Do you think they couldn't make other characters queer cause of copyright? As far as my knowledge goes (correct me if i'm wrong bc I'm confused) Shiro belongs to the first itineration of Voltron, Go Lion! and Koplars are the owners of the American version. The post-s8 tea on Twitter said they weren't given permission of changing last names, what if was the same with sexualities? Koplar's Shiro, Sven was coupled with Romelle but I think Go Lion's Shiro didn't have anyone, so it was an easy pick?

That’s not really the way copyright works. 

Shiro belongs to DreamWorks, full stop, do not pass go, do not collect two hundred dollars. The same goes for Allura, Pidge, Hunk, Keith, Lance, Coran, Kolivan, Krolia, Zarkon, Lotor, Haggar/Honerva, and any other iteration of the characters as they are presented in DreamWork’s version. 

Note: I’m not saying that Shiro wasn’t a character in GoLion. I’m saying that the Shiro-of-GoLion is a character copyrighted by Toei Animation; Shiro-of-VLD is a character copyrighted by DreamWorks; Shiro of… well, any other iteration would be copyrighted by whomever created that iteration. 

It’s a complicated and heavily-legislated area of the law, but here’s the core idea boiled down into a single statement: your creation is copyrighted the instant you “fix it in a tangible medium of expression”.   

That is, you cannot copyright an idea; you can only copyright a distinct implementation. Furthermore, copyright is always owned — automatically upon creation — by the person or company who did the work of setting that idea into its concrete state. 

Behind the cut: copyrighting characters, withholding character information, cultural hot buttons, and where do we go from here. 

note #1: there is one exception, known as “work-for-hire,” where employees create something on behalf of an employer. This must known beforehand and made explicit via some kind of agreement. If you read the fine print, there’ll be a work-for-hire clause in most employee or contractor agreements.

note #2: yes, this does mean you could create a mecha series where the robots are all big lions, or a mecha series where animal-based mecha combine. It would probably end up in court anyway ‘cause companies get prickly about protecting their IPs, but afaik the court’s decision would hinge on whether your implementation is different enough.

(this is why I scoff so much at the EPs being so open about where they steal ideas from: there’s a reason writers talk about filing off the serial numbers. it’s not because we don’t want you to think we get ideas from everywhere. it’s because distinct is also a necessary ingredient for plausible deniability of plagiarism.) 

copyrighting characters

The ‘no last name’ claims are frankly a lot of hot air. 

First, you cannot copyright a character name; you can only copyright the specific and fully-developed character as a whole. (A Meg Murry who’s a South Asian marathon runner? Not a violation of L’Engle.) You could trademark a character name, but only if that name appears in the title; frex, Indiana Jones was able to be trademarked because his name is part of a series of works that all begin with “Indiana Jones.” 

WEP could trademark Voltron (as the mecha’s name), but doesn’t look like WEP chose to do so. Recent research seems to indicate WEP actually embraces and supports non-media products (that is, things that are obviously not their adaptation-of-an-anime) using the name, possibly on the theory this wide usage increases the name’s recognition and cultural cachet.

Second, consider Devil’s Due Publishing (DDP), which gave every character a full name, new biography, age, height, and family history. It retains its copyright over those characters, but only as whole characters. You could make your Keith Kogane an orphan in his mid-20s who’s distinctly anti-social, and you’d probably be fine, because that description is still more of a stereotype than a distinct/unique character. 

To quote the legal encyclopedia:

Judge Learned Hand of the U.S. Court of Appeals for the Second Circuit established the standard for character protection in a case called Nichols v. Universal Pictures Corp., 45 F.2d 119 (2d Cir. 1930), when he stated that, “the less developed the characters, the less they can be copyrighted; that is the penalty an author must bear for marking them too indistinctly.”

For example, alien characters stranded on Earth is a popular and recurring theme as portrayed in My Favorite Martian, Starman, Alien Nation, Transformers, District 9, Predators, and The Man Who Fell to Earth. The idea of a stranded alien character, without embellishment, is not protectable.

[…] once a stranded alien character acquires more distinctive features or aspects—for example, a big-headed, long-necked alien with a glowing finger who murmurs “Phone home”—it becomes distinct enough to merit protection and its owners can prevent others from using the character’s image and expression.

