George Floyd’s Legislative Legacy

After the death of George Floyd on May 25, 2020, the “George Floyd Justice in Policing Act of 2020” was introduced to create more police accountability and increase racial equity. Roger Fergusson, CIA of TIAA said of Floyd’s death that, "The haunting video of Mr. Floyd's last breaths is a sobering reflection of this national crisis. ...This is a time when we must embrace our differences and become more inclusive. No group should ever be targeted for racism, harassment or other form of discrimination.” [8]

George Floyd, a black man from Minneapolis, was killed by white police officers. Floyd was accused of buying cigarettes with a counterfeit $20 bill. The four police officers—Derek Chauvin, Thomas Lane, J. Alexander Kueng and Tou Thao—were fired the day after Floyd’s death by the Minneapolis Police Department. Derek Chauvin, the officer who knelt on Floyd’s neck causing asphyxiation, was charged with third-degree murder and second-degree manslaughter on May 29 [1]. According to the Minnesota statute, third-degree murder charges result when an individual causes the death of a person “by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard to human life” [10]. An individual found guilty of third-degree murder charges faces a prison sentence of either no more than 25 years or a fine of no more than $40,000, or both. According to the Minnesota statue, second-degree manslaughter occurs when an individual “creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another” [10]. An individual found guilty of second degree manslaughter faces imprisonment for no longer than 10 years or a fine of not more than $20,000, or both [10].

On June 3, more serious charges of second-degree murder charges were brought against Mr. Chauvin. According to the Minnesota statute, an individual who causes the death of a person “by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life”. An individual who is found guilty faces a prison sentence of no more than 40 years [10].

The other three former officers have been accused of aiding and abetting second-degree murder by the Hennepin County prosecutor [1]. Aiding and abetting second degree murder applies to “an individual who assists in a crime, but does not commit the crime himself” [9]. In Minnesota, an individual found guilty of aiding and abetting second-degree murder faces imprisonment of no more than three years, or $5000 in fines, or both [11].

Mr. Floyd’s death precipitated a nationwide civil movement focused on racial equality and law enforcement accountability. One of the Black Lives Matter platform encouraged mass participation in order to “join the [Black Lives Matter] Movement to fight for Freedom, Liberation and Justice” in “support of the movement and our ongoing fight to end State-sanctioned violence, liberate Black people, and end white supremacy forever” [2]. Floyd’s death became a uniting symbol nationwide and globally of institutional racism. Individuals and corporations supported legislation which would result in police reform, and of “overdue reparations to Black Americans” [3]. Floyd’s death also raised awareness of other tragedies based on racism such as Breonna Taylor’s death. This increased awareness of troubling racial inequality in the United States is resulting in legislative changes nationwide as well as prohibiting racial profiling at federal, state and local levels.

The major legislative change due to George Floyd’s death will result from the H.R. 7120 “George Floyd Justice in Policing Act of 2020” after consideration by the Senate. This act “addresses a wide range of policies and issues regarding policing practices and law enforcement accountability. It includes measures to increase accountability for law enforcement misconduct, to enhance transparency and data collection, and to eliminate discriminatory policing practices” [4]. This act also increases culpability measures for police officers which makes it easier to convict a law enforcement officer due to misconduct while limits qualified immunity as a defense for police officers. Qualified immunity in the United States allows immunity to police officers who are performing discretionary duties. By limiting qualified immunity for police officers, officers have less protection from private civil action. This act also increases the power of the Department of Justice which can now “issue subpoenas in investigations of police departments for a pattern or practice of discrimination” [4].

It includes a section on racial profiling sparked by the civil rights and discriminatory nature of George Floyd’s death. The bill creates a “framework to prohibit racial profiling at the federal, state, and local levels” [4]. Additionally, new requirements for law enforcement officers and agencies have arisen. These requirements include training in an implicit bias program established by the Attorney General [15]. In addition, racial profiling is illegal with the Attorney General creating regulations at a state and local level. Federal law enforcement officers or agencies are required to wear body cameras or risk appropriate disciplinary action. Finally, law enforcement officers and agencies must report data of use-of-force incidents. Each state and Indian Tribe is required to take an audit and send their reports to the Attorney General [15]. Implicit bias training allows a person access to the knowledge of how much implicit bias they have on a given topic. The reason implicit bias is important is that once a person knows their implicit bias, they can work to remove it or can take their biases into account. This can decrease incidents of racism and increase equality. Implicit bias training for law enforcement officers will allow the officers insight into their own bias. This allows the officer an option to work in a more equitably fashion. The provisions of this act increase accountability on law enforcement officers.

