How to register as Patent Agent in India: Step-by-Step Guide

This article on 'How to get Registered as a Patent Agent in India' was written by Shruti Korgaonkar, an intern at Legal Upanishad.

Introduction

The subject of intellectual property law (IP) is expanding rapidly. We are seeing a paradigm shift where businesses are shifting their focus from purchasing physical assets like land and machines to acquiring intellectual assets. Startups and R&D facilities, which are nothing more than intellectual inventions, are proliferating in India. The goal of intellectual property law is to safeguard your intellectual property and allow you to profit from it. People defend their creations. They require an additional group of individuals to deal with this universal human inclination. Let's discuss in-depth Patent Agents and its qualification.

Patent Agent in India

A person who is registered as a patent agent according to Section 2(n) of the India Patent Act, 1970 is referred to as a patent agent. Who qualifies as a patent agent is defined under the statute. In simple words, the definition implies"a person who files the patent application." The patent agent is in charge of the procedure involved in putting together a patent application. In other words, he assists anybody seeking a patent with the document preparation process, including the drafting, submission, and prosecution of an application before the controller. According to the 2003 Patent Rules, a Patent Agent is required to be registered for practicing. Before the Indian Patent Office, the patent agent must file a Form 22 application for registration as a patent agent. The information of the registered Patent Agent should be added to the Register of Patent Agents, which is kept by the Controller, following the Indian Patent Office's approval of the application. All of the registered patent agent's information, including name, address, and other crucial facts, should be included in the Register of Patent Agents.

Who is Qualified to Become a Patent Agent Patent Agent in India?

Criteria mentioned in Section 126 of the said act shall be met to be registered as a Patent Agent in India. The qualification required is as follows: - He should be a citizen of India; - Should have completed 21 years of age; - He must have earned a degree in Science, Engineering, or Technology from a university recognized by law as being currently in effect in the Indian subcontinent, or hold other equivalent credentials as determined by the Central Government. Final-year students are also eligible to apply as long as they can provide their degree certificate and complete mark sheet within two months of the announcement of the patent agent examination. - He must have paid the required fees. - He must have completed the required qualifying examination, passed it, and either served as an examiner, carried out the Controller's duties under Section 73, or both, for a total of at least 10 years. However, he must no longer hold any such position at the time the registration application is submitted. Prior to the act's 2005 amendment, a person was required to have a degree in law in addition to a specific degree in one of the fields listed under clause (c). Through the amendment of 2005, this requirement was eliminated.

Register as Patent Agent in India

The procedure for registration

Step 1: Application for examination for registration  A person who wants to register as a patent agent in India must ask the Controller to appear for the qualifying examination, according to Rule 109 of the Patents Rules, 2003. The applicant must write a letter to the closest patent office with this request made in it and address it to the Controller. The letter must be provided with the necessary paperwork, including citizenship and age proofs, in accordance with Section 126(1)(c) of the Patents Act of 1970 After paying the required fee as specified in the First Schedule, the requests must be made. The Government of India's official website specifies the timeframe for making such payments. The Controller must receive the registration together with the payment information. Also, there is no restriction on how many times a person can apply for the qualification of the examination. Step-2 Passing the qualifying examination For the qualifying examination, a candidate must meet the requirements outlined in Section 126 of the Patents Act of 1970. The qualifying examination's specifics are listed in Rule 110 of the Patents Rules, 2003, and are as follows: The office of the Controller administers a written test that consists of two papers at 100 points each. The questions on Paper-I concern the patent legislation and its regulations. Questions about the development and interpretation of patent specifications and other related papers are included in Paper II. A viva, which carries 50 marks, is held to assess the applicant's practical expertise. The candidate must receive a minimum of fifty points on the written test and a combined total of 60 percent of the possible points in order to pass the qualifying examination. Once a year, the Indian Patent Examination is held. Two months prior to the scheduled exam date, candidates get notified of the exam. Results of the qualifying examination are released on the official website developed by the Indian government. Step 3: The controller registers patent agents In accordance with Rule 111 of the Patents Rules, 2003, the Controller enters the applicant's name in the register of Patent Agents and issues a certificate of registration to him after the application has been submitted to the Controller office in the prescribed format and the applicant has successfully completed the qualifying examination and has the credentials required by Rule 110. Only the territory of India is the scope of the registration certificate's applicability.

