Old man Bruce Wayne being held hostage. On one hand, he's a hard ass and no one could intimidate him. Just being perfectly grouchy while the bad guys plan is falling apart. Played for laughs. On the other hand, "kill another hero or your sugar daddy gets it" to Terry...and have Bruce encourage Terry to leave him dead? That his life isn't worth all the good the newer guys do? Heartbreaking. Bruce waiting out the clock for his medicine so they don't have to choose and the baddies lose their leverage.
That would be such a heartbreaking scene, but I can see Bruce being willing to die (especially if it was a choice between him and another person).
Terry wouldn't want to let him die, and especially not when it was on him to save him. And he wouldn't really listen to Bruce if he thought he had another choice.
But Bruce planning for his own death using his medicine or lack there of as a means of taking that choice out of Terry's (or the villain's) hands is exactly something he would do.
Either way it would be so sad, but thematically I think it would be great, giving Bruce a meaningful death that highlights his strategic mind and his desire to help others even when he's not physically able to be Batman anymore.

20/20.
This year, in hindsight, was a real write-off. I had grand plans for it, and while I ushered it in in a very low-key manner since I was recovering from the flu, I’d expected things to look up. Well, you know what they say about plans (RIP, my trip to Europe). I got very, very sick in early February, and I’m not entirely sure it wasn’t COVID. Since March, the days have been a carousel of monotony: coffee, run, work, cook, yoga, existential spiral, sleep. My Own Private Year of Rest and Relaxation, if you will. Of course, life has a way of breaking through regardless; I attended protests, completed my thesis, graduated from grad school, took a couple of road trips upstate, and celebrated the accomplishments and birthdays of friends and family from a safe social distance. It was all a bit of a blur, and not ideal circumstances to re-enter the real world, or whatever this COVID-present is.
Throughout it all, in lieu of happy hours, coffee dates, and panel discussions, I’ve turned even more to culture and cuisine to fill the the negative space on my calendar where my social life once resided. However, since a global pandemic ought not to disrupt every tradition, here’s my year-end round up of what made this terrible one slightly more tolerable.
TV
After an ascetic fall semester abstaining from TV in 2019 (save for my beloved Succession), I allowed myself to watch more as the year wore on, and especially after graduation. I caught up on some cultural blind spots by finally getting around to The Sopranos, Ramy, Search Party, and Girlfriends. I wasn’t alone in bingeing Sopranos, it absolutely lived up to the hype and then some; this Jersey Girl can’t get enough gabagool-adjacent content, pizzeria culture is my culture!
Speaking of my culture, there was also a disproportionate amount of UK and European shows in my queue. Nothing like being in social isolation and watching the horny Irish teens in Normal People brood. I’m partial to it because I share a surname with the showrunner, so I have to embrace blind loyalty even though there was, in my opinion, a Marianne problem in the casting. Speaking of charming Irish characters with limited emotional vocabularies, I belatedly discovered This Way Up a 2019 show from Aisling Bea and Sharon Horgan. And while Connell and Marianne are actually exceptional students, I found the real normal people on GBBO to bring me a bit more joy. Baking was abundantly therapeutic for me this year, and watching charming people drink loads of tea and fret over soggy bottoms was a comfort. I also discovered the Great Pottery Throw Down, and as a lifelong ceramics enthusiast, I cannot recommend it highly enough if you care about things like slips, coils, and glazing techniques. GPTD embraces wabi sabi in a way that GBBO eschews flaws in favor of perfection, and in a time of uncertainty, the former reminded me why I miss getting my hands in the mud as a coping mechanism (hence all the baking). Speaking of coping mechanisms, like everybody else with two eyes and an HBO password, I loved Michaela Cole’s I May Destroy You; though we’ve all had enough distress this year for a lifetime, watching Cole’s Arabella process her assault and search for meaning, justice, and closure was a compelling portrait of grief and purpose in the aftermath of trauma. Arabella’s creative and patient friends Kwame and Terry steal the show throughout, as they deal with their own setbacks and emotional turmoil. Where I May Destroy You provides catharsis, Ted Lasso presents British eccentricity in all its stereotypical glory. At first I was skeptical of the show’s hype on Twitter, but once I gave in it charmed me, if only for Roy Kent’s emotional trajectory and extolling the restorative powers of shortbread. For a more accurate depiction of life in London, Steve McQueen’s series Small Axe provides a visually lush and politically clear-eyed depiction of the lives of British West Indians in the 60s, 70s, and 80s. Lastly, how could I get through a recap of my year in tv if I don’t mention The Crown. Normal People may have needed an intimacy coordinator, but the number of Barbours at Balmoral was the real phonographic content for me.
Turning my attention across the Channel, after the trainwreck that was Emily in Paris, I started watching a proper French show, Call My Agent! It’s truly delightful, and unlike the binge-worthy format of "ambient shows” I have been really relishing taking an hour each week to watch CMA, subtitles, cigarettes, and all.
Honorable mention: The Last Dance for its in-depth look at many notable former Chicago residents; High Fidelity for reminding me of the years in college when my brother and I would drive around listening to Beta Band; and Big Mouth.
Music
My Spotify wrapped this year was a bit odd. I don‘t think “Chromatica II into 911″ is technically a song, so it revealed other things about my listening habits this year, which turned out to remain very much stuck in the last, sonically. I listened to a lot more podcasts than new music this year, but there were some records that found their way into heavy rotation. While I listened to a lot of classics both old and new to write my thesis (Paul Simon, Leonard Cohen, Prokofiev, and Bach) the soundtrack to my coursework, runs, walks, and editing was more contemporary. Standouts include:
Saint Cloud by Waxahatchee, which makes me feel like I’m breathing fresh air even when I’m stuck inside all day
La Bella Vita by Niia, which was there for me when I walked past my ex on 7th avenue (twice!) and he pretended that I didn’t exist
Fetch the Bolt Cutters by THEE Fiona Apple, because Fiona, our social distancing queen, has always been my Talmud, her songs shimmering, evolving, and living with me every year
Shore by Fleet Foxes, for the long drive to the Catskills
Women in Music, Pt. III by HAIM, because these days, these days...
