A 26-year old transgender woman who pleaded guilty to sexually assaulting a 10-year-old girl will be moved to a youth treatment center, despite prosecutor’s efforts to keep her in a Los Angeles County Jail.
LA County prosecutors said Hannah Tubbs, who identifies as female, also would not have to register as a sex offender once she finishes her two-year sentence.
Tubbs, who was busted for molesting a 10-year-old when she was a 17-year-old juvenile, will be sent to the kids lock up after LA County District Attorney George Gascón declined to file a motion to move the case out of juvenile court, where it was filed because of Tubbs’ age at the time of offense.
A judge in Antelope Valley, Calif. ruled Thursday that Tubbs would be moved to the youth treatment center immediately, where she will be kept with juvenile female prisoners.
“You have a violent sexual predator sentenced to two years in a juvenile facility,” said Deputy District Attorney Shea Sanna after the hearing. “It doesn’t change the fact that the public is safer, but we just preferred Tubbs to be with other adults and not prey on others.”
Tubbs was 17 years old when she grabbed a 10-year-old girl and put her hands down her pants in a stall at a Denny’s in Palmdale, Calif.
Tubbs was arrested and charged for the crime in 2019 after she was arrested on battery charges in Idaho and her DNA matched a national database. She pleaded guilty to the California sexual assault charge in November.
During Thursday’s hearing, Judge Mario Barrera reiterated several times that he was limited to sentencing Tubbs to two years because the LA County District Attorney’s Office did not file a request to transfer the case to adult court.
Attorney Justin W. Clark, who represented LA County in the case, argued Thursday that the court has the ability to allow the Probation Department to decide that Tubbs should stay in the adult county jail because the law states individuals who are over 19 years old should remain in an adult facility.
Sanna added the issue regarding where Tubbs should be housed is different from where she should be transferred.
The judge disagreed and ruled that an amendment to the law limits his ability to allow the Probation Department to transfer Tubbs. The law states persons 19 years or older who were already committed to a juvenile facility should remain there and cannot be transferred, the judge said.
Los Angeles County Supervisor Kathryn Barger said the outcome of Thursday’s judgment was unsatisfactory.
“Judge Barrera’s hands were tied today — due to the fact that the DA’s office failed to file a motion to transfer Tubbs to adult criminal court, which is where she rightly belongs. Instead, we’re left with a 26-year-old individual sentenced to two years in a juvenile facility in isolation, separated by sight and sound from the other juveniles,” Barger said in a statement.
“To carry out justice, all of the oars in the criminal justice system must be rowing in the same direction. Today, that simply didn’t happen.”
Because Tubbs is now recognized in California as a female, she will be housed with other female juveniles at the facility where she will be transferred. However, Clark said Tubbs would be housed alone.
The victim, who is now 18, no longer lives in California. In a statement she provided to the court, the young woman said she continues to live in fear.
Jonathan Hatami, a deputy district attorney with the Complex Child Abuse Unit, said Gascón’s decision not to transfer the case out of juvenile court sacrificed the public’s safety and the victim’s rights.
“There was evidence presented at the juvenile proceedings which showed that Tubbs sexually assaulted two young girls in different incidents in the past. The child victims will suffer lifelong trauma. Tubbs also has prior violent convictions and conduct as an adult,” Hatami told the Post.
“The victims will get no justice. The public will get no safety. George Gascón has sacrificed the safety of the public, the rights of the victim, and justice in order to follow his own political ideology. It’s an injustice against all of us, especially the young victims.”

LOS ANGELES — A 10-year-old Southern California boy was starved and tortured for days before his death, sometimes by younger brothers and sisters forced to take part in the beatings, according to prosecutors who have charged his mother and her boyfriend with his murder.
KNBC-TV on Tuesday cited court documents that alleged vicious and repeated abuse of Anthony Avalos at his Lancaster home in the Mojave Desert north of Los Angeles for five or six days before his death June 21.
The torture included slamming the boy onto the bedroom floor, whipping him with a belt and cord, pouring hot sauce into his mouth and forbidding him to use the bathroom, according to the documents.
Eight siblings witnessed and were forced to take part in some of the abuse, which according to the documents included making the other children fight Anthony and forcing the children keep watch “so Anthony would remain standing or kneeling.”
