Ex-Gov. Andrew Cuomo committed “medical malpractice” and publicly undercounted the total number of COVID-related nursing home deaths in New York during the worst period of the killer pandemic, a damning final investigative report released by a key House panel found.
The report from the Republican-led House Select Subcommittee on the Coronavirus Pandemic, released Monday, also concluded that Cuomo “likely gave false statements” about his role in pandemic decision-making.
That includes him actually being “directly involved” in the infamous March 2020 edict directing nursing homes to admit recovering COVID-19 patients — and downplaying pandemic-related deaths of residents in a July 2020 report, the House panel found.
In another finding, the report concluded that Cuomo “acted in a manner consistent with an attempt to inappropriately influence the testimony of a witness and obstruct the Select Subcommittee’s investigation,” referring to his contacts with former adviser James Malatras.
The House had previously released documents laying out the allegations about Cuomo and his administration’s actions — but the more-than 500-page final report paints a devastating picture of the three-term Democratic governor’s decisions that the subcommittee claims undermined public health.
Cuomo — who is weighing a political comeback run for mayor after resigning as governor in 2021 amid sexual misconduct accusations he denied — ripped the report as a partisan GOP witch hunt.
“This is the same weak gruel the MAGA Republicans on this committee have been peddling for months if not years,” said Cuomo spokesman Richard Azzopardi.
But Rep. Brad Wenstrup, an Ohio Republican who chaired the panel, said in the opening letter of the report that there was bipartisan consensus on numerous topics including “that former New York Governor Andrew Cuomo participated in medical malpractice and publicly covered up the total number of nursing home fatalities in New York.”
A more than 40-page section of the report focuses solely on Cuomo and the state government’s response to the pandemic. Cuomo’s name appears in the report 203 times.
Among the findings alleged in the report are that:
The Cuomo administration’s March 25, 2020 directive to admit or readmit recovering COVID-19 patients into nursing homes was “medical malpractice,” “antithetical to known science” and inconsistent with federal guidance — and the Executive Chamber “attempted to cover it up.”
Contrary to his denials during House testimony, Cuomo and his top aides and advisers were “directly Involved” in and approved the infamous directive, which was later rescinded following public outcry.
Cuomo administration officials testified that the governor ordered the controversial July 6, 2020 state Department of Health report — which was criticized for lowballing nursing home resident deaths from COVID — to combat criticism of the March 25 edict.
Cuomo was directly involved in editing the July report and directing people outside the government — such as Northwell Health CEO Michael Dowling and Greater NY Hospital CEO Kenneth Raske to review it. In a memo shortly before the report’s release and obtained by the House panel, Dowling offered to help “rewrite” it.
Cuomo’s executive chamber decided to remove “out-of-facility” fatalities — such as nursing home residents who died from COVID after falling ill and being transferred to hospitals — from the July report, thus dramatically reducing the total death toll.
The panel also concluded that “Mr. Andrew Cuomo Likely Gave False Statements to the Select Subcommittee in Violation of 18 U.S.C” — a federal crime that if proven could result in a sentence of five years in prison.
The committee in October said it had referred Cuomo’s “criminally false statements” to the US Department of Justice for potential prosecution.
Cuomo’s rep, Azzopardi, claimed the House was out to get “perceived political enemies.”
“From the very beginning this has been an abuse of power and a waste of taxpayer money aimed at punishing perceived political enemies – like Dr. [Anthony] Fauci [then Director of the National Institute of Infectious Diseases], Governor Cuomo and ‘the deep state’ – that does nothing to make us more prepared for the next pandemic,” he said.
He claimed federal data showed that New York ranked 39th in terms of per capita nursing home deaths in 2020.
“The DOJ -three times – the Manhattan DA and others looked at the nursing home issue and found no wrongdoing, while the meritless civil lawsuit launched by the very same people who have been working arm and arm with this committee was tossed out of court,” Azzopardi added.
Families of loved ones who were nursing home residents and died from COVID said Cuomo was finally being held to account.
“Cuomo has been lying about following the Trump CDC guidelines for years,” said Peter Arbeeny, whose father, Norman, died from the virus after being released from a Brooklyn nursing home.
“If the Cuomo administration would have followed the Trump [administration] CDC guidelines and also used the the USS Comfort ship and Javits Center [for more patients], thousands of lives would have been saved.”