Musicians have been reckoning with tumult this year as much as the rest of us, and the industry has dealt with loss on all fronts. I’d be remiss not to talk about how the passing of John Prine brought his music into my life, and McCoy Tyner, who has been a companion through good and bad over the years.
Honorable mention to: græ by Moses Sumney; The Main Thing by Real Estate; on the tender spot of every calloused moment by Ambrose Akinmusire; Punisher by Phoebe Bridgers; folklore by you know who; and songs by Adrianne Lenker.
Reading
What would this overlong blob be without a list of the best things I read this year? While I left publishing temporarily, books, the news, and newsletters still took up a majority of my attention (duh and/or doomscrolling by any other name). I can’t be comprehensive, and frankly, there are already great roundups of the best longform this year out there, so this is mostly books and praising random writers.
Last year I wrote about peak newsletter. Apparently, my prediction was a bit premature as this year saw an even bigger Substack Boom. But two new newsletters in particular have delighted me: Aminatou Sow’s Crème de la Crème and Hunter Harris’ Hung Up (her ”this one line” series is true force of chaotic good on Blue Ivy’s internet). Relatedly, Sow and Ann Friedman’s Big Friendship was gifted to me by a dear friend and another bff and I are going to read it in tandem next week.
On the “Barack Obama published a 700+ page memoir, crippling the printing industry’s supply chains” front, grad school severely hamstrung my ability to read for pleasure, but I managed to get through almost 30 books this year, some old (Master and Margarita), most new-ish (Say Nothing, Nickel Boys). Four 2020 books in particular enthralled me:
Uncanny Valley: Anna Wiener’s memoir has been buzzed about since n+1 published her essay of the same name in 2016. Her ability to see, clear-eyed, the industry for both its foibles and allure captured that era when the excess and solipsism of the Valley seemed more of a cultural quirk than the harbinger of societal schism.
Transcendent Kingdom: Yaa Gyasi’s novel about faith, family, loss, and--naturally--grad school was deeply empathetic, relatable, and moving. I think this was my favorite book of the year. Following the life of a Ghanaian family that settles in Alabama, it captured the kind of emotional ennui that comes from having one foot in the belief of childhood and one foot in the bewilderment that comes from losing faith in the aftermath of tragedy.
Vanishing Half: Similarly to Transcendent Kingdom, Brit Bennett’s novel about siblings who are separated; it’s also about the ways that colorism can be internalized and the ways chosen family can (and cannot) replace your real kin. It was a compassionate story that captured the pain of abuse and abandonment in two pages in a way that Hanya Yanagihara couldn’t do in 720.
Dessert Person: Ok, so this is a cookbook, but it’s a good read, and the recipes are approachable and delicious. After all the BA Test Kitchen chaos this summer, it’s nice we didn’t have to cancel Claire. Make the thrice baked rye cookies!!!! You will thank me later.
Honorable mention goes to: Leave The World Behind for hitting the Severance/Station Eleven dystopian apocalypse novel sweet spot; Exciting Times for reminding me why I liked Sally Rooney; and Summer by Ali Smith, which wasn’t the strongest of the seasonal quartet, but was a series I enjoyed for two years.
Podcasts
I’m saving my most enthusiastic section for last: ever since 2018, I’ve been listening to an embarrassing amount of podcasts. Moving into a studio apartment will do that to you, as will grad school, add a pandemic to that equation and there’s a lot of time to fill with what has sort of become white noise to me (or, in one case, nice white parents noise). In addition to the shows that I’ve written about before (Still Processing, Popcast, Who? Weekly, and Why is This Happening?), these are the shows I started listening to this year that fueled my parasocial fire:
You’re Wrong About: If you like history, hate patriarchy, and are a millennial, you’ll love Sarah Marshall and Michael Hobbes’ deep dives into the most notable stories of the past few decades (think Enron and Princess Diana) and also some other cultural flashpoints that briefly but memorably shaped the national discourse (think Terri Schiavo, Elian González, and the Duke Lacrosse rape case).
Home Cooking: This mini series started (and ended) during the pandemic. As someone who stress baked her way through the past nine months, Samin Nosrat and Hrishikesh Hirway’s show is filled with warmth, banter, and useful advice. Home Cooking has been a reassuring companion in the kitchen, and even though it will be a time capsule once we’re all vaccinated and close talking again, it’s still worth a listen for tips and inspiration while we’re hunkered down for the time being.
How Long Gone: I don’t really know how to explain this other than saying that media twitter broke my brain and enjoying Chris Black and Jason Stewart’s ridiculous banter is the price I pay for it.
Blank Check: Blank Check is like the GBBO of podcasts--Griffin Newman and David Sims’ enthusiasm for and encyclopedic knowledge of film, combined with their hilarious guests and inevitable cultural tangents is always a welcome distraction. Exploring a different film from a director’s oeuvre each week over the course of months, the podcast delves into careers and creative decisions with the passion of completists who want to honor the filmmaking process even when the finished products end up falling short. The Nancy Meyers and Norah Ephron series were favorites because I’d seen most of the movies, but I also have been enjoying the Robert Zemeckis episodes they’re doing right now. The possibility of Soderbergh comes up often (The Big Picture just did a nice episode about/with him), and I’d love to hear them talk about his movies or Spike Lee (or, obviously, Martin Scorsese).
Odds & Ends
If you’re still reading this, you’re a real one, so let’s get into the fun stuff. This was a horrible way to start a new decade, but at least we ended our long national nightmare. We got an excellent dumb twitter meme. I obviously made banana bread, got into home made nut butters, and baked an obscene amount of granola as I try to manifest a future where I own a Subaru Outback. Amanda Mull answered every question I had about Why [Insert Quarantine Trend] Happens. My brother started an organization that is working to eliminate food insecurity in LA. Discovering the Down Dog app allowed me to stay moderately sane, despite busting both of my knees in separate stupid falls on the criminally messed up sidewalks and streets of Philadelphia. I can’t stop burning these candles. Jim Carrey confused us all. We have a Jewish Second Gentleman! Grub Street Diets continued to spark joy. Dolly Parton remains America’s Sweetheart (and possible vaccine savior). And, last, but certainly not least: no one still knows how to pronounce X Æ A-12 Boucher-Musk.

