"Former president Donald Trump and 18 others were criminally charged in Georgia on Monday in connection with efforts to overturn Joe Biden’s 2020 victory in the state, according to an indictment made public late Monday night [on August 14, 2023].

Trump was charged with 13 counts, including violating the state’s racketeering act, soliciting a public officer to violate their oath, conspiring to impersonate a public officer, conspiring to commit forgery in the first degree and conspiring to file false documents.

The Recap

The historic indictment, the fourth to implicate the former president, follows a 2½-year investigation by Fulton County District Attorney Fani T. Willis (D). The probe was launched after audio leaked from a January 2021 phone call during which Trump urged Georgia Secretary of State Brad Raffensperger (R) to question the validity of thousands of ballots, especially in the heavily Democratic Atlanta area, and said he wanted to “find” the votes to erase his 2020 loss in the state.

Willis’s investigation quickly expanded to other alleged efforts by Trumpor his supporters, including trying to thwart the electoral college process, harassing election workers, spreading false information about the voting process in Georgia and compromising election equipment in a rural county. Trump has long decried the Georgia investigation as a “political witch hunt,” defending his calls to Raffensperger and others as “perfect.”

The Details

“Trump and the other Defendants charged in this Indictment refused to accept that Trump lost, and they knowingly and willfully joined a conspiracy to unlawfully change the outcome of the election in favor of Trump,” the indictment states.

A total of 41 charges are brought against 19 defendants in the 98-page indictment. Not all face the same counts, but all have been charged with violating the Georgia Racketeer Influenced and Corrupt Organizations Act. Willis said she has given those charged until Aug. 25 to surrender.

Among those charged are Rudy Giuliani, the former New York mayor who served as Trump’s personal attorney after the election; Trump’s former White House chief of staff Mark Meadows; and several Trump advisers, including attorneys John Eastman, Sidney Powell and Kenneth Chesebro...

Prosecutors brought charges around five subject areas: false statements by Trump allies, including Giuliani, to the Georgia legislature; the breach of voting data in Coffee County; calls Trump made to state officials, including Raffensperger, seeking to overturn Biden’s victory; the harassment of election workers; and the creation of a slate of alternate electors to undermine the legitimate vote. Those charged in the case were implicated in certain parts of what prosecutors presented as a larger enterprise to undermine the election."

Fulton County District Attorney Fani Willis is expected to seek charges against more than a dozen individuals when her team presents its case before a grand jury next week. Several individuals involved in the voting systems breach in Coffee County are among those who may face charges in the sprawling criminal probe.

Investigators in the Georgia criminal probe have long suspected the breach was not an organic effort sprung from sympathetic Trump supporters in rural and heavily Republican Coffee County – a county Trump won by nearly 70% of the vote. They have gathered evidence indicating it was a top-down push by Trump’s team to access sensitive voting software, according to people familiar with the situation.

Trump allies attempted to access voting systems after the 2020 election as part of the broader push to produce evidence that could back up the former president’s baseless claims of widespread fraud.

Another of Trump’s lawyers has pleaded guilty to charges as part of a cooperation agreement with the Fulton County, Georgia, district attorney’s office. This morning, Jenna Ellis pleaded guilty to aiding and abetting false statements and writings as part of the plan to overturn the results of the 2020 presidential election. She is the fourth of the 19 people charged in the Georgia racketeering case to plead guilty.   

In late September, bail bondsman Scott Hall, who helped to breach voting equipment and data in Coffee County, Georgia, pleaded guilty; lawyers Sidney Powell and Kenneth Chesebro pleaded guilty last week. 

Ellis opposed Trump’s 2016 nomination but supported him after his election in frequent television appearances as a “constitutional law attorney” although she had not worked on election law. After Trump saw her on the Fox News Channel, Ellis became a “senior legal advisor” to Trump’s reelection campaign. 

After he lost, she was a very visible television spokesperson for the Big Lie that the election was stolen. On November 19, 2020, she joined Trump lawyers Rudy Giuliani and Sidney Powell at the headquarters of the Republican National Committee to insist that Democrats had rigged the voting in majority-Black cities and that communist forces in Venezuela had tampered with U.S. voting machines. She also peppered her social media feed with MAGA statements, mixing it up with anti-Trump figures, making her a more public figure than the other lawyers.

Nonetheless, Trump declined to cover her legal fees after her indictment as a co-defendant in the Georgia racketeering case, possibly because she had supported Florida governor Ron DeSantis’s presidential bid. While Ellis said she had stopped supporting the former president because of his “narcissistic” tendencies, she continued to echo Trump’s rhetoric. In September she raised more than $216,000 for her legal defense fund from crowdfunding, claiming she was fighting “a weaponized government and the criminalization of the practice of law.” 