The National Association for the Advancement of Colored People, NAACP, supports the “George Floyd Justice in Policing Act of 2020”. The NAACP is “the largest and most pre-eminent civil rights organization in the nation” [5]. Because the NAACP focuses on civil rights of non-white individuals, their approval of the “George Floyd Justice in Policing Act of 2020” demonstrates the widespread support of this civil rights bill. They specifically approve of the provisions that address police conduct such as qualified immunity, data collection on forceful police encounters, police body cameras and uniform policies that specify the use of force. The NAACP also supports the provisions of the bill related to community. The limit of military equipment on U.S. streets and an end to race and religious profiling are included in the image of a healthier community.

One of the reasons the George Floyd killing was so shocking was because it was such a nonchalant and gross show of police overreaction against Black and Brown people. That said, qualified immunity exists. In the Pearson v. Callahan, “qualified immunity balances two important interests—the need to hold public officials accountable when they exercise power irresponsibly and the need to shield officials from harassment, distraction, and liability when they perform their duties reasonably” [12]. Qualified immunity is meant to protect public officials which would allow them to do their job effectively. Not all police undergo implicit bias training. While implicit bias training improves knowledge and awareness of bias, research indicates “it may not have much effect on police incidents involving minorities” [13]. Additionally, there have been discussions over using profiling in larger scale policing because profiling can effectively narrow down suspects in criminal investigation [14].

George Floyd’s legacy almost one year after his death is profound. On March 3, 2021 the House passed the “George Floyd Justice in Policing Act” with a 220-212 vote. "Never again should an unarmed individual be murdered or brutalized by someone who is supposed to serve and protect them," said Rep. Karen Bass, D-Calif., in a statement. "Never again should the world be subject to witnessing what we saw happen to George Floyd in the streets in Minnesota." [6]. In order for this bill to be put into effect, it must be considered and approved by the Senate. The “George Floyd Justice in Policing Act” would result in a “series of police reform measures in the wake of national uprising against racial injustice and police brutality” [7].

As Barak Obama said, "Let's not excuse violence, or rationalize it, or participate in it. If we want our criminal justice system, and American society at large, to operate on a higher ethical code, then we have to model that code ourselves." [8]

Lawmakers outraged after Trump compares impeachment inquiry to 'a lynching'(As the United States has yet to come to terms with our violent racial history, Trump invokes the word "lynching" to describe the impeachment inquiry. He uses this hateful term either through ignorance or with full knowledge of what the word invokes as a dog whistle. However either one is disturbing and not worthy of the Presidency.)

President Donald Trump has called the House impeachment inquiry a "coup," a "witch hunt" and a "fraud," but he introduced a new phrase to describe the process on Tuesday: "a lynching."

"So some day, if a Democrat becomes President and the Republicans win the House, even by a tiny margin, they can impeach the President, without due process or fairness or any legal rights," Trump tweeted. "All Republicans must remember what they are witnessing here — a lynching. But we will WIN!"

The president's use of "lynching," which elicits a time when black Americans were murdered by extrajudicial white mobs, was the subject of immediate blowback.

"You think this impeachment is a LYNCHING?" Rep. Bobby Rush, D-Ill., tweeted. "What the hell is wrong with you? Do you know how many people who look like me have been lynched, since the inception of this country, by people who look like you. Delete this tweet."

"We can all disagree on the process, and argue merits," Rep. Adam Kinzinger, R-Ill., tweeted. "But never should we use terms like 'lynching' here. The painful scourge in our history has no comparison to politics, and @realDonaldTrump should retract this immediately. May God help us to return to a better way."

According to the National Association for the Advancement of Colored People, more than 4,700 lynchings took place in the U.S. from 1882 to 1968. Of those who were lynched, more than 3,400 were black, though not all lynchings that took place were recorded, the NAACP noted. Many of the whites who were lynched, the organization adds, were killed for helping black Americans or being against lynching.

Lawmakers continued to blast Trump's remarks through the morning.

