Two women have filed federal complaints against Texas hospitals they say refused to treat their ectopic pregnancies, leading both women to lose their fallopian tubes and endanger their future fertility. Texas law allows doctors to terminate ectopic pregnancies, a condition in which the fertilized egg implants in the fallopian tubes, instead of the uterus. Ectopic pregnancies are always non-viable and can quickly become life-threatening if left untreated. Despite these protections, these women say they were turned away from two separate hospitals that refused to treat them. The complaint alleges that the doctors and hospitals are so fearful of the state’s abortion laws, which carry penalties of up to life in prison when violated, that they are hesitating to perform even protected abortions.
The complaints were filed with the U.S. Department of Health and Human Services, under the Emergency Medical Treatment and Labor Act, or EMTALA, a federal statute that requires hospitals to provide stabilizing medical care to anyone who shows up. That rule has long been interpreted to include medically necessary abortions, which has run up against state bans, including in Texas. Typically, federal EMTALA complaints are investigated by state health agencies, but the Center for Reproductive Rights, which filed the complaint, is asking for it to instead be handled by the federal Centers for Medicare and Medicaid Services, or CMS. “CMS should not rely solely on a state agency’s assessment of the facts in reaching its determination because of Texas state officials’ hostility toward interpreting EMTALA as requiring hospitals to provide pregnancy termination to pregnant patients experiencing emergency medical conditions,” they wrote in the complaints. The U.S. Supreme Court earlier this year declined to say that Idaho’s abortion ban trumps the EMTALA requirement, but a federal appeals court in New Orleans has found that Texas hospitals cannot be required under EMTALA to provide life-saving abortions.
Similar diagnoses, similar results
Kyleigh Thurman says in the complaint that she went to Ascension Seton Williamson Hospital in Round Rock, north of Austin, with a tubal ectopic pregnancy. She says the hospital initially discharged her without treating the ectopic pregnancy, but she returned three days later with vaginal bleeding and worsening symptoms. Despite her doctor’s orders, the hospital refused to give her methotrexate, a common treatment that stops an ectopic pregnancy from continuing to develop. “Infuriated, Ms. Thurman’s OB-GYN met Ms. Thurman at Ascension Williamson to plead with the medical staff to give her methotrexate,” the complaint says. They eventually agreed. But it was too late; the ectopic pregnancy had grown too large, and ruptured. Thurman nearly bled to death and had to have her right fallopian tube removed. A spokesperson for Ascension declined to discuss the specifics of the case, but said in a statement that they are “committed to providing high-quality care to all who seek our services.”
Kelsie Norris-De La Cruz had a similar experience at Texas Health Arlington Memorial Hospital, outside Dallas. An emergency room physician diagnosed her with a tubal ectopic pregnancy and said she should get an injection of methotrexate or have surgery to remove the pregnancy. She chose surgery, but once the on-call OB/GYNs arrived, the complaint alleges, the hospital refused to treat her and told her to come back in 48 hours. “Ms. Norris-De La Cruz’s mother asked if the hospital’s refusal to provide care had anything to do with Texas’s abortion bans but received no response,” the complaint says. “As the conversation became more heated, the OB/GYN confirmed it was possible that Ms. Norris-De La Cruz could rupture over the next 48 hours and subsequently stormed out of the room.” Texas Health did not immediately respond to request for comment.
Norris-De La Cruz eventually found an OB/GYN through a friend who agreed to perform an emergency surgery to remove the ectopic pregnancy. By then, the mass had grown so large that it required also removing her right fallopian tube and 75% of her right ovary. “I ended up losing half of my fertility and if I was made to wait any longer, it’s very likely I would have died,” Norris-De La Cruz said in a statement. “These bans are making it nearly impossible to get basic emergency healthcare. So, I’m filing this complaint because women like me deserve justice and accountability from those that hurt us. Texas state officials can’t keep ignoring us. We can’t let them.”

