Nonlethal weapons can kill you. Police crowd-control tools should be regulated

On October 16, 2004, about a thousand people gathered around an apartment complex in Davis, California, for a so-called "Picnic Day," an annual event noted for a lot of alcohol consumption. At some point, the streets became jammed with party-goers and illegally parked cars, and the Davis police called the  UC Davis campus police to assist with crowd control. UC-Davis's finest showed up to help.  Officers ordered the crowd to disperse, but the gathering was so raucous that many attendees could not hear the instructions. Others were pinned in by the hoard of partiers and were unable to comply with the police order to disperse. Unable to control the crowd, several UC-Davis police officers fired pepper balls (similar to pepper spray) from pepper ball guns. Timothy Nelson, a passive bystander, was hit in the face by a projectile and suffered a permanent eye injury.

Nelson sued the City of Davis and three UC-Davis police officers, claiming a violation of his constitutional rights. In 2012, the Ninth Circuit Court of Appeals ruled that the firing of pepper balls at a passive, nonresistant crowd constituted an unlawful seizure and a violation of the Fourth Amendment.  The court also ruled that a reasonable police officer would know that firing pepper balls at a passive crowd constituted unreasonable force. Did the UC-Davis police force learn its lesson from that lawsuit? Apparently not, In 2011, UC-Davis police officers sprayed pepper spray directly into the faces of passive protesters who were part of a nonviolent  Occupy Wall Street protestant event. Several of the injured students sued, and UC Davis quickly settled the lawsuit for a million dollars in damages.  But he local district attorney refused to file criminal charges against the officers involved. In fact, one officer, who was the chief offender, actually received a worker's compensation check for the psychological stress he claimed to have suffered while he was spraying students with dangerous chemicals. As the New York Times reported recently, the so-called nonlethal weapons that the police use to disperse crowds can sometimes cause severe injuries and even death.  According to the Times,  police in Austin, Texas fired rubber bullets that caused several people to be hospitalized and inflicted permanent brain damage to two individuals. I support calls for legal restraints on the police to keep them from recklessly firing tear gas, rubber bullets, pepper spray, or bean-bags as a means of dispersing crowds. Nevertheless, I am very sympathetic to the police, who put their lives in danger to suppress riots, looting, and arson.  More than 300 officers were injured during the George Floyd protests, and at least two were killed. The police definitely need access to non-lethal force to suppress crowds who threaten public safety--arsonists, looters, and brick throwers. So I hope that the restraints on the use of tear gas and rubber bullets will allow police to use whatever nonlethal tools are necessary to prevent lawless mobs from burning down our cities.

(LOS ANGELES) — Thousands of Los Angeles protesters arrested for violating curfew and other police orders will not be charged with a crime, prosecutors said Monday as hundreds took to the city streets carrying caskets to signify the death of George Floyd and others killed by police.

City Attorney Mike Feuer said his office will develop a court alternative that carries no punishment for those cited for violating curfew or failing to obey orders to leave demonstrations over the death of Floyd, a black man who died two weeks ago after a white Minneapolis police officer pressed a knee into his neck for several minutes.

District Attorney Jackie Lacey said she won’t file charges in protest misdemeanor cases from other parts of Los Angeles County.

The city had the largest number of the 10,000 protest arrests in the U.S. tracked by The Associated Press. Demonstrations over police brutality and racial injustice have gripped the nation for nearly two weeks.

In the Los Angeles area, police and sheriff’s deputies arrested more than 3,000 people over days of mostly peaceful protests. About 2,500 of those were in the city for violating curfew or dispersal orders, according to figures the Los Angeles Police Department provided June 2. Police didn’t have an updated figure Monday.

The city imposed curfews over five nights, and the county and surrounding cities ordered people to stay home over several nights of protests that had at times devolved into theft and violence. They used the curfew order to round up protesters who wouldn’t leave.