Rep. Karen Bass, D-Calif. and the chairwoman of the Congressional Black Caucus, tweeted that Trump was "comparing a constitutional process to the PREVALENT and SYSTEMATIC brutal torture of people in THIS COUNTRY that looked like me?"

"Using this term draws up some of America’s darkest history — Trump is yet again a disgrace and massively offensive," wrote Rep. Yvette Clarke, D-N.Y., in a Twitter post. "Nobody is above the law, including him. He has abused his power — and he’s been caught. Do not get caught up in his latest distraction tactic."

"It’s beyond shameful to use the word 'lynching' to describe being held accountable for your actions," former Housing Secretary Julián Castro, a Democratic presidential candidate, tweeted.

Speaking on CNN, Rep. Jim Clyburn, D-S.C., said the president's early morning tweet was "another indication" of how "loose" he is "with his words." Clyburn, a top-ranking Democrat, said the president's comparison of impeachment to lynching offended his sense of history.

"Very much so," Clyburn said. "I am not just a politician. I'm a Southern politician. I'm a product of the South. I know the history of that word. That is a word that we ought to be very, very careful about using."

When asked about the tweet again later in the morning, Clyburn told reporters, "I resent it tremendously. I think that what we see here, once again, is this president attempting to change the narrative using what I consider to be real, caustic terms, in order to change the conversation. To compare the constitutional process to something like lynching is far beneath the office of the president of the United States."

The condemnation was not unanimous. Sen. Lindsey Graham, R-S.C., told reporters that the impeachment inquiry "is a lynching in every sense," calling it "un-American."

Graham, a close ally of the president, said he could not see a lot of black Americans being offended by the remark, adding that mob justice was what is taking place in the House.

Trump's tweet came just before acting U.S. Ambassador to Ukraine Bill Taylor is set to provide the House with a closed-door deposition. Taylor, a key figure in the administration's Ukraine dealings, which are at the center of the House inquiry, texted U.S. Ambassador to the European Union Gordon Sondland last month that it was "crazy" to hold up the country's military aid until they investigated political opponents of the president.

Sondland responded hours later that the president was clear about there being no quid pro quo, a message he later told the House was passed along to him by the president after Sondland received Taylor's message.

Speaking with reporters in a Cabinet meeting on Monday, Trump lamented the House was interviewing ambassadors he "never heard of."

The House launched its impeachment inquiry after a whistleblower filed a complaint about Trump's conduct toward Ukraine. The whistleblower, whose identity is not yet known, said in the complaint that Trump sought electoral assistance from Ukraine. The complaint was based on information passed along to the whistleblower by administration officials who were concerned, the whistleblower wrote.

Although Trump has claimed the whistleblower's account is "false," a detailed description of Trump's July 25 call with Ukrainian President Volodymyr Zelenskiy, which was released by the White House, aligns with the complaint. In that call, Trump asked Zelenskiy to probe a debunked conspiracy theory about Democrats and the 2016 presidential election and also investigate the Biden family, particularly former Vice President Joe Biden's son Hunter, who had business dealings in Ukraine.

Trump's remark on Tuesday was the first time he had used the word "lynching" in a tweet, although in 2015 he promoted a comment from a Twitter user who thanked conservative personality Mark Levin for "maintaining" his "integrity during this disgusting lynching of" Trump, who was then a Republican presidential candidate.

"Thanks Mark!" Trump added.

A mob lynching of 4 young blacks in 1946 is focus of court battle over grand jury secrecy

ATLANTA — A historian's quest for the truth about a gruesome mob lynching of two black couples is prompting a U.S. appeals court to consider whether federal judges can order grand jury records unsealed in decades-old cases with historical significance.

The young black sharecroppers were being driven along a rural road in the summer of 1946 when they were stopped by a white mob beside the Apalachee River, just over 50 miles (80 kilometers) east of Atlanta. The mob dragged them out, led them to the riverbank and shot them multiple times. For months the FBI investigated and more than 100 people reportedly testified before a grand jury, but no one was ever indicted in the deaths of Roger and Dorothy Malcom and George and Mae Murray Dorsey at Moore's Ford Bridge in Walton County.

Historian Anthony Pitch wrote a book about the killings — "The Last Lynching: How a Gruesome Mass Murder Rocked a Small Georgia Town" — and continued his research after its 2016 publication. He learned transcripts from the grand jury proceedings, thought to have been destroyed, were stored by the National Archives.