A spokesperson for Texas Health said: “Treatment decisions are individualized based on a patient’s clinical condition and we believe the care provided to the patient in this case was appropriate.”
This is the future Republicans want for everyone in America, if they win in November they will enact a national abortion ban and scare the shit out of doctors all across the country leading to thousands of cases just like this every year. The Biden Administration has taken a number steps to try to protect access including issuing guidelines requiring hospitals to preform emergency abortions no regardless of state laws but if Trump is reelected those guidelines will go away day one and situations like this will get much more common as doctors will be stripped of federal legal protection in emergency situations and become more fearful of state laws.

Instead, they advised her and her mother to go home and wait, according to medical records reviewed by The Washington Post.
Norris-De La Cruz ultimately received emergency surgery about 24 hours later at a different hospital in the area, at which point her ectopic pregnancy had already started to rupture. The OB/GYN who performed the procedure said that, if Norris-De La Cruz had waited much longer, she would have been “in extreme danger of losing her life.”

Pointing to one outbreak at a watermelon farm in Alachua County and another in a migrant community known as Indiantown in Martin County, DeSantis argued that “the close contact” in those households as well as the work environments of farm laborers are “really providing areas for the virus to thrive.”
“Some of these guys — they go to work in a school bus, and they are all just like packed there like sardines, going across like Palm Beach County or some of these other places, and (there’s) all these opportunities to have transmission,” DeSantis said Tuesday, adding that some of the workers are “migratory” and that the state’s health department is alerting Georgia and Alabama about “what may be coming down the pike.”
In Texas, Gov. Greg Abbott continues to insist there is no reason for alarm because the state’s hospital bed capacity is dramatically better than it was earlier this year when the pandemic first hit.
Abbott, who wore a mask to his press conference and took it off while speaking, has rebuffed a request from nine city mayors that would allow them to require masks in their cities. He says local officials should be using other tools at their disposal — like fining rule-breakers for big gatherings. The Texas governor also said the rise in cases this week was due to a batch of positive tests that all came in on June 10 from Texas prisons and a data error in rural Pecos County.
“As we continue the process of opening up Texas — as we continue to have Texans return to their jobs, so that they are able to earn a paycheck that will help them pay their bills and put food on their tables,” Abbott said, “…we remain laser focused on maintaining abundant hospital capacity.”
Both DeSantis and Abbott have argued they always expected case numbers to rise when testing increased, statements that directly contradict the assertions by epidemiologists that case numbers should go down with greater testing, because theoretically health officials should be able to trace the cases and slow the spread of the virus.
Mixed messaging as coronavirus cases rise in many states
President Donald Trump has set the tone for these Republican governors from the top, intently focusing on ensuring that the economy recovers as the November election looms.
Trump described the virus as “fading away” during an interview this week as he prepares to host a campaign rally in Tulsa, Oklahoma, on Saturday that could pack thousands of people into arena with no requirement for participants to wear masks.
Vice President Mike Pence urged governors during a call this week to highlight ramped up testing in their states as a reason coronavirus cases are rising. Pence, who heads the administration’s coronavirus task force, declared on Thursday in Michigan that the nation has proven “that we can safely reopen America.”
“Every single day we are one day closer to putting the coronavirus in the past,” Pence said during remarks at a Michigan steel plant Thursday. “We slowed the spread. We flattened the curve. We cared for the most vulnerable, and we saved lives.”
Those claims by Trump and Pence, however, are not supported by the facts. Twenty-three states saw an increase in new cases between June 10 and 17, according to a Appradab analysis of data from John Hopkins University.
Florida and Texas are two of the 10 states experiencing record-high seven-day averages of new coronavirus cases, according to the analysis.
Florida officials are pointing to an “aggressive testing” strategy in their state, where DeSantis noted that health officials have made testing available to every resident of a long-term care facility as well as to the employees who work there.
Florida, which allowed certain businesses to reopen on May 4, announced its highest single-day count Thursday since the pandemic began, according to data released by the Florida Department of Health. The percentage of people testing positive hit a new peak of 10.18% on Tuesday, before falling to 9% on Wednesday, according to the new data from the state health department.
“Certainly as we reopened, we did expect to see an increase — but not like this,” St. Petersburg Mayor Rick Kriseman said during an interview on Appradab’s “At this Hour” Thursday. (The number of cases reported each day in Pinellas County, where St. Petersburg is located, has risen dramatically since early June).
“There are all kinds of alarm bells that are going off for me,” said Kriseman, a Democrat. “I’m not comfortable with what I see happening in my community,” he said, explaining his decision to require business employees to wear masks if they come face-to-face with customers beginning on Friday. “I think you’re going to see mayors across the state of Florida that are going to take actions in response to these numbers because we’re just not seeing that from our leadership in Tallahassee.”
But DeSantis this week rejected the notion that reopening Florida businesses led to the record numbers of cases, and said he did not think a requirement to wear masks is necessary. Restaurants, he noted, have been open for close to six weeks in some areas: “The idea that that all of a sudden is the reason (for the increase), I’m not sure that’s the case.”
“So no, we’re not shutting down, we’re going to go forward,” DeSantis said. “We’re going to continue to protect the most vulnerable. We’re going to urge, continue to advise, particularly our elderly population to maintain social distancing, avoid crowds.”
The Florida governor noted that from the beginning of the outbreak, he has recommended people wear masks if they are face-to-face with another person, or can’t socially distance. But, he said: “You don’t need to be wearing it if you are going for a jog or you’re on the beach. And so, some of this stuff can get out of hand. I want to be reasonable about it.”
DeSantis noted that the state has “6,400 ventilators that are just sitting idle.”
Texas governor battles mayors over mask requirements
Abbott has focused on Texas’s ability to handle new cases as hospitalizations reached a new record this week with 2,947 coronavirus patients — nearly doubling since Memorial Day (when 1,534 hospitalizations were reported), according to the Texas Department of State Health Services dashboard.
In their letter to Abbott, a group of mayors argued that requiring Texans to wear face coverings “could prove to be the most effective way to prevent the transmission of this disease.”
“Yet many people in many of our cities are still refusing to wear these face coverings even though these coverings are scientifically proven to help prevent the disease from spreading,” the mayors wrote in their letter Tuesday. “If mayors are given the opportunity to require face coverings, we believe our cities will be ready to help reduce the spread of this disease.” The mayors of Houston, San Antonio, Austin, Dallas, Fort Worth, El Paso, Arlington, Plano and Grand Prairie — a mix of Republicans, Democrats and Independents — signed on to the letter.
But the governor contends local officials asking for more authority have not imposed penalties and enforcement mechanisms currently available to them if Texans break the rules by participating in large gatherings, for example.
“I make clear on a daily basis around the entire state of Texas that wearing a mask is very important, and local officials send that same message,” Abbott said this week. “So all of us have a collective responsibility to educate the public that wearing a mask is the best thing to do. Putting people in jail, however, is the wrong approach.”

