ARTICLE 47. The action for annulment of marriage must be filed by the following persons and within the periods indicated herein:

(1) For causes mentioned in number 1 of Article 45 by the party whose parent or guardian did not give his or her consent, within five years after attaining the age of twenty-one, or by the parent or guardian or person having legal charge of the minor, at any time before such party has reached the age of twenty-one;

(2) For causes mentioned in number 2 of Article 45, by the same spouse, who had no knowledge of the other’s insanity; or by any relative or guardian or person having legal charge of the insane, at any time before the death of either party, or by the insane spouse during a lucid interval or after regaining sanity;

(3) For causes mentioned in number 3 of Article 45, by the injured party, within five years after the discovery of the fraud;

(4) For causes mentioned in number 4 of Article 45, by the injured party, within five years from the time the force, intimidation or undue influence disappeared or ceased;

(5) For causes mentioned in number 5 and 6 of Article 45, by the injured party, within five years after the marriage. (87a)

Facts:

Godofredo Buccat (petitioner) sought annulment of his marriage to Luida Mangonon de Buccat (respondent).

The case was elevated to the Supreme Court from the Court of First Instance of Baguio.

The marriage occurred on November 26, 1938, in the Catholic Cathedral of Baguio City.

The petitioner claimed he married under the belief that the respondent was a virgin, which he later contested as fraudulent.

The respondent did not appear in court despite being summoned, allowing the petitioner to present his evidence.

The lower court ruled in favor of the respondent, leading to the appeal.

The couple met in March 1938, became engaged on September 19, and married shortly thereafter.

They cohabited for 89 days before the respondent gave birth on February 23, 1939.

The petitioner claimed the birth resulted from the respondent's alleged deception regarding her virginity.

After the birth, the petitioner abandoned the respondent and ceased marital relations.

The lower court found the petitioner's claims unconvincing, particularly noting his awareness of the respondent's pregnancy.

Issue:

Whether or not petitioners claim was meritorious.

Ruling:

The Supreme Court affirmed the lower court's decision, ruling that the petitioner's claims did not justify annulment.

The court found insufficient evidence to support petitioners claim.

The Supreme Court emphasized the sanctity of marriage, requiring clear and convincing evidence for annulment.

The court deemed the petitioner's assertion of ignorance regarding the respondents condition was unmeritorious.

Toy Story has been in the movie industry for a long time. It has a long history, and a lot of people have been interested in it. I myself have been a fan of Toy Story since I was a child, even though Toy Story 1 was first released in 1995, I watched it on television when my mom showed it. It caught my attention when I watched, because I thinked about how I act or what I would do if I saw my toys talking to each other and moving. Whenever I watch it, the animation from every movie is improving. I also noticed how they improved Peep’s appearance in the latest Toy Story movie. The animation team made a lot of improvement in the movie. A lot can see the improvement of the animation from Toy Story 1 to Toy Story 4, also the simulation of the scenes looks much smoother than the other movies. Also, the voice of the actors and actresses are more accurate in Toy Story 4 than in Toy Story 1. In Toy Story 4, the voice actors have more equipment that can bring out the character in them and make the voice much clearer. The story team also guides the voice actors to help them in their scenes.

Facts:

The dismissed complaint, which was filed on September 6, 1955, was based on the ground of fraud, it being alleged, among other things, that defendant Conchita Delizo, herein respondent, at the date of her marriage to plaintiff, herein petitioner Fernando Aquino, on December 27, 1954, concealed from the latter the fact that she was pregnant by another man, and sometime in April, 1955, or about four months after their marriage, gave birth to a child. In her answer, defendant claimed that the child was conceived out of lawful wedlock between her and the plaintiff.

At the trial, the attorneys for both parties appeared and the court a quo ordered Assistant Provincial Fiscal Jose Goco to represent the State in the proceedings to prevent collusion. 

On June 16, 1956, the trial court—noting that no birth certificate was presented to show that the child was born within 180 days after the marriage between the parties, and holding that concealment of pregnancy as alleged by plaintiff does not constitute such fraud as would annul a marriage—dismissed the complaint.

On appeal to the Court of Appeals, that court held that there has been excusable neglect in plaintiff's inability to present the proof of the child's birth, through her birth certificate, and for that reason the court a quo erred in denying the motion for reception of additional evidence. On the theory, however, that it was not impossible for plaintiff and defendant to have had sexual intercourse during their engagement so that the child could be their own, and finding unbelievable plaintiff's claim that he did not notice or even suspect that defendant was pregnant when he married her, the appellate court, nevertheless, affirmed the dismissal of the complaint.