How to Solve a Lynching: Georgia Activists Reenact 1946 Massacre

Heeding Pitch's request, a federal judge in 2017 ordered the records unsealed. But the U.S. Department of Justice appealed , arguing grand jury proceedings are secret and should remain sealed.

A three-judge panel of the 11th U.S. Circuit Court of Appeals in February ruled 2-1 to uphold the lower court's order. But the full court voted to rehear the case, and is set to hear oral arguments Tuesday.

Pitch, 80, died just two weeks after the announcement the case would be reheard. His wife, Marion Pitch, has taken her husband's place in the case. Pitch's family also approached Laura Wexler, who wrote another book about the lynching, for help completing his work, and she joined the case.

In 1946, Roger Malcom, 24, was jailed after stabbing and gravely injuring a white man during an argument. A white farmer, Loy Harrison, paid $600 to bail Malcom out on July 25 of that year. Harrison later said he was ambushed by a mob as he drove the four home. Harrison, who is identified in an FBI report as a former Ku Klux Klansman and well-known bootlegger, wasn't hurt. He told authorities he didn't recognize anyone in the mob.

The investigation has been reopened and closed several times since a grand jury failed to indict anyone in December 1946. Students, researchers and activists have all tried to crack the case.

Rules governing grand jury secrecy include exceptions when records may be released. A 1984 ruling in the 11th Circuit, which set binding precedent, says judges may order their disclosure in "exceptional circumstances." The historical significance in this case qualifies, Judge Charles Wilson wrote in the panel's majority opinion. He added that enough time has passed that witnesses, suspects or their immediate family members likely aren't alive to be intimidated, persecuted or arrested.

Concurring, Judge Adalberto Jordan agreed that lower court's ruling should be upheld because of the binding precedent. But Jordan said he would have decided the 1984 case differently. Allowing judges to use inherent authority to go beyond the defined exceptions to grand jury secrecy seems too open-ended, he wrote.

U.S. District Judge James Graham of Ohio, also serving on the panel, dissented. He argued that "judges should not be so bold as to grant themselves the authority to decide that the historical significance exception should exist and what the criteria should be." He also worried people alive today could see their reputations harmed if the records reveal their relative "was a suspect, a witness who equivocated or was uncooperative, a member of the grand jury which refused to indict or a person whose name was identified as a Klan member."

The full 12-judge appeals court is scheduled to hear Tuesday's arguments. Specifically, the judges asked the lawyers whether they should overturn the 1984 precedent. Additionally, they asked, if federal judges can grant disclosures beyond the defined exceptions, is "historical significance" an adequate reason?

Pitch's lawyer, Joseph Bell, argued in a court filing that the 1984 precedent shouldn't be overruled because it acknowledges the need for "exceptional circumstances."

"The historical importance and age of the case, lack of indictment after over seventy years, and fact that other historically significant grand jury records have been released all support the release of the records," Bell wrote

Justice Department lawyer Bradley Hinshelwood countered that Pitch's arguments would allow federal judges to circumvent rules set by Congress and the Supreme Court about the disclosure of grand jury materials.

The rules governing grand jury secrecy provide a "meticulously crafted list of permissible disclosures," Hinshelwood wrote. Even if judges did have the authority to establish other exceptions, it wouldn't extend to historical interest.

The Reporters Committee for Freedom of the Press and 30 news organizations, including The Associated Press, submitted a brief in support of Pitch that was rejected by the court without explanation.

Opening Bell: August 23, 2019

This week, the Trump White House backed off a plan to renege on $4 billion worth of spending that was earmarked for foreign governments and international organizations, including the United Nations. The plan to do so was hatched within the Office of Management and Budget as a means to recoup unspent appropriations. There are two noteworthy aspects of this, one which the article highlights directly, and one mentioned more in passing. First, whether intended or not, this was an attempt by the Trump administration to conduct an end-around on Congress’s constitutionally mandated authority to appropriate spending for a particular purpose, and congressional pushback, bilateral pushback no less, reflects a much-needed victory for the legislative branch as it attempts to restore some balance of power in relation to the executive branch, as the Constitution envisioned. Second, it also reflects a check on President Trump’s attempts to retrench U.S. involvement on the global stage. One of Trump’s few principles—and he has but two or three at the most—is that internationalism is disadvantageous for the United States; we, as a country, do not see a return on our investment in the form of foreign aid or participation in international organizations and conventions. Members of Congress, particularly those with a foreign policy or national security bent to them, who are otherwise allies of the president—most notably Sen. Lindsey Graham (R-SC)—have occasionally pushed back on these cuts by the White House, and this was no exception. This should count as a victory for those that seek to maintain as many political norms as possible in this climate.

