After being accused of copyright-infringing CeCe Peniston’s iconic hit 90’s single – ‘Finally’ for her hit Juice, Lizzo may have a lawsuit on her hands.
Lizzo (real name Melissa Vivanne Jefferson), the 31-year-old singer, released her Juice in January 2019. Although the specific Juice didn’t set the charts on fire, it received endless airplay on radio, TV, and almost everywhere. But now, the song has been a subject of accusations of Copyright Infringement.
CeCe, the 50-year-old singer who released ‘Finally’ back in 1992, claims that features of Juice are similar to her song. She also shared a side-by-side comparison of a part of her song where she sings ‘Finally,’ alongside a particular part of Juice where Lizzo sings ‘ya-ya-ee, ya-ya-ee.’
CeCe’s caption, alongside her Instagram post, explains: the comparison between the two songs clearly shows that it is a copyright infringement case where Lizzo’s Juice is infringing ‘Finally.’
CeCe later added that this is a sensitive issue. She loves Lizzo’s music and artistry, but her concern is that lyrics and melody, which she wrote in her song ‘Finally,’ are now a part of Juice. She would like to resolve the issue positively without a nasty legal fight.
Although Lizzo is yet to respond to the allegations, it is not the first time when a singer has been alleged for copyright infringement. For instance, songwriter and producer Justin Raisen has recently alleged Lizzo for lifting the opening line, chords, and melody of her latest single – Truth Hurts from a song titled Healthy, which they had written together earlier this year.
Justin, in an Instagram post, said that they were never communicated about being credited for the profitable use of the parts of ‘Healthy.’ They have attempted to sort out the concern quietly for the past two years, asking for only 5% each but were shut down every time, Justin added in the last.

HUL seeks “Glow & Lovely” Trademark Registration
The meaning of beauty varies according to countries and cultures. While in Africa the darkest skin color with stretched earlobes marks a woman beautiful, in Chinese culture a beautiful woman is the fairest one with small feet. Talking about India, white-skin has always been kept on the highest pedestal. From ancient times till now, the top-most sectors are ruled by the fairer ones. The thought is interjected in the minds of people since childhood. A dark-skinned person, especially a girl is bullied and taunted throughout her life and is forced to seek remedies to get a fairer look. About now, the rise in the power of speech has greatly grouped the youth to create a revolution against this generalized thought. From anti-racial protests to slogans like “Everyone is Beautiful”, has definitely encouraged some to give a thought upon it. Other than that, it’s a long way to go until a transformed mindset is witnessed.

It is no surprise that demands increase production; this is why brands began selling fairness creams and products to lure customers into getting that fair and younger-looking skin, Hindustan Unilever Limited’s “Fair & Lovely” cream being the most renowned example. Seems like the ongoing protests hit them hard, thus and so they decided to eliminate the term “fair” from their brand name. The news came after Hindustan Unilever applied for the mark “Glow & Lovely” before the General of Patent Design and Trademark on June 17, 2020.
The Indian subsidiary of the British-Dutch multinational company Unilever PLC is known for its vast sales of FMCG products throughout Asia.  HUL’s “Fair & Lovely” attracts numerous markets majorly in Asian countries including India, Pakistan, Indonesia, and Sri Lanka, with a promising turnover of over 3000 crores. Many might think, this is an impact of anti-racist protest in the US, but Chairman Sanjiv Mehta says, rebranding was “purely coincidental.”
The present application filed for registration of “Glow & Lovely” states the mark is intended to be used for goods including soaps, oils, creams, lotions, beauty masks, facial packs, skincare preparations, shaving preparations, pre-shave and after-shave preparations, cologne, etc. As of now, the application is forwarded for ‘Vienna Codification’ and after further assessment and inspection formalities, a check of distinctiveness shall be done.
Post mentioning a prior application before the concerned Registry for the same mark in 2018, an HUL spokesperson said, “Some of them have received registration, while some applications are pending. We may choose to register other brand names too. We want to manage the unveiling of the new brand name carefully because we want to make sure that the market isn’t filled with counterfeit products that are unsafe. We will not be able to confirm what the new name will be.”
While talking about curbing out the generalized beauty norms and adopting a holistic vision of beauty, Chairman Mehta said, “We always believe in social justice as an organization. But this is something which we have been planning and we have done a huge amount of research on. These are not changes that you do immediately.”

