LABOUR LAW CHANGES As the economy struggles with the lockdown, a number of state governments recently made key changes in the application of labour laws.

Which states announced changes? The most significant changes were announced by three BJP-ruled states — UP, MP and Gujarat. But several other states, ruled by the Congress (Rajasthan and Punjab) as well as BJD-ruled Odisha, too made some changes, although smaller in scope. UP has made the boldest changes as it summarily suspended the application of almost all labour laws in the state for the next three years including the Minimum Wages Act. Some states have increased the shift duration from 8 hours to 12 hours. Important Info : View of critics: The subject of ‘Labour’ falls in the Concurrent List and there are many laws enacted by the Centre that a state cannot just brush aside. Estimates vary but there are over 200 state laws and close to 50 central laws.This will create an enabling environment for exploitation as it will not only strip the labour of its basic rights but also drive down wages. Firms can now fire all existing employees and hire them again at lower wages.This move will in one go turn the existing formal workers into informal workers as they would not get any social security.Experience of states that have relaxed labour laws in the past suggests that dismantling worker protection laws have failed to attract investments and increase employment. Telia Rumal: Telia Rumal cloth of Telangana involves intricate handmade work with cotton loom displaying a variety of designs and motifs in three particular colours — red, black and white. Telia Rumal can only be created using the traditional handloom process and not by any other mechanical means as otherwise, the very quality of the Rumal would be lost. Telia Rumals are offered at the dargah of Ajmer Sharif in Rajasthan, with some devotees offering 50 or even 100 cloths. Telia Rumals were worn as a veil by princesses at the erstwhile court of the Nizam of Hyderabad; and as a turban cloth by Arabs in the Middle East. About: The role of enzyme ACE2 in Covid-19 is already established: It responds to the novel coronavirus and enables it to infect the human cell. The new, large study of several thousand patients found men have higher concentrations of ACE2 in their blood than women. The researchers measured ACE2 concentrations in blood samples from several thousand heart failure patients from 11 European countries. The study also found that heart failure patients taking a certain class of drugs (called RAAS inhibitors) did not have higher concentrations of ACE2 in their blood. Some recent research had suggested that RAAS inhibitors might increase ACE2 concentrations in blood plasma, thereby increasing the risk of Covid-19 for cardiovascular patients taking these drugs, but the new study indicates that this is not the case. It was a wet, windy day on Pietermaritzburg’s railway platform, located an hour from South Africa’s port city of Durban. The 19th-Century, Victorian-style red brick station, with a corrugated iron roof, lace filigree and wooden ticket windows, was quiet. I pulled my coat closer around me and imagined how it would have felt to have stood here on one fateful night more than a century ago.
On 7 June 1893, Mohandas Karamchand Gandhi, then a young barrister, was on his way from Durban to Pretoria on behalf of his client, a merchant named Dada Abdulla. When the train came to a stop in Pietermaritzburg, Gandhi was ordered by the conductor to move from the first-class carriage (reserved for white passengers) where he was sitting, to the van compartment for lower-class travellers. When Gandhi refused, showing the conductor his first-class ticket, he was evicted unceremoniously from the train.
This incident changed the course of his life
A plaque on the platform marks the approximate spot where he was pushed from the train carriage with his luggage. “This incident changed the course of his life,” it reads.
Gandhi spent that cold winter night in the station’s tiny, unheated waiting room. “My overcoat was in my luggage, but I did not dare to ask for it lest I should be insulted again, so I sat and shivered,” Gandhi later wrote in his autobiography, The Story of My Experiments with Truth.

Gandhi had relocated to South Africa from Bombay in 1893 after accepting a year-long contract position with an Indian business firm based in Natal in the north-eastern Transvaal region, which had been settled by Boers (descendants of 17th-Century Dutch and Huguenots colonists) after Britain established the Cape Colony further south.