Today, in a court of law rather than in front of the television cameras, she sounded quite different.

“As an attorney who is also a Christian, I take my responsibilities as a lawyer very seriously, and I endeavor to be a person of sound moral and ethical character in all of my dealings,” a tearful Ellis told the court. “I relied on others, including lawyers with many more years experience than I, to provide me with true and reliable information.” (Ellis worked closely with older Trump lawyer Giuliani; she will be 39 on November 1.) 

“If I knew then what I know now, I would have declined to represent Donald Trump in these post-election challenges,” Ellis said in court. “I look back on this whole experience with deep remorse. For those failures of mine, your honor, I have taken responsibility already before the Colorado bar, who censured me, and I now take responsibility before this court and apologize to the people of Georgia.”

Ellis’s plea agreement spelled out the statements she made that were lies. As legal analyst Joyce White Vance explained in Civil Discourse, this means the court has identified the specific lies that made up the Big Lie that the 2020 presidential election was stolen, and that Ellis will testify that they are lies. Those claims include the lie that there were 96,000 fraudulent mail-in ballots, that 2,506 felons voted illegally, that 66,248 underage people illegally registered to vote, that 2,423 unregistered people voted, that more than 10,000 dead people voted, that Fulton County election workers counted ballots with no oversight. 

In the civil case in New York in which Trump, his older sons, two employees, and the Trump Organization are on trial for fraud, Trump’s former lawyer and fixer Michael Cohen testified today that he and the former chief financial officer of the Trump Organization, Allen Weisselberg, would reverse engineer Trump’s financial statements to meet whatever number Trump wanted. 

His testimony suggested that the alleged massive fortune on which Trump based his identity, as well as his presidential bid, was an illusion.

In a series of motions filed overnight, Trump’s defense team appears to be throwing anything it can at the wall to challenge the election conspiracy case in Washington, D.C.

But as Trump’s legal peril escalates, Republicans in the House of Representatives continue to reject any House speaker who does not embrace Trump. Representative Marjorie Taylor Greene (R-GA) today said, “We need a speaker of the House that reflects the values and the views of Republican voters across the country, and they support President Trump and they support his agenda.” Representative Troy Nehls (R-TX) suggested nominating Trump himself for the job.  

CNN’s Jake Tapper has had enough. “I'm covering life and death issues, serious tragedies, serious momentous occurrences here in Israel and of course in Gaza,” he said today. But, he said, “We have to interrupt this for one moment to cover the complete and utter clown car that is the House Republicans' Speaker's race.”

House Republicans today selected Representative Tom Emmer (R-MN) as their choice for the post, only to have him drop out of the race after Trump, apparently angry that Emmer had dodged a question about whether he supported Trump’s nomination for president, turned on him. 

Trump went on social media to call Emmer, whose work in Congress has earned him a 79% lifetime approval rating from the right-wing Heritage Action for America, a “Globalist RINO,” meaning “Republican In Name Only.” Trump warned that Emmer “never respected the Power of a Trump Endorsement, or the breadth and scope of MAGA…. I believe he has now learned his lesson, because he is saying that he is Pro-Trump all the way, but who can ever be sure? Has he only changed because that’s what it takes to win?”

Trump ally Ohio Representative Jim Jordan’s failure to win the speakership even after threatening his colleagues showed that Trump cannot put his chosen candidate into the chair, but Emmer’s failure to win the speakership suggests Trump’s opposition can keep a candidate out of it.

Just hours after Emmer dropped out, the House Republican conference threw up a fourth candidate for speaker: Representative Mike Johnson of Louisiana. Johnson is a self-described Christian and staunch Trump ally. He defended the former president during both of his impeachment trials and fought for Texas v. Pennsylvania, the key lawsuit contesting the results of the 2020 presidential election (the Supreme Court decided that Texas did not have standing to sue). He voted against certifying the 2020 election results.

Johnson won the conference’s nomination with 128 votes to 29 votes for Representative Byron Donalds of Florida, who only entered Congress in 2021. In an interesting sign that Republicans might be reconsidering their rejection of former speaker Kevin McCarthy (R-CA) three weeks ago, 43 Republicans voted for him even though he was not standing for the position. Johnson told reporters he expects a floor vote at noon tomorrow.

House minority leader Hakeem Jeffries (D-NY) has offered a bipartisan deal in which Democrats would help Republicans elect a speaker. In exchange for their help, Democrats have said they want a candidate who is not an election denier and who agrees to hold up-or-down votes for bills that have broad support across the parties. Such a deal would mean some security for future elections. It would also mean that a measure funding Ukraine, which is popular across Congress but which the extremists oppose, would get a hearing. 

