Hi, I am interested in people's views of the following: A friends daughter is 17 and last Friday passed her driving test to much family celebration. She went out driving to see her friends, grandparents, and to get some experience. She is still on Provisional Insurance as the call hadn't been made to change the insurance, mum and dad were just moving money about so they can pay. The Police say she wasn't speeding just lacked experience and was taken by surprise on the road in question in the rain. So the questions for them are: 1. What is the legal position? Neither parent is concerned about making an insurance claim or anything like that. It was one of those awful moments in life and they are not interested in the value of the car just the welfare of the girls. 2. What does she have to present to the Police - I think they said that she would have to present her licence? 3. Do the parents have to tell the insurance company if they don't intend to claim? They are very honest people but don't want to do anything that would unnecessarily impact their daughters ability to move forward. 4. What should they do going forward with her? In 2008 I had insurance in California, through my employer. I got laid off in June, but was on COBRA in Sept. 2008, when Blue Cross authorized me for gastric bypass surgery. Yesterday (Dec 23 09) I had to go to the ER due to abdominal pain that turned out to be a complication of the 2008 gastric bypass. Last night I had a CT scan and emergency surgery to correct the problem. Blue Cross rejected the claim, which of course makes sense and pushing it through was just a formality anyway. But today I wondered if, since the procedure was covered originally, would surgery to correct a complication be covered by law even if my insurance lapsed? I know I'm grasping at straws here, but it seems like it might be worth a consultation with an attorney to find out. I think this surgery is going to run to $40K or more. It was a simple laproscopic procedure, but y'know nothing's cheap. The original bypass was billed to Blue Cross at $38K. Drug Rehabs and Their Backdoor Dealers
Some drug and alcohol treatment centers are good places, but others see a person who has an addiction as a payday. Amid the growing opioid crisis, drug rehabs and sober living homes are being developed by the thousands with little to no regulations stopping these unlicensed and unregulated homes the nations addicts are clinging to for recovery.
The first step for the centers: recruiting clients who have good health insurance, then sending kickbacks to those who have gotten the center the referral. Rehab operators have admitted that they know it is wrong to offer money to middlemen in exchange for well-insured patients, but that the practice is so omnipresent that they would have no patients if they stuck to the high ground.
This all sounds so completely unethical right? Yet a bill to forbid and punish such patient brokering, SB 636 by Senator Steven Bradford, a Democrat from Gardena, has been sitting in the California senate since February of 2017 with no hearings currently scheduled.
“Who would be for patient brokering? Why would they kill that bill?” asked an exasperated Michael Cartwright, chief executive of American Addiction Centers, one of the nation’s largest for-profit, publicly traded treatment chains. “That makes absolutely no sense. We are 100 percent in favor of that bill.”
Although the bill is not completely dead, but it is stagnated, and it illustrates the difficulty in making changes for the recovery business. Even when most everyone agrees change is urgently needed. The Southern California News Group recently investigated the addiction industry and found it peppered with financial abuses that bleed untold millions from public and private pockets, can upend neighborhoods and often fails to set addicts on a path to sobriety. The revolving door between detox centers, treatment facilities, sober living homes and back again generates huge money for operators who know how to game the system.
Although it is known to operators who practice human brokerage to be unethical, they are at the mercy of the addicts, and supply and demand. To put their nerves at ease, it is common that they still have one interventionalist put on retainer for a certain amount each month, may it be $5,000 or $10,000. Regardless how many patients they refer to the center, which pushes the unethical into the “gray zone”.
And Addicts have in turn taken notice. They start to see their insurance cards as credit cards, demanding better food, cell phones and even cash at times from providers in exchange for remaining in treatment. If the treatment center doesn’t deliver, the patient walks, and find another treatment center who will.
Many private insurance plans reimburse their enrollees, the patient, for treatment. They are given a check in hand which can be for tens of thousands of dollars, that is meant to be forwarded to the treatment provider. This obviously doesn’t always happen. Direct payment to a person in recovery is a horrible idea because they are so overwhelmed by the amount and it often leads to overdosing and death. It takes a long time for an addict’s brain to be repaired, direct payment to individuals to those in early recovery can have dramatic impacts. 27 other states agree and have banned insurance payments directly being sent to those in addiction recovery.