Giannis is taking over the NBA, one playoff game at a time
MILWAUKEE — More than any young player in the game today, Giannis Antetokounmpo is staking his claim as the Next One in the great player lineage. He not only possesses the requisite combination of awesome talent and extreme competitiveness, he also has the rare gift of an easy, unforced charisma.
Antetokounmpo exudes both joy and unrelenting passion in his work. There is nothing dour about his persona, no great weight of the world resting upon his broad shoulders. Perhaps that’s still to come. Or perhaps we are witnessing his take over in real time with events happening too fast to even put it into proper context.
Consider Game 2 of the Eastern Conference finals, which was over a few minutes after it began. On the game’s first possession, Antetokounmpo rebounded his own miss and threw down a vicious two-handed dunk. On the second, he blocked Toronto’s Marc Gasol into oblivion. On the third, Giannis got loose for yet another dunk. And a few plays later, he kicked it out to Nikola Mirotic for a wide-open 3-pointer.
Over four possessions in the span of two and half minutes, Giannis imposed his will on the game and left no doubt that the Bucks were heading to Toronto with a 2-0 series lead. He showed it all in those opening minutes: the rim-rattling dunks, the imposing deterrent at the basket, and the crafty passing that has taken his game to an entirely new level.
“To script those first three possessions — and the blocked shot, to me, is the one that stands out,” said Bucks coach Mike Budenholzer said. ���I think when Giannis is active and protecting the paint, protecting the rim — he plays so hard. He lays it all on the line all the time.”
That, right there, is the essence of Giannis. He is not waiting his turn or asking for permission. Instead, he is taking this postseason and making it his own. Just as he did during the regular season when he led the Bucks to the best record in the league en route to what looks like the first of many Most Valuable Player seasons.
In the aftermath of yet another tour-de-force performance that featured 30 points, 17 rebounds, and five assists there was still a feeling that we still haven’t seen the best of what he can offer. Like, this dude is only scratching the surface of a potential so vast that it belies description or even categorization.
“I’m beyond fortunate to have Giannis,” Budenholzer said. “He’s incredible, and then you’re like, I think he can be even better. The great part about Giannis is he wants to be better. We’re coaching him and we’re on him. We think he can be doing more, and he just soaks it up. It’s just so unique to have a player like that that just wants to be great and you feel like he has more, and yet he’s been phenomenal. You can’t say enough good things about Giannis.”
Throughout NBA history there has been a well established protocol for any young player seeking to ascend to the pantheon of the immortals. First, there is the phenom stage when everyone marvels at the talent and dreams impossible dreams. Giannis enjoyed an extended version of this honeymoon phase because he arrived before us so raw, and so unknown.
Then, there is the reckoning, when playoff disappointments are tabulated and the challenge reveals itself. That’s where weaknesses are magnified and improvements become mandatory.
This is the path that Michael Jordan and LeBron James took. For MJ, it was developing a post game and learning to trust his teammates. For LeBron, it was adding a jump shot and understanding the proper balance between facilitating and domination.
On rare occasions, the struggle comes after the validation. Think Magic Johnson filling in for Kareem Abdul-Jabbar as a rookie and leading the Lakers past the 76ers in the 1980 Finals. Or Larry Bird winning a championship in his second season. Both players had to deal with post-championship fallout before reaching their prime years.
Antetokounmpo lies at the crossroads of those two journeys. Having absorbed the lessons of three first-round exits in the relative anonymity of low-key expectations, his Bucks are now two wins away from reaching the Finals. It’s a sudden turn of events that’s actually six years in the making, but it’s still staggering to consider how far he’s come in his career.
A setback, even at this stage, would set him on the familiar course established by LeBron and MJ. Winning it all would cast his trajectory into unchartered territory. However you want to frame it, Giannis has arrived as a force to be reckoned with for the next decade.
His emergence comes at a pivotal time for the league as it transitions from what could be the final act of the Warrior dynasty along with the latter stages of LeBron’s career. If these playoffs were first shrouded in uncertainty without LeBron’s immense star power, they have instead turned into a showcase for Antetokounmpo’s sublime gifts.
His talent is as undeniable as it is evolutionary. Like LeBron, he can do things that players his size would have never even considered, let alone attempted. Whether it’s getting to the basket with two giant strides from the mid-court line or flying in for a chasedown block, Giannis is good for a handful of transcendent players each night that leave you shaking your head in awe.

As Toronto’s Pascal Siakam put it, “Giannis is Giannis. I don’t think there’s anybody like him.”
What has separated him this postseason is his patience. Still just 24 years old, he plays with a poise and purpose that belies his age and experience. Consider the obvious hole in his game, which is the lack of a reliable jump shot. That may still come, and when it does, “We’re f--ked,” as a scout put it before the game. And by ‘we,’ he means the whole league.
Yet, Giannis has come up with a counter, which is reading the defense and making the right play. With shooters spread all over the court, his ability and willingness to kick it to open teammates out of double and triple teams is just as effective as doing it all himself. In fact, it’s even better since it involves every one of his teammates who have proven to be elite role players.
Some of Antetokounmpo’s most impressive work during the playoffs has come from elevating others. One night it’s Brook Lopez. The next it’s Malcolm Brogdon or Ersan Ilyasova. Playing with Giannis is a Podium Game waiting to happen for whoever has the hot hand. That’s the genius of the Bucks roster, and that was the message Coach Bud imparted to him before the season.
“That’s one of the things that Bud told me the first time we met,” Antetokounmpo said. “He told me, ‘You can be good. We know that. But how can we make your teammates be effective?’”
After the Bucks only loss of the postseason against Boston, Giannis set the tone by not taking the bait and trying to do it all by himself. Instead, he made the right passes and his teammates thrived. In the opener of the Eastern Conference finals, his 24-and-14 seemed ordinary by his standards. Yet, his effort was underscored by an understanding that trying to do too much would be detrimental to his team’s performance.
“This is the beauty of basketball,” Antetokounmpo said. “This is the beauty of our team, that we trust one another.”
And then there’s the competitiveness. Tales of his late night workouts are legendary, so much so that Budenholzer noted off handedly that it wouldn’t be a bad thing if he toned some of it down and allowed his body more time to rest and recover. There’s a balance that comes with age, but Giannis has the one thing you can’t teach, which is internal drive.
“It’s elite,” Budenholzer said. “There’s a lot of good players. There’s a lot of talent in this league. I think there’s a lot of great competitors in this league. And then there’s others that competitiveness just is on that next level. And it just stands out to you when you talk to him, when you watch him work and practice. He wants to win. And the great thing about him is, I think he’s happy when his teammates succeed. He’s happy when others are playing well, and he just — he’s all about winning.”
He’s all about winning.
Those four words are the ultimate compliment in this league. Beyond the glitz and glamour, it’s that drive to win that separates the great talents from the truly elite. This is what Giannis is delivering night after night and this is what we’ve come to expect. It’s all happening right now before our very eyes. Ready or not, the future of the league is here and he’s not waiting his turn.

