The International Trademark Association held its 140th annual meeting in Seattle, WA, May 19th-23rd, with almost 11,000 trademark practitioners from 150 countries and 1,250 corporations in attendance. A full program of educational sessions, table topics, networking events and receptions, guaranteed something for everyone, particularly with GDPR, Brexit and Seattle’s own Amazon looming over the proceedings.
INTA President Tish Berard kicked things off by noting that trademarks and brands bring order to the marketplace, but the role of trademarks is often diminished, and they are too often seen as a hindrance to change or innovation—a perception we all need to remedy. Keynote speaker Neil Lindsay of Amazon shared insight on how his company approaches naming and brand creation, with “access to magical moments” being the recurring theme, and optimism for the future at the core of the Amazon brand. Other values the brand embraces are trust and transformation, with Lindsay pointing out that when Amazon.com began, it was asking consumers to share their credit card online, a scary thing back then.

In addition to commenting that “We need to earn and work hard to keep our customers’ trust,” other tweetable quotes from Lindsay included “Eight out of 10 brands are built on good customer experience. We are customer-obsessed” and “Brands are characters in a company’s story.”
With the EU General Data Protection Regulation (GDPR) coming into effect this Friday, much attention was given to what brands need to understand and do about its far-reaching implications. The European regulations will grant people the right to know what personal data a company has on them and what it will be used for, and allows them to have access, correct and/or object to its use and to have it erased.

Emphasis was placed on the GDPR’s broad definition of personal data, whereby even basic information about a company’s clients and staff will now be protected. This even applies to companies that might not be based in Europe but offer their services there. It also raises problems for brand owners in protecting their marks, with the WHOIS system—which provides registrant information on domain names—now classified as containing personal information, and therefore may no longer be available as a resource to brand owners that encounter conflicting domains starting May 25th.
Trademarks in the cannabis industry was another hot topic. Although 31 states have legalized cannabis use (to the tune of $9.2 billion in sales last year), it remains illegal under federal law, and the United States Patent and Trademark Office refuses to register trademarks for cannabis products. One panelist commented that this ban is impeding the normalization of the industry, and that brand owners need to secure federal trademarks in order to best protect consumers.

Last year’s U.S. Supreme Court decision in Matal v. Tam, in which the ban on disparaging trademarks was ruled unconstitutional, provided plenty to discuss in a session on how all this will impact trademark registrations in the future. Simon Tam, founding member of The Slants, remarked how in 2009 a friend advised he should register his band’s name, it would only cost a few hundred dollars and take six months. Eight years later, he finally got his trademark registration, with the ban on scandalous and immoral trademarks also being ruled unconstitutional last December, and the refusal to register the mark “Fuct” being overturned.

Other subjects on the agenda included what Brexit might have in store for trademark owners, the implications of plain packaging for tobacco and other brands, and the “Yin and Yang of Licensing.” It was also interesting to see that, three years after it first appeared at INTA in San Diego, the .Sucks gTLD is now a recurring attendee, albeit perceived less of a threat than it was back in 2015. And adding to its reputation as the company that wants to do just about everything, Amazon Brand Registry was on display in the exhibition hall, offering its protection services to those interested in having better safeguards for how their brand appears on Amazon.
But lest we start to take all this too seriously, some refreshing perspective was provided by one panelist: “Our job is to help our clients do the dumb things they want to do, in the safest way possible, to run their business.”