Register of Patent Agent in India

In line with Section 125 of the Act and Rule 108 of the Rules, the Controller is responsible for maintaining the register of Patent agents. The information that must be recorded in the register includes: - Name - Nationality - Address of the main office and the locations of any branch offices. - Each patent agent's credentials and the time of their registration. - Any further information that the Controller thinks necessary and appropriate, including information about their registration renewal, must be provided. To maintain registration, the fee must be paid at the conclusion of each fiscal year. Generally speaking, the date of the fee for the continuation is calculated from the date of registration as a patent agent. Every year, a notice is published on the official website outlining the method of paying the required fees as well as other information, such as the hotline number to call in the event of payment errors or other procedural concerns. After the first registration, the registration is renewed annually. However, the fees for continuation can be paid at the time of registration. - Specimen signatures and photographs of the individuals listed as patent agents. - Furthermore, each branch office must retain a copy of the Register of Patent Agents. Additionally, subject to any applicable precautions that may be mandated in this respect, the Controller may retain such facts on computer floppies, diskettes, or in any other electronic format. That is, only those who have been properly allowed by the Controller may access it, and anybody who has not received such authorization from the Controller is not permitted to make any entries, changes to any entries, or corrections to any entries in the said register.

Conclusion

Since they have the necessary knowledge and experience in that area, those who want to get a patent registration frequently engage a patent agent. To practice as a patent agent in India, one must register in accordance with the legal requirements. Although drawn out, the registration process for patent agents is straightforward. I wish we could have gotten more on the bat's and their interpersonal relationships

okay we know which bat's are bonded to which humans, what each bat looks like, and basic descriptions of their personalities

Ex. Ares: large black bat. Had two bonds: Henry and the Gregor. Was very strong, a known risk taker, broody/emo, unpopular with others, still a very good guy.

Aurora: Bright gold bat. Bonded to Queen Luxa. Patient, quiet most of the time. Soft/gentle spoken the rest. Is very brave. Can fly in a series of complicated acrobatics to where a rider has to be very skilled to stay on her. Her and Ares are very close friends.

Nike: Silver and black stripped bat. Daughter to Queen Athena, and the second bond of Howard. Cheerful and helpful. Notably more talkative then other bat's. Boot's is the only one whom she allows to call her "Pincess Nike."

But that is really kinda all we know. Those couple facts about Nike's patentage and Ares&Aroura's friendship, plus maybe that the bats technically need Queen Athena's permission to join the humans for missions, is all we know about their relationships outside of the ones they have outside of their bonds

I do not think Nike is Queen Athena's oldest child. Her being allowed to go on the quest for the plague was explained as the prophacy specifically stating bat's needed to send a representative, and Nike also being a "back up princess incase Boot's role has been misinterpreted". So letting her go off into danger then checks out. The Marks of Secret quest checks out too as it was completely unsanctioned and none of the group had permission to be out searching for the nibbles. All of them knew and said they would be put on house arrest once the returned home.

But still if Nike is next in line for the throne why does the title "Princess" mean so little to her that she only allows a baby who is laughing at an inside joke address that way, She specifically asks others not to "hold it against me" when they try to call her "Princess Nike". Additionally after she and Howard become close and decide they want to eventually bond she starts spending a lot of time with him in the human land. Again there is nothing outright strange about that, plenty of bat's hang out in the humans land with their bonds. But Queen Athena can be noted to mostly stay in her land. The only time she came to the humans land was for the meeting in Curse of the Warmblood. If "overseeing her kingdom" and "preparing to one day rule" were part of Nikes daily life the way they are Luxa's, wouldn't it make more sense for Nike to stay in the fliers land with her mother and Howard to go visit her? Not the other way around? The humans are welcome in the fliers land just like the bat's are in there's. Howard has family connections, medical skills, and is the nicest guy ever. I would be very surprised if he was not allowed to go to any safe land anytime he wants. Nikes disregard of the "Princess" title and seeming freedom to leave her land for adventures as well as casual trips leads me to belive she has unamed older sibling in the bat's land who is on deck to rule befor her.

Gonna move on in a second, but while we are talking about unamed members of Nike's family let's talk about her father. He is not in the books and Queen Athena seemingly rules the Bat's by herself. Does the fandom believe he is dead and Athena was not required to take a second mate/King afterwards, or is he alive and the flyers are a monolithic kingdom (one ruler). Because of Athena's royal status I personally belive the monolithic kingdom. Secondly since Queen Athena is a white bat and Nike is zebra stripped, is her father a dark colored bat, or would that not be how bat genetics work? This is a question I do not know the answer to.

