When John died in 1888 she requested the help of architect Basil Champneys to design a building a Victorian neo-gothic style; the building's architecture also takes inspiration from churches which makes sense as the library was largely ment to be theological.

Later, I am planning to create a copy of the finished sketch above to colour using coloured pencils and maybe some coffee stains to create a different effect and possibly atmosphere without destroying the original.

I've been thinking a lot lately about something that's quite interesting.

I'm Australian Aboriginal. My people's culture has been around for about 80,000 to almost 120,000 years. It is the oldest culture on Earth. Yet, a lot of extremely racist people will say stuff like "80,000 years and yet no advancements" as a way to "prove" that we're biologically and intellectually lesser than many other ancient and modern cultures that had incredible architecture and art.

And it made start to think "why?"

Why do we consider advancements in all areas of life, such as science or architecture or agriculture etc. as proof that a society is intelligent and going in the right direction? Why do we even consider these advancements as good things in the first place?

Imagine living in an ideal world where there is almost no disease, no widely experienced health problems (both physical and mental), no food shortages or any other problems we currently have in our own society.

Why in such an idealsed version of  society would we need to have extreme advancements in agriculture or other areas? What if we already had the perfect amount of food, the right amount of knowledge to deal with the health problems and the diseases humans commonly experienced? Why would we need to make things better if what we already had was completely fine and didn't need an "upgrade"?

This is all speculation and personal opinion, but I believe that the extreme advancements in these areas in this day and age are symptoms of a failing society.

Australian Aboriginal people in the past may have had to deal with many different problems, but in the grand scheme of things these weren't society-destroying problems like the ones we deal with today. These were small problems that could be dealt with easily. If there was not enough water in one particular area, the community would simply move to a place where there was more water, which would be able to provide for ALL members of the community. In order to not drive our food sources out of extinction, we would hunt only a certain amount of individuals of a species, move away when the seasons changed, and come back at a later date, when the animals had had enough time to repopulate.

I wouldn't say it was entirely perfect, but given the fact that our cultures and people survived for over 80,000-120,000 years, it's certainly a testament to how well our methods worked. We didn't need to have advancements because...what we were already doing was good enough for our communities to survive and thrive. We weren't experiencing widespread disease and famine until a few hundred years ago, when colonisers completely destroyed our way of life.

This train of though also got me to think about the wider picture. Not just about Australian Aboriginal culture but human society as a whole. Our desire to make things faster, easier, more efficient, more money, more more more. This includes expansion, not just to other places in the world but other places outside our own world, like colonising other planets.

It made me think about the reasons why we haven't found aliens yet. It made me consider that maybe the reason we haven't found aliens is simply for the fact that we, as a species, are unique in our experiences of completely screwing up our planet so badly that we want to escape, so we can find a place that can actually support us, and aliens simply do not have this problem, so they do not advance beyond a certain point simply for the fact that they do not need to, so they never go to space. Because their lives are mostly good. Perhaps not perfect, but close to it. They have no reason to go to space because there's nothing there for them that they do not already have on their own planet.

Aboriginal people did not royally fuck up Australia in the 80,000-120,000 years we have been here, and it is quite possible that if colonisers just...never went to Australia, we would still be doing the same things 80,000 years later.

I believe that life is not supposed to advance beyond a certain point unless there is a problem that needs to be solved. I believe our extreme advancements are the symptoms of our society failing to provide for all of our needs. Why else would we want to go to space, if not because our own world is getting close to no being able to support us anymore (a problem of our making)?

Anyways those are my thoughts. Idk what else to say. It's 3 am and I literally just wrote this up

No matter the reality, he will continue to believe that what he sets his mind to, will come true. This becomes prevalent in his desires for you. No matter what you say, how you feel or respond to his advances, he will be blindly convinced that you do return his affections -- if not evident in your overt behaviour, then definitely somewhere deep down. In his eyes, if he asks you out, and you refuse, it is definitely because you are simply too shy, or want to play hard to get to test his dedication to you and not because you have no interest in him. Whenever he touches you, and you wince or flinch away because his touch is nothing but a reminder of the venom he seeps in you, he will simply think that it is because you are not accustomed to his public display of affections yet. Instead of respecting that and not pushing you with it like an actual caring lover, he will merely increase his displays of affection by ten folds more to help you get used to it faster. 