So would funding the government.

An examination by the Washington Post shows that Powell, a former Trump lawyer, helped organize the alleged breach in rural Coffee County and paid for the operation through her nonprofit, which at the time listed Michael Flynn among its directors, and the team she directed allegedly copied data from voting machines that have been misrepresented as "proof" of the former president's election fraud lies.

The Kabbalah of Writing: Chapter Two Writing Exercises

As a Jewish writer, I've been wanting to explore more about how to connect my writing to my spiritual and religious practices. As a first step towards this, once a week I will be responding to each of the writing exercises provided in Sherri Mandell's The Kabbalah of Writing. For the sake of being careful of copyright, I will not be posting the questions themselves. I encourage fellow Jewish writers to follow along.

The remodel is finally closing in on its final days, so we've started putting our belongings back into the new kitchen cabinets. This gave me the opportunity to unearth the boxes of my kitchen supplies from my old apartment, which I hadn't seen in almost a year. I gently removed each item, considered whether to keep it, and either re-homed it into its rightful spot in the kitchen or an extra moving box, to be given away. The simple act acknowledged the space as part of our home again, as no longer separate and forbidden.

I marched along underneath the dripping wet evergreens, a rhythmic thump and squelch of wet pine needles resounding from every step. Birds faintly chattered while the din of traffic droned on in the distance and planes rushed by overhead. This little segment of forest, filled with sword ferns and salal, is the farthest from civilization one is likely to get in the county. The trail was filled with the smell of decomposing leaves and ripening blackberries. Fresh, baby-green sprouts of new salal plants budded from the ground alongside purple and yellow wildflowers, huckleberry bushes unseasonably full of ripe fruit, and the occasional European slug.

I carve out a tiny portion of our newly renovated kitchen to serve as a hub for coffee and tea. A portion of myself spread out across a narrow cabinet and shallow drawers, I hoard supplies alongside the beans and leaves themselves. The flavors likely seep into each other - I don't properly store them in separate, airtight tins like you're supposed to - but that's alright. They still taste beautiful.

My body did not allow me to shower last night. I wanted to, desperately. I wanted to wipe off the grime and dried sweat from the day that had passed, to brush the food and plaque from my teeth, but my body would not allow it. Instead, I lay curled over my sheets, doom scrolling through YouTube as headline news items poked my mind from all sides. I could not shower last night and today, I am exhausted. I am distracted and dirty. I want to break through the physical barrier of depression, to breach my head above the waterline of the lake drowning me, but it's difficult with the seaweed curling around my legs and wrenching me downward, down down down into quietness and stillness and understimulation.

COVID-19 is not over. Not for me, not for anyone else who is disabled, not for anyone properly paying attention. COVID-19 is not over, but my town treats life as if it is, breathing into each others' faces and gathering in crowds, encouraging tourists to visit our mediocre-at-best bakery we're somehow famous for. COVID-19 is not over, but I have to pretend it is, despite the severe danger to my health, because otherwise I wouldn't be allowed to participate in community theater or eat with my family. I religiously cover my face, wash my hands, switch out my filters and while I've never gotten sick, it's only a matter of time, and G-d knows how my body will respond (or if I'll survive the encounter).

The most recent time I felt shame was when I had to leave a job over how it was impacting one of my disabilities. I was in my first year of graduate school and couldn't walk without the assistance of forearm crutches from how intensely I felt pain along my spine and in my legs. We still don't know why I was in so much pain. About halfway through the quarter, my pain became so overwhelming that it was no longer safe for me to drive, so I had to transition to online learning and quit my job, since it could not be done remotely. I couldn't give proper warning, nor could I accept the offer my supervisors extended to me to come back later, since I was unsure if or whether my status would improve. It was suffocating. I was living alone in a one-bedroom apartment, unable to care for myself properly, unable to cross a room without a cane. I'd been a captain of my undergraduate color guard team for three years. This felt like my body betraying me. To my former supervisor: I'm so sorry I couldn't give you proper warning. I know it was unprofessional and I know it made your job and the jobs of my peers more difficult. Thank you for being patient and understanding and extending olive branches to me even when you didn't have to. I wish I could have stayed, because I truly enjoyed that position, but my health would only decline over the course of that year. I don't have much else to say, other than I'm sorry. I hope you're doing well. To my shame: I promise you things get better. Your terrible partner breaks up with you, setting you free. You grow roots back in your home town. Your pain improves, although no one is sure why. It is not your fault that your body broke down the way it did, and it's not your fault that you had to leave your job. You did what you could and you were responsible. Thank you for reminding me of what is important, but it's time to let go now. What's happened has happened and it's okay now. From my shame: You were inconsiderate of others in placing your needs above the needs of the whole. Was it really that necessary to leave so suddenly? I have my doubts. We needed to hide after what you did. We still need to hide. You left a mess in your wake and ignored efforts to care for it. I'm not ready to be left behind.

