"“Always ask yourself: Why is this lying bastard lying to me?” Perhaps these blunt words of advice for journalists interviewing politicians, attributed to the late foreign correspondent Louis Heren, have endured because they are seen as self-evidently true. That politicians lie is viewed as established fact. 

Public confidence in lawmakers plunged to a record low last year in the wake of Partygate and other scandals: only 9% of British adults polled by Ipsos said that they trust politicians to tell the truth. Without trust, says Jennifer Nadel of the thinktank Compassion in Politics, faith in democracy is undermined. “If we can’t trust what politicians are saying, how can we decide who to vote for? We need to be able to rely on our politicians to tell the truth,” she explains. 

Compassion in Politics has long been campaigning to introduce criminal penalties for political lying, with a petition launched in 2019 attracting more than 200,000 signatures. In a surprise move two days before the UK’s general election, the Welsh government committed to passing legislation that would make lying illegal for Senedd members and candidates, having previously opposed the measure. Under the plans, those found guilty of deliberate deception by an independent judicial process would be disqualified from office. 

“We’re excited and optimistic,” Nadel says. “It’s unprecedented that the government has agreed to take this measure forward.” Although some countries have limited penalties for politicians who lie during election campaigning or when giving evidence to committees, Wales is the first in the world to propose legislation that would apply more broadly to lawmakers and candidates. 

Compassion in Politics’ next challenge is to persuade Westminster to follow suit by banning MPs and parliamentary candidates from lying.  

The campaign sprung from concern at the rapid normalisation of lies in politics. “We are slipping at an alarming speed into a post-truth era,” says Nadel. “We only have to look at what is happening in the United States.”

Fact-checkers at the Washington Post found that Donald Trump made 30,573 false or misleading claims during his presidency, averaging about 21 a day. “America is a warning of what can happen if this problem is allowed to go unchecked,” Nadel believes. “[Our proposals] are designed to stop [the UK] from getting to that stage.” 

Polling shows wide public approval for the measure, with 72% backing criminal penalties for politicians found guilty of deliberate lying in an Opinium survey conducted for Compassion in Politics in May. Though it is not yet clear whether Wales would make lying a criminal offence, Nadel says: “If the same goal of disqualifying politicians who deliberately misrepresent the facts can be achieved through using the civil law, then we’re happy.” 

A private member’s bill to ban lying in Westminster, introduced by Plaid Cymru MP Liz Saville Roberts in 2022, had cross-party support. “We will be looking to build [on that] and win the support of the Labour government to introduce the measure,” Nadel says... 

“I think it’s important to signal a different set of norms, and try to arrest a slide towards the acceptability of attempts to deceive in public life.” 

For Compassion in Politics, another challenge is persuading doubters that banning lying in politics is even possible. “There’s this belief that it’s too complex to stop,” says Nadel, who qualified as a barrister. “But the law prevents fraudulent misrepresentation in other walks of life. This is something that courts adjudicate on all the time. Why shouldn’t it apply to politicians?”"

Soooooo back when the first Indy Ref was going on, I was a English person, living in England. My spouse and I were in Scotland for the Fringe, visiting a friend, and we saw a *lot* of shows, talks, plays, and political panels about the ref (the Fringe isn’t just comedy, but the comedy that year was gold!) It seemed like a done deal. I was delighted for Scotland to be getting away from England.

When the vote came in and a Scotland had decided to stay in the union I was FLABBERGASTED. It made no sense to me, tho I’ve since learned a lot of Scottish people were told they’d lose access to EU is the left the UK (ha bloody ha). Even back then, it was obvious what England was turning into, and the long term effects of Tory austerity was going to be. People were already dying as a result of the disgusting DWP and wider government policies.

Brexit wasn’t even on the horizon.

Now, in 2023, I live in Scotland. I watched Westminster say that Scotland couldn’t have a 2nd referendum, and the High Court back that decision. Now I’m watching Westminster highjack a Scottish law, passed by a Scottish cross-party majority, and try to dismantle it.

