A trans-identified male in British Columbia, Canada, is suing the provincial Ministry of Health after it refused to fund the out-of-country vaginoplasty he demanded be performed in Bangkok, Thailand.

The man, referred to only as KW in legal documents due to a publication ban on his name, originally lodged a complaint at the BC Human Rights Tribunal (BCHRT) in 2019 alleging discrimination. KW claimed that being denied funding for the out-of-country surgery was akin to sex-based discrimination on the basis of his transgender status.

In his legal complaint, KW insisted that a female would not have been denied the same laparoscopic sigmoid colon vaginoplasty — a procedure that is sometimes performed on females who are born with exceedingly rare disorders of sexual development. The surgery includes utilizing sections of harvested colon tissue to craft the appearance of a vulva and vagina.

KW claimed that he was unable to apply for the surgery because he could not find a specialist to complete his application form, and argued that a female could have accessed a gynecologist to do so.

The BC Ministry of Health (MOH) sought to dismiss KW’s claim on the basis that it held no reasonable chance of success, but was denied in a May 10, 2024 ruling. The matter will now be scheduled for a hearing.

The Ministry argued that they did not discriminate against KW, deny him medical care, or treat him differently “than any other beneficiary who requests out of country medical services.” They also noted that KW did not fully complete his application for surgery, adding that vaginoplasty procedures are available in Canada “and as such, the public health system was not obligated to fund the service [he] was seeking overseas.” 

The MOH gave approval for KW to undergo a fully-funded vaginoplasty at GrS Montreal in October of 2017. However, months later in January of 2018, KW applied to the MOH to instead fund his surgery in Bangkok, Thailand.

He was advised that the application had to be completed by a BC specialist, and not the plastic surgeon from Thailand.

A letter from the Ministry read: “When surgery is available in Canada, the attending specialist in BC may recommend surgery outside Canada. The specialist must include peer reviewed medical articles with the application to confirm surgery outside Canada will result in a significant difference in success. The recommendation for surgery is sincerely respected; however as surgery is available in Canada, provincial coverage was not approved for surgery in Thailand.”

Ultimately, KW never completed his application and accepted the vaginoplasty at GrS Montreal on January 6, 2020. The hospital performs penile inversion vaginoplasty, in which penile tissue is “flipped” to create a vagina-like canal. This is the most common vaginoplasty technique in North America.

BCHRT panel member, Shannon Beckett, wrote in her May decision that the tribunal is also going to consider discrimination on the basis of gender identity, though KW did not allege this in his filing. She argued that the Ministry of Health made a “problematic” statement when they refuted KW’s claim about females accessing this type of procedure. Beckett appears to have taken specific issue with the Ministry’s explanation that vaginoplasties are “rarely performed on cisgender women, and only in cases where it is medically necessary (i.e. due to disease or injury).”

Beckett wrote that the Ministry’s usage of the term “medically necessary “ has “implied that where transgender women are seeking the same surgery, it is not in cases ‘where it is medically necessary.’ This argument appears to be based on stereotypical and outdated ideas about the nature and reason for gender-affirming surgery. There is no indication in the context of this complaint that the gender-affirming care KW was seeking was not medically necessary.”

This argument is reminiscent of a 2019 procedural decision by BCHRT member Devyn Cousineau wherein she referred to notorious trans activist Jessica Yaniv having his male testicles waxed by unwilling women as “critical gender affirming care.”

The hearing dates for KW’s suit against the BCHRT have not been scheduled, and it will likely take months if not years as the BCHRT is facing an enormous backlog of almost 5,000 active files.

This case is not the first of its kind in Canada. Earlier this year, and as reported by Reduxx, an Ontario man successfully sued the Ontario Health Insurance Plan to have the province fund an experimental surgery in Texas that will leave him with his penis as well as a surgically created “neo-vagina.”

The man in this case broke his own publication ban when he posted about his diaper fetish on Reddit, and openly admitted he was the individual documented in the highly-publicized case.