“This is just one more positive chip at this point, and if Anthony Davis is trying to decide if he can trust if we can build a winner, I hope we can build evidence of that day after day. And if AD wants to be part of that, wonderful. And if he doesn’t buy into what we’re trying to do, that’s okay too. This isn’t something for me that’s answered in a conversation. The answer is revealed over a period of time.”

Reaction: Count me among those who will be shocked if Griff can convince AD to sign that supermax extension, but if winning the lottery moves the needle ever so slightly then it’s worth trying.
“I can’t remember. When he had 33 in the second half, were they trapping then? They were? And he scored 33 in the second half? OK. Yeah, we’ll look at that.”

Reaction: Terry Stotts has wrung solid defensive teams during his tenure by dropping his big man into the paint and taking away the rim. That doesn’t work against Steph Curry. Stotts is no fool and he adjusted his coverages in Game 2.
“I talk about it all the time, so I blame you guys for not exposing it more. I don’t know. I think Klay gets lost in the shuffle a little bit around here just because we’ve got Steph and K.D., two MVPs, past MVPs. Draymond gets a lot of attention, as he should. He’s an All-Star player, and he’s kind of the emotional heartbeat of our team. Klay just kind of blends in sometimes. But you ask any coach around the league, he’s one of the most respected players in the game because of his ability to play both ends.”

Reaction: Kerr has a point. There have been times over the years when I’ve had a vote — whether it’s for All-Star or All-NBA or All-Defense — when I’ve thought about Klay and then voted for someone else whose impact seems a little bit greater because they don’t have so much talent around them. Honestly, that does him a great disservice.
“When they got Draymond with the ball in his hands and Steph and Klay moving around, coming off screens, you got to go to the ball because those guys shoot so well and once Draymond gets it, somebody has to step up and he’s great about making the next play. You know, one guy is getting a lot of attention and you’ve got to find somebody who can get the ball and then make the next play because it’s basically four-on-three. He’s just really good at it.”

Reaction: My favorite thing about the playoffs has been the resurrection of the Steph-Draymond pick-and-roll. Obligatory note that enjoying the way the Warriors play without Kevin Durant does not make them ‘better’ without KD.
“I think you have to as a player. You know, we can’t sit and look over our shoulder and say, “Hey, man, when is K going to be back.” We just got to play with whatever we got.”

Reaction: Players are way better than everyone else at contextualizing things like injuries and not worrying about them. Seems like a good life lesson.

Consumable NBA thoughts
It’s been a while since a lottery affected the course of NBA history the way this one did. Here are five thoughts on the ping pong balls, or whatever it is they use now.
The lottery gods love Griff
In addition to being an astute executive, David Griffin has a lock on lottery luck. He’s been with teams that grabbed the top overall pick in 2011, 2013, 2014, and now 2019. OK, so one of those picks became legendary bust Anthony Bennett, but Griff used those other choices to draft Kyrie Irving and Andrew Wiggins (who he turned into Kevin Love.) There’s been some talk about how the Pels don’t deserve the top pick since they squandered Anthony Davis’ first years, but that’s not how this works?
The lottery gods also looked kindly on Memphis
The Grizzlies took some heat from the basketball nihilism wing for actually trying down the stretch. Turns out that effort was rewarded with the second overall pick. Take that nihilists! That choice should be Murray State phenom Ja Morant. That, in turn, will make trading Mike Conley a little bit easier to justify. Good for the Grizz. Tanking is overrated. Trying is good for the soul.
This isn’t that bad an outcome for the Knicks
It’s very New York to be disappointed with only getting the third pick in a lottery in which Phoenix and Cleveland tumbled out of the top four. Sure, missing out on a chance to draft Zion Williamson is a tough beat, but the Knicks will still have control over the draft once Zion and Morant go 1-2. Considering Memphis won’t get into the Anthony Davis sweepstakes, the Knicks have the best trade asset in this draft. Is that enough to get AD? Maybe, maybe not, but it might get you someone else, should you decide to move the pick. The Knicks have options. That’s a good thing!
The Lakers have to decide what kind of team they want to be
Los Angeles went into this draft looking at a late lottery choice and wound up with the fourth pick. That gives them four top-four picks in the last five years, which should have been enough to construct a vibrant young roster. They messed up with D’Angelo Russell and arguably goofed by going with Lonzo Ball over Jayson Tatum and De’Aaron Fox. (It’s early yet, so we’ll reserve full judgment.) The larger issue is that developing young talent doesn’t go hand-in-hand with an enjoyable LeBron James experience. So, what it will be? Feels like a decision is necessary.
The lottery changes worked
By leveling out the odds at the top of the lottery, the NBA gave less of an incentive for teams to tank. And by expanding the draw to the top four picks, it allowed for a team like the Lakers to move up to four providing a further degree of volatility. We’ll never have a perfect system, but this was an improvement on the old way of doing things. Hooray for progress.