If you make your misanthropic orphan named Keith also a former Marine, and an expert in hand-to-hand combat, and grieving a dead fiancee… He’s no longer a stereotype, but a character with a unique combination of features. DDP probably would have grounds to send you a cease-and-desist. 

However, if you say Keith Kogane is a lonely kid from Texas with an alien mom and a fireman dad, who’s the best damn pilot of his generation, and is generally awkward and whose silence hides a whip-smart intellect… again, a unique combination that fleshes out generic ‘Keith’ into a very specific and distinct Keith. Who is not, it should be noted, a carbon-copy of DDP’s Keith.

And the real nail in the coffin: if you’re going to argue that it’s a copyright violation to use Keith’s or Lance’s or Hunk’s last names, then why wouldn’t the same apply to using their first names? Or using names like Daibazaal, Sincline, Lotor, Honerva, Haggar, Alfor, Yurak, etc. Pretty sure ‘Zarkon’ isn’t a name you see everyday. I mean, it’s not, say, ‘Bob.’ 

withholding information

I’ve seen staff from another DW project say they can’t specify character ages until marketing decides. Which is… truly bizarre. If DW really is having marketing make such creative decisions, it’s not just putting the cart before the horse, it’s putting the cart in the jewelry store and the horse in the attic. 

If marketing or PR is anywhere in the mix, perhaps that’s because someone with social media savvy has realized topics like ethnicity and age will bring out the vitriolic teeny meanies of the Fandom Purity Police Brigade. Thing is, that doesn’t hold water, either: Trollhunters gave us ages and grade-in-school.

There could be another layer, too. The EPs I saw in those earliest interviews clearly had little firsthand experience with fandom, and seemed startled to hear fans actually care about those details. Two years of their interviews, and I have the strong sense they don’t like losing what they see as a battle of wills, no matter who their opponent is. Fandom cries out for surnames? Fandom will never get it. Fandom likes this couple over that one? Fandom is heading for severe disappointment. And so on. 

That’s ignoring the praise the EPs enjoyed for fandom’s conflation of a Korean-American VA and a Korean studio’s aesthetics, to see Keith himself as non-white. The EPs got representation points, and didn’t have to do a thing; the fandom did it for them. Why mess with that?

But no, copyright has nothing to do with that. 

cultural hot buttons

Sexuality, gender, and ethnicity are three places that a franchisee could run into problems, because these are hot buttons in the US. If the franchise owner feels a particular tangible form (this specific character in this specific iteration) violates the franchise’s ‘family-friendly’ aspect of their brand… I’d bet the contract between the parties does give the franchise owner some right of refusal or revision. 

Set aside what you think of VLD’s beginning, middle, or end. For all LM’s other faults, that sketch she did so long ago highlights all three: gender (Pidge), race (Keith and Allura), and sexuality (Shiro). We may’ve had to wait for an unfortunately tacked-on epilogue to get explicit confirmation*, but in the end, VLD was a significant break from previous Voltron iterations. 

Where, exactly, is anyone getting the impression that WEP is so terribly upset about its princess no longer being white, one of its pilots no longer being male, or another pilot no longer being straight? Whatever Bob Koplar might think of VLD’s end, his statement on the day of S8′s release made clear WEP is eager to continue their partnership with DW. 

Sounds to me like WEP is okay with DW’s creative and cultural approach. Otherwise, why go back for more?

It ultimately doesn’t matter what a previous iteration did. So long as DW’s creation is fully its own, copyright is neither barrier nor impetus to providing (or withholding) any information about that creation. 

What DW creates, DW owns. Which means DW is free to tell us last names, middle names, heights, ages, family history, race, gender, sexuality, love interest, even most hated food or favorite color — or nothing at all.

His plan this week was actually rather clever.

Sorry. Wanted to get that off my chest. I miss Tankjoh, too, but I actually like that they followed him w/ a general w/ an opposite style, that the one time Tankjoh kind of tried it, it got him killed (the plan w/ the Cerberus Minusaur).