“do you believe in the power of the younger generation?”

is it even possible to feel so giddy and proud over this line? i relate to this so much because as a part of the current younger generation, i’ve seen others the same age as me fight for justice and rights !! using their platforms to speak out against the government’s injustices. lmao, kids my age from another country even made their president throw a temper-tantrum which led to him planning to ban TikTok, makes me chuckle everytime.

anyways, i truly believe in the power of the younger generation and i believe that all of us are willing to fight for what is right because its our future that’s at stake here. the decisions that the adults do in our community and government will either provide a good or a bad future, that will probably take so long to fix.

okayy, on to the review! :)

i honestly was hooked on this show after the first episode because the story kept making you want to see more and get to the bottom of what caused the island of Kra Ya Ngan to hate on Aiya (Aokbab Chutimon) so much. it had so many plot twists that i thought that the whole show would end up as one of Aiya’s dreams. fortunately, i wasn’t disappointed.

during the whole show, i kept thinking about the meme, “the villain.. the actual villain.” because everyone kept changing sides! i kinda understand though, since its honestly so hard to believe and accept that someone you love and known ever since you were brought up to this world is actually the most evil person on the planet.. yeah, i’m kinda exaggerating on this one but you get the gist haha.

i honestly thought that Suea (Best Nathasit Kotimanuswanich), Win (Gee Sutthirak Subvijitra, Mo (JingJing Varitsara Yu), and Yok (Ampere Suttatip Wutchaipradit) would end up siding with their parents and become one of the villains/antagonists in the show. i’m probably going to keep talking about the plot twists and i honestly thought that i was about to get mad at his character, he proved me wrong! he got his own dad in jail! lmao. i also thought i was going to be mad at Mo, but she was actually helpful towards Aiya and Faye.. i thought Faye and Mo wouldn’t get along but, girl code!

i felt bad for Suea and Yok because they were stuck in the middle because they wanted to side with their parents because “blood is thicker than water,” but they also want to side with their friends because they’re being unfairly treated by the society and the people that should be guiding them into proper and productive members of society.

the antagonists, Witsanu, Ram, Akkanee, and Sakka- i honestly felt so bad for them when i read their origin story. when Sakka ended up killing the Professor when he started provoking him by telling him about the time he molested him, i was liked, “that serves this bitch right!” but at the same time, i honestly thought that it was sad that instead of facing charges and actually cooperating with the police, they got away with it like nothing happened, even getting the Professor exposed for molesting the children, like them, in the orphanage that they grew up in.

also, what Ram did to Faye was appaling. just because someone did it to you doesn’t give you the go to pass the trauma on to someone else. i literally want to smack the guy in the face, it proves that someone shouldn’t be a parent if there’s something in their past is still openly haunting them to this day or if they’re not entirely in the right state of mind. fortunately, Faye ended up moving to Sydney after the whole thing to start fresh.

it was nice that Mo, Suea, and Aiya got the happy ending they wanted, and that Yok is finally moving to Bangkok to study. it was just so frustrating that Bud and Rassamee (Yok and Win’s mothers) are contunuing what Witsanu, Ram, and Sakka started. i honestly thought that it would end there. gosh, i hope they get what they deserve hNGGGG.

oh, and that scene where Tippy was replaced by an imposter who went to a good plastic surgery clinic because the original Tippy stole fake Tippy’s sketches and designs was so weird to me. if it were to happen in real life, it would be like OL replacing the real Jimin. LMAOOO

Win’s character was like Peter from Divergent (2014), guy looks and acts like a villain, but ends up being in the protagonist’s side by doing a power move and providing some major plot twists.

well, that ends my post! i decided to make this immediately after watching the show because i actually had a lot of thoughts while watching, like how frustrated and angry i am with rich people and politicians getting away with the shit they do lmao.

also, the actors who play Aiya and Suea are also in famous shows and movies like Girl From Nowhere (2018) and Bad Genius (2017) !!

Gender Reassignment Surgery – Transgender Procedures, the Facts.

