Employers in the United States can hire foreign workers on H-1B visas to work as engineers, physicians, architects, software developers, and other speciality workers in the country. Families of H-1B workers may enter the United States with them on an H-4 visa. Under some conditions, spouses on an H-4 visa are allowed to work. Frequently, an eligible H-4 spouse already has another employment visa, such as an H1B or L-1, and must decide between the H4 work permission (H-4 EAD), an H-1B or an L1 visa, or neither. Which work visa option is preferable cannot be said with certainty because it much depends on the individual's unique situation for the best immigration lawyers in UAE.
Eligibility and Benefits
Only one of the following scenarios will qualify an H-4 spouse for an H-4 EAD: (i) the H-1B worker is the beneficiary of an I-140 petition that has been approved; or (ii) the H-1B worker has extended their H-1B status past the six-year limit in accordance with the American Competitiveness in the Twenty-First Century Act (AC21). Procedure
The Form I-765 and necessary and supporting evidence must be submitted by eligible spouses in order to apply for the H-4 EAD. The government has up to 90 days to process the application, after which the candidate can begin employment. Unrestricted employment, including self-employment and owning a business, is permitted under the H-4 EAD.
Lower cost: Applying for an H-4 EAD is far less expensive than doing so for an H-1B visa. The federal filing cost for an H-1B is substantially greater than the $410 charge for an H-4 EAD (Form I-765).
No annual cap: Unlike the H-1B visa, which has an annual limit (the ordinary cap for H-1B visas is 65,000, and the master's cap is 20,000), the H-4 EAD does not have an annual cap.
No minimum salary criterion: Unlike the H-1B programme, the H-4 EAD has no need for prevailing wages.
Unrestricted work: Unlike H-1B, which exclusively permits employment in specified "specialty occupations," the H-4 EAD allows for any type of employment. Full-time, part-time, and several employers are all permissible for those with H-4 EAD employment. It's also vital to remember that an H-4 EAD holder is permitted to operate both a company and to work for an employer.
Greater flexibility: The H-4 EAD permits greater flexibility when it comes to taking unpaid time off or terminating employment, for instance, in between projects.

To file a petition in premium processing, you need to complete Form I-907, which is called “Request for Premium Processing Service” as per instructions, attach respective fee and submit this form along with Form I-129 or I-140. If you don’t want to live in the US or do a CPT or Select, it may be very helpful to remain on an H4 visa, because you already have an H1B visa listed under the limit. Additionally, you can apply for an Employee Authorization Document (EAD) when you convert to H4 and then you can get a job thereby.
But, as we described above, this opportunity is not the best choice for you if you have the target to get a full-time job and an H1B opportunity. On the H4 visa, you’ll be less likely to be able to get a full-time job. There are also situations where H4 partners are not qualified to qualify for an EAD, and if you choose to operate in the states, review the H4 EAD eligibility criteria.
You may need to spend a great deal of time and money to find a job to get an H1B visa with this method.
Let’s assume you ‘re graduating in May, which implies the H1B limit is already ended in April — you’ll still have to wait until next April to apply for an H1B visa. You ‘d still have to wait until October to start functioning again. That is like a year of doing little or being constrained on what you will do in the U.S.

We suggest you don’t go for the hybrid option because it could get a little too difficult to go around. Although this is still an option, we believe it could be easier and less of a headache to choose to study with either an H4 or an F1 visa.
Therefore, we suggest that you work on an F1 visa if your target is to get a job and an H1B visa.
On the other side, if you’re a spouse and your wife is moving close to having the green card, you probably will apply for an H4 visa so charging in-state tuition payments for your assets would be far smoother.
Recognize that you are not qualified for in-state tuition fees on an F1 visa; you will be required to pay out-of-state tuition if you’ve not lived in the same state for at least one year, which would not be the case for most of you.

You would only be qualified for in-state tuition payments if you have been residing in one state, and only one, for at least one year. Your university will ask you to include proof of residency rules, such as filing state tax or a state driver’s license.

Coming Soon – Premium Processing For H-4 EAD
Many legal and eligible dependents on H4 EAD have endured unemployment, loss of pay and frustration due to the unending wait for their H4 EAD visas to come through. Processing delays, both for new petitioners as well as those seeking a renewal have waited for over 12 months to receive their approved employment authorization documents. To remedy the situation, the U.S. Department of Homeland Security (DHS) is rolling out the premium processing option for these applicants. Once finalized, H4 EAD applicants will have the option to expedite their EAD process and receive an adjudication within 15 business days.

Which Visa Categories Will Have Premium Processing?
According to the Continuing Appropriations Act, 2021 (CAA), the additional fees collected for premium processing can be used towards the following categories:
Form I-765, which is used to apply for employment authorization documents (EADs)
Form I-539 applications, which is used to apply for a change or extension of status for B1, B2 visitor visa holders, F1 student visa holders and dependents including H4, L2 and F2 students.
All employment-based non-immigrant petitions
All I-140 employment based green card petitions, including for the EB-1(c) category and for EB-2 national interest waivers (NIWs)

Premium Processing Fees Increased, Scope Widened To Include H4 EAD Applications
Premium Processing Fees & Timelines
Once DHS announces the dates for the premium processing to go live, the following parameters will be implemented regarding premium processing fees and processing timelines:
The premium processing fee for all I-765 applications will be under $1,750. Once approved, the EAD will be processed in under 30 days.
The premium processing fee for most I-539 applications pertaining to B1/B2 visitor visa extensions should not exceed $1,750. Once approved, the B2 visitor visa extension should be processed in under 30 days. Currently, B2 visitor visa extensions are severely delayed.
The premium processing fee for I-140 petitions filed for EB-1 and EB-2 NIW employment based green card applications will be $2,500, and the processing timelines will be within 45 days.

When Can You Start Premium Processing For H4 EAD Approvals?
While DHS intends to announce the premium processing option this month, September 2021, they have not released a definite date. Moreover, once USCIS issues the regulation, it will still take a few weeks before the changes go into effect. 
In the meantime, here are some ways you can expedite your H4 EAD application without using premium processing.