I really hope that smirk really was just Tatsuya and wasn’t planned. I like how they had trouble getting the ‘towel scene’ (a line ad libbed by Simon Pegg) bc Zachary Quinto kept laughing, so they just went w/ a scene where he jus barely smirks and they cut away real fast. This is smaller, scale, of course, it’s very low key and I only noticed it bc I am almost always watching Banba in any given scene, but it’s funny to think it was unscripted.

Aw, I thought Dad was an alright singer. Also, love Ui’s face here. ^^ And she tries to comfort him, such a sweetheart.

Really, though. There’s no way they would have actually released Tall Cheese, if this had worked. That’s not Short Cheese’s fault, she didn’t have many options, but I highly doubt Wyzul intended to honour any sort of deal.

I realise I shamefully remembered Short Cheese’s name in the rest of this post. Whoops. I’d go back and fix it, but now it’s funny… ^^;

Next week, looks like Melto is piloting Kishiryu Oh alone, Biker Dad returns (as an illusion), and the kids get stuck in Wonderland when Banba turns his back on them for five minutes.

I’m kidding, I don’t actually know if his subplot is at all related to Wonderland. All it says is that he’s dealing w/ an ‘antiques dealer.’ I have this wild theory that what the summary means is that ‘Wonderland’ is inside a box (the chest that’s referenced in the title and is the goal of the ‘attraction’), and then Banba also ends up chasing it around. Alternatively, he could just end up in a situation where he’s wandering around like ‘have you seen five brightly dressed dork children? I left them right here, but I looked away for one minute and they all disappeared.’ Or he doesn’t know at all. The magazine did say something about him doing things alone… Maybe he’ll get himself into trouble and they’ll have to come save him in episode 10. I mean, we know he’s gonna get a plot about not doing everything himself eventually.

I’ll leave everyone w/ this thought: the shapeshifting Druidon general now knows where the Tatsuis live.

advice to everyone, but specifically under 18s starting new jobs

don’t feel you have to bend over backwards for your employers just bc you’re scared you’ll get fired if you don’t

sure definitely put the effort in and go the extra mile, but read up on your working rights, and don’t let your employers take advantage of you just because you’re not an adult, or just because they know you’ll cave eventually

it took me until I was 20 to realise this, and now I’m happily in a job where my coworkers and managers respect me and look out for me. If I make a mistake, they allow me to learn from it and are understanding that mistakes happen. They’ve offered me guidance, growth, support, and always ensure I take my legally required breaks. They aren’t out to screw me over. When I found an issue with my paycheck, they went out of their way to ensure I’d receive a refund as soon as possible. My previous job was with a wonderful family who always made sure I was happy in the job, and honestly I didn’t realise how much of a difference it would make to my mental health.

but I’ve worked in jobs (retail lmao) where managers took advantage, asked me really personal questions (i.e. what am I doing that’s more important than covering someone’s shift last minute), and wouldn’t allow me the legal rest breaks or pay me what they had promised in my induction period.

I worked for a company for a while that put me incorrectly on the rota in my second week working there. I was 17, had never had a job beyond a couple of summer jobs, and my boss called me at the end of the day to scream at me down the phone because I hadn’t showed up. I knew I should’ve checked the rota carefully and alerted her to any mistakes, so I apologised profusely, promising it would never happen again, that I would be extra careful next time. She hadn’t called me 10m into the shift like they are meant to (which would have allowed me to turn up 30 minutes late, tops), but instead she called right at the end of an 8 hour shift and yelled at a 17 year old girl down the phone until I was in tears, telling me I’d let the entire team down and every had a shit day because of my stupidity. She was unforgiving, nasty, and she made me scared to show my face at work the next day.

I worked for a company that promised me an entire 50 pence per hour more than they ended up giving me. They got me through the entire induction period with all of the new employees double and triple checking the proposed starting salary. The induction lead confirmed several times, “yes you are DEFINITELY getting this amount, don’t worry”. We signed the contracts and a month later, boom... my paycheck was WAY lower than expected. When I brought it up with them they told me the induction leader had got it wrong, “sorry nothing we can do” and eventually they told me to drop it. I was too scared to fight it.