Omantel “eFloos” digital wallet enables Local & International Money Transfers
Omantel, the leading provider of integrated telecommunication services in the Sultanate, reaffirms its commitment to offer value added services. With the introduction of “eFloos” digital wallet, customers can make safe and swift payments, especially through the Coronavirus (Covid-19) pandemic, where social distancing is required to stop the spread of the virus.
The digital wallet, which was launched in March 2019 in collaboration with Sohar International and Arab Financial Services (AFS) enabled over 12,000 users to perform transactions to India, Sri Lanka, Malaysia, Nepal, UK, Pakistan, Bangladesh, Egypt and the Philippines through a mobile application without the need for a bank card.
As a pioneering technological innovation in financial transactions industry, the digital wallet “eFloos” has been well received and widely used. Although it was initially confined to transactions among eFloos users only, the digital wallet currently enables its users to perform fund remittances with users of other digital wallets or banks in the Sultanate. Since launch, the number of users of the digital wallet “eFloos” has been growing reaching 12,000 users now, while the number of registered trademarks accepting payment option through eFloos has reached 547 trademarks.
Commenting on this, Mohamed Al Hakmani, Omantel’s Senior Manager of Emerging Services – Consumer Business Unit, said, “We strive at Omantel to align our efforts and initiatives with Oman Vision 2040 through continuous investment in ICT infrastructure and solutions. Last year when we were planning to offer a fintech solution that offers users ease of cashless payment and remittances, we entered into partnership with Sohar International, a leading bank in the Sultanate of Oman to launch eFloos in March 2019. We are proud of the customers’ response that saw the number of users growing to 12,000 now”.
“Nowadays, with the current exceptional circumstances of Covid-19. Customers are reconsidering the cash they handle on daily transactions, contactless and digital payment methods are a safer alternative that offers more secure transactions and less physical interaction. The eFloos digital wallet witnessed continuous upgrades including improved application user interface and adding new features, countries and languages. Besides, we have broadened the scope of users benefiting from this application. All this is aimed at providing a seamless and safe payment experience for our customers.” Al Hakmani added.
Customers can credit funds to their accounts through more than 140 Omantel bill payment machines available across various governorates in the Sultanate or by using debit cards issued in the Sultanate of Oman.

England hammered West Indies in Southampton to take a significant step towards the World Cup semi-finals, but sustained injuries to Eoin Morgan and Jason Roy along the way.
Roy hurt his left hamstring and Morgan suffered a back spasm, both while fielding.
Despite those setbacks, England dismissed West Indies for only 212 thanks to the hostility of pace pair Jofra Archer and Mark Wood, who took three wickets each.

Archer takes two wickets in two balls
This meeting between arguably the two most entertaining teams in the tournament promised much – a potential slugfest between speedy attacks and batting line-ups packed with power.
When Barbados-born Archer was hurling rockets at the belligerent Chris Gayle, the promise looked set to be fulfilled.
From there, though, England efficiently dismantled the sloppy West Indians, firstly exploiting the early damp conditions, then coasting the chase when the sun appeared.
The win may yet come at a price, though. Roy left the field in the eighth over of the day after pulling up while chasing the ball.
He missed almost seven weeks of action with a hamstring injury earlier this year.
Morgan’s back spasm came in even more innocuous circumstances, when he was moving to the non-striker’s stumps to back-up a throw.
Judging by the way he left the field – crestfallen and barely able to walk – the diagnosis of a back spasm actually seemed like good news, but the full extent of his and Roy’s injuries are yet to be revealed.