And OFC it’s a law that might actually make the lives of trans and non-binary people just that little bit better, that little bit easier. Because hey, let’s kick the vulnerable when they’re vulnerable - the unspoken motto of right wing bigots of the world. There’s a reason the Tories are called the Tories, after all.

God I hope they’ve overreached themselves this time. That for once they’ve fucked up so badly they might actually lose - not just in the polls (though that too, please); but in the very centre of them: Their gross ideologically driven culture war, their always successful divide and conquer strategy, their precious ‘empire’ and ‘union’, their fucking entitlement to just ride roughshod over people - always the people who have the least chance of fighting back - to get what they want.

Scottish independence cannot come fast enough. Bring. It. On. 🏴󠁧󠁢󠁳󠁣󠁴󠁿 🏳️‍⚧️

A Brief Summary of Scotland's Anger

Some of you may have heard that England has blocked Scotland's gender reform bill. Others may have seen the demands for dissolution of the union as a result. Please allow me to sum up the anger as impartially as I can:

Historically, the Scottish hate the English for a variety of reasons: see the Jacobite Uprisings and the Clearings. But this is about modern politics, so let's start there.

Essentially the SNP, the ruling political party in Scotland, have been trying for YEARS to get a referendum result where the Scottish people vote to leave the United Kingdom. In 2014, David Cameron (the then prime minister of the UK) gave permission for a referendum to be held, and 55% of the population voted to remain in the UK. Some of the reasons for staying was the economic stability from using the pound sterling currency and being able to stay in the EU, as well as access to funding from the rest of the UK (the arguement being that Scotland could not afford to support itself without help from Westminster).

Since then, the SNP and some of the other, smaller parties have argued that the initial result of the 2014 referendum was not strong enough, and that the initial promises made to the Scottish people are no longer valid (see Brexit and the recent economic crisis for the big examples, but there are others). Recently, the SNP has even taken the matter of the right to hold a second referendum to the Supreme Court, the highest court in the UK and one that deals mostly with English cases. The court ruled that, based on the current laws and treaties, Scotland needed permission from Westminster to hold another referendum. This has angered many people, regardless of if they want to stay or remain, and this latest action against Trans Rights could put more pressure on Parliament.

Scotland, as a country, has always been slightly more to the left of the political spectrum than England, which has led to many political conflicts where England just pulls rank to 'resolve' the issue. For example, Scotland HATES having nuclear weapons, and the UK's nuclear submarines are based on the west coast of Scotland. Another example is in the NHS, where prescriptions are free in Scotland but a flat rate in England. Nicola Sturgeon (leader of the SNP) had wanted to put Scotland in lockdown earlier than England and had even set up a different way out of lockdowns that was more gradual, but it ended up being watered down into 'Scotland had to wear masks for longer than England'.

Now, the Gender Recognition Bill removes many barriers for trans healthcare, such as how long an individual has to self-identify as a different gender to the one they were assigned at birth, lowering the age at which an individual can change the gender on their birth certificate to 16, and removing the need for a gender disphoria diagnosis. The gender disphoria diagnosis is one of the biggest barriers for trans healthcare in the UK at the moment, as a referal to even get the chance to be diagnosed can take years, and people have died on the waitlist just for a first appointment. The Gender Recognition Bill was passed by the Scottish Parliament, also known as Holyrood, by 86 votes to 39. That's pretty good for a bill like this, but the UK Parliament has prevented this bill from receiving 'royal assent', which is required to make the bill enforcable. This has angered a lot of people, as it could be seen as England blocking the will of the Scottish people. Unfortunately, Scotland cannot leave the UK without permission. This is why there has been so much emphasis on a referendum, as the result could put pressure on the UK Parliament. England is reluctant to give permission, and one of the main reasons floated for this are the oil fields in Scottish waters.

TLDR: Scotland has always been annoyed at England, and the latest action to block this bill could tip those bad feelings over into full on anger, revolt and revolution.