Transvaal’s Indian population had been growing for several decades before Gandhi had arrived. In an 1860 agreement with the government of India, the Transvaal government promised to help settle Indian immigrants in exchange for indentured labour in the region’s sugar fields. But even after serving their indenture, Indians were not fully integrated into society: regulations implemented by the white-minority government subjected new Indian citizens to extra taxation.
After arriving in South Africa, Gandhi was quickly exposed to racial discrimination: just days before boarding the train to Pretoria, he had excused himself from a Durban courtroom after the judge demanded that Gandhi remove his turban.

But that moment on the Pietermaritzburg train platform marked the turning point, the catalyst, when Gandhi made the momentous decision to fight the racial discrimination he experienced. “It would be cowardice to run back to India without fulfilling my obligation,” he wrote in The Story of My Experiments with Truth. “The hardship to which I was subjected was superficial – only a symptom of the deep disease of colour prejudice. I should try, if possible, to root out the disease and suffer hardships in the process.”

After the Pietermaritzburg incident, Gandhi refused to submit to bigotry, choosing instead to peacefully oppose discriminatory policies, organising strikes and marches to counter biased voting regulations and intolerable working conditions. He believed that by staying in South Africa, he could observe the real nature of racial oppression and effectively combat it. Out of this emerged the concept of satyagraha. Meaning ‘holding on to truth’, satyagraha employs non-violent tactics to win over an opponent’s mind and create a new harmony between both sides of a conflict.
In 1907, when the Transvaal government passed the Asiatic Law Amendment Act, an ordinance requiring the registration of its Indian population, Gandhi organised his countrymen in non-violent protests. Although his resistance led him to be imprisoned on four separate occasions, Gandhi was ultimately successful in negotiating with the white-minority government. As a result, the Indian Relief Act was passed in 1914, eliminating an extra tax on Indian citizens who had not renewed their indentures and recognising the validity of Indian marriages.
After his return to India in 1914, Gandhi employed satyagraha to protest Britain’s mandatory military draft of Indians during World War One; and again after World War Two to negotiate India’s independence from Britain, which was officiated in 1947.

Gandhi’s displays of passive resistance significantly influenced the path Martin Luther King Jr and Nelson Mandela. “The values of tolerance, mutual respect and unity for which he stood and acted had a profound influence on our liberation movement, and on my own thinking,” Mandela said as he accepted the honour of the Freedom of Pietermaritzburg, which was also posthumously bestowed on Gandhi. “They inspire us today in our efforts of reconciliation and nation-building.”
Today, Pietermaritzburg station is a pilgrimage site for Indians who come to pay homage to Gandhi at the spot where he was evicted from the train. During his 2016 visit, India’s Prime Minister Narendra Modi wrote in the museum’s guestbook, “An event at Pietermaritzburg altered the course of India's history”.
The small waiting room now houses a museum dedicated to telling the story of that night in 1893 and the two decades Gandhi spent in South Africa. Informative panels and interactive displays line the walls, and black-and-white photographs of Gandhi in his barrister’s robe adorn the window. I sat on a wooden bench in the centre of the room and contemplated that formative night.

With its grand Victorian-era buildings like the iconic red-brick city hall, KwaZulu-Natal province’s capital city looks much like it would have when Gandhi’s train rumbled into the station. As I watched the silhouettes of passers-by outside the window, my own eyes teared as I imagined Gandhi on a hard bench much like the one on which I was sitting, steeling himself for the struggle that would define his life and the lives of millions of others. Surrounded by his image, I was overwhelmed by thankfulness for what he had done for my country and my people.
In June 2018, to commemorate the 125th anniversary of this incident, India’s external affairs minister Sushma Swaraj visited Pietermaritzburg, retracing Gandhi’s journey from Pentrich in an old-fashioned carriage like the one Gandhi would have travelled in. Upon her arrival at Pietermaritzburg station, Swaraj inaugurated a statue of Gandhi that stands at the entrance to the platform.
