“4,500 Bicycles Thieves’ Haul; ‘It’s A Racket,’ Cadi States,” Toronto Star. October 20, 1937. Page 35. ---- Three Months in Jail for Thief as Crown Reveals Two-Year Toll --- TWO GET CHANCE ---- ‘From what I’ve heard in this court during the last few months it seems to me that the stealing of bicycles is increasing all the time,’ remarked Magistrate Cowan when he sentenced Henry Jawonsky to three months in jail in ‘B’ police court to-day for the theft of a bicycle.
‘Two thousand were stolen in Toronto last year,’ said Crown Counsel F. T. Malone, ‘and so far this year 2,500. A grand total of 4,500 in less than two years.’
‘It’s developing into a racket,’ commented Mr. Cowan.
Jaworksy pleaded guilty to the charge. Louis Snow, owner of the bicycle, told the court he had had it stolen from in front of a King St. W. store last January. It was recovered by the police the middle of October.
Several changes had been made to the wheel, said Snow, including an attempt to change the serial number.
Sequel to an argument as to who was to push a stalled automobile. James Zebor was found guilty of common assault on John Raczkiewcz, and given suspended sentence.
Appealing for sentence following their conviction last week of the theft of an automobile, George Blair and James Young were sent to jail for 15 days.
‘I remember these lads,’ said Mr. Cowan. ‘They are the ones who were drinking in a hotel and then instead of taking a taxi, took somebody else’s car.
Promises Not To Be Back ‘It’s a big-hearted court to-day,’ declared Crown Counsel Forsythe as William Walker, appearing for sentence on a charge of theft, was the second man in succession to be granted suspended sentence.
‘You were decent enough to take the blame. You and the other man whom I let go were both pretty well in on it, but I’ll give you a chance,’ stated Mr. Jones.
Accused said he was 58 and that this was his first offence.
‘If you’ll promise not to be here again for 10 years, I’ll grant you suspended sentencce,’ said his worship.
Accused promised and was remanded for sentence.
Five Plead ‘Joy-Riding’ Plea of guilty to ‘joy-riding’ was entered by Vernon Bewley, Hugh Holland, Malcolm Shelly, Robert Hunt, and Alfred Dumaresq, charged with theft of an automobile.
Crown Counsel Malone stated he would accept the plea only in the case of Hunt and Dumaresq.
‘Dumaresq didn’t know the car was stolen,’ volunteered Bewley, ‘he thought I had borrowed the car.’
Magistrate Cowan appointed counsel for Dumaresq and following a conference with Det. McMaster he was granted a remand until Oct. 26 without plea or election. The other youths will appear for sentence on the same date.
Holland and Shelly pleaded guilty to attempted theft of a purse from Miss. A. Taylor. Holland pleaded guilty to stealing a purse from Miss E. Traill and Shelly, not guilty,. These charges will also be heard on Oct. 26.
Charged with shopbreaking and the theft of a truck, Alex Murray was remanded until Oct. 25. ‘I advise you to get a lawyer,’ said Mr. Cowan.
Suspended sentence was given Paul Mifeud, charged with stealing auto tires, valued at $55. Accused claimed he did know the tired were worth as much and believed them to be practically worthless.
‘This man has no record,’ declared his worship, ‘and has already been in custody several days.’
Pleading guilty to consuming liquor illegally in a car on Oriole Parkway, Jack Wyatt was assessed $10 or 10 days by Magistrate Tinker.
Wyatt was originally charged with illegal possession but the charge was reduced with the crown’s consent. Charges of illegal possession against William Thomas and Murray Johnson, said to be Wyatt’s companions, were withdrawn.

