Hello! I was thinking about you recently and realized your petalstofish account was gone, and I started to worry about you. Because that’s what I do. Maybe you said something about leaving your previous accounts and I missed it, that would be likely on my part. So I was thrilled when Dumbest Witch Alive showed up in my inbox and I found you here again! I hope you’re well!
Hi friend!! thank you so much for reaching out and for reading DWA!!!!I told @gryffindormischief last night that I genuinely threw up words onto paper and that’s the mess that came out lmao
Alsoooooo…I am so sorry for dropping off the face of the earth. I had mentioned only a couple of times that I was dealing with some health issues, but I never went into full detail, so I’m sure it looked odd when I just disappeared. 2023 was really hard year, and I stepped away from all social media except for my instagram for quite some time…but I’m really really excited to be back here and feeling more like Petals again. I missed everyone, and even in the year or so away, I knew eventually I would come back. I just didn’t want anyone to worry if I told them what was going on, so I figured a cold cut was easiest ♥️
Short story:
I was very ill, but I’m feeling SO much better!
Long Story:
Essentially, I had just moved back to Florida after being gone for four years in Arizona. When my old doctor in Florida saw me, they decided that the plaquinil treatments that I have been taking for my chronic illness for the last few years in Arizona had not been working. They decided to put me on this drug called methotrexate. It was chemotherapy in pill form, low dose, and it’s commonly used for people who have rheumatoid arthritis and lupus. My genetics love me so I have both RA and Lupus. So they thought it was a perfect match for me. It’s rare for people to have a super bad reaction to it, usually just fatigue and hair loss, but of course I managed to have like the worst reaction of all.
Due to multiple side effects, I ended up bed bound within a few days of starting my daily doses. During this time I could barely sit up and eat a meal. My mental health was plummeting anytime I allowed myself to have my phone in bed. I knew I had to do something else, before I totally crashed off the deep end. I would go on and see all my friends at Taylor’s era tour, and I’d had to sell my tickets. I was missing birthdays, movies, long planned trips with friends. I was SO lost in a way I can’t even begin to describe.
Even though my wonderful parents moved me in with them and got me a second opinion, by the time the new doctor got me off of the methotrexate and onto a new drug, it took another few months for my body to complete expel it from my system. So I was down for the count from March to October.
Thankfully, I’m feeling SOOO much better now and have a wonderful doctor who listens to me and never tells me my feelings aren’t valid. Once I had a better grasp mentally and physically, and I felt okay enough to start writing and reading and reviewing again, I decided to return to social media. Im actually super excited because I start physical therapy this week, which is a huge step, and I no longer need to use FMLA every week at work. Yay!
ALSOOOO not wholly related but some bot stole PetalsToFish SO HERE I AM WITH A NEW NAME. THANKS BOTS🤪
Xoxo
If u read all the way thru this I owe you an ice cream sundae

OK, so -- states (and cities in some cases) are given the ability to beef up their labor standards. My state has -- actually, too complicated. Let me choose some other labor issues that are simpler.
Two good examples of this aside from vacations. One is the minimum wage -- the federal has been $7.25 for pretty much as long as I can remember. Where I used to live it's $14. Where I live now, it's $15. (None of these approach a living wage in their locations, btw.) Another is medical leave -- at the federal level, there's a program called FMLA to let workers take unpaid medical leave without risking their job. At the state level, in MA most workers using FMLA can apply for the time to be paid, by the state. (Not me, but don't get me started.)
There was probably a time in my life where I thought that breaking it down by states was a good method, because it allows for states with different living conditions to handle things differently. But actually, letting states have that control mostly allows for states to more effectively oppress their marginalized populace.
Lots of ways to think about that. Think about how Florida laws have made it unsafe for trans people to even visit, right now, and how people are fleeing the state. Think about which states have the lowest wages and who lives there (Alabama, Georgia, Louisiana...). Think about how the official southern argument in the civil war was "states rights."
And you pretty much have to conclude, oh, this is literally a shit way to run a country.
One of the most personal, saddest things about living in America is the summertime.
There is 0 reason for American adults not to have a summer break. I can only say this with a full throat so loud, but other countries have policies and laws that give adults summertime.
It is not a joke to say France is kind of shutdown for August. There are over a dozen countries that have enough mandatory, legally required leave available to take an entire month off, or more. PLUS mandatory PAID holidays.