Titled ‘Birth of Satyagraha’, the double-sided statue crafted at the Mahatma Gandhi Digital Museum in Hyderabad, India, features Gandhi as a young lawyer wearing a suit and tie on one side, and an older, bespectacled Gandhi dressed in a traditional Indian dhoti, on the other. The two-day event included a re-enactment of Gandhi being thrown off the train, as well as a banquet at the local city hall, which was lit up in the colours of the Indian flag.

Indian Startup Scenario-India Towards its True Potential
India ranks among the top five countries in the world in terms of the number of startups founded. India has made tremendous growth towards the creation of innovative startups and has emerged as the 3rd fastest growing hub for technology startups in the world.
Introduction of initiatives like GST and Make In India have given a momentum to the startup economy. Indian Start-ups are moving on the upper line and are expected to increase in size and number in the coming year. It is measured that India houses around 4,200 start-ups, creating more than 85,000 employment opportunities. With over $5 billion worth of investment in 2015 and three to four startups emerging every day, it is projected that the number of startups in India will increase to more than 11,500 by 2020, with job creation from these entrepreneurs reaching 250-300k. The number of Investors has also risen multi-fold in the past few years.
Recent Developments
Indian startups have undergone many developments in the second quarter of 2017. From being selected in the Google’s accelerator program, to raising funds from the Chinese investors, the startup ecosystem has been quite encouraging. Google selected six Indian startups for the accelerator program in July 2017. Startups using latest technologies such as machine learning and artificial intelligence have been chosen for the same.
Limitations
Despite such promising statistics, only 9% of the Start-Ups have female founders/co-founders. Delhi NCR, Bangalore, and Mumbai, along with Hyderabad, Pune and Chennai account for more than 90% of the Start-Ups in India. The focus is largely limited to information technology-enabled products and services including e-commerce, aggregators, analytics, health-tech and online payments. Amongst all this, the product start-up sector has been largely ignored. A big factor behind India’s growth is software enabled firms such as Flipkart and Ola. Rarely do hardware product companies bring about such success. The reason for this can be attributed to the lack of funds. India’s ecosystem clearly does not have any scarcity in terms of capital. However, only a very small amount of this capital reaches these startups. Additionally, startups in India spend five times the amount of effort to raise funds as compared to US startups.
This is where the Government intervention is required. Through the provision of alternate sources of funding and through a partnership between the Industry and Academia, the government can facilitate and accelerate the growth rate. Alternate debt financing instruments will help Start-Ups and other small enterprises to overcome the problem of lack of adequate collateral, limited cash-flow and the high risk involved. While direct support of start-ups and the right kinds of skills to start & run a business are important, the ease of doing business in the country also matters a great deal. This includes ease of starting a business, obtaining relevant permits, accessing credit, paying taxes, etc. The Labour laws in India are out-dated as well. Thus, appropriate government policies are required to make the Indian Start-Up Ecosystem reach its true potential.
However, Government and international organizations are investing in innovative ideas. Monetary and infrastructure support is accelerated. Start-ups are also making good use of the facilities available and are showing a sign of good times. This can certainly not be dismissed as a passing trend and it’s surely going to change the way the markets are working today in India. Government initiatives are also expected to play a vital role in the startup ecosystem’s bright future. For instance, the commerce and industry department of the Indian Government is planning to organize a south Asia regions’ meet of startups for exchanging new ideas and increasing interaction among them, thereby showing confidence in startups.
Thus, the scenario in the last quarter suggests that the investors’ interest towards funding the India startups remains strong. Next quarter is likely to be more attractive owing to the economic reforms and their implementation. Startups are now focusing on cutting losses, increase their overall valuation and attain operational excellence. These qualities along with the positive sentiments of the investors and support from the government can make the startup ecosystem of India reach new heights in the near future.

1. the NITI Aayog constituted an Expert Task Force to create new jobs.