~Naruto is the type of the yandere to love everything about you. Truly, Naruto is a person who finds beauty and good in everything; he developed love and the sense of urge to protect the very village that dehumanized and degraded him. So, it would only be evident that no matter what your flaws are, he will still find many things to love about you, many things to admire about you, and by extension, many aspects of yours that he can obsess over. While this type of unconditional admiration and love seems optimum, the unrealistic idealsations of you that stem from this unreasonable thinking and through putting you on a pedestal, will lead to nothing but detrimental instances that will feel suffocating. This is because while he does love you for who you are, he will love your potential more --  the potential of who you can be from his ideals. 

~Naruto is a master at guilt trip, and using it to get his way. He hasn’t had the best childhood, nor has he received love, respect or acknowledgement in general. As the object of his ‘affections,’ he will constantly reach out to you for validation, attention, acceptance, and making him feel loved the way he wants to feel. Any time you try to get out of having to spend time with him or not be around him, he may use his past as a tool to manipulate you into abiding by his demands. 

~There will be times when the requests Naruto asks from you are rather…questionable. He did not grow up with parents or decent people to model after from whom he could have learnt what love is. The people who could have taught him what love between a couple is supposed to be like would either be Iruka, Kakashi, or Jiraya: open perverts who truly never been in a relationship and understood the idea of intimacy from porn books. With the unrealistic portrayals of women and sex that are depicted in porn, and that being his only source of knowledge, some moments with him can be rather morbid. 

~Whether he does it by himself, or uses a shadow clone; Naruto will always be watching you. He liked to simply observe you do whatever you did throughout the day, and see if there was anyone else other than him that you ever interacted with. If he thinks there is someone else you are spending more time with, or prefer over him, then he will get rid of them. 

~In the instance Naruto lost himself to the Kyuubi’s chakra because of you, his personality would do a complete flip. While he can be uncomfortable to be with, generally, Naruto will be nice to you. Compared to some other yandere (cough the Uchiha cough), he will be much gentler; however, enveloped in the Kyuubi’s chakra, it is well known that his chakra is vile, filled with hatred and draws on negative emotions. As a result, he will be become crueler and be more possessive of you. In this mode, he would not hesitate to hurt you if that is what it takes for you to behave in whatever way he wants you to behave. 

~In most cases, with how much he lingers around you and desperately and constantly craves attention, it is a given that Naruto will likely always be by your side. Once he becomes enamoured with you, any alone time and privacy you may have had before, will be a forgotten construct because he will never leave you alone. His reasons are that he has always been alone and knows how agonizing isolation is. Naruto will not understand that the loneliness he experienced, and the alone time you craved are two very different underlying concepts. In his eyes, really, he is only doing what he thinks is best for you. If not today, then eventually, you will come to realise that whatever he did, he did it for your own good.

Los concursos penales (I): lo más difícil y divertido de la teoría del delito

Voy a probar una cosa: intentar explicar la parte más compleja, intricada y a la vez divertida y polémica que hay en el derecho penal, si le coges el gusto. Ver a dos buenos abogados discutiendo esto es una auténtica delicia.

Si hay una palabra que en lo jurídico tiene una acepción muy distinta que en lo coloquial, es "concurso". La primera vez que oímos hablar de un concurso de delitos nos imaginamos un Tú Sí Que Vales en el que Risto Mejide o su sucedáneo diría "Me ha gustado el apuñalamiento, pero te ha faltado sentimiento en la decapitación". O un concurso de acreedores: "Con la I, suceso en el que una empresa no puede hacer frente a sus gastos corrientes".

Sin embargo, según la RAE, "concurso" en el término más habitual está en la última acepción. La primera se limita a establecer un sinónimo: "concurrencia".

En este artículo (probablemente el más difícil que he escrito) intento condensar una discusión interminable, sin conclusiones establecidas, de cientos de años, que trajo y trae de cabeza a los mejores juristas del mundo, para que vosotros intentéis pillar de qué va el asunto.

Sed pacientes y recordad que si no entendéis algo, ha sido culpa mía por no explicarlo bien y no vuestra, porque es el tema más complejo y filosófico de toda la teoría del derecho, junto, tal vez, con las teorías del nexo causal.