LA ended its curfew after the American Civil Liberties Union sued on behalf of Black Lives Matter, saying the order suppressed First Amendment guarantees to political protest and freedom of movement.

Feuer did not provide specifics on how he would handle the cases but said some type of forum would bring protesters together with police and others to “create an environment where participants really listen to each other.”

Chase Bucklew said she was relieved to hear she would not be prosecuted, though she felt she never should have been arrested.

She was among a group of about 300 protesters in downtown LA on June 1 who were told to leave the area 15 minutes before a 6 p.m. curfew. People began to panic and run and she thinks most would have left, but she said officers surrounded them and wouldn’t let them go.

She was handcuffed with zip ties, forced to sit on the street for hours, then loaded on a bus in close quarters with three dozen other women during a pandemic and had to wait to be processed and eventually released. The entire process took more than seven hours from time of arrest.

“I guess the whole thing seemed like such a farce that I think I would be surprised if they did follow through with (charges),” Bucklew said. “Not to mention the sheer numbers of people they arrested this week for curfew violations. I don’t think anyone wants to deal with that. It’s just too many people.”

Prosecutors said they would keep pursuing charges for looting, burglary, vandalism and any violence. Lacey has already charged more than 60 people with felonies related to the protests, the majority for looting.

The decision not to bring charges followed a weekend of peaceful protests that continued Monday.

Hundreds of people marched in Oakland for Erik Salgado, who was shot and killed by California Highway Patrol officers Saturday in a neighborhood.

Protesters say officers fired dozens of times into a car, killing Salgado and injuring his pregnant girlfriend, who was in the passenger seat.

Oakland police, which are investigating the shooting, have only confirmed that a man was fatally shot and a female passenger is in stable condition at a hospital.

“They could have shot a child, they could have shot anybody, they could have shot into someone’s home and killed someone, but clearly they didn’t care. We want justice for Erik, we want it now,” said Hoku Jeffrey with a civil rights group known as By Any Means Necessary.

In Sacramento, the state Assembly speaker and other key lawmakers on Monday backed making it illegal statewide for police to use a type of neck hold that blocks the flow of blood to the brain and can cause serious injury or death if used for too long.

The proposal appears to go beyond any other state. Major law enforcement groups did not immediately say if they will oppose the move.

As the final public viewing for Floyd was held at a Houston church Monday on the eve of his funeral, Los Angeles rolled out funeral-style car processions that culminated downtown with a memorial service. Hundreds of people chanted “Black Lives Matter” and Floyd’s name.

Kelly Griffin, who wore a shirt saying, “I am black history,” brought her 12-year-old son, Isaiah McClurg, to his first protest to be part of history and someday tell his own kids about it.

“I came because George Floyd was killed,” Isaiah said. “And other people were killed. And I want to say that black lives matter.”

The gathering on a street near courthouses and City Hall felt more like a funeral than a protest with sermons and hymns and symbolic caskets for Floyd and others killed by police.

“It was more emotional” than previous rallies, said Phylisha Stinson, who has been impressed by the daily demonstrations across the nation. “This is the highest level of momentum. We have to keep it going so we can see real change.”

Police: Army vet drove into people thinking they were Muslim

An Iraq War veteran deliberately drove into a group of pedestrians because he thought some of the people were Muslim, California authorities said Friday.

Isaiah Joel Peoples, 34, faces eight counts of attempted murder for injuring eight people, including four who remain hospitalized. The most seriously injured is a 13-year-old Sunnyvale girl of South Asian descent who is in a coma with severe brain trauma.

“New evidence shows that the defendant intentionally targeted the victims based on their race and his belief that they were of the Muslim faith,” Sunnyvale police chief Phan Ngo said.

Peoples appeared briefly in Santa Clara County Superior Court on Friday. He did not enter a plea and is being held without bail.

The former U.S. Army sharpshooter experienced post-traumatic stress disorder after serving in Iraq, his family said. Peoples’ attorney, Chuck Smith, said Friday that the crash was in no way deliberate.

