FREE ERIC B #Freeericb Hip-hop musician Eric Barrier, currently an actor on the CBS series “Blue Bloods,” has been jailed in New Jersey since Oct. 28 on a warrant for failing to appear in court 17 years ago, his attorney said Tuesday. Barrier, 56, who was part of the legendary rap duo Eric B. & Rakim, became aware of a warrant for his arrest when questioned by state police in Vermont last month, according to the attorney, Patrick Toscano of Caldwell. Court records show Barrier pleaded guilty to aggravated assault and resisting arrest/eluding on Jan. 28, 2002 for an incident that occurred in Bergen County about a year earlier. A bench warrant was issued for his arrest after he failed to appear in court for sentencing on March 8, 2002, according to court documents. Barrier’s attorney at the time, Paul Bergrin of Nutley, told him “there was no need to appear on the sentencing date,” Toscano said in a letter to the court last week. Years later in an unrelated case, Bergrin was convicted of murder, cocaine trafficking, racketeering and other crimes. He is currently serving six life sentences at a “supermax” federal prison in Florence, Colorado, Toscano said. “Mr. Bergrin told Mr. Barrier that his case was ‘dismissed’ because he was accepted into PTI (pre-trial intervention),” Toscano wrote in the letter to Judge James Guida. “When Mr. Barrier asked Mr. Bergrin if he was sure of that, Mr. Bergrin advised him that he definitely did not need to appear, and that Mr. Bergrin would be in court on that date to handle everything for him,” the letter states. Barrier also said he received no notice from the court about his failure to appear. Toscano said Barrier came back to New Jersey, contacted an attorney about the warrant and has been in the Bergen County Jail since Oct. 28.
