An Overview of the JAMS International Arbitration Mechanism

I. Introduction 

The development of peaceful settlement of disputes has been a matter of discussion over the years. There has been a growing interest in instituting amicable resolution mechanisms across the globe. In terms of terminology, the term “Alternative Dispute Resolution [ADR]” will be used to refer to any means including arbitration and mediation dedicated to settling disputes without any trial and outside the courtrooms. 

There are a wide variety of ADR mechanisms across the globe. Nonetheless, the nature of most international arbitration mechanisms remains unclear. It is helpful to address here that the present article will only focus on one JAMS:Mediation, Arbitration and ADR Services [hereinafter as JAMS International]. It necessarily follows that all other domestic and the rest of international systems fall within the outside of the available work.To date, only a limited scientific evaluation on the JAMS International have been identified. Therefore, in terms of methodology, the available research will be concentrating on founding instruments and international arbitration |mediation rules formulated by JAMS Mechanism. 

Overall, the core objective of the present article is to critically examine the role of JAMS International. In doing so, Chapter II highlights the informative background of the foundation purposes of the JAMS. That part will be followed up with Chapter III analyzing the unique opportunities presented by the JAM International.