Richard Barnard, the cofounder of pro-Palestinian activist group, Palestine Action, was charged under the Terrorism Act by UK police on 29 August. Barnard is being accused of “expressing an opinion that is supportive of a proscribed organization contrary to section 12 of the Terrorism Act 2000.” He also faces two charges of encouragement or intention to encourage criminal damage. A hearing will be held at the Westminster Magistrates’ Court on 18 September.  

The charges against Barnard originate from a probe launched by the UK Counter Terrorism Policing North West (CTPNW) unit into a protest held on 8 October, one day after Operation Al-Aqsa Flood, in Manchester. “After a targeted campaign by the Zionist lobby, Palestine Action’s co-founder Richard Barnard is facing three charges for two speeches. He is accused of supporting a proscribed organization under the Terrorism Act and encouraging ‘criminal activity.’ Mobilize in support at his plea hearing on September 18th from 10:00 AM at Westminster Magistrates’ Court, London, NW1 5BR,” Palestine Action said via social media.

British police raided the home of another Palestine Action activist on the same day that Barnard was charged. The activist is suspected of involvement in the storming of a facility belonging to the Israel-based weapons manufacturer Elbit Systems.  Palestine Action activists have stormed Elbit facilities several times over the past several months in protest against the genocide in the Gaza Strip and against Britain’s provision of arms to Israel. A group of their members stormed an Elbit facility earlier this month, destroying weapons and machinery at the site. 

Elbit Systems supplies 85 percent of the Israeli army’s drones and land-based equipment. It also exports drones, aircraft parts, and other equipment to the UK. On the same day Barnard was charged, UK police British detained pro-Palestinian human rights activist and social media influencer Sarah Wilkinson, reportedly over “content that she has posted online.”

Wilkinson’s arrest came two weeks after Syrian–British journalist Richard Medhurst was detained and questioned by UK police upon his arrival at Heathrow Airport under the Terrorism Act, Section 12. Other British journalists who have reported critically on Israeli, UK, and US foreign policy have also been detained and harassed upon returning to their home country, including The Cradle contributor Kit Klarenberg and Vanessa Beeley.

Judges have ruled that the UK government acted lawfully in blocking Scotland's gender self-ID reforms.

Legislation making it easier for people to change their legally-recognised sex was passed by the Scottish Parliament last year.

The UK government blocked it from becoming law over fears it would impact on equality laws across Great Britain.

The Court of Session in Edinburgh has now rejected a Scottish government legal challenge to the veto.

The Scottish government has 21 days to decide whether it wants to appeal against the ruling, and the case could ultimately end up in the Supreme Court in London.

The legislation received cross-party support in Holyrood, passing by 86 votes to 39 after a highly-charged debate.

Campaigners against the reforms warned the legislation could risk the safety of women and girls in same-sex spaces such as hospital wards and refuges.

Supporters argued it would make the process of obtaining a gender recognition certificate (GRC) easier and less traumatic for trans people.

The legislation would remove the need for trans people to be diagnosed with gender dysphoria by a doctor before they are allowed to change their legally-recognised sex in Scotland, and would lower the age that someone can apply for a GRC from 18 to 16.

The period in which applicants would need to have lived in their acquired gender would be cut from two years to three months.

The UK government stepped in to block the bill from receiving royal assent after it was passed by MSPs, using powers contained in section 35 of the Scotland Act for the first time.

Scottish Secretary Alister Jack raised concerns that the reforms could adversely impact on the 2010 Equality Act, which applies in Scotland, England and Wales and sets out protections for groups including women and transgender people.

The Scottish government challenged the move at the Court of Session - Scotland's highest civil court - with its top law officer, Lord Advocate Dorothy Bain, arguing that Mr Jack did not have "reasonable grounds" to block the bill.

Ms Bain also claimed that if the UK government was successful, Westminster "could veto practically any act of the Scottish Parliament having an impact on reserved matters because he disagreed with it on policy grounds".

But in her written ruling, judge Lady Haldane dismissed the Scottish government's appeal and said the block on the legislation was lawful.

She said Mr Jack followed correct legal procedures when he made his decision to invoke section 35 and that the Scottish government had failed to show that he had made legal errors.