In the proposed SBS 636 is the first bill in CA, its written to address the rampant selling of patients. With SBS 636 would make patient brokering a misdemeanor with a $2,500 fine, as well as possible revocation of suspension of facility licenses and professional certifications. Out of Network treatment providers would be able to collect payments instead from insurance companies.
A similar bill was put into effect in Florida, the only state in the US who has more addiction treatment facilities than California. But in Florida the bill has made payment for patients a third degree felony punishable by up to five years in prison.
Others are asking for the California law to be as strict, Jerrod Menz, Co-founder of American Addiction Centers says “Tighten the law, Make it as strict as you want – $25K and a felony. If you’re marketing against these brokers getting $5K, $8K, 10K a patient, it creates such an un-level playing field. Anyone spending that kind of money is not leaving much for treatment.”
It is important to be aware of the type of facility you are committing yourself to before you attend treatment there. Sadly, with a growing market there will always be vultures and not everyone in health care will have your best interest at heart.

The Abstract Works of Tomashi Jackson & Mark Bradford

Abstract art has traditionally been a genre that refutes or denies political expression, but artists Mark Bradford and Tomashi Jackson implement what Bradford calls “social abstraction” — not abstraction that is inward looking but “abstraction that [looks] out at the social and political landscape” (Tomkins, Jenkins). By giving value to materials of every day life in the inner city and employing the formalist and intuitive nature of abstraction, Bradford and Jackson present a complex visual representation of race and socioeconomics for people of color in the United States.
Born and raised in South Los Angeles, Mark Bradford grew up with a single mother who owned a beauty salon in an all-black neighborhood until he was 11, when they moved to an all-white neighborhood. Bradford’s art practice goes back to childhood but he insists, “it’s not an art background. It’s a making background” of growing up around other makers and working in his mother’s salon after high school (Art21). From early on, he used the materials found around the salon such as the paper rectangles used for permanents, bobby pins, and hair dyes— effectively engaging the discarded materials of urban life in the inner city. His process continued when he began scavenging neighborhood ad posters to use as paper pulp material. While collecting materials, Bradford is thinking “about all the white noise out there in the streets: all the beepers and blaring culture—cell phones, amps, chromed-out wheels, and synthesizers. I pick up a lot of that energy in my work, from the posters, which act as memory of things pasted and things past. You can peel away the layers of papers and it’s like reading the streets through signs” (The Broad). Over time, Bradford’s deeply layered materials transformed his abstract work into complex visuals of race, class, and orientation; today his art practice has grown to include video, installation, and photography in addition to his work in printmaking and collage.
Bradford’s mixed media painting, Scorched Earth (2006), was created after researching the Tulsa race riot of 1921—one of the wealthiest black communities in the United States that was burnt to the ground after a white mob started attacking African-American residents and businesses. The painting is made from billboard paper, photomechanical reproductions, acrylic gel medium, carbon paper, acrylic paint, and bleach on canvas to resemble an aerial map of a location that has been blacked out, a topography of ruins. The Broad gallery which houses the painting adds that “the blackness of this land mass resonates on many levels: black as in the demographics of this neighborhood in Tulsa, Oklahoma… black, as the title suggests, meaning burnt or scorched; black as in redacted; and black as in nothingness” (The Broad). Bradford’s abstract process mimics the construction and deconstruction of African American culture in the United States— Bradford explains that “my practice is décollage and collage at the same time. Décollage: I take it away; collage: I immediately add it right back. It’s almost like a rhythm. I’m a builder and a demolisher. I put up so I can tear down” (Art21).
Tomashi Jackson was born in Houston, Texas but raised in Los Angeles, California; while studying painting and printmaking at Yale University, Jackson noticed that the language Josef Albers used in his instructional text Interaction of Color mirrored the rhetoric of racialized segregation found in the transcripts of education policy and civil rights court cases fought by Thurgood Marshall and the NAACP Legal Defense and Educational Fund. As a result, Jackson started to use the properties of color perception as a tool for investigating the history of school desegregation in the United States and the contemporary resegregation of public space and violence against the black body. Both Marshall and Albers concluded that color perception is not static but instead is relative and that how a viewer perceives color is determined by the color nearest to it—tools that Jackson employs in her work through the placement of different colors, textures, and materials.