One of the most controversial areas of cosmetic surgery that has arisen in the last decade is ‘Gender Reassignment Surgery’.  This is both of medical and political interest.  The emerging transgender movement and its position at the very forefront of ‘identity politics'  means that it is a very special and sensitive topic in cosmetic and reconstructive surgery.  It also requires a very specialised background to fully explain how the surgery works and what can be attained.

Sex reassignment surgery (SRS) is known by a variety of labels, including gender reassignment surgery (GRS), sex change surgery, sex affirmation procedures, and genital reconstruction surgery. These operations, which are known clinically as genitoplasty procedures, are done to surgically change the genitalia from one gender to another.

For the majority of patients undertaking SRS, the surgery is performed in order to match their physical gender with what they feel emotionally and intuitively is their correct gender. This syndrome, known as gender dysphoria or gender identity disorder, is infrequent but getting more widely diagnosed. You may also hear these individuals being referred to as “transgender.”.

Gender identity struggles usually begin in early childhood but descriptions of feeling like a man trapped inside a woman’s body, or vice versa, have been identified in and reported by people of all ages. A person living with this an internal conflict may develop anxiety and depression, and go on to be diagnosed with gender dysphoria, formally known as gender identity disorder

(GID). Gender dysphoria is a mental health condition that can arise when a person lives with ongoing feelings of being physically incongruous with his or her birth sex — and medical intervention may be beneficial. Identifying as transgender, itself, is considered by scientists to be, at least in part, biological and not a mental illness

Male to Female Transition. The procedures that change male genitalia to female genitalia include a penectomy (removal of penis) and orchiectomy (removal of the testes), which are typically followed by a vaginoplasty (creation of the vagina) or a feminizing genitoplasty (creation of female genitalia).

For those born male and transitioning to female, there may also be procedures that include breast implants, gluteoplasty to increase buttock volume, a procedure to minimize the appearance of the Adam’s apple, and possibly, feminizing hormones.

Facial feminisation surgery (FFS) is often done to soften the more masculine lines of the face.2 Each patient is unique and the procedures that are done are based on the individual need and budget, but facial feminization often includes softening the brow line, rhinoplasty (nose job), smoothing the jaw and forehead, and altering the cheekbones. For some, a chondrolaryngoplasty, commonly known as a “tracheal shave,” can help reduce the prominence of the Adam’s apple.

Female to Male Transition. The procedure that changes female genitalia to male genitalia is a masculinising genitoplasty (creation of male genitalia). This procedure uses the tissue of the labia to create a penis.

The procedures that change the genitalia are rarely performed without other procedures, which may be extensive. For those born female, the change to a masculine appearance may also include hormone therapy with testosterone, a mastectomy, a hysterectomy procedure, and perhaps additional cosmetic procedures intended to masculinise the appearance.

Transitioning is often two-fold: a social transition, such as new clothing, a new name and new pronouns; and a medical transition, with treatments such as hormone therapy and surgical procedures. Depending on the needs and wants of each individual, transitioning may include both social and medical transitions; just one of the two; or for those who eschew gender completely, neither.

But does GRS really work for everyone?

Medical evidence suggests that sex reassignment does not adequately address the psychosocial difficulties faced by people who identify as transgender. As Ryan Anderson points out in his book ‘When Harry Became Sally'  ‘even when the procedures are successful technically and cosmetically, and even in cultures that are relatively “trans-friendly,” transitioners still face poor outcomes’.

There are strong arguments on both side of the line and this is not really the place to debate them since the argument as to whether sex can be truly reassigned is an enormous political and cultural battlefield.   Experts like Dr Lawrence Meyer from Princeton is quite clear on the subject:

Cosmetic surgery and cross-sex hormones can’t change us into the opposite sex. They can affect appearances. But they can’t transform it. They can’t turn us from one sex into the other.  “Scientifically speaking, transgender men are not biological men and transgender women are not biological women. The claims to the contrary are not supported by a scintilla of scientific evidence,” explains Mayer.