Para eso están los comentarios: para solicitar aclaraciones y recriminarme que no me posicione sobre la LIVG y traer la LIVG a palestra, a pesar de que ya van varios artículos escritos, porque parece imposible últimamente que no salga algo de LIVG en cualquier tema penal, el otro día no pasé la escobilla del váter y me salió un meneante pidiéndome explicaciones sobre cómo encajaba el frenazo en la porcelana con la teoría de género.

CONCURSO DE DELITOS

Hay tres tipos de concurso de delitos: el ideal, el real y el medial. Este último da un poco de problema. No, todos dan problema. Lo cierto es que todo este asunto lo explicaré muy, muy por encima, porque es, probablemente, el tema más complejo de toda la teoría jurídica del delito. Las colisiones, ramificaciones, interpretaciones y problemas siguen a día de hoy dando lugar a estudios de cientos de páginas.

Así que, como siempre, si hay algún compañero en la sala que me perdone las generalidades. Y si eres estudiante de Derecho, no creo que esto te sirva como sustituto de los apuntes, pero, espero, te sea útil para entenderlos un poco mejor.

Al turrón.

Concurso ideal

Se da cuando una sola acción provoca dos o más delitos. Por ejemplo: cometes un incendio adrede y sale quemada una persona: concurso ideal entre delito de incendio y delito de lesiones.

Sin embargo, el ejemplo clásico es el de la bomba, que ayuda además a diferenciar concurso ideal homogéneo (infringes el mismo precepto varias veces) y heterogéneo (con un único acto infringes varios preceptos distintos).

1- Pones una bomba que hieres a varias personas (civiles). Concurso ideal homogéneo: un único acto (poner una bomba) crea varios delitos (lesiones), pero todos son idénticos.

2- Pones una bomba que hiere a varias autoridades. Concurso ideal heterogéneo: delitos de lesiones y delito de atentado, mediante un único acto.

En el concurso ideal heterogéneo no se acumulan las penas sin más, sino que se sigue la teoría jurídica de la absorción agravada: coges el delito más grave por la pena y lo limitas a su mitad superior.

Así, con el ejemplo anterior: delito de atentado contra autoridad: de 1 a 4 años. Delito de lesiones: de 3 meses a 3 años. Cogemos el más grave de los dos, el de atentado, y lo limitamos a su mitad superior, así que el culpable deberá ser castigado con una pena de entre dos años y seis meses y cuatro años por cada uno de los heridos.

Concurso real

Cuando varias acciones independientes dan lugar a varios delitos que, aquí viene lo importante, son juzgados en un mismo proceso.

De lo que va es de la acumulación de las penas. De uno o varios hechos conectados en el tiempo y en el espacio de alguna forma que se sustancian en el mismo procedimiento. Un ejemplo sería el de un fulano que roba un comercio, y al huir le pega a un tipo para robarle el coche, escapando a toda velocidad en el coche y siendo apresado al final. Tenemos aquí un concurso real de robo con violencia, lesiones, robo de vehículo y delito contra la seguridad vial.

El concurso real permite que todos estos hechos se sustancien en un único procedimiento, ante un único juez, para proteger la agilidad procesal. Imaginad el caos que supondría tener cinco procesos abiertos al mismo tiempo. ¿Y si sale antes la sentencia que considera no probado que el tipo hubiese robado? ¿Y si sale al mismo tiempo una condena por lesiones pero una absolución por robo de vehículo? ¿Y si todo eso tuviese "hechos probados" contradictorios? Sería el equivalente jurídico a un multiverso o el reo de Schödringer donde el acusado al mismo tiempo lo hizo y no lo hizo.

En este caso, a diferencia del concurso ideal, no se absorben las penas sino que se acumulan. Si es posible, se cumplirán al mismo tiempo todas; en caso de no serlo, se hará un cumplimiento sucesivo según el orden de gravedad.

Ah, pero hay dos límites con el concurso real:

1- La pena máxima total por todos los delitos no puede superar los 20 años (o 25, 30 o 40 en situaciones de emergencia). Esta excepción tiene otra excepción en el caso de la prisión permanente revisable.

2- La pena total no puede ser mayor que el triple de la pena del delito individual más grave.

Concurso medial

Este, según algunos autores, es un subtipo de concurso ideal; según otros, es un tipo de concurso de delitos distinto. Va de que se cometen varios hechos delictivos, pero con una relación de causalidad: cometes un delito para poder cometer otro. Falsificas un documento público para estafar: concurso medial. Allanas un domicilio para robar y violar: concurso medial.