It's Brazil and Russia (ooh scary BRIC countries outgrowing the US and coming for us). India AND China give up to 2 weeks mandatory vacation leave, plus sick leave on top.
It's Afghanistan (20 days). It's Angola (22). It's Argentina(25) and Armenia (25) and Australia (20). It's Cambodia (technically unlimited; you can eventually get 15 or 17 days per month vacation).
That us on top of mandatory PAID public holidays. Cambodia can somehow manage 27 mandatory paid holidays plus upwards of 18 vacation days per year and going up from there, and we in the US can't even manage mandatory paid holidays.
We don't even get paid on Christmas and Memorial Day. And even trying to convince some people, let alone politicians, that everyone should get paid on Christmas is unfair to compare to pulling teeth.
Please. Please. I want to have a better life. I want you to have a better life.
I want you to not miss Summer Break. Because France and Cambodia don't.

Federal lawsuit claims CSX violated FMLA anti-retaliation provisions
A federal class action lawsuit alleges that Class 1 railroad CSX wrongly discouraged workers from taking leave under the Family Medical Leave Act and retaliated against workers who used the leave. Photo by CSX The complaint, filed last Tuesday in the U.S. District Court for the Middle District of Florida, alleges that CSX inflated the amount of time employees were charged for FMLA leave,…

Asking for help.
It’s not in my nature to reach out for help, but my little family has hit an incredibly rough patch these past few weeks.
We moved back to Tampa in December when my wife was fortunate enough to reapply for the job she left right before Wesley was born. It’s a live-on position at a college campus in Florida, which comes with a lot of stress and odd hours. Right as we were settling in and adjusting to the new routine with both of us as working parents, my wife suffered a freak accident that will impact her for the rest of her life.
As she was shaking food out of a small glass bowl into the trashcan, she caught the edge of the bowl on the metal lid. The bowl broke into two pieces, slicing through her finger. She immediately noticed that she couldn’t move her finger. Consequently, she severed two tendons, including her flexor tendon, in her right index finger. This is particularly terrifying because they explained to her that this area used to be referred to as “No Man’s Land” in the medical field, meaning that it was deemed useless to attempt fixing it. Before surgeries for finger injuries in this area advanced, some people would even choose to amputate the finger since it was essentially limp. Luckily, the trauma team at TGH connected her with a surgeon the very next day and gave her hope of movement again. She underwent surgery on 1/13 and eerily enough, was completely conscious throughout the procedure. This allowed her to move her finger before they finished the surgery to ensure she had the best possible shot at recovery.
Between the ER visit, surgery, and seemingly endless physical therapy visits, this has put us out significantly when it comes to finances. If anyone has a spare dollar or two, any little bit will help us as we move forward. My paypal is [email protected] and my Venmo is @Kyle-Oliveira-125
Though it’s still early, her biggest fear is already coming true - that she will never play the piano again. While we’re thankful she has received great care so far, she is on a long road to limited recovery. She has an innovative splint that allows her to do exercises without the fear of snapping her fixed flexor tendon, but the tendons were difficult to locate and damaged at each end. This required her surgeon to open up her finger far more than he originally anticipated, resulting in a large amount of scar tissue. She has been working nonstop since the injury, even hours after her surgery. She doesn’t qualify for FMLA yet, and her position is so unique that no one can fill in on her behalf. Right now, she is most heartbroken that she can’t pick up and hold our baby, and worries how this will impact her ability to care for Wesley in the future.

I would definitely love to take armor requests, like a greeting or dance, in exchange for any monetary gifts - just DM me and we can work out the details.

Trent Kellee Freeman, 38, who worked as a detective for the Gilchrist County Sheriff's Office, claimed she was hospitalized and forged doctors' notes, according to ABC Channel 20. Her boss, Gilchrist County Sheriff Bobby Schultz, told the station he was under the impression that Freeman was in a coma.
But Freeman was actually working at another full-time, private-sector job — which she applied for before submitting fraudulent Family Medical Leave Act (FMLA) paperwork to the sheriff's office.
Following an investigation by the Florida Department of Law Enforcement, Freeman was charged with two counts of uttering a forged instrument and one count of scheme to defraud.
According to Main Street Daily News, Freeman fraudulently solicited and received 219 sick leave hours from her colleagues, defrauding the sheriff's office out of $3,727.
