I know there's a precedent with Ujiko | Garaki nabbing Shirakumo's corpse, but no, I don't think Garaki would be able to repossess Nighteye's body for a Nomu. For one thing, Nighteye went to a nearby university hospital (C161), whereas Garaki's spheres of influences are (1) a general hospital of which he is the founder/chairman of, (2) orphanages and carehomes of which he has philanthropized, and (3) private clinics.

Now, in C167, it's shown that he has a closed casket funeral, so MAYBE Garaki could have arranged for a little graverobbing. But as compared to Shirakumo, Nighteye had friends in higher places. I doubt they would risk having his body stolen.

This doesn't necessarily negate the possibility of a Nomu Nighteye, but I think it's unlikely for Horikoshi to bring Nighteye back in any capacity except in the event of All Might's death (we all saw him ditching Naomasa; it's a nonzero probability).

The new vid puts some things into context for Milgram as a whole, so I wanted to touch on that:

Verdicts are canonically handed out at the same time as they are decided via vote (instead of waiting for the end of trial to do so in bulk)

Despite this, restraints for Guilty prisoners are only put into effect at the end of the trial, as we see Haruka wearing his T2 outfit here

The infoblock at the end means the Milgram system already knows all the ins and outs of their crimes, which is concerning. I was under the impression that Milgram/Jackalope was just in the dark as us/Es and making assumptions but if he already knows, then why do this? And also it makes some Jackalope remarks hit harder (the one that instantly comes to mind is saying Mikoto has the largest killcount. If even Haruka had two, then... hm.)