As soon as Justice Anthony Kennedy announced his retirement after 31 years on the Supreme Court, picking his replacement immediately became one of Donald Trump’s most important acts as president. Kennedy is a center-right figure who is solidly conservative on most business and First Amendment cases but strongly pro-gay rights and cautiously supportive of reproductive rights. His replacement is sure to be a more doctrinaire conservative along the lines of Neil Gorsuch, Trump’s first pick for the Court.
Unusually, Trump has been releasing shortlists of candidates he’d consider for the Court ever since the presidential campaign. His current list, issued in November 2017 in the aftermath of Gorsuch’s appointment, has 25 names. It’s largely a list of solidly conservative options who’d be on most Republican nominees’ shortlists for the Court.
Not all 25 are likely to make it very far in Trump’s vetting. Prediction markets can help us winnow down the list. The following nine people are listed on PredictIt as having the best odds of being tapped by Trump to replace the departing Kennedy. They are listed according to their ranking as of Wednesday at 9 pm Eastern.

Current position: Federal appellate judge (DC Circuit Court of Appeals)
Why Trump picked him: Brett Kavanaugh has about as long and high-profile a record in Republican legal circles as anyone on this list. A former clerk to Anthony Kennedy, as well as appellate judges Alex Kozinski and Walter Stapleton, he represented Cuban child Elian Gonzalez pro bono during the conservative battle to keep him from returning to Cuba, and was one of the George W. Bush campaign’s lawyers in the Florida recount.
Before that, though, Kavanaugh was a protegé of Kenneth Starr, whom he served both in the solicitor general’s office under George H.W. Bush and as independent counsel during the investigation into the Clinton family’s Whitewater real estate deal. He was a principal author of the Starr Report, which detailed Bill Clinton’s affair with Monica Lewinsky and misrepresentations of that affair in sworn testimony.
“As a prosecutor, Kavanaugh set a bracing literary standard (‘On all nine of those occasions, the President fondled and kissed her bare breasts…’),” the New Yorker’s Jeffrey Toobin recalled in 2012, “but his work as a judge may be even more startling.” Toobin cites Kavanaugh’s opinion on the DC Circuit when considering a constitutional challenge to the Affordable Care Act:
[A]ccording to Kavanaugh, even if the Supreme Court upholds the law this spring, a President Santorum, say, could refuse to enforce ACA because he “deems” the law unconstitutional. That, to put the matter plainly, is not how it works. Courts, not Presidents, “deem” laws unconstitutional, or uphold them. “It is emphatically the province and duty of the judicial department to say what the law is,” Chief Justice John Marshall wrote in Marbury v. Madison, in 1803, and that observation, and that case, have served as bedrocks of American constitutional law ever since. Kavanaugh, in his decision, wasn’t interpreting the Constitution; he was pandering to the base.
It’s hardly his only stridently conservative opinion on the DC Circuit. In a profile for Ozy, Daniel Malloy notes, “Kavanaugh this year declared that the Consumer Financial Protection Bureau is unconstitutional, given the agency’s independence and unitary structure, and he has voted repeatedly to slap back aggressive regulations from Barack Obama’s Environmental Protection Agency.”
At the same time, Kavanaugh knows how to do the DC song and dance of pretending not to believe what he clearly believes on key questions of jurisprudence. He told senators during his confirmation hearings that he’d respect precedent on abortion and declined to share his views on Roe v. Wade. But there’s little doubt that he’d be a doctrinaire conservative on the Supreme Court, and one with a strong belief in presidential power, similar to Samuel Alito.
C-SPAN
Current position: Federal appellate judge (Seventh Circuit Court of Appeals)
Why Trump picked her: Amy Coney Barrett, only 46, is relatively new to the bench; her first appointment came from Trump in 2017. She only got her commission last November. But Clarence Thomas was barely on the circuit court for a year when he was elevated to the Supreme Court, and there’s no reason Barrett couldn’t follow in his footsteps.
A clerk to conservative appellate Judge Laurence Silberman as well as Antonin Scalia, and a longtime professor at her alma mater Notre Dame Law School, Barrett’s confirmation hearings earned headlines due to a controversial line of questioning from Democratic Sens. Dick Durbin (IL) and Dianne Feinstein (CA), who asked her repeatedly about her Catholic faith. Durbin asked, “Do you consider yourself an orthodox Catholic?” while Feinstein commented, “When you read your speeches, the conclusion one draws is that the dogma lives loudly within you.”
Liberal groups, while not defending the precise questioning, highlighted some of her writing on questions of Catholic faith and constitutional interpretation as concerning, noting a piece she co-authored that rejected Justice William Brennan’s argument that Catholic judges should always hold the Constitution as more important than their religious faith. In her confirmation hearing for the Seventh Circuit, Barrett asserted that these were her co-author’s views, not her own.
Barrett also argued that the birth control benefit in the Affordable Care Act impinges on religious liberty, argues that cases like Roe v. Wade might not need to stand as precedents if future courts judge them to be wrongly decided, and has explicitly asserted that the “original public meaning” of the Constitution must be upheld, even though that “adherence to originalism arguably requires, for example, the dismantling of the administrative state, the invalidation of paper money, and the reversal of Brown v. Board of Education.”
Barrett was ultimately confirmed with only three Democrats (Joe Manchin, Joe Donnelly, and Tim Kaine) voting in favor. But an elevation to the Supreme Court would force a much larger dispute about what, exactly, she believes the original meaning of the Constitution requires.
Roy Engelbrecht
Current position: Federal appellate judge (Third Circuit Court of Appeals)
Why Trump picked him: Donald Trump’s been known to say that “the police in our country do not get respect.” That is assuredly not Thomas Hardiman’s fault.
On the Third Circuit, Hardiman has consistently sided with law enforcement against defendants and inmates. He ruled that a policy of strip-searching jail inmates didn’t violate the Fourth Amendment’s protections against unreasonable search (an opinion the Supreme Court upheld). He’s also written, in dissent, that the First Amendment does not give citizens the right to tape police — something with which every state in the union currently disagrees.
Hardiman’s pre-judicial career is full of the kinds of things liberals and Democrats don’t like: He donated to Republican candidates before being appointed to the bench (something that is neither illegal nor, to most legal experts, a big deal), and he represented plenty of political clients and political cases while he was in private practice. Most of this is insignificant: Just like it’s a defense lawyer’s job to defend murderers, it’s a civil lawyer’s job to defend companies accused of discrimination.
But it’s ironic that one of Hardiman’s most high-profile cases was a housing discrimination suit against a company accused of conspiring to keep out low-income clients — given that the president who might appoint him to the Supreme Court, early in his own career, settled a housing discrimination suit of his own against the federal government.
Perhaps most relevant to Hardiman’s chances, though, is that he was reportedly Trump’s second choice after Neil Gorsuch to replace Antonin Scalia. Despite his conservative record, grassroots right-wing activists freaked out when his name was floated, arguing he could be a stealth liberal (the evidence for this was shockingly weak). Perhaps, then, second time’s the charm?

