Frequently Asked Questions about Estate Planning
Question: What rights do I have to challenge an old trust document when a new will and an asset protection trust were completed but not signed? My grandfather has a very large estate.  He created a revocable trust and will in 2011. At that time I did not know he was my grandfather, so I was not included in his 2011 trust or will. We met in 2012 and he created a new will and an irrevocable trust in 2014 and was working on a new irrevocable trust and will in 2017. I sat in on several meetings with him pertaining to his estate planning documents and he openly discussed the contents and what he wanted to happen in his new estate plan, including naming new beneficiaries, naming a new trustee and new attorney-in-fact for his power of attorney, and naming a new health care agent for his advance medical directive. But for some reason, unknown to anyone in the family, these 2017 documents were never signed. Now that my grandfather has died, is it cut and dry where if the new estate planning documents were never signed, then I have no case?

Answer by Evan Farr: Unfortunately, it is pretty cut and dry. Any estate planning documents that were completed but not signed have no legal meaning. The law presumes that if someone did not sign a legal document, that it was intended that they did not want to sign it. There are some rare exceptions to this rule, such as holographic wills which are entirely in someone’s own handwriting, and an even rarer exception that allows death bed verbal wills, but it does not sound like any of these exceptions apply to your situation.
