‘From service to disqualification owing to Family Size and Service Rules’

Dismissed on 20.02.2024 in view of the Rule 24(4) of the Rajasthan Police Subordinate Service Rules, 1989, amended as Rajasthan Various Service Amendment Rules 2001.
Accordingly, a candidate is disqualified for appointment in Rajasthan Subordinate Police Service if the candidate is having more than 2 children after 01.06.2002.
Fact
The appellant an ex-serviceman, applied for the post of Police Constable in the Rajasthan Police on 25.05.2018.
His candidature was rejected on the ground that since he had more than two children after 01.06.2002, hence, he is disqualified for public employment under the State, as per the Rajasthan Various Service (Amendment) Rules, 2001.
The Rules 2001 provides that “no candidate shall be eligible for appointment to the service who has more than two children on or after 01.06.2002”.
Aggrieved by the disqualification order appellant approached the High Court of Judicature for Rajasthan. The Division Bench of the High Court vide its order dt.12.10.2022 turned down the prayer of the Appellant.
High Court turned down his claim on the ground that the case of the appellant falls within the realm of policy and his disqualification does not warrant any interference by the Court.
Submission of the Appellant
In addition to above Rules 2001, there are 109 sets of Statutory Service Rules, where the aforesaid eligibility condition has been introduced, but there are Rules regarding the absorption of ex-servicemen and in these Rules the condition of not having more than two children is not specified.
Observation of the Court
Apex Court referred similar case came before it in ‘Javed and others vs. State of Haryana and others, (2003) 8 SCC 369’ similar provision, was introduced as an eligibility condition to contest Panchayat elections, and this Court has upheld the disqualification.
The Court in the aforesaid case held that the classification, which disqualifies candidates for having more than two living children, was non-discriminatory and intra-vires the Constitution, since the objective behind the provision was to promote family planning.
Assuming the contention of the Appellant to be correct, we are of the view that such a plea does not advance the appellant’s case.
It is undisputed that the appellant applied for recruitment to the post of Constable in Rajasthan Police and recruitment of Constable is governed by the Rajasthan Police Subordinate Service Rules, 1989.
These 1989 Rules have been specifically enlisted at Serial No.104 of the Schedule appended to the 2001 Rules.