Current position: Federal appellate judge (Sixth Circuit)
Why Trump picked him: Thapar was a US attorney turned district court judge appointed by George W. Bush when Trump first floated him as a Supreme Court candidate in September 2016. But district court judges are almost never elevated directly to the Supreme Court (the last person to make that jump was Edward Terry Sanford in 1923), and so nominating him for a circuit court was a natural stepping stone for an eventual Thapar Supreme Court bid.
Brian Fitzpatrick of Vanderbilt Law, who researches federal courts, told Bloomberg BNA that Thapar was ”very Scalia-like and Thomas-like” in his jurisprudence. The liberal group Demand Justice has, accordingly, already mobilized to stop his prospective nomination. They highlight a 2016 decision in which he ruled that a Kentucky state prohibition on political contributions by judges violated the First Amendment; his judgment was later overturned by the Sixth Circuit, which argued the restriction furthered a “compelling interest in preventing the appearance that judicial candidates are no different from other elected officials when it comes to quid pro quo politics.”
The left-wing Alliance for Justice highlights five other decisions sure to come up should Thapar be nominated, including one where he ruled that a male employee alleging a male coworker sexually harassed him had to provide “credible evidence that the harasser was homosexual,” and another where he imposed harsh sentences on antiwar activists, including a nun, for an anti-nuclear protest that he alleged threatened national security (their convictions were later overturned).

Current position: Federal appellate judge (Sixth Circuit Court of Appeals)
Why Trump picked him: Raymond Kethledge appears to be the kind of judge who very much enjoys telling people why they’re wrong.
In 2014, he wrote an opinion upholding the use of credit checks to screen potential employees at Kaplan, a for-profit education firm, defending the company from an Equal Employment Opportunity Commission (EEOC) lawsuit. The opinion noted, pointedly, that use of credit checks was permitted by the EEOC’s own hiring guidelines — an act of gotcha jiujitsu that was praised by the Wall Street Journal. More recently, in a case involving the IRS’s alleged persecution of conservative political groups, Kethledge forcefully ordered the agency to turn over information — and rejected the tactic it had tried to use in its defense as an “extraordinary remedy” not appropriate for a suit like this.
But if you’re picturing Kethledge as a mini Scalia, all flashy rhetoric and black-and-white conservative principle, you’re off the mark. He was a Senate Judiciary Committee staffer under Michigan Republican Spencer Abraham in the 1990s, but Abraham, while a founder of the Federalist Society, was also a pro-immigration Arab American who lost (to Debbie Stabenow) after being attacked as a terrorist sympathizer. And during his confirmation hearings before the committee in 2003, he emphasized his pro bono work with criminal defendants and low-income residents trying to keep their homes.
A 2013 Kethledge opinion, which is already being cited outside his home circuit, says “there are good reasons not to call an opponent’s argument ‘ridiculous’” — not the least of which, he elaborates, is that you might be wrong. It’s hard to imagine hearing that sentiment from Scalia — or from the president now offering to appoint Kethledge to the highest court in the land.

Current position: Federal appellate judge (Sixth Circuit Court of Appeals)
Why Trump picked her: Judicial conservatives have historically believed in a restrained executive. Donald Trump very much does not.
Then again, neither did President George W. Bush. So Trump could do worse than to appoint someone who worked in the Office of Legal Counsel during Bush’s administration — and wrote one of the legal memos on which he based his administration’s activities in the early days of the war on terror.
Joan Larsen was a deputy assistant US attorney general from 2002 to 2003. While that’s the period during which the Office of Legal Counsel (led by John Yoo) churned out memos authorizing waterboarding and other forms of torture, Larsen claims she didn’t have the security clearance to know anything about those. She did, however, write a memo about indefinite detention — one that still hasn’t been released to the American Civil Liberties Union, despite a lawsuit.
Larsen has some experience in the judicial branch: She was a clerk for Antonin Scalia himself before going to the executive branch. (After his death, she wrote a eulogy for the New York Times in which she said her proudest moment was persuading him “that a criminal defendant should win a case that none of the justices originally thought he should win.”) She was appointed by Michigan Gov. Rick Snyder (R) to the state’s Supreme Court in 2015. Between the two, she taught constitutional and criminal law at the University of Michigan and served as counsel to the dean.
Her tenure in the Bush White House didn’t sink Trump’s nomination of her to Sixth Circuit in 2017, to which she was confirmed by a 60 to 38 vote (with both Michigan Democrats voting yes). But it will be newly relevant if she is nominated to replace Kennedy.
Justice Britt Grant
Current position: State Supreme Court justice (Georgia)
Why Trump picked her: Grant, 40, was appointed to the Georgia Supreme Court in 2017 by Republican Governor Nathan Deal. She’s since been offered a promotion of sorts: Trump tapped her as a judge for the 11th Circuit Court of Appeals. She faced a relatively uneventful Judiciary Committee hearing in May — though her confirmation is currently caught up in Sen. Jeff Flake’s (R-AZ) fight on tariffs.
Grant is one of the younger of Trump’s potential nominees, but, based on her resume, she’s a reliably conservative, Federalist Society card-carrying justice. She worked in the George W. Bush White House on the Domestic Policy Counsel, did a stint at the white-shoe Kirkland & Ellis LLP as an associate, and clerked for Kavanaugh.
Her judicial resume is a bit thin for Supreme Court territory, though the bulk of her litigation experience comes from her time as Georgia’s solicitor general from 2015 to 2017, and before that, her work as the counsel for legal policy in the Office of the Georgia Attorney General. Liberal groups have objected to Grant for her work on amicus briefs in politically charged Supreme Court cases, including Shelby County v. Holder, regarding the Voting Rights Act, which Grant said she “edited and reviewed.”

