Influencer has admitted no licence for my image but trotted the same old excuses of not done in bad faith/ poor cataloging of images/ I’ll give you credit. Is this good enough from a ‘friend’? Or should they know/ do better and cough up/ remove the image?

I don't think so. Either way, first things first, start investigating all the facts and take note of all infringements to build a case. Otherwise throwing unsubstantiated accusations around isn't useful.

Yup. That’s all true. However my contract had a clause giving me % of sales and I would have hoped to have been notified. The title isn’t good at policing work.

Thanks for the support. This ain't my first rodeo. This is one reason why I've stepped away from menswear and working with influencers; don't care/ rarely any budget/ time spent policing my work/ mutual back slapping... the negative, self serving, energy is tiring to deal with.

@sabguthrie I saw an influencer IG post complaining about new accounts with bought for 50- 100k followers. The irony is the influencer never includes #Ad or #Sponsored or is transparent in any of his own dealings.

If the ruling finds he in his favour and doesn’t have to pay, it’s a dangerous precedent. Why bother having contracts if they’re not enforceable?

It’s called an agreement for a reason and protects both sides. Hope the influencer, who’s admitted the wrongdoing, is legally found guilty and is made to pay up.

FYI- my recent experience is agents on behalf of shareholders don’t care about the biz of being in biz. They’re maximising short term profit over any longevity. The only long term companies I’ve met are all family owned.