“At one point Anthony could not walk, was unconscious lying on his bedroom floor for hours, was not provided medical attention, and could not eat on his own,” Los Angeles County Deputy District Attorney Jonathan Hatami wrote in an motion filed Monday that asks a court to admit previous child abuse reports into evidence.
Sheriff’s deputies were called to Anthony’s home a day before he died at a hospital. His mother said the boy had fallen down stairs.
Heather Maxine Barron, 28, and her boyfriend, Kareem Ernesto Leiva, 32, were charged with torture and murder. They haven’t entered pleas and remained jailed on $2 million bail each pending a hearing next month.
Hatami’s motion said that when the boy was brought to a hospital, his heart had stopped and he had suffered a traumatic brain injury and a brain bleed.
Anthony also had reddened eyes and numerous bruises, cuts and scrapes on his forehead, nose, mouth, cheek, neck, legs, shoulder, hips, back, buttocks, stomach, ankle, legs and foot.
County child welfare officials had received a dozen referrals of suspected child abuse about the boy from 2013 until 2016. Anthony had been removed from his home for several months when some of the reports of abuse were substantiated. He was returned after family members received in-home counseling, welfare officials said.
After Anthony’s death, authorities removed the eight other children — aged between 11 months and 12 years old — from the home. They are being cared for by county child welfare workers, officials said.
If convicted, Anthony’s mother could face up to 22 years to life in state prison. Her boyfriend could be sentenced to 32 years to life in prison.

Late at night and in the silence of her early morning drives, the first-grade teacher thinks of her former student. She assigns each child in her classroom a number — he was No. 28. She tries to focus on his kindness — on the times he offered to help her staple homework packets and tutor his classmates. She tells her new students about him, explaining when she assigns numbers why she now skips 28. She had repeatedly reported signs of abuse but still wonders whether she could have done more to help save Gabriel. When the familiar pit returns to her stomach, she bubbles with anger. She thinks of the people convicted of torturing and murdering Gabriel — the boy’s mother, Pearl Sinthia Fernandez, and her boyfriend, Isauro Aguirre. “They are evil,” Garcia said Thursday in a downtown Los Angeles courtroom as she glared at Fernandez, who sat stone-faced with her hands cuffed on her lap at the defense table. “I know who’s truly to blame.” The scene in the courtroom served as a dramatic coda to a tragedy that became a symbol of bureaucratic failure, propelled far-reaching reforms within L.A. County’s child welfare system and led to unprecedented criminal charges against social workers who handled the boy’s case. At the end of the hearing Thursday, Superior Court Judge George G. Lomeli sentenced Fernandez, 34, to life in prison without parole and Aguirre, 37, to be executed for the 2013 torture killing of Fernandez’s 8-year-old son — abuse that the judge characterized as “horrendous, inhumane and nothing short of evil.” It was the worst abuse he’d seen in nearly 20 years on the bench, he said, telling the defendants he hoped they woke up in the middle of the night plagued by their actions. “I hope you think about the pain you caused this child and that it tortures you,” Lomeli said. “I rarely say that.” During the hearing, several people in T-shirts bearing Gabriel’s face addressed the court. When Emily Carranza, Gabriel's cousin, stood at the podium, Fernandez locked eyes with her. “Gabriel loved you,” Carranza said to her. “The world fell in love with Gabriel as their own. Why couldn’t you?” Fernandez — who wore jail scrubs and a heavy coat of brown lipstick and eye shadow — struck a tone of contrition, and then blame. “I want to say I’m sorry to my family for what I did…. I wish Gabriel was alive,” she said, adding that she felt that some people who had been vocal after the death were only interested in fame. A volunteer jail chaplain told the judge she’d prayed and studied the Bible recently with Fernandez. “Pearl has agreed and has acknowledged her part,” the chaplain said, as the mother nodded. “She will have a void in her heart for the rest of her life.” When paramedics arrived at the boy’s Palmdale home in May 2013, Gabriel had slipped out of consciousness. He had a fractured skull, broken ribs, burned skin, missing teeth and BB pellets embedded in his groin. A paramedic would later testify that every inch of the boy’s small body had been abused. At Aguirre’s trial, Deputy Dist. Atty. Jonathan Hatami told jurors that the defendant had enjoyed tormenting the boy, forcing Gabriel to eat his own vomit and sleep in a cabinet with a sock gagging his mouth. The torture, Hatami said, stemmed from Aguirre’s hatred of Gabriel, who he suspected was gay. Before the boy’s death, Garcia repeatedly reported signs of abuse to county child services workers, saying she’d seen bruises on his face and learned that he’d been beaten with a belt buckle. She said she believes the entire system failed her student. “There were signs that were ignored. Why were they ignored? I don’t know,” Garcia said, as her shoulders slumped. The Trials of Gabriel Fernandez: Honoring Gabriel's Legacy on his 17th Birthday
We had the amazing opportunity to join LA County Deputy District Attorney Jonathan Hatami and the Antelope Valley community in celebration of Gabriel Fernandez's 17th birthday yesterday, February 20th, 2022.