“This act was clearly the product of some mental disorder or mental defect,” Smith said after the hearing.

Peoples was on his way to a Bible class Tuesday in the Silicon Valley suburb of Sunnyvale when he told investigators he intentionally drove into a group of men, women and children, police said. The 13-year-old girl was hit along with her father and brother, who had minor injuries.

Jay Boyarsky, chief assistant district attorney for Santa Clara, said the charges carry a sentence of life in prison. He said they will file hate crime allegations if warranted.

“There is very appalling and disturbing evidence that at least one or two of these victims were targeted based on the defendant’s view of what their race or religion may have been,” he said.

Three adults also remain hospitalized with injuries that include broken limbs and fractures.

Peoples showed no remorse after his car plowed at high speed into a group of people in a crosswalk before hitting a tree, Ngo said.

Witness Don Draper said he marched over to Peoples’ car after he crashed, and he found the driver muttering over and over, “Thank you, Jesus. Thank you, Jesus.”

But Ngo said that “he did not behave in any manner that would be considered bizarre,” when taken into custody.

Family and friends described Peoples as quiet and polite and expressed shock at his involvement. His mother, Leevell Peoples of Sacramento, said her son had “a bad episode” with PTSD in 2015, for which he was hospitalized.

Peoples was deployed to Iraq in 2005 and 2006.

Peoples was honorably discharged from the Army, and police were investigating the PTSD report, Ngo said. Peoples had no criminal record and owned one weapon, a disassembled and inoperable shotgun that was in the trunk of his vehicle, according to the police chief.

5 Monstrous Mothers That Deserve to Die

If you were to ask me if I believed in the death penalty before I had children, it would have been an all out NO! No one deserves to die.

But since I've had my boys, that over protective badass she-wolf has come out in me. I would defend my cubs with my life – as I'm sure most other mothers do. Most…

But these mothers didn't. These mothers did the most evil, despicable thing known. Not only did they kill their own children, some of them abused them for years in the worst way possible.

A mother's job is to protect her child. And if she can't do that – either ask for help, or give that child to authorities to re-home where they will be loved, cherished and adored.

You might think that the title 'Mothers That Deserve to Die' is harsh – and why do we need to read about it, but I want you to know that there are evil people like them out there… and to keep an eye out not only on your child, but others too. Because if you can save another life by being vigilant and taking notice of what just might be happening, you could save a child's life.

FACT: Over 27 children are killed by their own parents in Australia every year! In the USA, that figure is over 200.

5. Ka Yang

Where: California, United States

Victim: Mirabelle Thao-Lo (2 months old)

Sentence: 26 Years to Life

Ka Yang is a truly despicable 34-year-old human being. In March 2011, the mother-of-four claimed that she had lost consciousness and woken up next to a heater which had injured her baby daughter. On further investigation, it was found that the burns were not caused by the heater but by placing her seven-week-old baby, Mirabelle, in a microwave oven for two minutes. Police had discovered a dummy remaining in the microwave.

The baby girl suffered horrific burns to 60% of her body. A pathologist doing the autopsy said that the radiation from the microwave had 'cooked' the child's small intestines and stomach. Ka Yang's defence attorney alleges the mother was suffering from a seizure at the time of the incident.

The jury rejected arguments that the Sacramento-based woman did the crime during an epileptic seizure and found her guilty of first degree murder.

Ka Yang had no prior criminal history.

Her three remaining sons are in the care of family members.

4. Alexandra V Tobias

Where: Jacksonville, United States

Victim: Dylan Lee Edmondson (3 months old)

This young mother was only 22 years of age when she killed her three-month-old son. His cries were a distraction from her playing 'Farmville' on Facebook. Alexandra informed police that she 'shook' her son when he would not stop crying, she smoked a cigarette, then shook him again. The shaking caused severe brain damage and death.