Now let's move on from Nike and talk about our boy Ares. Again even before bonding with Henry he was known to be reckless, disobedient, and a risk taker. While in our safer society this might make Ares seem really cool to kids/teens he was never popular in the underland. Since the underlanders are always at war, or trying to live through or recover from a crisis this possibly made Ares seem like he was kinda crazy/dangerous to be around (You all judged him wrong). After Henry betrayed everybody and Ares broke his bond to save Gregor Ares was then completly shunned by every bat and human, save Luxa and Aurora. Okay to give minor credit: Nerissa still cared about Ares, and the reason he didn't know that was he was avoiding her. While Andromeda and (I guess) Nike did not originally trust Ares after the events of the first book, they got over it and became friends with him. Gregor started visiting more, and Howard is friendly to everybody. But still for like six months Ares had no one in his life but Luxa and Aurora. When they got lost on the second quest he referred to them as his only two reasons to live. He gave up going to the doctor for medical treatment for his mite bites and made a desperate venture into enemy lands alone to search for them, only going back to his cave when he was to sick to keep going.

During all these times there is no mention of Ares having parents, siblings, or relatives of any kind. So was he an orphan who had no one? Or did he originally have family, who after the events of the first book, hated and shunned him with all the rest? And if so were they ever sorry?

Lastly let's talk about Thailiah. Poor, brave, little Thailiah who was such a young bat when she died so tragically. Her friends all tried so hard to take care of her on the quest, and when she still died they all cried and promised to hold her in their hearts forever. Did she have a mother and father back home? What did they think/feel when the "picnic crew" went missing? When Gregor brought the other pups back did her patents believe Thailiah would be with them? Who had to tell them she was never coming home?

What is the difference between the different types of magic (witch v. fairy) that exist in the DisneyVerse?

As per the magic itself, not much really? Magic is power, anyone can access it and use it for good or ill. There can be evil fairies and good witches (though both are rare than not), and a lot of people called witches are really just magic users.

Fairies are born fairies (though if someone has enough fairy magic granted to them, they could become one, ala Aurora becoming the Fairy Queen), while witches can be born witches but usually become so by learning magic.

I guess overall I'd say that fairies are a race, while witches are more of a class?

The way I sort of have seen it in my head is that Witches are people who have made a bargain with a powerful entity to grant themselves access to greater magical power. They usually already have a natural aptitude for magic, either due to patentage or just a deep affinity for one of the elements (all humans have a natural draw to one of the 4 Elements as a basis for their magical ability in my DisneyVerse) but making the pact allows them greater abilities.

The evil witches all make pacts with Chernabog--the lord of demons in the DisneyVerse-- even if their contracts are technically with one of his lesser agents.

But there could be other people called "witches" that have made pacts with more benevolent or at least not straight up evil patrons, like their land's deities, or even the spirit of the land itself.

It starts to all get kinda metaphysical but basically it comes down to the intent behind the magic use.

I really never got where the political Jon theory came from tbh. He wouldn't even lie to Cersei. I think there will be a lot of Jon/Dany together in the first episode to set them up as being in love before Jon is told about his patentage, which he'll probably have to come to terms with in episode 2 and get over as the big battle is episode 3.

To a degree, I do. But a lot of posts I’ve seen really zero in on how ‘well he’s capable of it’ because it’s essentially what he did in late S1 and S2. But I just---that is imo robbing Jon of his growth? S8 Jon isn’t the same as S2 Jon. 

And also the circumstances imo aren’t even remotely comparable. In S2, we had a man who swore an oath, to what was seemingly the sole responsibility of a man in the night’s watch---to protect the realm from wildlings. He has since built a great relationship with those people, and learned that there are bigger problems in the world. 

And that problem then, is the same problem now---white walkers. Like I just don’t buy that Jon is playing this gigantic politics game. In my opinion, I think he couldn’t care less about politics. That’s a matter for after, if there’s land to fight over. He saw that entire army, and they could lose, so to think he gives af about politics rn, I just---I disagree.

Also, Daenerys---whether you like her or not---lost something in taking the risk to go get him north of the wall. Her advisor urged her not to go, she did anyway, and lost something very important to her. Jon saw that, and was quite sorry that the price of saving him, was losing one of her dragons. So I disagree yet again, that knowing all of that, knowing what their dynamic in S7 cost her, that he’s gonna pull a GOTCHA on her. Like make that make sense to me, asjbdjbashja. 

SO ANYWAAAAYS, long rambling short, I just disagree. People can think and theorize what they want of course, but those are my thoughts.