Rating Methodology
Health Inspections Every year, the government assigns inspectors to conduct a formal review of nursing homes for regulatory purposes to meet the mandates outlined for Medicare and Medicaid, this aims to measure and improve the safety of residents across providers. Facilities may also be inspected when complaints are submitted or based on a reported incident. When noncompliance is identified, the facility is served a citation that indicates which regulation that was identified, along with the severity of the incident. Nursing homes are subsequently required to execute a program of resolution in order to meet compliance. Some scenarios require enforcement actions to be applied, such as a civil monetary penalty or withholding of payment(s), to incentivize resolution in a timely manner. Penalties Facilities are applied 2 types of penalties due to non-compliance / accumulation of incidents. Civil penalties are monetary fines that may be applied to a facility based on citations / infractions identified during a review. The severity of a penalty is defined primarily by the size and frequency of the infraction. Quality of Residence Care There are 3 types of resident care ratings, but for this exercise, we primarily focused on the overall quality measure rating. The quality measures (QMs) include 17 data points that are derived from clinical information reported by the respective nursing home and also from Medicare claims data submitted for payment. Ratings are calculated for the QM domain using the 4 most recent quarters for which data are available. A nursing home receives points contingent on performance on each measure (weighting distribution is not equal). Staffing Staffing research is submitted regularly by the facility and is adjusted for the requirement of the facilities residents. For each of registered nurse staff and total staffing, a 1 - 5 rating is applied according to definitions established for each category. These ratings are subsequently combined to assign an overall staffing rating. As an example, to get an overall staffing rating of 5 stars, nursing homes must earn a rating of 5 stars for both registered nurses and total staffing. Nursing homes could also be assigned a 1 star rating should they not have a registered nurse on-site daily, and do not submit staffing data, or which the data cannot be verified.