Farmville has over 60 million members and has been named by Time Magazine as one of the 'worst inventions' in recent decades. Some players have found it so addictive they have lost employment and racked up personal debts of over $1000.00.

Alexandra now faces a lifelong imprisonment as it was not considered a 'first degree murder'. Tobias claims that she was suffering from postpartum depression at the time, and wanted to go back to being 'a good person that I was before'.

3. Lianne Smith

Where: United Kingdom

Victim: Daughter, Rebecca (5 years old), Son, Daniel (11 months old)

In May 2010, 45-year-old former child protection worker Lianne Smith was upset when her long-time partner, Martin Smith, was arrested on child sex offences. So in her grief (even though it is claimed she KNEW her partner was a paedophile whilst she was with him), and whilst she was on holiday in Spain, she suffocated her five-year-old daughter, Rebecca and 11-month-old Daniel with plastic bags. She later told police she killed them out of love.

She was found guilty of murdering her children even though she pleaded insanity. Lianne claims she killed her children because she thought they would be taken into care by Social Services because of her partner's crime. So instead, she decided they were better off dead.

Lianne has an older son and daughter. Chris, her 21-year-old son says he would never ever forgive his mother. He said 'I wish I could have been there as justice was done.'

Ms Smith had abandoned Chris in 2007 after his sister, Sarah had reported that her stepfather had sexually abused her for 11 years.

'What kind of mother chooses a man like him over her children?'.

During Ms Smith's trial, she said that she had given the children 'a perfect three-day holiday' before she killed them.

Lianne Smith's partner, Martin Smith was charged with 13 counts of sexual offences including rape and attempted rape against a girl under 16.

2. Kristi Abrahams

Where: Sydney, Australia

Victim:  Daughter, Kiesha Weippart (6 years old)

Unfortunately, the worst mother of them all comes from right here in Australia. Kristi Abrahams, 30, had abused her six-year-old daughter, Keisha Weippart for her entire life. The abuse escalated in the last 18 months of Kiesha's life. In August 2010, Kristi and her de-facto partner, Robert Smith, reported to the police that Kiesha had gone missing. The public rallied. The couple even made a media appearance pleading for Keisha's return.

Eight months later, Keisha's remains were found in bushland in Western Sydney in April 2012 after a 'midnight visit' from Kristi, laying flowers at her shallow grave. Police had been suspicious of Kristi from day one of Kiesha's disappearance and after a lengthy undercover police operation, Kristi and boyfriend Robert were arrested at the grave.

The court heard that Kristi Abrahams had knocked her daughter unconscious by throwing her against a wall in July 2010 and did not seek medical assistance. Instead, the couple put the little girl under a cold shower and put her to bed. The couple discovered she had died from her injuries the next morning, placed it in a suitcase for five days before burning it and placing it in the shallow grave.

The postmortem results were horrifying with evidence of the long term physical abuse at the hands of Abrahams.

Kristi was sentenced to a mere 16 years in prison.

1. Megan Huntsman

Where: Utah, United States

Victims: 7 unnamed infants

Megan Huntsman, 40, was a methamphetamine, cocaine and marijuana addict who continued to get pregnant time after time. Rather than using birth control or placing these babies with the authorities, she strangled them shortly after birth, wrapped their body in cloth and placed them in a plastic bag before placing them in a box in her garage.

Ms Huntsman said she was so high she didn't realise what she was doing. Forensic evidence on the seven little bodies revealed that one had been a stillborn. All were born full-term - five were girls and two were boys. The killings occurred between 1996 and 2006.

Megan's partner, Darren West who fathered all seven children located the bodies when he collected his belongings after Megan had moved out of the home. Mr West advised he knew about some of Megan's pregnancies but had been told that she had miscarried. He alleges he had no idea that she had chocked and killed six of his children.

Ms Huntsman advised she wanted to get rid of the bodies but was afraid she would get caught.

The couple have three surviving children.