“Obviously I’ve seen law enforcement officers get in trouble, (but) to this magnitude of what she did and how she took advantage of the goodness of her fellow employees is saddening,” Sheriff Schultz told Channel 20, adding that authorities will review cases Freeman handled as a deputy.

Sunday: First full day of re-entry
We took Christmas down and put it all away. Who decorates for January? If you do, I’d love to see some ideas. Specifically, I miss the twinkling Christmas lights since it is dark so early in the evenings in the Midwest. Without a fireplace, it’s nice to have some lights that add a little bit of cheer and cozy to so much darkness. In addition, I’d like to find a wreath (or two) for our front door (and porch door). What says January? Pine boughs and pinecones? Bonus, if you have links to anything.
I emailed each of my students individually to give them their class standing, remind them about a major assignment due tomorrow, and to try to create some connection with them in a fully virtual class that only runs three (intense) weeks. I also created a short video explaining an assignment, graded an assignment and made sure things were good to go to start the work week.
We attended virtual church, which is a lot of kid wrangling. We don’t force the kids to watch, but they either need to be quiet so we can listen/pay attention/participate, or find something to do in another room that is not disruptive. DH and I still spend more than 50% of the hour managing kids. At least in regular church, they could go to the nursery or their own kid classes, and DH and I could sit next to each other in mostly peaceful quiet. That said, we also couldn’t have attended a church in Florida so I guess it’s a toss up?
More laundry. Our new flannel sheets are on the bed. I think we did another four loads. It never ends. I’m so excited to crawl into bed tonight with cozy sheets!
The kids made taco soup (basically chili with corn and black beans). I created a menu plan for the week and grocery list. DH is out at the grocery store now.
DH did the Target Christmas returns (no small task) and took NB with him to buy him a pair of snow boots. NB has been asking to go in the snow, but despite two several pairs of hand me down boots we have at the house, none of them fit him—they’re all too small.
I listed some boots on Marketplace and sold one of two pairs. Pick up is scheduled for tomorrow.
I placed a Lands End order. I had ordered my mom a tote bag from there for Christmas, but it was HUGE. I am keeping that one, and ordering a new one for her in a smaller size.
It has been a collective effort working on getting short-term disability straightened out for DD. Her medical provider finally filled out the paperwork and Starbucks accepted it, but the doctor only wrote it for her hospitalization time and her in-patient program. Her therapist said she needed additional time before returning to work, but the therapist quit, and the doctor didn’t feel that DD needed more time or that DH needed FMLA to help care for her. She basically told me it wasn’t that big of a deal. Now I need to see if her GP will do paperwork for the remainder of the time she has been out of work. It’s never ending.
We opened gifts virtually with DH’s parents. My MIL asked me if I’ve lost weight. I basically checked out after that. DD commented on it later. Said it was “weird,” and she was clearly upset about it. I am too, but they’re in their 70s. They’re not changing. I have no idea how to navigate this, and I feel like if DH would have managed some of these things early on in our marriage that I wouldn’t be in this position. He is willing to step in now and say something, but again, they’re not going to change. I wish it didn’t bother me so much, but weight is very, very important to them. It’s such a different value system than I grew up with.

Here’s some more good election news.
Colorado also passed funding for service and housing for people experiencing homelessness, funding to address climate change, and FMLA leave.
Voters overwhelmingly approved Michigan Proposal 2. The referendum, put to the ballot by lawmakers, amends the state constitution to add "electronic data and electronic communications" to the state's search and seizure laws, thus requiring police to get a warrant for electronic data. The relevant part of the state's constitution will now read:
“The person, houses, papers, possessions, and electronic data and electronic communications of every person shall be secure from unreasonable searches and seizures. No warrant to search any place or to seize any person or things or to access electronic data or electronic communications shall issue without describing them, nor without probable cause, supported by oath or affirmation. The provisions of this section shall not be construed to bar from evidence in any criminal proceeding any narcotic drug, firearm, bomb, explosive or any other dangerous weapon, seized by a peace officer outside the curtilage of any dwelling house in this state.”
In Los Angeles County, George Gascon beat incumbent District Attorney Jackie Lacey 54 to 46 percent. Lacey was criticized by Black Lives Matter activists for failing to prosecute fatal police shootings. Gascon, the former San Francisco County district attorney, has promised to re-open investigations of police killings, focus on rehabilitation and drug treatment over incarceration, and not seek the death penalty. He will now be the chief prosecutor of the most populous county in America.