KAUFMAN, Texas — Effective immediately, Texas Presbyterian Health of Kaufman Hospital is among 14 DFW emergency rooms who are no longer in the Blue Cross Blue Shield of Texas network after negotiations failed between the insurance provider and the emergency room contractor.
Contrary to belief, BCBS says most emergency rooms are not operated by the hospital it’s attached to. Many ER doctors, including those who work in Kaufman, are actually employed by third-party contractors that work with hospitals. Currently, Texas Health Resource ER doctors work for a contracting company called Texas Medicine Resources.
BCBS is warning members that they could face steep bills if they use emergency rooms that are no longer in network after negotiations failed between BCBS and the emergency room contractor, according to a statement from BCBS which was also sent to all BCBS Texas customers, the largest health insurance provider in the state.
“We try to negotiate contracts with these outside companies to bring and keep them in network, so you won’t have to pay more for services. In some cases, they choose not to contract with us,” the letter reads.
Customers who do go to these ERs will likely face steep bills, the letter warns. BCBS is encouraging its members to double-check which hospitals are in-network, and to use an in-network urgent care center or hospital in the case of an emergency.
The letter is below.
“Dear Member:
We want you to know that as of April 15, 2019, the emergency room (ER) doctors at many Texas Health Resources (Texas Health) facilities are no longer in our network. Texas Health is a network facility, but most of its ER doctors work for an outside company, Texas Medicine Resources.
Hospitals across the nation are hiring outside companies to run their ERs and employ the doctors, nurses and other health professionals you see when you visit the ER. Since these outside companies are not in our network, there are no limits to what their providers charge, potentially resulting in significantly higher out-of-pocket costs.
We try to negotiate contracts with these outside companies to bring and keep them in network, so you won’t have to pay more for services. In some cases, they choose not to contract with us.
Things to know about emergency care at Texas Health:
While the facilities listed on the following page remain in our network, the doctors with Texas Medicine Resources who staff their ERs are out of network as of April 15, 2019.
You may get multiple bills, including one from Texas Health and one from Texas Medicine Resources. This can vary based on the care you received.
Because they are out of network, Texas Medicine Resources doctors can charge you more than our allowed amount.
All plans help pay for medically necessary emergency care services. Go to the nearest hospital or urgent care when you have a true emergency.

MLB Bullets is a legend in these parts
We interrupt your regularly scheduled off-season deals and rumors fest for this special report from Arlington, Texas.
It wasn’t unexpected, but Rangers third baseman Adrian Beltre called it a career after 21 seasons. If I’m correct, I believe this means that Bartolo Colon is the only remaining active player from the 1990s.
As Tim Kurkjian writes, no one had more fun playing baseball than Adrian Beltre.
Benjamin Hoffman calls Beltre the “all-time great that you didn’t notice.”
Except, as Grant Brisbee notes, you probably did. Brisbee calls Beltre the favorite ballplayer of the baseball internet bubble. Brisbee notes that while the public at large may not have been aware of Beltre’s greatness, those of us who live in a world where we regularly read about baseball on the internet (and that means you, because you’re here reading this) were hip to the greatness of Adrian Beltre. I mean, you know that Beltre has a higher career WAR than Brooks Robinson, George Brett and Wade Boggs, right? That’s what makes you (and Beltre) special.
The other thing that made Beltre special was how much fun he had at the game and Emma Baccellieri writes that the game is now less fun without Beltre in it.
Bill Baer explains why Beltre is a no-doubt Hall-of-Famer.