It takes a lot to make me truly angry. Annoyed? Sure, I feel that frequently. But red-hot, fuming angry? That's uncommon. I think what really gets me is when others display a blatant disregard for the health, safety, and wellbeing of those around them. A driver swerving between lanes, a parent ignoring their sobbing child, someone smoking at a bus stop. These examples may not be comparable to each other, but the underlying theme is. In these types of situations, I feel upset for my own sake, but more so I feel upset for others around me also impacted by reckless or damaging behavior. I don't often have the chance to do something about these situations - not that I would have the bravery to approach a stranger about their behavior in the first place - so I'm usually not able to do anything about it or enact change, and that irks me.

I don't use the name my parents gave me. It felt too feminine, enclosing, like it was a sentencing for something that wasn't me. My name is androgynous and fairly uncommon, since it's an unusual shortening of many common names. I won't share much information about my name because I don't want to connect my real name to this account, but it feels like home.

I wish I knew more about boating and being on the water. I live near an environment rich with marine life (human and otherwise), but I rarely have the chance to get out on the water because my family doesn't own a boat and can't afford one. I like the idea of knowing more about space and astrophysics, but I think the reality of learning about those things isn't quite as magical as we often make them out to be, so I'm not sure I'll really learn about them. I'd also love to learn how to use an espresso machine and use syrups to make drinks, because I'm so terrible at it and I feel like it would be easier to write cafe scenes if I knew more about what was going on behind the counter.

I wouldn't say inspiration has played as much a role in my life as spontaneity has. I frequently experience spontaneous desires to do an activity or try something new, which often leads to interesting and well-worth-it places, but inspiration hasn't made as frequent of an appearance in my life.

My favorite quote, which has gotten me through a lot, is "Don't cry because it's over, smile because it happened," by Dr. Seuss.

I don't dream often, so I'll answer this prompt focusing on a repeating nightmare from my childhood instead. I tend to think of it as a stress dream, because sometimes it will reappear when I'm under significant amounts of stress. The dream begins on an empty suburb street, entirely gray, with perfectly identical manicured lawns and porches and no cars in the driveways. A small girl will knock on one of the front doors, holding a perfect little flower in one of her hands. When the door opens, the scene switches to color as bright, writhing, bloody, uncontrollably pounding viscera seethe across the entire view of the scene. These scenes repeat over and over again for the entire night, or until I wake up. I interpret this now as a symbol for my discomfort with lack of control and fear of the trauma and violence inherent in portions of my home life. I don't think there's much more that can be explored in that dream, to be honest.

..."On Monday, ABC News and The Washington Post published footage of the proffer sessions, which showed the four defendants who pleaded guilty being questioned by prosecutors about their involvement in various efforts to overturn the 2020 election results.

Prosecutors said the footage was turned over to the remaining defendants as part of discovery, urging the court to impose restrictions on how the defendants can disclose the materials.

“The release of these confidential video recordings is clearly intended to intimidate witnesses in this case, subjecting them to harassment and threats prior to trial, constitutes indirect communication about the facts of this case with codefendants and witnesses, and obstructs the administration of justice, in violation of the conditions of release imposed on each defendant,” prosecutors wrote in their motion.

To prevent further disclosure, prosecutors said they will not provide videos of any proffer sessions to defendants moving forward.

“Instead, defendants must come to the District Attorney’s Office to view confidential video recordings of proffers. They may take notes, but they will be prohibited from creating any recordings or reproductions,” prosecutors wrote in the filing.

Fulton County District Attorney Fani Willis (D) charged former President Trump and 18 others in a sprawling racketeering indictment that accuses each of them of conspiring to unlawfully keep Trump in power following the 2020 election.

Four of the 19 defendants have since taken plea deals, including three Trump-aligned attorneys: Sidney Powell, Jenna Ellis and Kenneth Chesebro. Bail bondsman Scott Hall, who was charged over an elections office breach in Coffee County, Ga., also took a deal.

As part of their agreements, each sat down with prosecutors in a recorded session to discuss the facts of the case. They also agreed to testify truthfully against the remaining co-defendants, who all pleaded not guilty."