With an aim to create new jobs by enhancing India’s export, the NITI Aayog constituted an Expert Task Force.
The task force will be chaired by the NITI Aayog Vice Chairman, Dr. Rajiv Kumar.
The task force that also includes Secretary Department of Commerce; Secretary, Department of Industrial Policy and Promotion among others have been asked to submit its report by November 2017.
The steps outlined by the task force to address this challenge of creating well-paid, formal sector jobs, include:
1. Proposing a comprehensive plan of action to generate employment and alleviate under-employment in both goods and services sectors and low wages by boosting India’s exports in key labour-intensive industries
2. Recommending sector-specific policy interventions in key employment sectors
3. Recommending measures to enhance trade in services with high employment potential
4. Identifying key macro economic factors constraining exports and suggesting methods to address these constraints
5. Assessing the effectiveness of existing schemes to promote exports
6. Addressing issues related to logistics, export credits and trade facilitation
7. Suggesting ways to enhance the availability of data on trade such that it is reliable, globally comparable and timely, particularly with respect to trade in services.
Why was the task force formed?
A majority of the workers in indian workforce are still employed in low-productivity, low-wage jobs in small, micro and own-account enterprises.
An urgent and sustained expansion of the organized sector is essential to address India’s unemployment and under-employment issue.
An important strategy is also to enable a shift towards more labour-intensive goods and services that are destined for exports.
Given the importance of exports in generating jobs, India needs to create an environment in which globally competitive exporters can emerge and flourish.
2. Central governmemt asks banks to restrict accounts of 2.09 lakh firms
The finance ministry has advised all banks to take immediate steps to restrict transactions in bank accounts of more than 2.09 lakh companies, whose names have been struck off the Register of Companies.
‘Not compliant’
Prima facie, those companies are not complying with their mandatory statutory obligations to file vital information for availability to its stakeholders.
On July 1, Prime Minister Narendra Modi had first revealed the government’s decision to cancel the registrations of one lakh companies that had suspicious and questionable operations, identified on the basis of data mined from the deposit of bank notes following last November’s demonetisation of ₹500 and ₹1,000 notes.
The PM had promised more action would follow on two lakh similar firms and 38,000 shell companies.
The existing directors and authorised signatories of such struck-off companies will now become ex-directors or ex-authorised signatories.
These individuals will therefore not be able to operate bank accounts of such companies till such companies are legally restored under Section 252 of the Companies Act by an order of the National Company Law Tribunal.
3. Railways to take up cleanliness drive
As part of an intensive drive to ensure cleanliness on trains and station premises, Railway Board Chairman Ashwani Lohani has called for a sanitation strategy for immediate action.
Some of the actionable items are creating awareness on the use of bio-toilets, washing of trains/ stations at night, disposal of garbage en route and at destination points aand display of anti-littering rules.
The Board has authorised its frontline staff to rope in the expertise of Eureka Forbes, one of the leading health and hygiene brands in the country, for the sanitation programme.
Urging officers to make field visits and check cleanliness by adopting a “smell/feel and check dust by touch” approach.
Officers were also told to interact with the cleaning staff, address their grievances and respect their self-esteem.
In September, the Board said there should be visible improvement at 107 stations identified across the country.
These stations included two from each zone that were rated lowest in the Station Cleanliness Survey conducted in 2017.
In Southern Railway, the two stations (A-category) that stood last were Ernakulam North and Kollam.
Among A-1 category stations, New Delhi, Hazrat Nizamuddin, CST Mumbai, Hyderabad, Visakhapatnam, Chennai Central, Chennai Egmore, Chandigarh, Ahmedabad, Bhubaneswar, Lucknow, Jodhpur, Bengaluru and Thiruvanthapuram stations were among 75 major stations chosen for the plan to bring about visible improvement in cleanliness.
Swachatha Pakhwada
The Indian Railways had conducted a fortnight-long sanitation programme called Swachatha Pakhwada from August 16 in compliance with the directions issued by the Ministry of Drinking Water and Sanitation.