The judge wrote: "I cannot conclude that he (Mr Jack) failed in his duty to take such steps as were reasonable in all the circumstances to acquaint himself with material sufficient to permit him to reach the decision that he did."

Lady Haldane also said that "Section 35 does not, in and of itself, impact on the separation of powers or other fundamental constitutional principle. Rather it is itself part of the constitutional framework."

Welcoming the judgement, Mr Jack said it "upholds my decision to prevent the Scottish government's gender recognition legislation from becoming law".

He added: "I was clear that this legislation would have had adverse effects on the operation of the law as it applies to reserved matters, including on important Great Britain-wide equality protections.

"Following this latest court defeat for the Scottish government, their ministers need to stop wasting taxpayers' money pursuing needless legal action and focus on the real issues which matter to people in Scotland - such as growing the economy and cutting waiting lists."

Alister Jack blocked the legislation because of its potential impact on equalities law that applies across Scotland, England and Wales

Humza Yousaf decided to proceed with the legal challenge shortly after succeeding Nicola Sturgeon - a passionate supporter of trans rights - as first minister earlier this year.

Writing on X, formerly Twitter, he described the ruling as a "dark day for devolution".

Mr Yousaf said: "Today's judgment confirms beyond doubt that devolution is fundamentally flawed. The court has confirmed that legislation passed by a majority in Holyrood can be struck down by Westminster.

"The only way to guarantee we get true self-government is through independence. Sovereignty should lie with the people of Scotland, not a Westminster government we didn't vote for with the ability to overrule our laws."

He was the only one of the three candidates in the SNP leadership contest who backed taking legal action and the issue has been deeply divisive within the party.

Colin Macfarlane, director of nations at LGBTQ+ charity Stonewall, said the ruling would "mean more uncertainty for trans people in Scotland who will be waiting once again to see whether they will be able to have their gender legally recognised through a process that is in line with leading nations like Ireland, Canada and New Zealand."

Labour's shadow Scottish secretary Ian Murray said it was "disappointing this legalisation ended in the courts but this ruling should be respected".

Shortly after the reforms were passed, double rapist Isla Bryson - who changed gender after being arrested for attacking two women - was remanded to a women's jail.

Bryson was subsequently moved to a male prison after the case sparked widespread anger. The Scottish government said the new legislation had no impact on the decision about where Bryson was held.

As befitting an unprecedented case, this is in Lady Haldane's words a "novel and complex" ruling.

She actually concluded in part that this is a situation where many decisions could have been taken, and that "there is possibly no single right answer" - but that the courts should only intervene in the case of a clear error in law.

The judge concluded that Alister Jack was entitled to make a decision on this, and that he had taken the proper steps to come to a view, without going into the even knottier territory of whether it was the right one.

All of that complexity means there could be room for appeal.

The Scottish government will be combing through the ruling to see if there are grounds to go back to court.

Mr Jack has urged them not to, telling them not to waste public funds on further legal action.

But ministers will perhaps put more weight on the position of the Scottish Greens, their partners in government, who are absolutely furious about the "horrible, heartbreaking and unjust" outcome.

Challenging UK ministers on this has been a red line for the Greens in the past. It may be that Scottish ministers have little choice but to fight on if they are to keep their partnership government together.

Meet the ghouls squabbling for power in the race to rule the Tories

Tory MPs are donning their robes and sharpening their sacrificial blades this week as they prepare to ritualistically cull a second candidate from the Conservative Party leadership race. 

Priti Patel was eliminated last week after securing just 11.9% of the vote, which already sounds quite embarrassing, then you do the maths and realise that’s a total of 14 votes. Considering the sheer number of controversies that litter her political career like dog shit in a play park, I’m amazed she didn’t perform better.  

(Formerly of the tobacco industry, Patel voted in favour of overturning the smoking ban because she recognises that mainly poor people use public spaces so, y’know, fuck ‘em.) 

Patel resigned as Home Secretary in 2017 after attending up to a dozen private, unsanctioned meetings with Israeli officials where departmental business was discussed while she was on holiday.