Current position: United States Senator (Utah)
Why Trump picked him: It might not seem surprising that Donald Trump would put the chair of the Senate Judiciary Committee’s Subcommittee on the Constitution on his Supreme Court long list. But back in 2016, when Donald Trump put out the first edition of the judge list, Lee was very much not on it.
Lee, stung by Trump’s treatment of his close friend Ted Cruz during the Republican primary, went on rants against Trump during the presidential campaign — and even called for Trump to stand aside after the Access Hollywood tape was released.
After all that, it’s somewhat surprising that Trump is willing to give Lee the time of day, much less consider him for a Court spot. But Lee, like most congressional Republicans, has tamped down his criticism substantially since Trump became president. He’s criticized Trump’s comments after Charlottesville and about “shithole countries,” but praised, for the most part, the president’s actions.
Trump isn’t just nominating Lee for partisan reasons, either. After all, the man wrote a book about the Constitution. Lee is more comfortable in conservative legal circles than most senators, and frames his opposition to progressive legislation or regulation in terms of the constitutional commitment to federalism and a limited national government.
Lee’s constitutionalism has given him something of a civil-libertarian streak: he’s cautiously supportive of sentencing reform; he has attacked both Obama and Trump for engaging in military action without authorization; and his book attacks the National Security Agency’s use of widespread surveillance. That isn’t likely to jibe with a president who doesn’t appear to appreciate any limitations to his power.
But he has plenty of admirers among Washington conservatives. As Vox’s Jane Coaston wrote, “Conservatives reacting to Wednesday’s announcement of Supreme Court Justice Anthony Kennedy’s retirement already have a popular choice for his replacement: Sen. Mike Lee.”

Current position: Federal appellate judge (Eleventh Circuit)
Why Trump picked him: Pryor has been on Trump’s shortlist since a GOP primary debate in February 2016, where he came up as an example of the kind of justice Trump would like to appoint. Pryor, 54, has among the highest profiles of the judges on this list — due to his starring role in the 2005 showdown between President Bush and Senate Democrats over judicial appointments.
He was initially nominated in 2003 and faced fierce opposition for his unusually strident and blunt recitation of conservative dogma. Asked about a statement he made calling Roe v. Wade “the worst abomination in the history of constitutional law,” Pryor said, “I stand by that comment. I believe that not only is [Roe] unsupported by the text and structure of the Constitution, but it has led to a morally wrong result. It has led to the slaughter of millions of innocent unborn children.”
He also, as attorney general of Alabama, wrote an amicus brief urging the Supreme Court to uphold laws banning sodomy and, in the words of Sen. Russ Feingold (D-WI), “equated private, consensual sexual activity between homosexuals to prostitution, adultery, necrophilia, bestiality, incest and pedophilia.” He also purposely rescheduled a family trip to Disney World to avoid attending during “Gay Day,” lest his children see gay people enjoying theme park rides.
Pryor eventually got a recess appointment to the 11th Circuit in February 2004, and was finally officially confirmed in 2005 as part of the “Gang of 14” compromise. In his position he’s mostly been a doctrinaire conservative, the most notable exception being a ruling arguing that discrimination against trans people violates the Equal Protection Clause.

We’re back with another installment in our ongoing fan casting series, Canon Casting! If you’re unfamiliar, we take a canon, non-film project, assign a budget to it, and cast it! Aside from our podcast, Canon Casting gets the most feedback from fans and we are so stoked you guys like them! For today’s update, I am going to keep it short and sweet, and fan cast a novel that flies under the radar for most fans, but one that is among the best – Battlefront: Twilight Company! If you’re unfamiliar with Canon Casting, here’s how it works:
We tackle a non-film project and fan cast it – with a few rules. Actors have to be alive, and age appropriate. So, in other words, you can’t cast an actor who’s passed away, even if it means a recast. Same deal with not being able to ‘time travel’ to find the perfect actor – no, Marlon Brando isn’t available… Lastly, if one of my current or previous Canon Casting choices actually gets cast in an official Star Wars film, I have to recast them. Yes, it happens, ask Thandie Newton…. Make sense, good? I also approach each Canon Casting project with what I feel is an appropriate budget, etc., as not every story will be made into a billion dollar movie. For Twilight Company I’ve chosen the route of a premium, direct-to-consumer movie (i.e. Disney Now, Netflix, HBO, Showtime, etc.) OK, let’s get to it:
There are a TON of characters in Twilight Company, but not a lot of major ones. For this update I’ve focused on the ten characters I feel made the most impact on the story and/or left the largest impression on me after running through the book a few times. Let’s start with a couple of the minor members of Twilight Company, but two that made an impression on me:
Roach and Pol ‘Charmer’ Andrisius:

Doug Savant as Pol Charmer Andrisius
For the role of recovering spice addict and new Twilight Company ‘fresh meat’ recruit Roach, I tapped up-and-coming actress Analisse Basso. I recently watched Electric Dreams on Amazon Prime, and while the series itself was up-and-down, I loved Annalisse’s performance in the episode Safe and Sound. The role of Roach is small-but-important, and I have no doubts that Annalisse will be amazing playing the part. For veteran company member Pol ‘Charmer’ Andrisius, I went with a leftfield kind of choice (which I’m known to do..) in Doug Savant. Charmer is a battle-hardened solder for the Rebellion who’s good looks were marred by an explosion a few years back. While he still carries the nickname Charmer, it’s obvious those days are long past for him. I’ve always liked Savant, sue me. Based on his previous work I have no doubts that he will step right into the role of Charmer and perform admirably.
Gadren and Brand:
Terry Crews as Gadren
Aisha Hinds as Brand
For the pivotal roles of Brand and Gadren, two of Twilight Company’s veteran members, I am tapping Aisha Hinds and Terry Crews (in a voice/mo-cap performance). Brand, the former bounty hunter-turned rebel, and Gadren, the gruff Besalisk warrior, both play important roles in not only the action but also the character arc and development of our main protagonist, Hazram Namir (more on him in a bit). I first came across Hinds in True Blood, and quite frankly she’s the first actress that came to mind when I was listening to the Twilight Company audiobook. Brand is a reluctant leader who does so by example, and I would be stoked to have Hinds in this role. Since a Besalisk is a large, four-armed alien (think Dexter Jettster from Attack of the Clones), the character of Gadren would certainly have to be brought to life via motion capture. In the audiobook Gadren is Namir’s compass in regards to how and when to do the right thing. And although Jonathan Davis’ (the narrator of the audiobook) performance is deep and commanding, I decided to go a slightly different route and tap retired NFL player and an accomplished actor in his own right, Terry Crews. I think Crews would deliver on both the gruff mentor role that Gadren provides to Namir, but would also lighten the role up a bit from the portrayal in the audiobook. If you follow Canon Casting you know that I will take a chance out of left field once in a while, and this would probably qualify here.
Thara Nyende:
Taylor Hickson as Thara Nyende
Thara Nyende was a stormtrooper on her homeworld of Sullust and is yet another prime example of allowing the readers to get inside the head of the everyday men and women under the employ and in service of the Empire, something the stable of authors Lucasfilm is employing for their new canon stories is excelling at. We see that she is shunned by many of the locals of Sullust who oppose the oppression of the Empire, yet still feels a sense of duty to fulfill what she believes is right. In the end, it blows up in her face and Nyende is left to face some hard truths about war and the galaxy… For this role, I went with up-and-coming actress Taylor Hickson, best known for her role in the TV series Aftermath. I would love to see the lives of female troopers and officers explored a bit deeper in future on-screen Star Wars projects, and for our Canon Casting series Taylor as Thara would be a great place to start!
Micha ‘Howl’ Evon:
Scott Glenn as Micha Howl Evon
As the battle-hardened founding member and leader of Twilight Company, Micha ‘Howl’ Evon, I went with the no-brainer choice of veteran screen and film actor Scott Glenn. Glenn needs absolutely no introduction, and he’s the very first name and face that came to mind when I first heard Jonathan Davis’ portrayal of the reserved and calculating Captain. Our main protagonist, Hazram Namir, doesn’t always understand how and why Howl made decisions for Twilight Company, and it was this brand of leadership that gives our hero the foundation he needs to step in and lead the battalion once Howl is cut down at Echo Base on Hoth by none other than Darth Vader. Hell, if any actor in Hollywood deserves an on-screen death by the most famous Dark Lord of the Sith in the galaxy it’s Scott Glenn!
Prelate Verge and Captain Tabor Seitaron:
Freddie Highmore as Prelate Verge
Mitch Pileggi as Tabor Seitaron
Now we are getting down to the meat and potatoes of this edition of Canon Casting, as we tackle the two main antagonists of the book, the young Prelate Verge and the former Academy Instructor and present Captain, Tabor Seitaron. The latter was easy – as I love Mitch Pileggi. The man needs no introduction to any fans of the sci-fi genre, as he portrayed FBI Director Skinner on The X-Files for a decade. Seitaron is a man who is at the end of his career and certainly doesn’t like being put under the incredibly young and ambitious Prelate Verge, at least at first. However, as the story progresses he learns to appreciate and respect the youthful leader but has to make a difficult decision in the end regarding that relationship… And that leaves us with Prelate Verge. Young. Very young. Brash. Ambitious the point of considering to scar is visage to more closely resemble Emperor Palpatine. I had a few actors in mind for this role, but I decided Freddie Highmore of Bates Motel fame was the man for the job. Equal parts babyfaced and psychotic in his portrayal of Norman Bates on the show, there is no doubt in my mind he would crush it in the role of Verge.
Governor Everi Chalis:
Lara Pulver as Governor Everi Chalis
I absolutely love the character of Everi Chalis. In fact, she’s one of my favorite new characters created within the rebooted canon. Beautiful, cunning, and scorned, the former member of the Imperial Ruling Council and Governor of Haidoral Prime, Chalis is a force to be reckoned with – a force who’s introduction into Twilight Company’s ranks wreaks havoc on the destiny of the battalion and its members. For this role, I chose Lara Pulver, who I first saw playing Irene Adler on Sherlock opposite Benedict Cumberbatch. Her initial episode of that show is quite possibly one of the best entries of any television show in history, and I immediately thought of her when I heard the part of Everi Chalis for the first time – so much so that I don’t think I even considered anyone else! For this role, you have to have a beautiful actress that equal parts vulnerable and ruthless, and Pulver is THE choice. Period.
Hazram Namir:
Ricky Whittle as Hazram Namir
The role of Hazram Namir, the main character in Battlefront: Twilight Company, goes to Ricky Whittle. Best known for his roles on The 100 and American Gods, Whittle is, in my opinion, the best choice for Namir. Hailing from the war-torn world of Crucival, Namir joins Twilight Company after a gruesome battle on his homeworld left him with nothing left to fight for there. A capable soldier, Namir learns leadership as the novel progresses, eventually assuming control of Twilight Company after its leadership is decimated on Hoth. Whittle has the combination of rugged good looks, charisma, and an edge to bring the role of Namir to life on the screen, and I for one would absolutely love to see it happen!
There it is, short and sweet – my Canon Casting of Battlefront: Twilight Company. As I mentioned this book has really flown under the radar for most fans, even those who are all-in on the rebooted canon, and that’s a shame. I for one loved getting down and dirty with the members of Twilight Company, and I have little doubt you’ll enjoy the book as well. Be on the lookout in the coming weeks for a couple more additions to Canon Casting, as I have some rad stuff in the works!

Diego Costa will not return to Chelsea team unless his attitude improves