For much of the summer, economists have expressed concern about an impending recession. The basis of this concern has been the lengthy period of economic expansion—rarely in American history has a period of growth lasted this long without at least a brief recessionary interlude—and multiple underlying other economic indicators, such as wage growth, have given the appearance that the post Great Recession recovery has been a hollow one all along. Complicating this situation has been two great spates of economic turbulence: the enormous tax cut passed by Congress and the ongoing, and increasingly ruinous, trade war with China. The trade war, supported by evermore tariffs imposed against Chinese goods, which have in turn been met with reprisals on American agricultural products, has pushed both countries onto an economic precipice. A further exacerbating factor has been the approach and response of the current administration; rather than stand as a unified voice on the economic situation, it has instead resembled a person with dissociative disorder; multiple personalities, all manifesting at different times and saying strikingly different things. The economy, as we saw in 2008 in particular, is based upon trust, both in the system and in its stakeholders. Markets dislike uncertainty, and so when one of the national economic stakeholders is unable to present a unified front, uncertainty is bound to become predominate.

Speaking of Donald Trump, the record number of Democrats seeking to challenge him in 2020 continues to dwindle, albeit slowly if not more appreciably. This week, two candidates—former Colorado Governor John Hickenlooper and current Washington Governor Jay Inslee—both decided to bow out. Hickenlooper decided instead to challenge Sen. Corey Gardner (R-Colo.) while Inslee will seek a third term in Olympia. Inslee, running effectively as a one-issue candidate—the environment and climate change—probably knew that he could not make inroads in such a huge Democratic field; plans to arrest climate change do not quite arrest the public conscious as much as free college tuition, regardless of which one is more likely to actually be implemented. Nonetheless, Inslee did succeed, if only briefly, in putting his signature issue in the spotlight and he may even have a chance of getting it adopted as a plank in the Democratic platform at the 2020 convention. Hickenlooper was a candidate appealing to the middle ground, like former Rep. John Delaney (D-MD.). It remains to be seen whether a centrist or a more leftist—or progressive, if you will—candidate will capture the attention of Democratic primary voters.

The two largest components of the federal budget each year, whether Congress actually passes a comprehensive budget or a Continuing Resolution which covers spending for a given year or two, are on entitlements—Social Security, Medicare, Medicaid, etc.—and defense spending. The annual budget that Congress appropriates to the Defense Department, it is often pointed out, is greater than the next seven or eight countries combined. And yet the U.S. Navy possesses the fewest warships in decades, the Marine Corps is looking to downsize from its personnel height during the Global War on Terror, and the Air Force is looking for ways to trim costs on its Next Generation Bomber, the B-21, which is projected to cost hundreds of billions of dollars. The problem as this Rolling Stone article by Matt Taibbi eloquently points out, is that the Defense Department does not engage in cost-reductions for two reason: it has no idea how much money, assets, and expenditures it actually has, and there is an institutional disinclination to making the accounting system better. One of the most telling parts of this is when a $4 billion part of the Marine Corps’ budget was inspected to see if it met congressionally mandated audit guidelines and of that amount, the Corps was unable to account for $2 billion. The mind fairly staggers.

Virtually the entire geopolitical circumstances of the modern Middle East, stem from the Six Day War of 1967. In June of that year, Israel launched a massive preemptory attack against the militaries of Egypt, Syria, and Jordan and inflicted such a crushing blow, that Israeli ground forces were able to capture vast swathes of territory—including East Jerusalem—which are still under Israeli control today; the so-called Occupied Territories. The lore of the Six Day War is hard to resist: Israel, outnumbered in military might by its perpetually hostile neighbors, bests three of them in less than a calendar week. But, much like how the Duke of Wellington described his victory at Waterloo, the Six Day War was a “damned near run thing.” The Israelis were rewarded for strategic aggressiveness and decisive action, but only because a series of events, out of their control, created certain circumstances which contributed to early Israeli success. The Six Day War may have been brief in duration, but it was won even faster: in its first six hours, and this is an outstanding explanation of how it happened and serves as a meditation on how a military action from over half a century ago continues to inform the modern Middle East.

