Further to my previous post

Whilst it’s mildly entertaining that Australian news sources have been pulled, and it’s simple for people to be crying JUST QUIT FACEBOOK! It’s not that easy

Facebook is a hub for many communities, parents, neighbourhoods, to connect and stay healthy.

In a pandemic Facebook was a VITAL way to keep people safe and spread information via news sites about lockdowns, health legislation, mask wearing.

It is dangerous and irresponsible, outside of the big arguments of censorship and legislative regulation, this is a vital way for the public to be connected and informed.

Why is the government playing with our right to information at a time when it is literally vital to the safety and survival of many?

Luật sư của Văn phòng Đất Vàng Châu Úc tại Melbourne cho biết việc hủy visa thông thường xảy ra do vi phạm điều khoản visa, không đáp ứng yều cầu nhân cách hoặc cung cấp sai thông tin khi nộp visa. Một khi visa bị hủy, người đó sẽ trở thành người sống bất hợp pháp, tức là sẽ bị đưa đến trại giam giữ di trú và sẽ bị trục xuất khỏi Úc.

Luật sư Tim Madigan thuộc Trung tâm hỗ trợ pháp lý Queensland cho rằng: “Điều an toàn nhất cần làm ngay khi nhận thông báo Xem xét việc hủy visa từ Bộ Nội vụ Úc đó là phải đi gặp chuyên viên tư vấn pháp lý ngay, vì đôi khi hạn chót rất gấp, có thể chỉ vài ngày hoặc một tuần, đôi khi được 28 ngày để trả lời… cho nên thời hạn còn tùy thuộc vào lý do visa bị hủy.”

Luật sư Kate Bones thuộc Trung tâm Hỗ trợ Pháp lý New South Wales nói việc hủy visa do cung cấp thông tin không chính xác có thể xảy ra ngay thời điểm người đó nộp hồ sơ xin quốc tịch. Bà cho biết việc hủy visa kiểu này đã tăng lên trong những năm gần đây, đặc biệt xảy ra với người tị nạn và người tạm trú.

“Bộ Di trú Úc cho thấy họ đã tăng cường rà soát, xem xét rất kỹ những thông tin và giấy tờ được nộp trước đó. Thường sẽ có lời giải thích hợp lệ vì sao tại thời điểm khác nhau thì giấy tờ cá nhân lại khác nhau, chẳng hạn giấy tờ cá nhân bị mất hoặc không phải quốc gia nào cũng cung cấp hoặc giữ loại giấy tờ đó. Cũng có thể vì lý do văn hóa mà người nộp hồ sơ đã không điền một số thông tin như ngày tháng năm sinh trong hồ sơ.”

Tiến sỹ Daniel Chezelbash, giám đốc Viện Pháp lý xã hội thuộc Đại học Macquarie – nơi cung cấp tư vấn pháp lý cho những người tị nạn và người tạm trú, cho biết những người bị án tù 12 tháng hoặc hơn sẽ tự động bị hủy visa.

Nếu visa của bạn bị hủy tự động thì bạn không thể kháng án nhưng có thể nộp lại hồ sơ trực tiếp cho Bộ trưởng Di trú để xem xét, nhưng trong suốt thời gian đó bạn phải ở trong trại giam giữ di trú và có khi phải mất vài năm đến khi mọi việc xong xuôi.

Luật sư Kate Bones cho biết có những nạn nhân của bạo hành gia đình đôi khi bị người sống chung đe dọa sẽ hủy visa nhưng thực tế là họ không có quyền đó. Nếu cần phải rời bỏ người sống chung bạo lực mà bạn đang phụ thuộc dưới dạng visa tạm trú, bạn phải thông báo tới Bộ Di trú Úc và họ sẽ không hủy visa của bạn.

Luật sư của Đất Vàng Châu Úc cho biết tại Úc có những nơi có thể xem xét lại quyết định hủy visa nhưng thông thường người dân có quyền kháng án lên Ủy ban Kháng Án (AAT) nếu visa bị từ chối hoặc bị hủy theo điều 501 của Bộ luật Di trú.

Sẽ có những thành viên độc lập nhưng có vị trí ngang hàng với Bộ trưởng để xem xét toàn bộ chứng cứ của hồ sơ để xem việc hủy visa có phù hợp hoặc có phải là hủy tự động hay không. Quý vị cũng có thể kháng án lên Tòa án liên bang ở cấp thấp (Federal Circuit Court) để xem liệu có sai sót pháp lý trong quyết định hủy visa hay không.

Luật sư của chúng tôi đã có phân tích hơn 50 quyết định kháng án của Ủy ban Kháng án AAT và nhận thấy có sự khác biệt trong kết quả kháng án tùy vào người ra quyết định:

“Có 2 người không bao giờ ra quyết định có lợi cho người tị nạn, trong khi có một người đã chấp thuận 86% hồ sơ kháng án. Những người ra quyết định thường nhìn vào quốc gia và đặc biệt là nhìn vào loại visa mà người đó kháng án, nhưng dù sao vẫn có sự sai lệch rất lớn. Do đó một trong những yếu tố ảnh hưởng đến sự thành công hay thất bại của hồ sơ là tùy vào người được chỉ định thụ lý hồ sơ đó.”