Archer, who has a British father, opted to play for England after joining county side Sussex. His decision was fuelled by previously missing out on the West Indies squad for an Under-19 World Cup.
After qualifying to play for England in March, he was already their leading wicket-taker in this World Cup and seemed to turn things up a notch against a team he knows so well.
The crucial blow, though, was struck by Liam Plunkett. Gayle was dropped by a diving Wood at third man when on 15 and was threatening some trademark destruction when he pulled Plunkett to deep square leg to depart for 36.
From 55-3, the Windies were stabilised by a stand of 89 between Nicolas Pooran, who made a composed 63, and Shimron Hetmyer.
With Adil Rashid starting poorly, Root made the breakthrough – he had both Hetmyer and Jason Holder caught and bowled.
From there, Archer and Wood, passed fit after ankle soreness, took over.
Their venom, at lengths of either very short or very full, saw the last five wickets fall for 24 runs.

‘Absolute comedy’ – Gayle lights up match with bowling antics
Given the setbacks of the injuries and the dangerous nature of the West Indies, this was England’s most impressive display of the tournament so far.
By the end, when Gayle was rolling out ineffective off-breaks while still wearing his cap, the gulf between two sides that drew a series 2-2 earlier this year was massive.
Any suggestion that the meagre target would be a challenge was dispelled at the beginning of the England chase, when Bairstow and Root ruthlessly dealt with some awful West Indies bowling.
The elevation up the order did little to change Root’s method – he played glorious cover drives and hared between the wickets.
Even after Bairstow uppercut Shannon Gabriel to third man for 45, the Windies could not take advantage of the promotion of Woakes, who helped himself to 40.
Soon after, Root, the tournament’s leading run-scorer, became the first England batsman to register a third hundred in World Cup cricket before Ben Stokes hit the winning runs.

