure and simple executive posts such as, Governor of States. Precedents would include Justice Fazl Ali (Former Governor of Odisha), Justice Fatima Beevi (Former Governor of TamilNadu) and Justice P Sathasivam (Former Governor of Kerala).
Law should be progressive according to the changes in society. India is a country which has both âConstitutionâ as well as âConstitutionalismâ. The Constitution not merely confers powers on different organs of the Government but also seeks to restrain those powers. Constitutionalism on the other side insists upon the limitations being placed on the Governmental powers and envisages checks and balances on different organs of the Government and not making them arbitrary. At present, the judicial independence is affected to a large extent by the internal networks of the Judges itself! It is time for all of us to recognise this reality and act upon it. There is a dire need to enact new laws and devise new mechanisms to look into all these loopholes in Judiciary and to uphold the constitutional values. Justice done to some and denied to others doesnât amount to Justice! Judiciary can be completely effective only when it is both independent and accountable.