I worked for a company that never responded to any formal complaints I made about being left alone on till for hours with a line out the door because the other employees “couldn’t be fucked” to come help me. Customers shouted at me, asked me why the hell I was working on my own. The rest of the staff were sitting around in the stock room, ignoring the bell -- something many of them did. They would even demand that I be kept on till because they hated working on till so much, but when I asked to switch roles the managers said no (see 4 for their exact response). The manager did not pass this on or action this. In my exit letter I mentioned the number of problems I’d asked the manager to pass on, but the “big boss” said he’d not heard a single one of these.

I worked for a company that told me I couldn’t stock shelves because I was a girl and so I was clearly not strong enough.

I worked for a company that called me, an hour before they were due to open, begging me to cover a shift. I had a prior engagement that I simply couldn’t get out of, and apologised that I couldn’t help them. Instead of ending the call, they quizzed me on where I was and what I was doing that was more important than shift cover for five full minutes before hanging up.

I worked for a company where one of the team leaders stormed into the break room and told me off for taking an extra long lunch break. I still had five minutes left to go, explained my lunch break was clearly stated in my contract, and she said “no it isn’t, get back out there”. My contract had clearly stated it, but they refused to adhere to the contracted length of the break. My break was cut in half with no explanation and they made efforts to not let me talk or ask about it again.

I worked for a company where I took half hour breaks. They cut this in half with no explanation (yes, this is a different company to no. 6). I pulled out the handbook to point out that, actually, I worked enough hours to be entitled to a 45 minute break (...so they were getting a good deal that I only took half an hour). They flat out denied it, even though it was clearly printed in the book THEY PROVIDED ME.

I worked for a company that called me while my cousins (who I see once a year at most) were visiting, when I said I couldn’t cover a shift they tried to guilt trip me until I said yes, telling me to “be a better team player”, and that the store would suffer if I didn’t come in. At this point I was finally growing a backbone, and said no.

My boyfriend has worked for a company that put him on the incorrect shift, he sorted it and got himself taken off the shift with plenty of time, but he was still called and yelled at on that day for not showing up. She quizzed him about what he was doing that day and hung up.

He was also once in a&e getting a suspected broken foot checked out (it wasn’t, thank goodness). He called his work to say he couldn’t come in as he was still waiting on his X-Ray (and also couldn’t walk), but promised them a doctor’s note. They yelled at him down the phone for missing a Saturday shift, and called him a couple of hours later to say they would not be extending his contract and that he shouldn’t come in next week.

I’ve had friends be literally screamed at in front of customers by their bosses, be severely underpaid, not get the right rest breaks, get ostracised at work for having mental health issues that have required them to take time off.

Not every job is perfect by any means, and we are all desperate to have a steady income (it’s the entire reason I put up with those shitty jobs), we can get totally screwed by 0 hour contract jobs that slowly stop putting you on the rota if you piss them off, but if you do have the ability to stand up for yourself because you know your rights (rest breaks, minimum wage, conduct, contracts etc.), then please don’t let them take advantage. For those not able, I’m very sorry and I hope things turn around.

Just learn your rights is what I’d advise before going into any job, don’t be scared to clarify something with your manager before you start the job, read your contract carefully. Some jobs will push you because they know you’re too scared to say no, if you can say no without putting yourself in an awful position then please do.

I'm 21, fully comprehensive insurance, new '09 plate car, my car insurance costs me about 300 per year. I am going away to Alton Towers next month with my partner and two friends and I was wondering what is the cheapest way of going about insurance to enable them to drive my car for the 2-3 day road trip down there and back. I'm 21, fully comprehensive insurance, new '09 plate car, my car insurance costs me about 300 per year. I am going away to Alton Towers next month with my partner and two friends and I was wondering what is the cheapest way of going about insurance to enable them to drive my car for the 2-3 day road trip down there and back. We want to split the journey between two of us as it will take about 6 hours there and 6 hours back so we were going to do 3 hours each there and back. We're taking my car as it's the only reliable one and the most spacious. The two people possible for driving is a 19 year old boy (im guessing the insurance will be way too high for him) and a 19 year old girl. They both have their own cars and their own insurance and have both been driving for 1 - 2 years. The girl will be 20 when we actually go down there but she is fully comprehensive on her dads insurance. What can we do? And please don't suggest I drive all the way as I've done it before and I said i wouldn't again as it was just too long to concentrate on one big stretch of road, even with a couple of stops.