Austin, Texas, and Orlando, Florida elected two former defense attorneys to be their top prosecutors.
In Honolulu, Hawaii, a retired judge running on a reform platform was elected district attorney. The current Honolulu prosecutor is on paid leave amid an FBI investigation.
Cook County State Attorney Kim Foxx, one of the first reform candidates to take over a major prosecutor's office in 2016, easily won reelection.
Voters in Portland, Oregon, and Columbus, Ohio, approved ballot measures to create new police oversight panels by significant margins.
The race for New Orleans District Attorney will go to a run-off between two candidates who have both pledged to reform the office, although to differing degrees. The Orleans Parish District Attorney's Office became a high-priority target for criminal justice reformers after 12-year incumbent D.A. Leon Cannizzaro announced that he would not seek reelection. Cannizzaro's office is currently fighting an ACLU lawsuit over its practice of sending fake subpoenas to crime witnesses and victims. His office once used a habitual offender enhancement to get a man convicted of stealing a candy bar sentenced to 20 years to life in prison.
San Francisco voters overwhelmingly passed a measure to create a Sheriff's Department Oversight Board and an inspector general's office to review misconduct and in-custody deaths.
Virginia voters have approved a constitutional amendment creating a bipartisan redistricting commission. The panel will be made up of eight citizens and eight legislators, with an even split between Democrats and Republicans. If the group is deadlocked, the state Supreme Court would step in, as is the case now.
San Diego’s Measure B, which dissolves San Diego’s existing police review board and create a new Commission on Police Practices, easily passed. The measure requires the City Council to pass an ordinance detailing the rules by which the commission would operate. The charter amendment created by the measure provides a detailed framework, mandating that the commission and its outside investigators must investigate all police shootings and in-custody deaths.
The commission also would have the discretion to investigate a wide range of officer conduct, including complaints; use-of-force incidents resulting in serious injuries; dishonesty related to reporting, investigating or prosecuting crimes; and allegations of inappropriate sexual conduct, physical assault or domestic violence by officers.
Finally, the commission would have the discretion to investigate “an incident in which data shows a pattern of misconduct by any police officer or pattern of misconduct from policies, procedures, or practices of the Police Department.”
New Mexico will become the first state in the country in January to be entirely represented in the House of Representatives by women of color.
In the most expensive ballot initiative campaign in Massachusetts history, voters overwhelmingly approved Massachusetts Question 1, "Right to Repair Law" Vehicle Data Access Requirement Initiative. Voters in the state approved a similar right-to-repair ballot measure in 2012, but the ballot initiative closed a loophole that auto manufacturers had been using to skirt the requirements established by that earlier vote. Car manufacturers will be now required to provide vehicle diagnostic data to consumers and independent mechanic shops, including wirelessly transmitted data.
Far-right internet personality and Islamaphobe Laura Loomer was crushed in her attempt to unseat Rep. Lois Frankel (D–Fla.) in her deep blue South Florida district.
One other good thing, though it happened in June. Colorado passed SB- 27, which allows individuals whose rights are violated under the state constitution to bring a lawsuit for damages in state court, thus bypassing qualified immunity and preventing police officers from escaping liability for their misconduct. Additionally, under the law, officers found guilty of excessive use of force will have their certification permanently revoked. Courts will also be required to award attorney fees to plaintiffs that win their case.
i know all eyes are on the presidential candidates for this election, and rightfully so, but some very wonderful and important things are happening statewide that should be celebrated and highlighted, so here’s a few:
Florida passed Amendment 2, which will raise minimum wage to $15/hour by 2026
South Dakota, Montana, Arizona and New Jersey all passed an amendment that legalized marijuana
Utah will now be removing gendered language in the Utah Constitution and will replace it with gender-neutral language
California passed Prop 17, which restores voting rights to previously imprisoned citizens
Delaware elected the first ever openly trans state senator
Ritchie Torres and Mondaire Jones are the first ever openly gay black members of congress
Cori Bush is the first ever woman of color to win a seat in Congress in Missouri
Mauree Turner became the first non-binary state lawmaker in America and the first Muslim member of the Oklahoma state house
Oregon has become the first state to decriminalize all drugs (small amounts of cocaine, heroin, methamphetamine and other drugs will have lesser punishments, similar to traffic tickets, and no jail time.)