With a slogan ‘Swachh Rail Swachh Bharat’, railway employees and volunteers drawn from various organisations were engaged in cleaning up station premises and trains.
CCTV footage was used to identify areas vulnerable to litter and action taken to create awareness among passengers/visitors on the upkeep of railway assets.
4. Chemical, fertiliser, pharma turnover at ₹ 13.5 lakh crore
Fertiliser, pharmaceutical and chemical—petrochemical sectors have become a growth engine of Indian economy, clocking a combined turnover of ₹ 13.5 lakh crore.

5. first batch of 1000 E-rickshaws launched in Gurugram.
Union Minister for Road Transport and Highways Nitin Gadkari launched a fleet of first batch of 1000 E-rickshaws from Huda City Centre metro station in Gurugram.
The e-rickshaw fleet will provide cost effective and pollution free substitute in transport system of Gurugram along with generating employment opportunities for marginalised youth.
Key Highlights
• These e-rickshaws were manufactured in India and are fitted with GPS and tracking system.
• The E rickshaw fleet is operated by Treasure Vase Ventures Private Limited in partnership of Delhi Metro under the ‘SmartE’ brand name.
• SmartE will provide the last mile transport connectivity to metro commuters in the area and will provide meaningful self-employment for over 100000 marginalised youths in next 4-5 years.
• SmartE established strategic partnerships with the Haryana government (HSIIDC) and Delhi Metro Rail Corporation to launch 1000 vehicles in Gurugram and Faridabad in 2017.
6. India and Myanmar signed eleven agreements
India and Myanmar signed eleven agreements following delegation-level talks headed by Indian Prime Minister Narendra Modi and Myanmar State Counsellor Aung San Suu Kyi at Nay Pyi Taw, Myanmar.
Highlights of the 11 Agreements
• A Memorandum of Understanding (MoU) was signed between the Election Commission of India and Union Election of Myanmar.
• An MoU was signed on cooperation between Myanmar Press Council and the Press Council of India.
• Both the sides signed an agreement for cultural exchange programme for the years 2017 to 2020.
• Two MoUs were signed on establishment of the India-Myanmar Centre for Enhancement of IT Skill and the Myanmar Institute of Information Technology (MIIT).
• Two other MoUs were signed on medical products regulation and in the field of health and medicine.
• Another MoU was signed on enhancing cooperation for upgrade of the Women’s Police Training Centre at Yamethin, Myanmar.
• The two sides also signed an agreement for sharing white shipping information to improve data sharing on non-classified merchant navy ships or cargo ships.
• An MoU on Maritime Security Cooperation was also signed.
• A Technical Agreement was signed between both the sides for providing Coastal Surveillance System.
Myanmar is one of India’s strategic neighbours and shares a 1640-km-long border with a number of north-eastern states including Nagaland and Manipur.
7. NITI Aayog on launched the National Nutrition Strategy
To make sure that malnutrition is eliminated India, NITI Aayog launched the National Nutrition Strategy aimed at Kuposhan Mukt Bharat.
Under the strategy, the problem of malnutrition will be eradicated in a phased manner.
The strategy intends at bringing nutrition to the center-stage of the National Development Agenda.
The nutrition strategy calls for convergence between four proximate determinants of nutrition - food, health services, income & livelihoods and drinking water & sanitation.
The Nutrition Strategy framework envisages a Kuposhan Mukt Bharat - linked to Swachh Bharat and Swasth Bharat.
It enables states to make strategic choices, through decentralized planning and local innovation, with accountability for nutrition outcomes.
Currently, there is a lack of real time measurement of these determinants, which reduces the capacity for targeted action among the most vulnerable mothers and children. The Strategy lays down a roadmap for effective action, among both implementers and practitioners, in achieving our nutrition objectives.