Eight+ Things to Read About China and Other Things, Part 3
This is part 3 of our (relatively) new series on listing out eight+ things to read about China and a lot more. We constantly get emails from readers asking what to read on China and all sorts of things related and even barely related to China and the plan of this series would be to constantly and consistently answer this very question. We also have a few very loyal readers who often send us truly great articles on China (and other things). We owe these unpaid and truly superb researchers a big debt and this week’s post is dedicated to them!
As I said in our initial post on this, our plan is to list out eight (or so) articles we benefitted from reading and think you our readers would also benefit from reading, along with a very brief explanation why the particular article was included. More specifically:
The articles will likely include many on China and on Asia and a few on international trade, international politics, Spain and Latin America, economics and really just anything else we believe might benefit our readers or even that we just want people to read. We do not plan to choose articles that push our or any other political agenda or any other agenda for that matter, but having said that, we are not objective and our views may creep through. Our goal though is to focus on articles that are important or helpful or — most importantly — that make you think. Our posting of an article will NOT mean we agree with all of it or even any of it. Most of the articles will be from the week preceding the post but we will also sometimes throw in older articles (classics if you will) as well.
And though I have said this previously, it is important enough that I feel compelled to state it again: Please do not hesitate to comment at the end of this or any other post. We cannot tell you how much we appreciate your comments, good, bad and indifferent.
Here we go, in absolutely no particular order
1.Let Go of Your Grudges. They’re Doing You No Good. New York Times.  Because the older you get the more you realize how true this is.
2. The Preachers Getting Rich from Poor Americans. BBC. Because if there is a hell, there has to be a special place there for those who (1) steal from the poor (2) in the name of religion. It is also troubling how many Americans fall for this sort of thing. Is there any other country where this goes on as much as in the United States? This is not a rhetorical question; I would love people to answer it.
3. Iraq’s Christians close to extinction. BBC. Speaking of religion, why is the world being silent as the Arab world moves apace in getting rid of pretty much anyone who is not a Muslim. Within 25 years, there very well might be no Christians nor Jews left in any Arab country, but for an expat or two in a place like Dubai. For a somewhat more uplifting flip side, read this BBC article, The man who might have stopped Sri Lanka’s Easter bombings, on a Muslim in Sri Lanka who acted on his belief that “people of different religions should get along.”
4. What Four Decades of China Trademarks Says About Chinese Trademarks. Managing Intellectual Property. The data say that the number of trademark filings are exploding in China and the reason is because they are super-important and they work. See China Trademarks: Register Yours BEFORE You Do ANYTHING Else.
5. Five Reasons Why Valencia, Spain Should Be Your Next Holiday Destination. Because I spent a summer in Valencia, Spain, working on my Spanish and I loved living there, but if you are going to Spain for a week or two, there are easily 20+ places you should visit before going to Valencia. Valencia is a really nice city the way Grand Rapids, Michigan (45 minutes from where I grew up) is a really nice city, but if you are a tourist in the United States and you go to Grand Rapids over New York or San Francisco or Las Vegas or Santa Fe or Yellowstone National Park or…. you are making a mistake.
6. Bart Starr was the toughest football player who ever lived. ESPN. Because, along with Walter Payton, he was. And because I get to use this Bart Starr article as an excuse to cite to a 1999 article I read on Walter Payton at least once a year, entitled, He Was the Rock of the Bears, because it is maybe the singular best/most moving piece/most accurate piece of sports journalism ever:
Walter Payton always got up. Always.
For 13 years with the Bears he took every hit, survived every collision, confronted every menace, shook off every tackle, always gave better than he got. Walter Payton always got the extra yard. Always.
He was the rock of the Bears, the one to take the ball every time anyone wanted to hand it to him, and he outlasted a full dozen Bears quarterbacks, any one of whom can claim no higher accomplishment than having handed the football to Walter Payton.
Because I would watch Payton on TV every week and when he retired my football consumption decreased by about 98%.
7. Why Business Schools are Shutting Down their MBA Programs? Because there is a lot of talk out there about how MBAs are neither relevant nor worthwhile, but all I know is that my clients with MBAs always strike me as exceedingly well educated in a wide range of areas relevant to operating a business. At the same time, what’s the deal with all of these one year practical Master’s Degrees springing up that look more like certificate programs. Is this degree inflation?
8. How to Pack a First Aid Kit for Extended International Travel. New York Times. Not because I don’t think it’s possible to easily secure Ibuprofen at a Oaxaca or Hohhot pharmacy, but because there is a lot to be said for being able to reach into your carry on to pull out bandages to stanch the bleeding you get from a badly constructed/maintained Qingdao Airport security scanner or to give your kid Ondansetron when she wakes up at 3:00 a.m. in a Seoul hotel throwing up.
9. China won when Trump blindsided Mexico with tariffs, says former Mexican ambassador to China. CNBC. Because Trump’s proposed tariffs on Mexico are stupid/incoherent/unnecessary/bullying/etc. and they give China the ability to argue that the tariffs against China are no different, even though they are. Because they make the world further question how much they can trust the United States. Everyone better hope these tariffs never go into effect, but even if they don’t there will be long-lasting damage from this.
10. Want to Keep Your Business in China? Do These Things Now. This is the first time (and it very well may be the last time) I’ve listed another China Law Blog Post on here, but I feel compelled to do so because the post came out late on Friday afternoon (not exactly prime time) and it was the second post of the day and I worry not enough people will see it. Yesterday, China’s Ministry of Commerce announced it will kick out of China “foreign enterprises, organizations and individuals that do not comply with market rules, violate the spirit of contract, block or cut supplies to Chinese firms with non-commercial purposes, and seriously damage the legitimate rights and interests of Chinese enterprises” and I take that threat exceedingly seriously. This post explains the things foreign companies and individuals need to do now to minimize their chances of being shut down and/or booted out. So yes, it is important!