Y es complicado porque muchas veces resulta difícil de separar del ideal (hay unidad de propósito) y del real (varias acciones, varios delitos). Es difícil, por ejemplo, saber si el tipo allanó un domicilio para robar y violar, o sólo para robar y una vez que vio que las circunstancias le eran propicias, pues violación. Y la cosa, como veréis, cambia mucho.

En el ejemplo que puse de concurso real, puede considerarse que el delito de lesiones concursa de forma medial con el delito de robo de vehículo, porque le cascó al tipo para quedarse su coche. Concursos dentro de concursos.

Que no se entere Nolan de esto.

Así, el concurso medial es una especie de híbrido entre los dos anteriores, enormemente polémico, que ha sido, de hecho, retocado en la reforma del 2015. Y esto ha creado un quebradero de cojones a los jueces.

Veréis, hasta antes del 2015, concurso ideal y medial se trataban de la misma forma: coges la pena más grave y la aplicas en su mitad superior. Así que los jueces no tenían que romperse demasiado la cabeza sobre si un delito era ideal o medial, porque la pena era la misma.

-Señoría, oiga, que usted dice que esto es medial y no, es ideal.

-Letrado, deje de hacer el gilipollas, si total la pena para su cliente es la misma.

-Pos es verdad.

Pero ahora los criterios de pena son distintas, porque para el delito medial la pena es imponer una pena superior de al menos un día a la que habría correspondido por la infracción más grave. Lo que quiere decir que se castiga mucho más el concurso medial que el ideal. Así que ahora, los jueces van a tener que justificar mucho (y andarse con pies de plomo) si el concurso es medial o ideal. Gajes del oficio, anda el Supremo cabreado por esto y los abogados han visto un filón en argumentos de apelación que dan lugar a teorías realmente fascinantes para conseguir rebajar la pena a su cliente.

Resumen de las penas hasta ahora:

Concurso ideal: Se coge el delito más grave y se pena en su mitad superior.

Concurso medial: Se pena siempre más que el delito más grave.

Concurso real: Se acumulan las penas de todos los delitos.

Vale, estos son los tres clásicos concursos de delitos. Pero tenemos un tipo de concurso distinto a estos tres que, para complicar más la cosa, es muy dado a confundirse: el concurso de leyes.

CONCURSO DE LEYES

Si los distintos tipos de concursos de delitos (ideal, medial, real) se basaban en una o varias acciones lesionando más de un precepto penal, los concursos de leyes van de un hecho que puede ser encuadrado en varios preceptos penales distintos, en el que uno de ellos "desplaza" al resto. Y esto se hace para cumplir el "non bis in idem", latinajo que quiere decir que no se puede castigar a alguien más de una vez por el mismo delito.

Así que el concurso de leyes va de decir: "Vale, este hecho cuadra en tal, tal y cual artículo a la vez. Vamos a ver en cuál cuadra mejor y nos olvidamos del resto". Por esto hay señores que dicen que el concurso de leyes realmente es un "concurso aparente", dado que al final sólo se juzga un delito. Yo seguiré llamándolo concurso de leyes en aras de la simetría conceptual y porque veo problemas:

Pongamos que un hombre mata a otro a cambio de dinero. A priori, encaja en homicidio, pero también en asesinato. Y como el asesinato recoge específicamente el homicidio a cambio de precio, promesa o recompensa, este concurso de leyes se resuelve a favor del asesinato.

Y por eso no lo llamo "concurso aparente", porque el homicidio no se desvanece sin más. Si luego no se considera probado o cambian las circunstancias y el tipo no lo mató por dinero, el homicidio "renace". No se elimina, se desplaza.

Así que aunque la definición es fácil, separar concurso de leyes y concurso de delitos es un follón de cojones. Llevo unos minutos rompiéndome la cabeza intentando poner un ejemplo claro y actual, pero he repasado mis antiguos apuntes y lo que mejor lo muestra fue el follón jurídico que hubo entre el parricidio (ya derogado) y su relación con el asesinato. Así me entró a mí en la mollera y así espero que os entre a vosotros:

Un padre mata alevosamente a un hijo. ¿Parricidio a secas? No estás castigando la alevosía. ¿Asesinato a secas? No estás castigando el parentesco como es debido. ¿Asesinato con agravante genérica de parentesco? El castigo con agravante genérica es mucho menor. ¿Parricidio con agravante genérico de alevosía? Mismo problema.

