Selling sprite edits?

Alright everyone, time for a reality check.

There is a blog that does edits, mostly shitposts. Recently it came to the attention of some of my friends and myself that they opened a Patreon so they could continue making edits, even sell their edits as merchandise.

I hope I don’t need to tell you how illegal that is.

It’s very obvious who these friends of mine are due to who originally made and reblogged the post, but I’m going to keep them out of THIS post.

If there are any concerns or issues on this post, I ask they come to me. I ask you read this whole post, though, and take it into consideration. I am not, “coming at people’s throats.”

Look, here’s the thing: I don’t try to hide the fact that I’ve made mistakes before because I’ve learned and grown from them. You can definitely find posts of myself trying to sell my own edits before. If you’ve been following long enough, you probably saw it, too. I did take a commission to make a Queen Elise where I recreated the official Fates sprite, which at the moment of posting this, am issuing a refund so I’m not being hypocritical.

The point is this: you cannot make money on something that someone else made just because you made some adjustments. It is illegal. Just because you put personal work into it, no matter how much effort, it is not your property to sell.

But Soffia, people sell fanart all the time! This is a big blurred line that I won’t completely delve into, especially since I buy fanart, but the big fact is you cannot make a profit over something you only partially did if you do not have the consent and approval of whoever else was involved. If you made said fan work from scratch, you do you.

Think about it this way: you take the Disney movie Snow White and the Seven Dwarfs, edit the visuals, and then sell that. Disney would have you practically buried.

It’s definitely worth mentioning that in regard to edits, I personally tend to categorize them. The big categories for me are custom work and spliced work. Spliced work is using more assets from the original product(s) or using assets from other sources. Of course, custom work is custom work.

If you are selling an edit that has assets from two different artists, you are actively making a profit on TWO peoples’ work. Lawsuits coming from every end of the Earth.

Soffia, are you saying people should stop making edits? Of course not! I am in no position to tell you that, especially since I don’t believe you should stop if you’re enjoying yourself and it’s not causing any problems. I honestly found in my hobby of editing video game sprites that it helped me learn about art, and I implore you to explore.

I’d like to address an accusation, too. We were accused of judging people. I personally was quite upset to see that they claimed we didn’t know how to treat other people since I was raised on treating people with decency. I promote it since I wasn’t given that pleasantry.

I can guarantee for both myself and my friends that we were and are not judging you as people. Doing illegal things does not always define people, and of course that’s a case by case basis depending on what illegal activity is committed. Do you think I’m a bad person because I tried to sell edits? That’s your prerogative and your right. Do we judge you for making edits? No. And do we judge you for trying to sell them? No.

I can personally say our attempt to stop you, which was deliberately peaceful, was to protect you from lawsuits. It seems like a faraway issue until it’s a reality. I was extremely lucky to not run into any detrimental consequences, and I hope you will be, too.

Also despite my better judgement, I also want to put it out there that judgement is someone’s right. They are allowed to think whatever they want even if you think it’s wrong. It becomes a problem if they act out on their opinions and it is causing harm to others. There’s a difference.

My friends and I have been accused of, “unfair and anxiety-inducing harassment.” The person in question claims it’s not about us, so I’m going to take her word for it. Should that be true, that’s extremely unfair the mods are claiming it’s us that is harassing her since all we’ve done is treat her like a friend.

Should someone accuse me of actual harassment towards someone though, I encourage you to post your proof. I absolutely HATE that line, “where’s your proof,” but it’s honestly the truth since it just doesn’t exist. All my interactions about this issue have been on a public Discord server you can find on my blog. I don’t omit things on that server and I don’t censor people, either.

If this is harassment, go off, I guess.