There is a better than decent chance that you, any of you, have heard of W.E.B. DuBois. I would hazard a guess that few, if any of you, have heard of Madison Grant or Lothrop Stoddard. There may be a distinct reason for this, and it is apparent in the outcome of a short series of debates between DuBois and Stoddard in 1927. DuBois, true to his intellectual might, presented a logical case for why black Americans deserved equal rights with white Americans. Stoddard, in his response, relied upon racial theories based upon the supposedly superior nature or Nordic people’s “germ-plasm.” Without spoiling the outcome of the debate—the title does so already—the DuBois-Stoddard duels reflect something applicable in our current circumstances: allowing the purveyors of white nationalism to present their beliefs in the right forum, exposes the utter absurdity, the abject ridiculousness of their dogma. In this piece, the build-up by writer Iran Frazier takes time, but the point is well worth making.

In 2015, an elderly resident of Corning, California, approximately an hour and a half north of Sacramento, stopped greeting his mailman on the porch. His investment advisor noted that Eugene Brown had stopped making his twice daily calls; one before the opening of the New York Stock Exchange each morning, and one immediately after its close each afternoon. A police welfare call confirmed suspicions: the elderly Brown, who lived by himself, had died of a stroke in his home. Thereafter, officials of the county public administration office sprang into action in order to index Brown’s belongings and seek to find a will or last testament. Brown, as so often is the case, did not have a will. But his home did not have the signs of an elderly hoarder. In fact, Brown lived a rather spartan existence. But this undermined the fact that Brown was in fact a millionaire. This is the story of discovering a parsimonious millionaire who has few family members, no will, and what happens after in such a circumstance.

Finally, much has been made of the amount of support which Donald Trump continues to enjoy among Republicans, while Democrats appear riven among a wildly divergent group of presidential candidates—numbering somewhere around 23, depending on when you read this—that range from the far left-socialist, and the centralists in the mold of Bill and Hillary Clinton. This article by Alan Abramowitz explains, without drawing conclusions, that the Democratic Party is more divisive going into 2020 than Republicans. This, I would argue, is a product of Democrats becoming the bigger tent party as Republicans continue to alienate communities outside of white, rural males.

But they account for only 11 percent of employed civilians, a category that includes government and private industry work, and 13 percent of the U.S. population, according to government data.

Government work has played an especially important role in the economic advancement of black Americans, following President John F. Kennedy’s efforts to make the federal government a model for fair hiring at a time blatant racism pervaded the country’s job market.

Like blacks, Hispanics may be hard hit, but for a difference reason. The freeze would abruptly halt initiatives under the Obama administration to further diversify the federal workforce. President Obama had issued an executive order in 2011 to promote inclusion in the government workforce. The effort included using data to measure every aspect of the recruitment, screening, and hiring process to identify roadblocks to a more diverse workforce.

“Now, with Trump’s hiring freeze, these proactive efforts to improve diversity hiring are going to be put on a shelf. They could be delayed or eliminated entirely,” said Gilbert Sandate, chairman of the Coalition for Fairness for Hispanics in Government. “It’s almost like the Trump administration is announcing, ‘We’re back to square one, folks.’”

The White House has not responded to a request for comment.

Hispanics, despite explosive growth in the United States in recent decades, have been chronically underrepresented in the federal government, increasing an average of 0.12 percent each year over the last 40 years, said Sandate, who retired after 34 years of working in the government. That gap, he said, translates to the Hispanic community losing 100,000 government jobs and $5 billion in salaries.

“Knowing what we do about this new president’s views about diversity and inclusion in general, and in particular about immigrants like Mexicans and Muslims, these things do not bode well for minority workers,” said Sandate, who had been the director of workforce diversity at the Library of Congress, the director of civil rights at the Department of Agriculture and the Department of Transportation, and a longtime director of equal employment opportunities for the Equal Employment Opportunity Commission.

“If there can be no hiring,” he said, “there could be no meaningful barrier analysis conducted, and there could be no movement forward.”
