SE ACATA, PERO NO SE CUMPLE
¿Cuántas veces habremos oído aquello de que las leyes de Indias, se acataban pero no se cumplían? Un mito más como los anteriores vistos. Las Leyes en América, se cumplían de la misma forma que se hacían cumplir en Europa… o es que ¿alguien en su sano juicio piensa que las leyes no se hacían cumplir?
¿Podemos decir que hoy día las leyes no se cumplen en México o ecuador? ¿Acaso en estos países no hay jueces y policías que hagan cumplir la ley?
Aquellos que dicen que las leyes de Indias se acataban pero no se cumplían y ponen como ejemplos algunos sucesos, se les olvida mencionar que les ocurría a los que incumplían la ley… pues los que incumplían la ley terminaban encarcelados, desterrados o incluso ejecutados. Algunos se iban de rosita, cierto, ¿pero es que acaso eso no ocurre hoy día en cualquier país del mundo, donde los más poderosos, a pesar de incumplir las leyes acaban absueltos?
Hay algunos o muchos ignorantes que eligen un suceso y lo hacen la norma general, lo cierto es que realmente di existe el dicho de: Se acata pero no se cumple, pero ¿de dónde viene? ¿Cuál es su origen? Pues vamos a desgranarlo:
La fórmula de "la ley se obedece, pero no se cumple" fue un aforismo mencionado con mucha frecuencia durante la aplicación del derecho indiano. Aquello ha generado, en la historiografía una creencia de que las autoridades americanas estaban en constante rebeldía con los mandatos de la Metrópoli, y que solamente las leyes indianas fueron cumplidas, en ocasiones raras, dándose una imagen de que la Hispanoamérica virreinal fuese un lugar con total desprestigio de las leyes y un ejemplo de la Corrupción política de los países hispanos.
"En lo que no es justa la ley no ha de obedecer el Rey". Tendría fuertes bases esta costumbre en las Siete Partidas.
El no obedecer una ley, por motivos de rebeldía de los súbditos o malicia de los ejecutores de la ley, se consideraba una acción ilegal y podía ser algo penalizado como un delito. Solo era legítimo la oposición a una ley que estuviera reglamentada por el derecho, en tanto que era legal oponerse a leyes que pudieran perjudicar al Bien común o causasen daños mayores que los que pretenden remediar.
La potestad para suspender alguna ley se basaría en evitar la injusticia, pero siempre teniendo que reconocer su acatamiento como obligación de reconocer la autoridad legítima del rey y sus funcionarios y más bien, permitiendo que la monarquía española pudiera enmendar sus mandatos y hacerlos más justos y viables ante leyes y decretos que fueran contra el derecho y las partes involucradas.
“Los virreyes y las audiencias tenían autoridad discrecional en aquellas situaciones en las cuales los mandatos reales discreparan notablemente con las realidades locales o cuando su puesta en vigor pudiera crear una injusticia. Ellos podían suspender la ejecución de una ley, y lo hacían en una pintoresca ceremonia: el presidente besaba la real cédula e invocaba la fórmula “obedezco pero no cumplo”. Una vez aplicada la fórmula, la audiencia debía presentar al Consejo de Indias propuestas concretas en virtud de las cuales se pudiera mejorar o modificar la legislación suspendida”. CONCLUSIÓN: la alusión de “Se acata pero no se cumple”, era una fórmula legal que tenían los gobernantes de los virreinatos ante una ley que podía ser contraproducente. Cuando esto ocurría, la ley era devuelta al Consejo de Indias para su revisión, modificación o incluso su eliminación. Pero si no eran aceptadas las súplicas de los gobernantes virreinales, la ley volvía a América para su cumplimiento siendo la frase completa:
“Se acata, pero no se cumple, empero si después el Rey quisiere, que sea, deben cumplir lo que el mandare.”
Como habéis podido comprobar, una frase fuera de contexto ha dado lugar a una de las mayores falsedades y mitos que se van pregonando: Que las leyes no se cumplían en América.
Nada más lejos de la verdad y de la realidad, el “obedézcase, pero no se cumpla” era una fórmula administrativa del derecho castellano medieval que tenía como objetivo el comunicar al rey o emisor de una Real Cédula o Provisión Real que la misma era injusta o no se ajustaba a derecho, por lo que la ley capacitaba al receptor a acogerse a obedecer, muestra de respeto al rey, pero no cumplirla. También podía aplicarse en el caso de que tuviese algún tipo de defecto formal o de procedimiento.
Con el “pero no se cumpla” no es que se desobedezca, lo que se hace realmente es solicitar la suspensión de su aplicación y su revisión por el rey. Una vez revisada se resolvía ya de forma definitiva, momento en el que ya no cabía el “que no se cumpla”. Por eso cuando alguien utilizaba esta fórmula lo único que hacía era advertir de que esa ley podía ser injusta y solicitar una revisión, cuya resolución final sería aplicada. En muchas casos el legislador en su trabajo provocaba choques normativos de carácter particular con las leyes más generales y esto era advertido y suplicado.