Mr. Hatami was actually the prosecutor on Gabriel's case, securing guilty verdicts against both of his murderers. He was featured heavily in the Netflix documentary, The Trials of Gabriel Fernandez. Every year, he visits the tree outside of the apartment Gabriel lived in - this is now "Gabriel's Tree."
It was surreal to be outside of the very place that such horrendous and unimaginable things happened to a child, what should be a very sad place. But there were also children playing in the grass, laughing. Families and friends reconnecting and hugging. A community making memories. There was also a beautiful flock of birds that flew overhead while a local pastor said a prayer. And, since you can't have a birthday party without cupcakes, all the children attending got a cupcake and a Justice for Gabriel shirt. The cupcake line was very long and a lot of kids had fun at Gabriel's birthday that day, right outside.
After briefly beginning to address the crowd, Hatami paused to check on and console an upset toddler in the crowd. When he continued, his message was:
"I want you all, first, to remember the legacy of Gabriel and as a result of that, go out there and live.
God wants you all to live. Go out there and fight for children. Go out there and be who you want to be. Take care of your children and take care of your family. If you see other children who are in need, help them. Don't be afraid to step forward and help a child, or to help somebody who is vulnerable, or to help somebody who can't help themselves. We are all a part of this community. We are all interrelated and we all need to help each other. We need to all look at Gabriel's legacy. Don't look at Gabriel and what happened to him . . . . Gabriel is looking down on us. He wants you to fight for the children. He wants you to fight. . . . We come here to celebrate Gabriel's life. We come here also to celebrate Gabriel's legacy.
I want you all to know that what is happening in my office, is sad. I've dedicated my life to fighting for children and right now, we have a real major problem where we have someone who doesn't wanna do that. And so we all have to join together. All . . . that's why Los Angeles is so great. We have so many different backgrounds and this community, this city, this county, is worth fighting for. I'm not leaving. I hear so many people are leaving. I'm not leaving! I'm raising my children here. I'm raising my family here. You are all a part of my family. You are.
My door is always open. I'm always here to help. I'm always here, no matter what. . . . All of us together, we are so much stronger. So go out there and live! Live. Do what you wanna do. Be who you wanna be. Always fight for the most vulnerable. Always protect the most vulnerable. Don't be afraid to step forward and do what's right. Sometimes, doing the right thing, is USUALLY the harder thing. It is the more difficult thing to do. But it's the right thing to do. It's the right thing for all of us.
So I want you to celebrate Gabriel's legacy. Celebrate his birthday. Meet one another, talk to Gabriel's family, talk to other families. . . . And live. Go out there and live, 'cause that's what Gabriel would want you to do. He would want you to go out there and live your life. Be a part of this community. Help one another. Fight for one another. I'm gonna keep fighting for you in all these cases. Gabriel is always gonna be a part of me, part of my family. Gabriel's family is my family. You all are. I love this community, and I'm gonna keep fighting for all of you. I'm gonna keep fighting for all of you. I think we all are.
So I love you all, I do. I get re-energized every time I come here. It's sad looking at the apartment, it's sad. But then I think about Gabriel. I think about the fact that he wants us to live and to fight for each other. So I want to thank you all for coming here. I met a pastor, his name is Carlos, he's a pastor out here in Palmdale. I am a believer and my belief is important to me and my family and it helps me get through a lot of the cases that I have. It does give me strength, and so I would ask that if Carlos doesn't mind, that he lead us all in a prayer, before we hear from Gabriel's family."