'The management to pack the jury,’ a radical partisan wrote, ‘was evident to every impartial spectator.’ This is not an exaggeration. Of the twelve jurors, five, Philip Dumaresq, Gilbert Dublois, William Hill, Joseph Barrick and William Wait Wallis, were later loyalist exiles. The available evidence indicates that these men were supporters of Preston and the King well before the trial. Dumaresq, for example, was ‘an intimate aquiantance’ of Preston’s. Hill was a baker who supplied the British Fourteenth Regiment its bread. Barrick boasted of his open avowal of support. Deblois’s case is even more interesting, as Preston pointed out in the 1780s when testifying on the juror’s behalf to the board of commissioners appointed to examine the losses sustained by the American loyalists: ‘The testimony of Thomas Preston…Sheweth that he knew Gilbert Deblois Merchant in Boston…That when said Preston was thrown into jail there, for what was call’d the bloody massacre, said Deblois got him several valuable evidences, and gave him the character of many of the persons returned for jurors, by which means he was enabled to set aside most of those return’d by the town, who were men of violent principles, and pick out some of the moderate ones sent up from the country. That on a deficiency of jurors said Deblois attended, and got himself put on the pannel, where during the tryal which lasted a week, he was confin’d in the jail along with the other jurors, to the great neglect of his business. That by his strict attention and close examination he detected some of the evidences of perjury; and also that by his personal influence on the rest of the jurors he was a great means of said Prestons being acquitted.’

The 16-gun French Mutine-class corvette Aurore was launched in 1799. The British frigate HMS Thames captured her in 1801; she was commissioned into the Royal Navy in 1803 and named HMS Charwell (or Cherwell). Charwell served in the Channel, South Atlantic, and Indian Ocean. She was laid up in 1810 and sold in 1813.
French career and capture
Aurore was built to a design by Charles-Henri Le Tellier.[1] From April to July 1800 she was on a liaison mission to Île de France, via Brest and Santa Cruz de Teneriffe. On 23 September she was fitted out at Brest. She then sailed again for Île de France. At the time her captain was lieutenant de vaisseau Charles Girault.[3]
On 18 January Thames, under the command of Captain William Lukin, captured Aurore. She carried as a passenger the Governor’s Aide de Camp, who was carrying dispatches.[4]
She arrived at Plymouth on 6 February. She was then fitted out there between March and June 1803.[1] The Royal Navy already had an Aurore in service (as a prison ship), so renamed the prize HMS Charwell after the River Cherwell, a tributary of the River Thames.
British career
Charwell was commissioned in April 1803 under Commander Phillip Dumaresq.[Note 1] In early May Charwell was in the Hamoaze completely rigged and fitted for sea, but was short a crew.[5] Once he had succeeded in forming a crew, Dumaresque sailed her in the Channel.[1] However, by 1 September she was back in the Hamoaze. She had grounded on some rocks on the French coast. There she had had to throw her guns overboard to lighten her sufficiently that the next incoming tide could lift her. At Plymouth she was going to have some of her copper plates removed to permit inspection of her hull.[6]
On 13 September 1803 Cerberus served as flagship to Admiral Sir James Saumarez. Saumarez commanded a small squadron comprising the sloops of war Charwell and Kite, the schooner Eling, the cutter Carteret, and the bomb vessels Sulphur and Terror.[7] The squadron massed for a bombardment of the port of Granville where there were some gunboats moored. The squadron bombarded the port several times over the next two days. On 15 September, as Cerberus was withdrawing, she grounded. For the three hours it took to refloat her nine gunboats harried her, but without effect.[7] When the rest of the squadron, came up they drove the gunboats away. The British retired with no information on what, if anything, the bombardment had achieved.[7]
In September 1806 Charwell was at Guernsey, under Commander Phillip Brown. However, in October Commander Edwin Chamberlyn replaced Brown. Charwell then sailed with the convoy to the River Plate where the British planned to attack Montevideo.[1] At Montevideo, the Navy furnished guns and men for batteries. In the siege Charwell had one man killed and one missing.[8]
In April 1807 Commander the Honourable William Gordon replaced Chamberlyn. Then in 1809 Lieutenant Charles Robb sailed her for the Cape of Good Hope.[1] On 15 July 1808 Nereide, Otter, and Charwell shared in the capture of the French brig Lucie, and her cargo of slaves.[Note 2]
On 28 June 1809, Charwell captured the French letter of marque Hyène. Hyène was on her way from Bordeaux to Iles de France with a cargo of wine and naval stores when Charwell captured her.[10] Admiral Bertie, commander of the Cape of Good Hope Station, described Hyène as "a very fine vessel of 230 tons, pierced for 18 Guns and masted as a man of war".[11][Note 3]
In March 1810 Commander James Tomkinson replaced Robb. He then sailed Charwell back to Britain as escort to a convoy.[1]
Charwell was laid up at Deptford in July 1810. The Admiralty first offered her for sale in August 1812.[13] She was sold 28 April 1813 for £700.[1]
