The Canadian government introduced a new work permit program for H-1B visa holders from the United States, effective July 16, 2023. The permit allows current H-1B visa holders to work in Canada and potentially pursue permanent residency based on their qualifications.
Immigration, Refugees, and Citizenship Canada (IRCC) has allocated a special stream for 10,000 US H-1B visa holders, aiming to provide them with more secure and long-term prospects compared to the United States. The work permit was met with an extraordinary amount of interest; in just the first day, the 10,000 available permits were taken.
In March 2024, Canada announced that it would be processing a number of H-1B visa holders who applied for the pilot project before the deadline but were not granted work permits due to the declared cap.
Dependents of H-1B visa holders can also now benefit from this initiative. Work permit holders can sponsor dependents for work, study or visit in Canada.
Who can apply
To qualify, you must be the spouse, common-law partner or dependent child of an H-1B visa holder applicant
currently live in the US. If you’re not eligible to come to Canada under this policy, you may qualify as a family member of a highly skilled worker .
Applications for open work permits for dependents must be submitted by September 27, 2024, while there is no deadline for visitor or student applications.

Study Permit To Canada And The COVID-19 Impact

All International students require a study permit to Canada to join a course of study with a duration longer than 6 months. The first step in your quest to studying in Canada is securing admission at a designated learning institution (DLI).
What Is A DLI?
The provincial and territorial governments in Canada allow a number of educational institutions to host foreign nationals as students. Such institutions are called designated learning institutions. Admission Process For A Study Permit
DLI will issue a letter of acceptance, once you meet with all eligibility criteria. This letter is an important document and will be required for visa application process. Visa applications can be submitted online or on paper for ease of students. Due to Covid-19 Pandemic, online application submission is the only option.
SDS Stream Vs. Regular Application
There are two ways applicants from certain countries (India, Pakistan, China, Philippines etc.) can apply for study permit. Besides the regular application process, they can go through SDS- student direct stream. SDS provides a faster application processing (20 calendar days) provided you are able to provide the required documents. Notably, only the applications submitted electronically are eligible for SDS processing. In addition, SDS requires acceptable IELTS scores; GIC of $10k CDN; payment of first year tuition in full; upfront medical etc besides the usual set of documents.
SDS allows you to submit a temporary resident visa (TRV) application for any accompanying family member(s) at the same time you submit your study permit application.
On the other hand, Regular Study Permit Applications include non-SDS electronic applications and paper-based applications submitted through visa application centres (VAC). For regular applications, the current processing times are approximately 15 weeks when applying from India. This excludes the time it takes for you to give your biometrics and your application to move from a VAC to Immigration Refugees, and Citizenship Canada (IRCC).
In the current scenario, you will need funds of at least CAN $14,000 p.a. for yourself and an accompanying family member. Above which, you will need an additional CAN $3,000 for every additional family member accompanying you to Canada.
Apart from the above-mentioned mandatory documents, you may have to submit additional documents such as a letter of explanation, custodian declaration for minor children and any other documents according to your country/region-specific visa requirements.
Processing Time And Fee
The processing time may vary depending on whether you apply for study permit from within or outside Canada. Variations in processing times are also possible as per   the country you apply from.
In the current COVID-19 situation, it may take longer than the usual processing time of about 15 weeks for your Canada study permit application to be processed. The current processing fee Canada study permit is $150 CAD. There is a biometrics fee of $85 as well.
Impact Of COVID-19 On Canada Study Permit

In the first stage, IRCC will check your eligibility. This includes checking your letter of acceptance and availability of funds among other things.
While the second stage entails, checking your application for admissibility and changes to your eligibility since you submitted your application. Any fitness and police certificates along with biometrics will be reviewed at this stage.
If your application passes the two stages, your study permit will be approved and you will be issued a visa.

Federal Skilled Workers Program
The Federal Skilled Worker Program (FSWP) is the main pathway for Express Entry candidates to obtain permanent residence. Since the start of the pandemic, however, Express Entry draws have only focused on Provincial Nominee Program (PNP) and Canadian Experience Class (CEC) candidates. IRCC’s rationale is it wants to issue invitations to apply (ITA) to candidates within Canada since they are less likely to experience coronavirus disruptions than candidates overseas.
It is important to remember, though, that some of the CEC and PNP candidates now receiving ITAs are also overseas. Moreover, it is reasonable to expect that by the time that successful candidates submit their permanent residence applications and IRCC processes, we will be in 2021. At that point, hopefully, Canada’s border rules will have been eased.
Therefore, a strong argument can be made in favor of IRCC including FSWP candidates in Express Entry draws right now. Even if one is not convinced by this argument, remember, again, that some CEC and PNP candidates are currently abroad, so why should FSWP and Federal Skilled Trades Program (FSTP) candidates — some of whom are actually currently in Canada — be excluded?

Family class
A common question right now is whether IRCC will renew the Open Work Permit Pilot before it expires on July 31.
The pilot gives an open work permit to spouses and partners of Canadian citizens and permanent residents who are waiting for their spousal sponsorship application to be processed.
Given how beneficial this pilot is to Canadian families and the economy, we should expect it to be renewed.
Another major question mark is with respect to the Parents and Grandparents Program (PGP). It has been delayed due to IRCC reviewing how to improve it, and then the onset of COVID-19.
IRCC has stated it is committed to announcing details about the program’s launch later in 2020.
One obstacle, which minister Mendicino has noted, is that parents and grandparents are more vulnerable to COVID-19. Hence, IRCC is trying to identify how it can welcome such individuals to Canada in a manner that protects their health.
Immigration Levels Plan 2021–2023
Aside from any forthcoming announcements on travel restrictions and when IRCC will invite FSWP candidates again, the third-biggest story in the next six months will be minister Mendicino’s 2021–2023 Immigration Levels Plan announcement.
This will be the most anticipated announcement since the government tabled their immigration plan in 2017 — back then, stakeholders wanted to know if Canada would commit to significantly higher immigration levels and whether it would re-introduce a multi-year plan (prior to 2017, plans were announced one year at a time).
By November 1st, Mendicino will tell us the extent to which COVID-19 will impact Canada’s short- and medium-term immigration goals. We all know immigration is critical to Canada’s economy and society, but at the same time, COVID-19 has created much uncertainty.
Ultimately, COVID-19 has not impacted Canada’s need for immigration, so there is a strong chance immigration levels will remain high in 2021 and beyond.