Để tránh việc rơi vào tình huống may rủi, một tình huống mà nhiều người tạm trú và tị nạn ở Mỹ hay Canada cũng đã gặp, chúng tôi khuyên quý vị phải tìm một luật sư hoặc đại diện di trú uy tín để được tư vấn bởi sức ảnh hưởng của họ sẽ giúp khả năng kháng án thành công cao gấp 7 lần so với hồ sơ không có luật sư.

Quý vị có thể xin visa bắc cầu để sống hợp pháp ở Úc trước khi visa hết hạn, trong khi chờ kết quả kháng án từ AAT, hoặc quý vị định rời khỏi Úc trong thời điểm dịch COVID-19. Nếu cần phải rời Úc nhưng lại không có chuyến bay nào để trở về, hoặc Việt Nam đóng cửa biên giới, quý vị vẫn có chứng cứ thuyết phục cho thấy bạn đang nỗ lực tìm cách rời khỏi Úc.

Khoản hỗ trợ này được đánh giá rất cần thiết đối với những nhân viên thời vụ bị mất việc và du học sinh đang trải qua giai đoạn khó khăn khi visa sắp hết hạn.

“Khoản tiền hỗ trợ khoảng 400 đô cho một gia đình. Đây là khoản hỗ trợ trả một lần nhằm hỗ trợ càng nhiều người càng tốt. Số tiền này có thể không quá lớn nhưng đối với những gia đình còn đang phải đắn đo cân nhắc nên dùng tiền để mua thực phẩm và thuốc men trước, hay trả tiền thuê nhà trước, thì ít nhất số tiền này có thể giúp họ trong hoàn cảnh đó.”

DRIVER CAUGHT WITH SHED BALANCED ON CAR IN NEWTON ABBOT DEVON ENGLAND…. A motorist has been caught by police driving with a shed balanced on a car roof. Devon and Cornwall Police said the car was spotted driving in Newton Abbot town centre on Saturday with the shed held in place "with a single rope and no roof rack". Sgt Olly Tayler tweeted that it "could have ended far worse than a ticket for an insecure load". The driver was issued with a fixed penalty notice. Alyssa Jade, five, was reported missing when she failed to return from her first day of school in Queensland. Police said the girl had fallen asleep in the back of the bus and had failed to draw the attention of the driver who drove to the depot thinking he had no remaining passengers. ANGER OVER 'STINKING SEAWEED' IN EMSWORTH STREET HAMPSHIRE ENGLAND…. Piles of "stinking seaweed" from winter storms are being removed from the streets of a coastal town after residents claimed they had been left there for almost three weeks. The seaweed washed onto King Street, Emsworth from Chichester Harbour. Resident Brian Sims said it was a "disgrace" it was still there, despite him making eight calls to the council. Havant Borough Council said its contractors did not have a record of any complaints to its hotline. After being contacted by the BBC, a council spokesman said contactor Norse South East would be removing the seaweed. Contractors began work to move it on Monday afternoon. The seaweed was washed ashore along with other debris during Storm Eleanor on 2 January. Mr Sims said the smell was "very unpleasant". "I have tried moving this health and safety hazard myself, but being in my 70s found it too much," "This stinking pile still blocks our road. It's frustrating and worrying - if an emergency vehicle had to come down here, and there are a lot of elderly people living on this street, it would battle to get through," he added…. I think I would prefer to live next door to the seaweed myself….

ZIMBABWE FAMILY LEAVE BANGKOK AIRPORT AFTER THREE MONTHS…. If you've ever complained about being forced to sleep in an airport after a delay, spare a thought for one Zimbabwean family who have finally left Bangkok's Suvarnabhumi airport where they've lived for the past three months. The family - four children under the age of 11 and four adults - first arrived in Bangkok in May. When they tried to leave in October for Spain, they didn't have the right visas. They couldn't legally re-enter Thailand as they'd overstayed their tourist visas and had to pay a fine. But they said they could not return to Zimbabwe because they faced persecution. The family asked for assistance from the UN, saying they feared persecution in Zimbabwe after the November unrest which saw the removal of long-term leader Robert Mugabe. The UN said a the time that it was "exploring options". Thailand does not provide legal status to refugees and asylum seekers. Meanwhile, the family stayed inside the departure area, being looked after by airport staff. According to a Thai immigration bureau spokesman, they finally left Bangkok on Monday afternoon.

CHINESE STAFF PAID IN BRICKS TO TOP UP UNPAID WAGES…. Employees at a brick factory in southeast China who were collectively owed some 90,000 yuan (US $14,050; £10,080) had their unpaid wages topped up in bricks, it's reported. According to the Xinhua News Agency, some 30 factory workers in Nanchang, Jiangxi province, agreed to receive 290,000 bricks in exchange for 80,000 yuan of their owed earnings. Jiangxi Daily reports that the workers, all of whom were migrants, came from mountainous regions of Yunnan province in the southwest, and had no choice but to live "by candlelight, with wood fire heating". After their local labour department intervened with the help of the courts, the employees agreed to receive bricks from the factory in exchange for their unpaid earnings. Xinhua says that their employer, who has not been named by local media, is still trying to figure out a way to repay staff the remaining 10,000 yuan that they are owed… Well that’s the final story cemented firmly into place…