Kim Jackson is the first out LGBTQ+ state senator in Georgia
UPDATED WITH MORE GOOD NEWS:
Shevrin D. Jones is Florida’s first opnely LGBTQ+ state senator
Jabari Brisport became New York’s first gay Black member of the house
Arizona flipped blue for the first time in 24 years
Michele Rayner-Goolsby became the first Black LGBTQ woman in the Florida Legislature
Voters in Colorado overwhelmingly rejected Prop 115, a state ballot measure that would have banned abortions after a fetus reaches 22 weeks gestational age. In rejecting the initiative, Colorado remains one of the most progressive states in the country on reproductive rights
Arizona will now send two Democrats to the Senate for the first time since 1951, thanks to the win of ex-astronaut Captain Mark Kelly.
Democrats have flipped the senate seat in Colorado, with the win of former Gov. John Hickenlooper
Mississippi is removing the confederate flag from their symbology
Marie Newman, who has been titled ‘a leader of the pro-choice movement’, will now represent Illinois’ 3rd Congressional District in Congress
Nevada became the first state to protect same-sex marriage in it’s constitution
Immigrant rights activist and former public defender José Garza won the race for District Attorney of Travis County, Texas

We spent most of today cleaning. I doubt that we rival @that-girl-erin’s depth of cleanliness, but I took all the cushions off of our couch and vacuumed it. Then I took the couch apart and swept under it.
I deep cleaned the girls bedroom which was a mess. All three of them are messy. I had the kids wash the living, dining room, and kitchen floors once I had swept everything. I picked up Baby’s room. That leaves mine and H’s. I probably won’t get to his, but I’m sorting through nearly two years of foster care paperwork for NB that I was keeping in my closet so that will be thrown or filed depending on what it is. I need to scan a few documents first so that we can make changes to insurance and medical files. Once that’s done, I’m hoping to sweep and call it a day. I’m on my second of what’s shaping to be 4-5 loads of laundry.
Work is basically done for me. I’m so grateful! All of the major grading is complete. I’m waiting for exams to come rolling in, and then I will be calculating final grades and submitting them. Hopefully that will happen on Tuesday or Wednesday. I’m already prepping my J-term class, but not too much because enrollment is down so far and I don’t want to put the work in if the class isn’t going to be a go.
We scheduled the big van to have new tires installed on Tuesday. If I weren’t waiting on that, I’d probably have already gone to Florida. Ms. 6 has to work on Monday and Tuesday. Myself and two of the kids have dentist appointments this week too.
I’m trying to decide if if DH should return to work ASAP, or he should stay home on FMLA and then fly back from Florida for work at the end of this week and into next week. My other option would be to drive down with the kids solo. I feel like maybe I could do that but I’m not positive. DD will still be in her virtual PHP which means someone has to wrangle all the kids enough so that it’s not complete chaos in the car. I also could not drive straight through on my own so then I would have to figure out stopping and the potential COVID risk. I’m sure I will decide about two hours before heading out of town.

So I’ve actually had a pretty productive morning. I’m honestly not sure what time I woke up cause of the whole daylight savings thing and my stove saying one thing, then my phone saying another and then going out to get coffee and being like oh wait it is earlier (car clock), then coming back and seeing the stove and I was like wtf is going on and then I remembered😂😂
Okay so moving on, after weeks of letting the dishes pile, thank you depression, I finally got them done. I cleaned the bathroom and now I’m about to tackle the kitchen which shouldn’t take long. It’s mainly cardboard food boxes that need to be flattened and then sweep the floors and flip the couch cushions and clean off the living room chair as well.
My friend is coming over later to see the babies and I haven’t seen her in forever cause she’s in nursing school and I also flat out suck as a friend. So her coming over was motivation to get the cleaning done today. It had to happen before I left for Florida cause my Nana is coming over everyday to feed my cats but like I would have left this all til tomorrow at the last possible second 🙃.
Besides cleaning and hanging out with my friend I have to also do my diary card and fill out the forms for the partial programs cause tomorrow on my lunch hour I’m going to therapy and we’re going to go over them.
I’m so glad tomorrow is my last shift. I talked to my manager at my full time job yesterday about how when I come back I’m going to start group therapy twice a week so I’ll be coming in late a couple times and that I’ll probably need those FMLA forms when I get back. She was nice and understanding but did casually say “okay well just enjoy your vacation and we’ll see what happens when you get back, maybe you just need some time to unwind” so I smiled and said okay but I know what’s going to happen when I get back...