Tile Inc., an American consumer electronics company specializing in providing wireless tracking devices and services, has quite recently filed four Trademark Infringement lawsuits against CellnTell Distribution Inc., 888 Digital Inc., S&W Dealz, and Digital Pavilion Electronics. The four lawsuits are filed in the New York Northern District Court, New Jersey District Court, Massachusetts District Court, and New York Eastern District Court, respectively.
Tile has accused all the four defendants of unauthorized and wrongful promotion and sale of its products. The company sells its products via authorized resellers. Additionally, it has also implemented an authorized reseller network for assuring that all of its products sold meet the high standards of quality control. Tile sells its products under the “Tile” brand, and none of the defendants in this lawsuit filed are authorized resellers. It got its “Tile” trademark registered long back and has been using it since 2014. The company always advertises, distributes, and sells all of its products to the customers under its Registered Trademark.
According to Tile, all four defendants are responsible for offering for sale and selling non-genuine Tile’s products under its registered trademark. It stated that the unauthorized sales don’t have the company’s warranty. It concluded by saying that the defendants are deceiving the customers in the market by selling the products that aren’t covered under Tile’s warranty and also lack quality. For instance, Tile believes that CellnTell Distribution and S&W Dealz are involved in selling stolen products on e-commerce platforms like Amazon by advertising that the products are all new. When it comes to 888 Digital, Tile mentioned that the company is marketing Tile’s products as new and deceiving the customers by selling used, liquidated, or even potentially stolen Tile products on its official business website. Meanwhile, talking about Digital Pavilion Electronics, Tile specified that the company is selling non-genuine Tile products bearing Tile’s registered trademark on Amazon and other platforms.
The defendants’ actions, without any second thoughts, have confused the customers and damaged Tile’s goodwill and reputation as the customers believe that they are buying the legitimate products in the scenario where the reality is the opposite.
As a consequence of these unauthorized actions, Tile has claimed in its lawsuit filed that it is losing upon a lot of profits and suffering a loss of the enormous goodwill and reputation, which the company has created in its registered trademark over the years. Additionally, Tile has stated that the unauthorized sellers have indeed infringed upon its registered trademark via the reproduction, sale, distribution, interstate commerce, and advertisement of its products. At last, Tile said that all the four defendants are involved in willful trademark infringement, unfair competition, deceptive trade practices, and false advertising violations. As the slogan “OK Boomer” has gained remarkable attention in the mainstream beyond Generation Z, someone has applied for the Trademark Registration of “OK Boomer” with the United States Patent and Trademark Office (USPTO).
TikTok, the incredibly popular video-sharing app, has emerged as a launchpad for various viral memes and internet trends, including “OK Boomer” to diss the older generation. Someone is attempting to capitalize on this latest internet meme spawned from Generation Z by filing a Trademark Application to get it registered with the USPTO.
Teens have been using the phrase “OK Boomer” to push fun at old generations for being and remaining out-of-touch and controlled it as a rallying cry over the internet, especially TikTok. The slogan has obtained attention in the mainstream – thanks to articles – in news outlets, encompassing profile from the New York Times’ Taylor Lorenz.
Hence, the fact that people are finding ways to extract profit from the popularity of the slogan or phrase beyond framing social media content or receiving laughs out of their friends should not come as a surprise.
The application filed on 31st October 2019 with the US Patent and Trademark Office (USPTO) shows that someone is trying to turn “OK Boomer” into a Registered Trademark. The $275 application, which aims to trademark “sweaters, shirts, accessories, and shorts,” appeared sporting the two-word slogan.
The person behind the recent trademark application isn’t the only individual or first one with the idea of getting merchandise “OK Boomer” registered. A 19-year-old girl, Shannon O’Connor, recently announced that she has been marketing hoodies and shirts with “OK Boomer” in style similar to the font on the plastic shopping bags, which read “thank you.” She further continued by saying that since promoting her Bonfire merchandise on TikTok, the girl had made around $25,000 in sales. Indeed, not just Shannon but many other sellers have also been using the phrase “OK Boomer” to sell buttons and stickers for iPhone cases and coffee mugs.
Indeed, the latest filing with the USPTO is just a trademark application, and in general, the process of obtaining Trademark Protection for anything by officially registering it takes more than a year. Besides, considering that “OK Boomer” has already seemed on merchandise and in the current culture, it is a bit unclear how successful the trademark application would prove.
A case that could provide an idea regarding the “OK Boomer” trademark potential is Lebron James’ recent endeavor to trademark the two-word phrase – “Taco Tuesday.” The USPTO rejected the basketball star’s trademark application stating that the phrase is a “commonplace term, expression, or message” used widely by several sources that convey a familiar and well-recognized sentiment or concept. ✅  For view-source: https://bit.ly/2s505dr