This gross breach of the ministerial code wasn’t enough to prevent her from being reinstated to the position under Boris Johnson’s government, where she dedicated herself to ruthlessly targeting asylum seekers, lobbying for pharmaceutical companies during the height of COVID, and bullying her staff. 

Next up on the chopping block appears to be Mel Stride MP who narrowly escaped elimination last round with a whopping 16 votes. 

(Launching his campaign, Stride said the Tories need to “build trust with the electorate again", presumably so they can get right back to abusing it.)  

Mr Stride served as Financial Secretary to the Treasury in Theresa May’s cabinet, when he spearheaded the controversial loan charge policy which – as of January 2024 – has been linked to ten suicides. He was then elected as chair of the Treasury select committee, effectively securing himself a position where he was the one responsible for scrutinising his own dastardly deeds and, unsurprisingly, finding nothing to be concerned about. 

Former Minister of State for Security Tom Tugendhat limped a single vote ahead of Stride in the first round. Tugendhat is notable only in how boring he is, and hasn’t even breached the ministerial code once (that we know of). Total amateur. His strategy appears to be to fly below the radar, presumably in the hope the other candidates will destroy each other and he can rule over the ashes. 

(Having already lost one leadership race to Liz Truss of all people, Tugendhat looks like a surefire bet to lose another.) 

A former soldier, Tugendhat holds some classically conservative positions like increased military spending, opposition to the European Court of Human Rights and wanting a cap on immigration but these days that’s a mild salsa. He appears moderate compared to the others, and lacks the brain rot and crypto-fascist brainworms that UK conservatives have been steadily importing from America over the last decade. The most interesting thing about him is that he had to change his campaign slogan because the acronym spelled TURD. 

Now we’re done with the dregs, let's take a look at the front runners starting with weed smoking, Warhammer playing, porn enjoyer James Cleverly. That makes him sound much more interesting than he is. Having previously filled both the Home and Foreign secretary positions, Cleverly has long had leadership aspirations.  

(Cleverly once had to apologise for an “ironic joke” about spiking his wife’s drink with rohypnol during a Westminster reception, apparently being both a weird creep and not understanding the definition of irony.) 

Another paint-by-numbers Tory, he stirred up a fuss a few years ago by saying that gay football fans should show "a little bit of flex and compromise" when visiting Qatar for the 2022 FIFA World Cup. He added that it was "important when you're a visitor to a country that you respect the culture of your host nation." Cleverly it seems considers a seven year prison sentence for being gay little more than a cultural quirk rather than something queer football fans might have legitimate concerns over. Basically saying reign it in lads, no need to be homo in public. 

Landing in second place during the last vote is former Minister for Women and Equalities Kemi Badenoch who claimed in a speech last year that transgender people could transition “too easily”. This is supported by the fact that waiting times for an initial assessment are as high as seven years in some parts of the country, so that definitely tracks. Badenoch clearly knows what she is talking about. 

(Speaking on the Spectator podcast, Badenoch said the Tories need to “stop acting like Labour”. I can only assume she misinterpreted the narrowing ideological gap between Labour and Tories as a softening in her party’s ranks rather than a calcification of right wing leanings in Westminster.) 

Characterised as an “anti-woke” politician, she has also supported conversion therapy for trans people. Speaking like someone who has never actually heard themselves talk, she also claimed that providing gender affirming care for trans kids was a “form of conversion therapy” intended to turn gay kids trans. It’s ironclad reasoning and, as a trans dyke, I value above all else the perspective of a cisgender, hetrosexual woman in all matters relating to queer issues. If anyone is going to lay down the law on who gets to be gay and in what way, it should be her. 

Badenoch bravely announced during a recent campaign video that she was unafraid of fictional character Doctor Who. Furthermore, as a woman of colour, she believes that Britain is not institutionally racist, so we can all stop worrying about that now. What a relief, I was starting to get really concerned about it. You know, what with all the institutional racism that’s been going around. But turns out that was a false alarm, which is probably why she also said “I don’t care about colonialism”. 

