Although the Act does not define cruelty specifically, courts have construed it to entail both physical and psychological injury. Acts of aggression or abuse that result in physical harm to the spouse are referred to as physical cruelty. On the other side, behavior that results in severe psychological trauma, mental distress, or emotional agony that makes it intolerable for the spouse to stay in the marriage is referred to as mental cruelty.
Constant humiliation, unfounded allegations, erroneous suspicions, and refusal to enter into matrimonial relations are a few instances of mental cruelty. When assessing whether cruelty has occurred, the courts take into account the specifics of each case, the behavior of the parties, and the overall effect on the impacted spouse. Cruelty is defined as behavior that is so extreme that it prevents the victimized spouse from cohabiting with the other.

Hindu marriage are Rich in different rituals and ceremonies that differ region-wise and community-wise. Other conventional rituals include the Kanyadaan where the bride is handed over to the groom by the parents and Saptapadi where both husband and wife take seven steps holding a ring of fire indicating their commitment to each other. These ceremonies are full of religious overtones and are carried out with utmost seriousness, proving that marriage is a sacred contract that has god’s blessing.

Apart from the spiritual orientations, Hindu marriage also has social and relational perspectives. आपको बता दें कि उत्तर प्रदेश के मिर्जापुर निवासी सत्यम सिंह ने अपनी अलग हुई पत्नी स्मृति सिंह पर दूसरी शादी का आरोप लगाते हुए याचिका इलाहाबाद हाईकोर्ट में एक याचिका दायर की थी। सत्यम सिंह ने कोर्ट से मांग की थी कि उसकी अलग हुई पत्नी को सजा मिलनी चाहिए। इसके जवाब में स्मृति सिंह ने इन आरोपों को खारिज करने की जवाबी याचिका दायर की थी।