Because of this, employees seeking addiction treatment are protected from job loss under the Family Medical Leave Act (FMLA). When School is Closed
Tumblr media
Florida State University, caused a roar when they announced last month, via memo, that the school’s employees could no longer care for their children while they worked remotely (reinstating a pre-pandemic policy). The backlash across the nation was so swift and fierce that the university quickly redacted the statement, stating:  “We want to be clear—our policy does allow employees to work from home while caring for children”.
While that clarifies the policy for Florida State University, where does it leave everyone else? As most schools are just starting to announce their plans for fall, it leaves most employers in limbo when determining what kind of leave they are able to approve, and how flexible they need to be. We have had a taste of how difficult this situation will be this fall because many summer camps were unable to operate this summer. Summer camp, like schools, is a staple of childcare for most working families. The issue of how to now juggle childcare, and work, is a major one.
While we do not know exactly yet what schools will do this fall, and all schools will have different plans, it is safe to assume that we are not yet returning to the pre-pandemic school system. A Gallup survey  found that 54 percent of parents surveyed said their child’s remote learning has been difficult to manage. Parents often cited reasons such as short attentions pans in children, and lack of motivation. Further, in 700 company’s surveyed Gallup found that child care is one of the largest hurdles in preventing employees from returning to work. It also causes the most decrease in employee productivity.
The Department of Labor (DOL), has issued lengthy guidance about the emergency Family and Medical Leave Expansion Act (EFMLEA). It is suggested that Intermittent EFMLEA leave may be taken if the employer and employee can come to an agreement. Employees would need to submit documentation that their child’s place of care or school is closed, and the employer can use it to claim a tax credit.
Another option is FMLA leave, which is taken typically to deal with medical issues for family members. Previously parents of special needs children were able to use FMLA to attend school meetings, therapies, and medical appointments.  Parents who are able to show evidence of a child’s medical condition or disability that requires them to oversee remote schooling (beyond any entitlement under FFCRA), have this as an option.
Many organizations do not want their employees to have to exhaust their PTO to care for their kids. An unpaid leave of absence may be another option, although this results in an understaffed work environment and the employee is left without a paycheck. While many larger companies are providing resources to keep children engaged through virtual camps, daily challenges, or activities (the goal of these programs being entertained children will lead to focused employees), it is a band aid and not a solution. As well, many smaller companies do not have the ability to do this. The answer to what to come is still unsure, but decisions that companies are making right now will affect the entire labor market in the long haul.
Now more than ever is a time to be flexible and understanding with your employees. You must consider creative options to meet your business and employee’s needs. You may need to redefine goals, performance expectations as well and how you manage your employee’s performance.  How you handle this situation will effect employee retention, employee morale and company culture.

Miscarriage Reality: Are Women’s Rights Being Infringed Upon?
By Matthew Ginsberg, University of South Florida, Class of 2021
February 18, 2020
Tumblr media
There is nothing purer than the love a parent has for their child. When a woman discovers she is pregnant, soon-to-be parents have a new-found responsibility to commit their lives to providing for their baby on the way. And while many spouses are excited about the new journey they have created, not everybody is fortunate enough to complete the pregnancy with a healthy baby. That’s because an estimated 25% of pregnancies in the United States end in miscarriages, without any negligence or irresponsible behavior from the carrier.  When a woman discovers she has had a miscarriage, the emotional trauma can be absolutely devastating- questioning what could have gone wrong, mourning over the loss of a fetus. With the tragic news of a miscarriage typically coming as a surprise, spouses need time to grief before they can go back to their daily responsibilities- so why is it that there is no federal legislation enacted that would allow women paid time off after a miscarriage?
The “Family and Medical Leave Act” allows women unpaid time off for serious health conditions that may have resulted from a miscarriage. While a woman’s job may not be in jeopardy for taking time off, contingent upon her suffering from “serious health conditions,” critics believe this act “is insufficient and fails to consider the emotional ramifications, as well as the financial burden of not being compensated for the days or weeks off necessary to regroup.” Although it is typically acceptable for employees to get temporary paid leave of absence compensation to grieve over the loss of a loved one, employers are far less sympathetic when it comes to the loss of a fetus. That’s because under current federal law, “women do not qualify for maternity leave or paid leave if they have a miscarriage.” And while the “Equality Act” was passed in 2010 to help protect against discrimination of pregnant women, “forcing all employers to give women two weeks off for pregnancy- related sickness after a miscarriage,” critics argue that this act is outdated and fails to accommodate all women, who may be struggling to cope emotionally, but cannot afford to take unpaid time off. With nearly 70% of businesses owned by men and about 90% of lawmakers also male, it’s no coincidence that women are not being compensated or given adequate time off after the loss of their fetus.
