🎯 Penn State Wins Trademark Case Over Retailer's Use of Vintage Logos, Images

Penn State emerged victorious in a significant trademark dispute concerning the use of its vintage sports logos and imagery by an online retailer. A Pennsylvania jury awarded the university $28,000 in damages for products created and sold by Vintage Brand and Sportswear Inc., companies co-founded by former minor league baseball player Chad Hartvigson.

Penn State accused the firms of distributing “counterfeit” clothing and accessories, while the defendants argued their website clearly stated they were unaffiliated with the university. The case, filed by Penn State in 2021, was the first among similar lawsuits by other universities, including Purdue, Stanford, and UCLA, to proceed to trial. Many viewed it as a precedent-setting case in the sports merchandising industry.

Tiffany Gehrke, a Chicago-based trademark attorney uninvolved in the case, noted the trial addressed a critical trademark law issue—whether trademark owners can prevent unauthorized use of their marks on merchandise. She stated that the verdict upholds existing protections, whereas a win for Vintage Brand could have significantly altered the industry landscape.

The six-day trial took place in federal court in Williamsport, Pennsylvania, presided over by Chief U.S. District Judge Matthew W. Brann. Defense attorneys did not comment on the outcome or whether they plan to appeal.

Penn State celebrated the decision, emphasizing the importance of its trademarks to the university’s brand. In a statement, the school expressed gratitude for the outcome, highlighting its partnerships with licensed vendors who adhere to the proper processes for using its marks.

According to the lawsuit, Penn State has used its Nittany Lion mascot, adopted in 1904, along with its seal and other logos, for decades. Founded in 1855, the university now operates 24 campuses with more than 100,000 students.