A career of hard knocks to the head will not necessarily leave pro athletes with serious, permanent brain damage. That’s the take-home message from a small study. It included pro athletes who had taken a lot of hard hits during their career — including to the head. The findings now challenge what had been suggested by other studies that had autopsied the brains of former college and pro football players.
The new data come from tests of 21 retired athletes. All had been football players with New York’s Buffalo Bills or hockey players with the Buffalo Sabres.
Explainer: What is a concussion?
Each player allowed researchers to extensively scan his brain. The players also took behavioral tests. From these, the scientists turned up no signs of early dementia or unusual rates of mental decline. Both can point to a brain disease known as CTE. That’s short for chronic traumatic encephalopathy (KRON-ik Traw-MAA-tik En-seff-uh-LAH-puh-thee). Today, doctors diagnose CTE only by looking at a brain after someone has died.
For the new study, University of Buffalo researchers gave the athletes a battery of clinical tests. These measured brain function and mental health. Other tests probed such health features as diet, obesity and history of drug or alcohol use. Findings from these men were then compared to those from 21 noncontact athletes (such as runners and cyclists).
The former hockey and football players had expected bad news. They “were pretty much their own worst critics,” says Barry Willer, an author of the new research. This psychiatrist studies traumatic brain injury at the University of Buffalo in New York. The athletes had believed their brains to be impaired, he notes.
In fact, the new tests did not find high rates of problems with memory, solving problems, decision making or being able to plan things. The researchers also found no evidence of declines in the men’s attention, language and spatial abilities. Based on these tests, none of the former football and hockey players appeared to have early-onset dementia.
The good news “was a big surprise to us — and a big surprise to the athletes,” Willer says. The results are in line with several earlier studies of living athletes. This includes one published last year. It, too, found no major problems in the mental abilities of 33 retired hockey pros.
The authors shared their latest findings in a series of papers. All were published August 7, 2018 in the Journal of Head Trauma Rehabilitation.
Not all athletes were totally fine
Eight of the 21 contact athletes appeared to show mild mental impairment. So did three of the 21 other athletes. Such mental problems could hint that dementia will develop. But the difference in rates between the two groups may not be due solely to more head knocks in the hockey and football players. Education, IQ and a man’s weight also could have contributed to some of the apparent difference. As such, the authors say they cannot firmly link rates of mild mental decline seen to which sport a man had played.
Brain scans told a similar story. Several types of magnetic-resonance imaging, or MRI, turned up no big differences. They showed no big differences in brain anatomy. They also didn’t show big links to behaviors in athletes with a history of contact versus noncontact sports. Still, seven of the non-contact athletes showed microbleeds. Scientists have linked these tiny ruptures in brain blood vessels with poorer brain function. The same microbleeds showed up in only two of football and hockey players.
Carrie Esopenko works at Rutgers University in Newark, N.J. She’s trained as a cognitive neuroscientist and a psychologist. Studies of the living, as here, “are exactly what we really need,” she says. Such studies “are really going to help us understand what’s going on in these lives.”
The new study also may ease some recent concerns. Last year, researchers had reported in JAMA that 110 of 111 autopsies turned up CTE in the brains of former pro football players. Those brains had been donated by family members who had suspected something was amiss. However, such concerns and symptoms may mean this sample represented the sickest of former players.
Indeed, notes neurologist Rodolfo Savica: “People who do not have symptoms do not donate their brains.” Savica works at the Mayo Clinic in Rochester, Minn., and was not involved in either study.
Athletes who took part in the new study were in their mid-50s. So they would have been relatively young for a dementia diagnosis. Still, based on earlier reports of brain damage, the researchers had expected to find some signs of dementia in these football and hockey players.
To better understand the prevalence of CTE, though, more research will be needed. Researchers want to see a larger sample of athletes who suffer blows to the head as well as those who don’t. “There’s a lot more that we don’t know than we do know,” says coauthor John Leddy of the University of Buffalo’s Concussion Management Clinic.