The fact that nearly 1 in 4 pregnancies ends in a miscarriage signifies that women must work together to ensure that their rights are equally considered and respected- no matter the circumstance. Living in the 21st century, many assume that gender discrimination is no longer a prevalent issue. But statistical analysis verifies that “the majority of business owners and lawmakers are male,” signifying that the majority of the time, women must confide in a male boss to plea for the opportunity to get temporary paid leave; as if men could possibly understand the physical and emotional toll a mother undergoes after losing her fetus. While both spouses are definitely affected by the sudden loss of their future pride and joy, the federal government refuses to pass legislation that will help accommodate either gender. Fortunately, some large businesses have begun actively working to restructure their policies- to help ensure the rights of soon-to-be parents are protected. In mid- 2019, Reddit officially released their new policy, which “offers eight and a half weeks of fully paid leave for anyone who goes through a pregnancy loss- mother or father.” Reddit claims that their new policy will help encourage “building an inclusive environment where employees feel supported.” With major companies like Reddit restructuring their policies on paid time off after a miscarriage, will this start a domino effect on a state and national level?
New York passed updated legislation in 2019 that treats miscarriages the same as off-the-job injuries or illnesses. Their updated law on employer rights, gender, and pregnancy discrimination forces “employers to provide women who recently experienced a miscarriage weekly compensation for up to 26 weeks based on the patient’s specific health conditions.” And while employees are only qualified to earn half of their typical wages (and no more than $170 a week) it’s clear that New York’s updated policy is the first step in the right direction, even if it fails to consider other key factors, like women experiencing emotional heartache and pain. Since New York and Reddit updated their policies, other major companies like Yelp, Microsoft, and Adobe have also implemented new policies, which range anywhere from two weeks to unlimited paid time off after a miscarriage, based on the specific company’s rules and procedures. In December of 2019, California passed PDL laws (Pregnancy Disability Leave laws) which provide legal protection to any employee that is disabled and recovering from a miscarriage through financial compensation and 5-20 weeks off, dependent on the severity of the conditions. Through transitions in policies on a state and local level, as well as businesses restructuring their policies on paid leave after a miscarriage, it’s clear that progress is being made to help accommodate those who are suffering both physically and emotionally. But with such high rates of miscarriages annually, is the government doing enough to ensure that women’s rights are protected?
On a federal level, there have been no bills or federal programs implemented to help contest current policy on paid leave (or lack thereof) after a miscarriage. On the contrary, there have been several reported incidents where women felt threatened that they could lose their jobs for taking even a single week off to recover. NBC’s Nightly News reporter Kate Snow recently interviewed Angelica Gunn, who suffered from three miscarriages. Gunn, who was working as a receptionist at the time, stated that “my workplace sent flowers, but when I asked for a paid week off to recover, the company policy did not provide paid time off after a pregnancy loss.” With nearly 29% of women struggling with PTSD after such a traumatic experience, you would think that employers would be more considerate of women taking time off to make sure their health and well- being is prioritized. But rather than supporting Gunn’s request for a single week off, she explained that “I had to continue working because I had to feed my other child. It felt like I had to shut myself off to make everyone else feel happy. I felt like I didn’t matter.” Angelica Gunn represents one of many, who felt forced to return to work, without being given the opportunity to regroup and heal. While Gunn’s situation is symbolic to what so many soon-to-be mothers go through after a miscarriage, it seems counterproductive to expect somebody to be psychologically or physically able to immediately return to work after such excruciating circumstances. Employers’ may be hesitant because the financial burden of compensating an employee for an extensive period of time after a miscarriage may be disruptive and unfavorable, but disallowing even a single week of paid time off hinders the preservation of equality for all citizens. To help ensure that the rights of all people, regardless of race, gender, or ethnicity are protected, more legislation needs to be passed on a state and national level to accommodate all people suffering from the tragedy of a miscarriage.