Perhaps no one will miss Beltre more than his friend and teammate Elvis Andrus who posted a tribute about what Beltre meant to him.
The Yankees and Mariners made a major deal as the Mariners sent pitcher James Paxton to New York in exchange for pitchers Justus Sheffield and Erik Swanson along with outfielder Dom Thompson-Williams.
Jeff Sullivan breaks down the deal for both sides.
Travis Sawchik writes that the Yankees got the best pitcher available this winter and he may only get better in New York.
Zach Kram explains why Paxton really is an “ace” pitcher and possibly one of the ten best pitchers in the game today.

Grant Brisbee has some rules for how to take this blockbuster trade in.
Jeff Passan writes that with the Paxton deal, the Yankees sent a message to the Red Sox (and the rest of the American League) that the Yankees aren’t to be ignored. Passan also writes that the consensus within the game is that the Mariners return for Paxton, while not bad, is “a little light.” Many of the other commentators linked to above came to similar conclusions.
Mike Axisa points out that the Yankees aren’t done this winter with the Paxton deal and explains what they still need to accomplish.
The Mariners aren’t done yet either and there is a rumor that the Mariners are discussing a deal with the Padres that would send Jean Segura and Mike Leake to San Diego for Wil Myers.
Staying with the Padres, they have designated third baseman Christian Villanueva for assignment and he is expected to sign with NPB’s Yomiuri Giants. Villanueva, a former Cubs farmhand, was the National League Rookie of the Month for April, but the rest of his 2018 season didn’t live up to its first month.
We spent most of yesterday at Bleed Cubbie Blue tracking Cubs roster moves before rosters froze for until the Rule 5 draft. But other teams had interesting day as well. For example, the Rays DFA’d C.J. Cron, who hit .253/.323/.493 with 30 home runs for Tampa Bay in 2018. This puzzling move was made to protect more minor leaguers from the Rule 5 draft, but some are pointing Cron being arbitration-eligible this winter. Still, it seems like even the Rays could easily afford Cron.
The Marlins designated Derek Dietrich for assignment, who had been the team’s longest-tenured player.
The Mets released reliever Jenrry Mejia, who hasn’t pitched since 2015 thanks to three PED suspensions.
The Nationals got a catcher as they signed free agent Kurt Suzuki to a two-year deal worth $10 million. It’s Suzuki’s second stint with the Nats.
Jon Paul Morosi has seven MLB storylines as we head into the Thanksgiving holiday.

One of the biggest issues surrounding free agent Bryce Harper this winter is his defensive play, which by all measures was frankly terrible in 2018, but not bad at all in every year before that. This piece by Mike Petriello is the best that I’ve seen that explains what went wrong with Harper in the field in 2018 and why the defensive metrics were so hard on him. Unfortunately, you can see what you want to see in the details. There are many that suggest that it was a momentary blip in Harper’s career and others that are more troubling.
Ben Lindbergh does a similar dive into Harper’s defense. Lindbergh also goes deep into the details and seems to conclude that Harper was “Roger Dorn-ing” it (perhaps subconsciously) so as to not get hurt before his impending free agency.
Here’s good news. Indians outfielder (and former Cub) Leonys Martin has been cleared to begin baseball activities with no restrictions. Martin was hospitalized at the end of last season with a potentially life-threatening infection.
More good news from Cleveland. The Indians revealed their new red alternate home jerseys, which are the first Cleveland uniforms in 70 years not to feature Chief Wahoo. (Unless you count their trip to Toronto last summer where they just removed the patches.)
The new Pioneer League team in Colorado Springs have declared themselves to be the “Rocky Mountain Vibes” and have a roasted marshmallow/s’mores theme. This one is a bit too wacky for even me, but maybe you like it. It’ll probably sell a lot of merchandise, which is all that really matters.
Two pitchers, David Price of the Red Sox and Jonny Venters of the Braves, were named Comeback Players of the Year.