This is especially relevant in view of enhanced resources available with states to prioritise focused interventions with a greater role for panchayats and urban local bodies.
In India 20 per cent of children under five years of age suffer from wasting due to acute undernutrition and it pays an income penalty of 9 to 10 per cent due to a workforce that was stunted during their childhood.
Report by NITI Aayog
A report by NITI Aayog says that every third child in India suffers from stunting or wasting or from malnutrition which is a big number.
The recently published NFHS-4 results reflect some progress, with a decline in the overall levels of under nutrition in both women and children.
Moreover, India pays an income penalty of 9 per cent to 10 per cent due to a workforce that was stunted during their childhood.
8. Disability pension of Defence personel tonbe in par with civilians.
The Union government has accepted the recommendations of National Anomaly Committee that recomended penision for defence personel to be in oar with civilians.
The move was undertaken after an increased request from the armed forces to revert back to the percentage-based regime for disability pension instead of the slab-based system conceived under the 7th CPC.
The Ministry of Defence had referred the matter to the NAC in order to decide methodology for calculation of disability element of the disability pension under the 7th CPC.
With this, the Government has decided to continue with an earlier system of disbursing disability pension and not to go ahead with a new regime recommended by the 7th CPC.
The armed forces personnel had felt that the new slab-based system would result in a reduction in the amount of disability pension for existing as well as future retirees compared to percentage-based disability pension.
New Scheme for Defence Veterans
The Ex-Servicemen Health Contributory Scheme (ECHS) has launched Complaint and Litigation Reduction Scheme (CLRS) for grievance redressal of veterans and their dependents.

In the Age of Trump we cannot lose track that there are many old and dangerous villains still out there. American children and Third World countries need to beware as a badly wounded Pearson (Mis)Education desperately hunts for profits. In January, Pearson’s stock value dropped sharply when the company reported lower than expected profits, especially in its United States college textbook division where revenue declined by 18%. Overall Pearson’s operating profit for 2016 was down about $800 million or 8% and the company expected it would continue to decline in 2017. In one day, Pearson’s stock plummeted 30% to $7 a share. Pearson also admitted its shift from print to digital was going slower than expected. In response to the collapse in Pearson’s stock value Moody’s Investors Service, changed the outlook on Pearson’s ratings from stable to negative and Goldberg PC, a Los Angeles based shareholder rights law firm, announced it was investigating Pearson for possible violation of federal securities laws. Corporate CEO John Fallon said Pearson would take “radical action” to recast its overall business. That’s why American kids and Third World countries got to be scared. Profits rose slightly in student assessment, which means Pearson will continue to push its standardized tests and test prep material. About 30% of Pearson’s revenue currently comes from assessment — including the hated Common Core aligned high-stakes assessments that have led to a parent revolt in American school districts. Pearson also plans to increase its role in virtual schools and professional certification programs like the much-maligned New York State teacher certification tests. Pearson’s attempt to promote private schools in the Third World through its Pearson Affordable Learning Fund has also produced intense opposition. According to Education International (EI) researcher Curtis Riep of the University of Alberta, Pearson’s business strategy in the Third World is to turn education from a social good and essential public service into a marketable for-profit commodity. But it has not been doing that well. In India, Pearson was charged with undermining public education in Hyderabad, a city of about 4 million people. In Africa Pearson supports the low-cost low quality private school chain Bridge International Academies that has been shutdown in Uganda and is under attack by education advocates in Kenya. In the Philippines, Pearson schools are explicitly designed, not to educate pupils, but to “produce a repository of cheap and flexible labour that can be employed by multinational corporations operating in the Philippines.” I received an email report that in Japan Pearson and its partner Kirihara Shoten are accused of violating labor laws by unfairly cutting worker salaries and working to undermine their labor union. The Tokyo Labor Commission has scheduled hearings. In response to Pearson declarations Stock Market analyst Neil George of The Street called the stock decline “unprecedented” and recommended that investors stay away from the company.