Issue/s:

Whether or not the concealment of pregnancy as alleged by plaintiff does not constitute such fraud as would annul a marriage.

Ruling:

Concealment by the wife of the fact that at the time of the marriage, she was pregnant by a man other than her husband constitutes fraud and is a ground for annulment of marriage (Art. 85, par. (4) in relation to Art. 86, par. (3), New Civil Code).

MANILA – Three of the 13 detainees who escaped from the Caloocan City Hall Custodial Unit have been re-arrested as police manhunt operations continue.

National Capital Region Police Office (NCRPO) said the Caloocan police recaptured Harris Danacao at Barangay 8 in Caloocan City; Mark Oliver B. Gamutia at Barangay Tonsuya in Malabon City and Aldwin Jhoe Espila at 178 in Camarin, Caloocan City.

Still at large are Martin Mama, Gerrymar Petilla, Hudson Jeng, Reymark delos Reyes, Norbert Alvarez, Jovel Toledo Jr., Arnel Buccat, Raymond Balasa, Reynaldo Bantiling, and Justine Tejeros.

NCRPO chief Maj. Gen. Debold Sinas said based on initial information, the detainees were missing around 1:50 a.m. Thursday.

Sinas ordered Northern Police District (NPD) director Brig. Gen. Ronnie Ylagan to investigate the case and to immediately submit an initial report.

He also directed the NPD to inspect the extension facilities for other vulnerabilities while the jail guards on duty were relieved from post pending the result of investigation.

“Relative to this incident, all chiefs of police, were directed to inspect their respective locked up cells to determine weak areas and vulnerabilities,” Sinas said.

Reports said the inmates escaped by carving a hole on the wall of the vacant warehouse which had been converted into a temporary custodial facility near the city hall.

A total of 31 inmates was recently taken to the facility after assessment showed that they are vulnerable to Covid-19 infections.

Two of the 31 inmates were later found positive for Covid-19 in a rapid test but they were awaiting results of confirmatory swab test. The two Covid-19 positives were among those who escaped.

A closed-circuit television from the barangay caught some of the escapees running after breaking out of the facility.

The escapees are facing charges ranging from illegal possession of firearms, illegal possession of drugs and violation of ordinances.

PNP spokesman Col. Ysmael Yu said the Criminal Investigation and Detection Group, Intelligence Group, Highway Patrol Group, Integrity and Monitoring Group, Maritime Group and Aviation Security Group have been alerted to help in the arrest of the escapees. (PNA)

BAGUIO CITY, Feb. 3 (PIA) - -The intensified anti -illegal drugs operations of the Baguio City Police Office in January led to the arrest of seven individuals  including three who are listed in the high value individuals of the Philippine Drug Enforcement Agency (PDEA).

In January 20, personnel of BCPO Station 10 arrested a certain Jhunnel Lozano, 25, along Marcos Highway, Santo Tomas Proper in a buy bust operation and confiscated from him 50 grams of suspected shabu with an estimated price of P340, 000.

 In Jan.  21, Baguio police also arrested a 17 year old boy in a buy bust operation along Quezon Hill barangays.  Operatives found in his possession 0.5 gram of suspected shabu worth P3, 400.

Combined personnel of BCPO Station 10 and PDEA Baguio arrested Rogelio Buccat Jr., 27, and listed as high value individual, and his companion Maria Damalerio in a buy bust operation on Jan. 24 that also led to a hot pursuit after the suspects tried to run away with their vehicle. 

Confiscated from the two were four grams of suspected shabu with an estimated value of P27, 200.

The following day, a certain 23 year old Jerry Rivera was also arrested in a buy bust operation along Cresencia Village. Two sachets of suspected shabu worth P3, 500 were confiscated from him.

A buy bust operation at the rice section of the market on Jan. 29 led to the arrest of a certain Josephine Catapang, 47, a high value drug personality. Confiscated from her was 1.5 grams of shabu with an estimated value of P10, 300.

Joint personnel from Station 2 and PDEA Baguio arrested John Patrick Peñamante, listed as high value drug personality, in a buy – bust operation in East Quirino Hill barangays.

All arrested individuals are in police custody and will be charged with violation of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002.

 The intensified campaign against illegal drugs is among the top directive of President Rodrigo Roa Duterte to the PDEA and the Philippine National Police. (JDP/CCD-PIA CAR with reports from PRO-Cor RPIO)