Vale, el concurso de leyes no está funcionando. ¿Concurso ideal de delitos, entonces? Juas, entonces estás castigando dos veces por un delito de muerte a alguien que sólo ha matado una ; es como si ese muerto contase por dos (recordad: non bis in idem).

¿Veis el enorme problema, y por qué esto lleva siglos trayendo de cabeza a los mejores juristas?

El Supremo al final se decantaba por el parricidio. Lo cual daba lugar a una paradoja curiosa: la pena por parricidio era más pequeña que por asesinato, lo que en la práctica la agravante por parentesco se convertía en una especie de ¿atenuante por parentesco?

En fin. Un follón de tres pares de cojones.

La cosa se pone más graciosa. Como he dicho en alguna ocasión, nuestra teoría del delito se basa en la teoría de los Bienes Jurídicos Protegidos (BJP). Se castiga el asesinato porque el BJP es la propia vida. Se castiga la violación porque el BJP es la indemnidad y libertad sexual. Se castiga el robo porque el BJP es la propiedad. Me seguís, ¿verdad?

Vale, ahora recordad el ejemplo del ladrón que huye y roba un coche. Pongamos que mientras huye a toda velocidad provoca que otros coches se salgan de la vía y sufran daños, o gente se aparte de él haciéndose daño. El tipo ha lesionado varios BJP (la seguridad del resto de viandantes y conductores, y las lesiones) mediante un único acto. ¿Concurso ideal de delitos? Meh, estarías castigando dos veces un único hecho, según algunos. Así que aplicas concurso de leyes, y lo metes todo como un delito contra la seguridad vial porque también es susceptible de causar daños lesivos.

Sé que ahora os pide el cuerpo decir que eso es medial de toda la vida. No os lo voy a discutir. Nadie lo tiene claro. Recordad: Intento condensar cientos de años de discusión interminable en un artículo que no os reviente la cabeza.

La diferenciación entre el concurso de leyes y el concurso de delitos ideal es casi la más complicada de la más complicada de las materias. La diferencia entre ellos es el perjuicio completo: se aplica el concurso ideal si el perjuicio o desvalor únicamente se puede incluir completamente si, a cojones, concursas los delitos.

Así que, en teoría, si el concurso de leyes es una infracción a la que se le pueden aplicar varios artículos, el concurso ideal de delitos es una acción que da lugar a varias infracciones.

Pero luego llega la práctica: Un contable que sisa de la caja de su cliente. ¿Concurso ideal entre apropiación y deslealtad? ¿Concurso de leyes, subsumido todo a apropiación con agravante? De hecho, casi todos los ejemplos que he puesto de concurso ideal pueden discutirse como concurso de leyes.

Recordad esto cuando penséis que el trabajo de juez es sencillo: en un supuesto de pluridad, primero tienes que diferenciar si es un concurso de leyes o de delitos. Luego, si es el segundo, diferenciar si es ideal, medial o real. Y si eliges ideal, asegúrate de que no es realmente medial.

Creo que es la labor más difícil del derecho penal. Y son estas cosas, con tantos matices, tan complejas e intricadas, que justifican nuestro trabajo.

Me gusta pensar en estas cosas cuando siento la tentación de cuñadear sobre sentencias que no me he leído.

This is not a political piece OR maybe it is. Nevertheless, the recent elections lead me to start thinking about what the world use to look like through the eyes of my children’s grandparents – when they were just kids – products of the 1950’s. 

As well-meaning as OUR parents were this is where most of today’s 50, 60 plus year-old Americans picked up the leftover beliefs of an era of ignorance on the behalf of white people feeling a sense of entitlement over another human being. 

Until this election I truly believed that WE were the last molds of the “Monstrous old white man” legacy in America that represented hatred and bigotry towards those of color. 

Here’s what I saw when I took a real��good hard look at the late 1940’s thru the early 1970’s when people still sat down at the kitchen table and ate dinner together while engaging in conversation about how their day went.