okay I'm lowkey getting into the Islanders but idk very much so could you give me a rundown of your team. they're from what i've seen good guys and I want to love them
i’d like to welcome you to the biggest mistake of your hockey-loving career. you’ll probably hate and love every second of it like i do. i’m trying to think of important info (or at least important to me and it’s definitely biased and missing GREAT guys) so here we go….
before we jump into players it’s CRUCIAL you know isles fans HATE the GM Garth Snow who is honestly a rat. He does NOTHING for this team and needs to be fired. #SnowMustGo and Doug Weight…. he was only supposed to replace our former coach Jack Capuano but here he is… still fucking coaching.
now onto players who make my world go round.
we’ll start with our lord and savior, John Tavares (#91). sometimes called JT. sometimes the biggest loaf of plain ole boring bread, but he’s our captain and we love and need him forever. he’s now a free agent so i’m honestly going to sell a kidney to ensure his spot on the team next year.
then there’s his dare i say elite winger, Josh Bailey (#12). you either hate him or love him, there is no in between on the island. the guy has come a long way from the ~trash~ hockey player we have seen in the past and for that i want to hug him and keep him forever. he finally went to the all star game this year and dang, i’m proud
next is the final part of the BLT line, Anders Lee (#27) (get it… bailey, lee, tavares…) this man just got 40 goals this past season so i am proud!!!! his most notable contributions to the team is being a stud in front of the net and having the anders lee kancer jam which is to fundraise for childrens cancer research. he’s also a proud notre dame alum. one time i saw him on the train and literally walked to barclays next to him and went to talk to him but he had his headphones in and didn’t notice me omfg.
nexT is the second line… they are my life….. let’s start with our absolute gem of a rookie centerman, the loml, mathew barzal (#13). only one t in mathew because he’s fucking cool like that okay? he’s a SHOE IN for the calder. the kid can skate circles around defensemen and create plays in almost any situation. it’s definitely because he had figure skating lessons this past summer, so kudos. i feel like i need a separate post for his perfection and i’m trying to be limited in how much i talk about him because ARE YOU STILL READING? i digress… he is just good at everything. literally. plus he got his first goal in the game against the rags. he is a true islander.
then we have, mathew’s #1 bff / butt buddy….. anthony beauvillier (#72), aka beau aka tito aka a french canadian BEAUT. he speaks french fluently and him and barzy speak it to each other… rt if you cried. this boy was a rookie last year, spent his sophmore year in a lil bit of a slump and was sent down, BUT with ladd’s injury he was recalled and FUCKING DESTROYED IT. he ended this season with 21 goals. dang boy, i’m a proud mom. he is SWEET, he writes cute shit on his stick and smiley faces before games. nothing says panty dropper like a bilingual, sweet, hockey player.
next we finish the line with the gap toothed beauty that is jordan eberle (#7). thank the lord we got him from the oilers (what a fuckin steal…. ebs for ryan strome….) he plays on the most electric line with barzy and beau. he’s probably the consistency this team needed and GOD I LOVE IT. he just does so many things for this teams offense. he said he had fun playing here this season and honestly that’s reassuring to hear someone enJOYING their time on the island.
now to onto less popular guys, but all goodies! we’ll start with cal clutterbuck (#15). most notoriously known on tumblr this past season for injuring both brock boeser and auston matthews. he’s AGGRESSIVE. we need it tbh. plus, he’s not hard to look at. if you’re into older men with great facial hair and tattoos… he’s your dreamboat.
ok next we have in my opinion one of the most beautiful men ever, casey cizikas (#53). he’s just had a baby so he’s truly a ~daddy~ he’s another aggressive guy on the team which is beyond fabulous. i love that shit. he used to be matt martin’s #1 butt buddy but that’s long gone since matty has parted ways with the isles. i feel like zeeker had a pretty quiet season, a lot of ups and downs with an injury.
i would talk about brock nelson but i’m not a fan. andrew ladd also would get a mention in this but he royally blew it this season too. :-)
now onto defense.. this will be short since i’m super biased and only really want to discuss like… 3 of them… nicholas leddy (#2). i really love him for some reason and honestly he’s FAST. he can bring shit into the zone and is fabulous, but he definitely had a rough season. started off great and then it went into a serious decline along with the team :’) i still love him so so so so so much. like if you know anything about me it’s my unnatural love for leds.
then we have leds’ liney.. JOHNNY MUTHA FUCKING BOYCHUK (#55). honestly i would never look at this man the wrong way in fear for my life. recently he fought nolan patrick so he has my FUCKING HEART. he’s a good fucking guy who has dealt with an injury all season and he’s finally having surgery so here’s to hopefully a better year next season.
next is RYAN PULOCK (#6). WATCH THE FUCK OUT FOR HIS ONE TIMERS. HE IS A BEAST. a 10/10 guy in my opinion. he had a 5 point game against the bl*ckh*wks which was INCREDIBLE because he’s the first rookie defenseman in team history to get five points. he’s still young and fresh to the nhl… so he’s probably going to pop the fuck off next season…you heard it here first, a @nyisles hot take.
honarable d-men to mention - thomas hickey, BRANDON DAVIDSON… he’s attractive otherwise can’t say much since he was acquired at the trade deadline, cal dehaan who was hurt :’(, scott mayfield who seems like a good guy (also like scary if you ever were to fight) and adam pelech… very quiet guy.
not discussing goaltending because i don’t like jaro and griess isn’t that great.