Badenoch came out swinging on the subject, making claims broader than my fat ass in order to minimise the brutality of Britain's well-documented colonial history. 

"There was never any concept of 'rights', so [the] people who lost out were old elites not everyday people,” she said in some leaked WhatsApp messages. It’s a relief to know that the three million people who died in the 1943 Bengal Famine were all elites. 

Lego figure cosplayer Robert Jenrick is the current frontrunner, having secured 28 votes in the first round. Jenrick served as Secretary of State for Housing, Communities and Local Government under Boris Johnson where he dedicated himself to pulling political favours for luxury property developer and Tory party donor Richard Desmond. The move allowed Desmond to avoid paying a community council levy of £40 million which could have been used to fund schools and health clinics. 

(Courting the far right voters who flocked to Reform in the last election, Jenick resigned from his position as immigration minister, saying the policy of deporting asylum seekers to Rwanda didn’t go far enough.)

Grenfell United, the pressure group dedicated to securing justice for the victims of the Grenfell fire refused to meet with Jenrick in 2020, saying: "Your perceived focus on the interests of property developers over the needs of an impoverished local community has soured our opinion of you.” 

Jenrick also served as Minister of State for Immigration where he took aim at the greatest threat to our nation: unaccompanied asylum seeking children. During a visit to an intake centre in Kent last year he reportedly told staff to paint over a mural depicting cartoons and animals, saying it was a “law enforcement environment” and “not a welcome centre”. 

Finally, someone had the courage to put those kids in their place. If they wanted to experience even a single moment where they felt safe, or like they weren’t completely alone in this terrifying and hostile world, they shouldn’t have crossed the bloody channel should they? They need to learn that actions have consequences, unless of course you’re a Tory politician then you can basically just get away with whatever and certainly not have your political ambition stymied in the slightest. That would be unfair.  

With such political titans in the running, Labour should be quaking in its boots. This gaggle of ghouls is among the finest we could hope for, and the fact that they each crave power enough to run the highest office in the land should in no way concern anyone. As the old adage goes: Power corrupts, but only if you’re a little bitch. 

Which of these unscrupulous, foreigner hating, homophobes will proceed to the next round? Tory MPs will be casting their vote today in order to separate the wheat from the chaff, and trim the eligible candidates down to four. 

This three month slog is only just beginning, so buckle your pants because we have to put up with this fucking circus until November.

However, this progress is contrasted with an increasing anti-trans backlash from certain governments and media outlets. TGEU warns that the risk of regression remains a significant concern.

Countries at Different Stages

While Spain, Moldova, Andorra, Finland, and Iceland have been praised for their development in trans rights, with Iceland topping the ranking, nations like Slovakia face the risk of regression. Ongoing debates in Slovakia revolve around possibly banning legal gender recognition. Romania, Latvia, Lithuania, Cyprus, Belarus, and Bulgaria are also considered weak in protecting trans rights.

Spain’s Significant Changes

Self-ID in Europe

As of March 2023, 11 European countries have legal gender recognition procedures based on self-determination. These include Belgium, Denmark, Finland, Iceland, Ireland, Luxembourg, Malta, Norway, Portugal, Spain, and Switzerland.

The UK’s Controversial Stance

The UK is perceived as falling behind, with recent actions by Prime Minister Rishi Sunak and his government drawing criticism. The blocking of a Self-ID bill by the Westminster government and the proposed plans to ban gay and trans conversion practices have sparked concerns and debates within the country.

Need for Action Beyond Listening

TGEU criticizes many EU member states for failing to meet obligations to trans people. They emphasize the importance of action beyond just dialogue with governments. Additionally, nine countries are cited for failing to provide adequate asylum protection, violating EU law.

Very disappointing about the UK Supreme Court ruling but it may actually help the cause for Scottish Independence as it shows we are not in fact a union of equals.

I imagine it'll be down to using the next general election as a defacto referendum and going to the UN about Westminster not honouring an international treaty and right to self determination.