The Subliminal is Now is the exhibit Jackson created in response to her research findings, a series of large-scale abstract works that “connect past and present, formalism and intuition, languages of color theory and human rights legislation” (Shabaka). Jackson combines painting with sculpture, textile, embroidery, printmaking, and photography thoughtful media to comment on the “materiality of resources and how value is created” (Puleo). The body is always present in Jackson’s work— implications of bodies and the law come together through the employment of painted and collaged gauze, a translucent material most often used for repairing injured flesh. The provocative titles, such as “The School House Rock (Brown, et. al. v Board of Education of Topeka) (Bolling v Sharpe (District of Columbia))” reference landmark court cases which addressed civil rights and racial segregation, Jackson evokes the socio-political history of protest and struggle on the part of black people in the United States. The Subliminal is Now investigates color as a vehicle for painting, complex narrative, and emotion meanwhile interrogating the subliminal impact of color perception on the value of human life in public space.
While both artists search for found materials from the street and address institutionalized racism in the United States, Bradford works to rediscover the past as opposed to Jackson who juxtaposes hints of the past with contemporary events. In reference to my current practice, the value of every day, discarded materials and substrates becomes increasingly important to tell the story of a contemporary time and place. Found papers and materials add a complexity to the work and a visual image that becomes abstracted through layers of additive and subtractive processes. Both artists also address painting and collage in a way that does not sit on the wall that same way a traditional canvas might. Jackson’s paintings “hang from rods that position the works away from the wall. When flooded with natural or artificial light, the paintings evoke stained glass, immersing the body of the viewer with their scale” (Art Haps). Bradford’s size and scale are all-encompassing, “twelve feet high by twenty feet long… [the] physical presence [overpowers] everything else in the room” (Tomkins). In my next works, I intend to push the scale to form larger gestures and consider the form of the substrate I create to be more a part of the process instead of simply painting a scene or image on a canvas

The Southern California News Group recently investigated the addiction industry and found it peppered with financial abuses that bleed untold millions from public and private pockets, can upend neighborhoods and often fails to set addicts on a path to sobriety. The revolving door between detox centers, treatment facilities, sober living homes and back again generates huge money for operators who know how to game the system.
Although it is known to operators who practice human brokerage to be unethical, they are at the mercy of the addicts, and supply and demand. To put their nerves at ease, it is common that they still have one interventionalist put on retainer for a certain amount each month, may it be $5,000 or $10,000. Regardless how many patients they refer to the center, which pushes the unethical into the “gray zone”.
And Addicts have in turn taken notice. They start to see their insurance cards as credit cards, demanding better food, cell phones and even cash at times from providers in exchange for remaining in treatment. If the treatment center doesn’t deliver, the patient walks, and find another treatment center who will.
Many private insurance plans reimburse their enrollees, the patient, for treatment. They are given a check in hand which can be for tens of thousands of dollars, that is meant to be forwarded to the treatment provider. This obviously doesn’t always happen. Direct payment to a person in recovery is a horrible idea because they are so overwhelmed by the amount and it often leads to overdosing and death. It takes a long time for an addict’s brain to be repaired, direct payment to individuals to those in early recovery can have dramatic impacts. 27 other states agree and have banned insurance payments directly being sent to those in addiction recovery.
In the proposed SBS 636 is the first bill in CA, its written to address the rampant selling of patients. With SBS 636 would make patient brokering a misdemeanor with a $2,500 fine, as well as possible revocation of suspension of facility licenses and professional certifications. Out of Network treatment providers would be able to collect payments instead from insurance companies.
A similar bill was put into effect in Florida, the only state in the US who has more addiction treatment facilities than California. But in Florida the bill has made payment for patients a third degree felony punishable by up to five years in prison.
Others are asking for the California law to be as strict, Jerrod Menz, Co-founder of American Addiction Centers says “Tighten the law, Make it as strict as you want – $25K and a felony. If you’re marketing against these brokers getting $5K, $8K, 10K a patient, it creates such an un-level playing field. Anyone spending that kind of money is not leaving much for treatment.”
It is important to be aware of the type of facility you are committing yourself to before you attend treatment there. Sadly, with a growing market there will always be vultures and not everyone in health care will have your best interest at heart.