By: Douglas Murray
Published: May 16, 2024
Remember when we were all told to “Mask up”? Well perhaps it’s time for us to change that rule. How about: “Mask off.”
It still astonishes me how many New Yorkers still scuttle around this city with their N95s clasped to their faces. Assistants in shops. Straphangers on the subway. Even people hurrying through the windy streets.
With some people I get it. A few have underlying health conditions — like morbid obesity. Or different-bodyness. Or whatever it is we’re allowed to call what we used to term “overweight.”
And sure some elderly folks now on their 9th boosters have decided to treat COVID as they once did the winter flu season.
But how to explain all the young people — particularly the young protestors — who seem to be so unnaturally scared of COVID?
How to explain all those rage-filled keffiyeh-wearing students who just happen to mask up whenever a camera is around?
Perhaps the students at Columbia and other campuses really do have a mortal fear of COVID.
In which case let me set their minds at rest.
New York State no longer has a COVID-19 problem. At the height of COVID, in the week ending April 11, 2020 the CDC reported that there were 6,900 total NY State COVID deaths that week. By last month the total was down to 15 deaths in a week.
What is more, young people are at the lowest risk of dying from COVID. Last year COVID was the eighth leading cause of death for young people in the United States.
According to the official data people aged 18-29 comprised just 0.7% of COVID-related deaths in the US. And that is from a group that makes up 16.4% of the total US population.
College-age Americans are more likely to die by homicide, suicide or being hit by a bus than they are through complications caused by COVID.
Even better news for the mask-wearers — NY State is one of the most vaccinated populations in the world. Fully 81% of NY State’s population is fully vaccinated. While a full 95% of the state’s population has gotten one dose of the vaccine or more.
So rejoice, oh brave protestors. The masks can come off!
And yet, with something like inevitability, there is one thing you can predict about protestors in New York today.
Which is that anytime that they are protesting they will be strangely scared of COVID. At the height of the BLM protests in 2020 you might say that there was some excuse for this.
There’s nothing like a fear of COVID to keep you cautious as you smash up a store.
Indeed I am sure that it was always perfectly natural that people swiping a set of sneakers for social justice would at the same time mask up to protect their respiratory system.
But why is that in 2024 today’s brave protestors in New York are nearly always wearing a mask?
Why should it be that the students making their demands for ceasefires in the Middle East and humanitarian aid at home have to holler their demands through a piece of cloth?
What is it about the outside trouble-makers who come onto this city’s campuses that makes them at one and the same time brave enough to cause disruption to students and citizens and yet terrible hypochondriacs over COVID?
Well I would like to suggest a reason. And it has nothing to do with CDC data, vaccination rates, COVID or anything similar.
The reason is that they are bullies. And like all bullies they are at the same time terrible cowards.
Despite pretending that they are world-beating revolutionaries the protestors who now push people in this city around are trying to keep their identities hidden.
Perhaps it is because they are professional agitators — drafted in by a range of left-wing “grass-roots” organizations to cause trouble. That is certainly what many people — including the police — believe.
Perhaps these people want to cover their faces because the media in this country might just notice that the same professional revolutionaries tend to turn up wherever there is trouble, almost as if they are paid to do so.
Presumably they want to keep their identities hidden as much as possible.
But what about the students at Columbia and elsewhere who want to sit in their tents and “bravely” protest about something they don’t know anything about?
Maybe, just maybe, they too are not actually afraid of COVID. What they are afraid of are the opinions they are espousing.
Because they know, at some level, that bullying other students and shrieking about things they don’t know about is not a good look. They want to intimidate people, but they never want to be intimidated themselves.
So I have a suggestion. At all future protests in New York State let’s have a masks off policy.
The KKK was the last organization in America that was so proud of their beliefs that their members covered their faces during protests.
Now “Students for Jihad” are doing the same job. For strangely similar reasons.
So let’s demand they take the hoods off too.
Sorry — I meant masks.
Shame of a canceled commencement
Talking of Columbia, yesterday morning I was invited to give an “alternative” Commencement address to students who have completed their studies.
Since the leadership at Columbia had canceled their official graduation ceremony, a number of faculty and student leaders arranged an alternative event for students and their families.
Attendees at the event in the city included students who had served in the US military, Jewish students, Christian students and conservative students. All from a bewildering variety of backgrounds.
We also heard from one of the students who had protected their campus when student radicals were trying to trash it earlier this year.
It was a great honor to speak with them all. And a great pleasure to give them a few words of advice as they set off on what I’m sure will be great and adventurous careers.
But what an indictment that students at Columbia who can actually think have to organize a graduation for themselves.
==
These privileged, entitled students at elite Ivy League colleges being paid for by their daddy want to agitate and roleplay as revolutionaries today, without negatively impacting their ability to work for a Fortune 500 company or get into a prestigious law firm tomorrow. They're fucking hypocrites.
You saw them as they were being arrested and their masks removed - many of them resisted and tried to hide their faces.

i can tell ive started letting my apartment/kitchen get bad again and it’s upsetting me but i feel paralyzed about it
one of my best friends is having a really tough time too and we keep messaging each other little check-ins even though neither of us have the capacity to really support or help the other person in any meaningful way
ive just been way too tapped out lately, and it has been affecting my health for quite awhile

another student had made me a little embroidered camera patch for my bag
im still very much thinking about applying to graduate/phd programs in the fall
there’s about 5 programs im interested in, but none of them are local so i’d have to move pretty far if i were accepted
im going to re-apply to university of denver for the MA emergent digital practices program
i applied to there in 2021 and was accepted but i wasn’t offered enough financial aid since i applied after the priority deadline so i’ll try it this fall and see what happens
im still dreaming about going to Brown for their digital writing/cross-disciplinary writing and art MFA but it's such a pipe dream
i also found a fascinating phd program at duke but they're not accepting applications this year?
i want to write and photograph more but by the end of the day i am so incredibly burnt out that it seems more like a chore than an outlet
i really wish there was a way for me to just quit my job and take some time off before going into another job
anyway therapy is back to once a week and sometimes 2x a week just depending on how well i handle things
my mom is still being the worst person ive ever met and im really trying to disconnect from her/the family as much as i can