God forbid that you take a phone call at dinnertime because that would actually mean having to get up, walk to the phone, and sit down next to the phone because there was a cord attached to the wall.  Also, it was well-known and considered bad manners to call anyone or schedule anything during dinnertime. This was a time in history when parents weren’t afraid to tell their kids NO, or swat their ass for misbehaving.

According to inflation calculator, in 1955, a three-minute phone call from Los Angeles to Washington DC cost the equivalent of $17.63 today. Needless to say, electronic communication was limited due to the high cost. Thus, forcing us to look each other in the eye and speak in full sentences during a conversation.

Nevertheless, remember, I said, “Good hard look“, so let me continue… I found that the white man’s generational mindset during the 1950’s thru early 1970’s was based on a solid amount of fear and confusion. Fear that too much information, outside influences,  individual idealsism, and education would undermining their way of existence.

Young white boys listening to and adapting to their father’s discriminatory, racist rhetoric for which they dared not question nor disagree with in fear of retribution. A good father would beat, what he considered to be good solid work ethics into his boys with a leather belt if they didn’t understand or comply.

Any child who misbehaved in school was taken into the hallway (up to the mid 1970’s) and wacked on the butt with a wooden paddle (this was their cure for ADD). Most would get hit again (as punishment) when they got home by their God fearing, well-meaning parents.

Young girls throughout time had watched their mothers define themselves by how well the food was prepared and how clean their house was. Women were severely judged on how polished, pressed, and groomed their children were. God forbid that a girl have dreams beyond marrying the right man and (the illusion of) getting an education past high school.

We lived in a world full of well-meaning adults suppressing idealism – it was the father’s way or the highway. Higher education was considered mostly for the “Rich White Folk”. We oppressed Negros while encouraging the Hillbillies and White Trash (in their true ignorance) to persecute the Black man unlawfully while law enforcement and government looked the other way.

For which was a clear violation of simple human decency but the men in the pointy white hats didn’t give a shit about the law – for their hatred was deeper than any human walking the face of this earth.

  Now, imagine being a black person in the 1950’s and 60’s – imagine how humiliating it must have been walking up to a public bathroom or water fountain only to see a sign that read, “Blacks” – “Whites”.

Now let’s add insult to injury – the proud Black man having to answer his children’s question as to WHY the white people hated them so much.

Finally the Black people were tired of being treated as third class citizens and were rising up – creating problems – interfering with the white folks comfy lifestyles. Brave people, very brave people who actually stood up in protest some actually loosing their lives (both black and white) in order to pave the way for a better way of life so that ALL of could live harmoniously together as“Americans”, not defined by the color of our skin. Those people stepped outside the box and said, “Enough!”

Look at how far we’ve come just by taking a good hard look at ourselves in trying to justify these kinds of actions. This was all normal back then – this was the era that my father and my children’s father came from – our parent’s were those kids hanging around the card table on a Saturday evening listening to the rhetoric of racist conversations from “their” burbon breathing father’s.

Do not be fooled into thinking that the scars left on our society from over 60 years ago are gone from either the Black people or the White people. The open wound may have healed but the feelings in some can and will resurface from time to time especially if provoked. Like I said, it truly must have become a part of our DNA.

What really scared me is the self observation of my own actions during this election. I found myself falling into combative rhetoric with not Black people but those white adults for whom truly do not know any better. Mainly due to the richness of their culture continuing to feed off of the pain of another human being and this most certainly lye’s prevalent in their heads and hearts and is much alive today. Thank God for self awareness!

Nevertheless, I find it extremely easy to show compassion for the haters rather than for the leaders who actually do know better, and do understand exactly what they are doing. The leaders who are purposefully guiding these people in whatever direction they chose to take them for their own personal cause, gain or egostical fix.

So, what do we do? We peacefully move forward, doing whatever we can to protect not only our rights but those who are following in the footsteps of their fathers before them in fearing the unknown by demonstrating behaviors of hatred through ignorance.

We let go and let God do the rest – I promise, God never ever makes mistakes, but He will let us continue making the same mistakes over and over again if we insist on not opening our hearts and minds. In this case, it’s for the sake of  our Country’s Unity! 

We aren’t there yet but we’re getting closer every day  – with every conversation that is civil and non combative. Old habits die hard!

This is where patience, love, compassion, kindness, and understanding for all mankind will triumph further down the road. I think that Martin Luther King Jr. understood this concept quite well!
