What happened in NEET case: an eagle’s View
First of all, I apologize to sister Anitha who lost her life due to #NEET exam. You may ask, what is the need for this apology. Though I know about the legal mistakes in the NEET cases, I didn’t bring that information to the view of society and court(s) of justice, and I am also responsible for the death of that girl. This is a lengthy post to expose the legal faults in NEET cases.
 There are various discussions going on whether NEET is right or wrong. However, Do you know how NEET entered through the backdoor?
 One right judgment was taken for review in a hurry, with a misdemeanour the previous judgment was recalled saying that they are going to hear the case ‘afresh', and while the case is still in pending status, NEET is imposed on our children today. Many of us are not aware of this fact.
This post is dedicated to innocent people of the country who believe the following myths.
·         NEET is legally correct
·         Supreme Court of India has given its final verdict on it
·         NEET is being conducted according to orders of supreme court
·         Ruling BJP government has no relationship with this NEET imposition on us
·         Students have no other option rather than preparing for NEET examination.
 While reading this post, you may even wonder, “Could a judge be like this? Such a judge inquired the NEET case and give judgment?  Is it possible for a judge to issue orders violating the laws and make the government machinery to function according to his orders? " But that is the blatant truth. After reading this, if you raise voice against the injustices, you are also an anti-Indian like me.
NEET Cases – An eagle’s view :
 Two gazette notifications were released by Medical Council of India (MCI) for making a single national level entrance test for admission to Undergraduate (NEET-UG) and Post graduate (NEET-PG) Medical courses on 21.12.2010. Similar notifications were issued by Dental Council of India (DCI) on 31.05.2012 for making NEET mandatory for UG & PG dental courses admission.
Against these gazette notifications, many medical colleges (including Christian Medical college (CMC) Vellore) & state governments (including the government of Tamil Nadu) filed writ petitions. More than 100 such writ petitions were transferred to the supreme court of India and heard together by a bench consist of Hon’ble   CJI altamas Kabir , justice Vikramajit sen and Justice Anil R Dave and gave final verdict of 203 pages on 18.07.2013.
 Justice altamas kabir & Justice Vikramajit Sen gave the verdict that,
·         according to constitutional law
·         according to a judgment given by Supreme court full bench (11 judges) in 2002 {T.M.A. Pai Foundation Vs. State of Karnataka [(2002) 8 SCC 481] }
·         according to judgment given in { Islamic Academy of Education Vs. State of Karnataka [(2003) 6 SCC 697] } case,
·         according to judgment of 7 judges constitutional bench { P.A. Inamdar Vs. State of Maharashtra [(2005) 6 SCC 537]} case
·         and
·         according to the judgement given in {Indian Medical Association Vs. Union of India[(2011) 7 SCC 179] } case
Medical Council of India and Dental Council of India doesn't have powers to conduct NEET examination, NEET is against the constitutional provisions and further cancelled all 4 gazette notifications released by MCI and DCI in their 176 pages judgment.
  Justice Anil R dave said that he doesn’t not agree with the other two judges and gave his dissenting verdict (DCI and MCi have powers to conduct NEET) from 177th page 203rd page in the same judgment. i.e he gave his judgment only in 27 pages citing the following cases { Dr.Preeti Srivastava and Another vs. State of M.P. and Others (1999) 7 SCC 120 }, {Veterinary Council of India vs. Indian Council of Agricultural Research, (2000) 1 SCC 750 }.
 according to law, 2:1 ratio Justice Anil R dave ‘s minority judgment became invalid. Thus, NEET was cancelled in 2013.
Against the above-stated judgment given on 18.07.2013, in  { Christian Medical College Vellore & Ors.Vs.Union of India & Ors. [(2014) 2 SCC 305] } case, MCI (& others) filed Review Petitions in supreme court. Court notice was not served to the respondents (respondents: opposition parties added in the case) since 2013 and Justice Altamas Kabir and Justice Vikramjit Sen has retired subsequently. Using this chance, MCI effectively moved the pieces.So, the review petition was transferred to a 5 judges bench,  to be heard with a similar appeal petition ( Civil Appeal No.4060/2009 ) on 21.01.2016.
 The chief judge of that 5 judges bench is the same Justice anil R Dave who has given dissenting judgment in same {Christian Medical College Vellore & Ors. Vs. Union of India & Ors. [(2014) 2 SCC 305] } case. Other judges were Justice A.K. Sikri, Justice R.K.Agarwal, Justice Adarsh Kumar Goel, Justice R Banumathi. Court notice was not served to most of the respondents, in this case, thus as an alternative advertisement was given in news papers about the case hearing and the case is taken up by the court on 15.02.2016. further, the case was heard on 16.03.016 and given ‘judgement’ on 11.04.2016.  
 You may think that ‘Judgement' means something in hundreds of pages after studying constitutional law, other related laws and relevant supreme court judgments. Put that innocent thinking away and read further. The judgment which is given in "4 pages" is pasted word to word in the following paragraph. In calibri font 12pt , it's coming only one page.
  These review petitions have been filed against the judgment of this Court dated 18th July 2013 passed in Christian Medical College Vellore & Ors. Vs. Union of India & Ors. reported in (2014) 2 SCC 305. The review petitions were placed before a Three-Judge Bench and notices were issued on 23rd October 2013 and thereafter, it was brought to the notice of the Bench that Civil Appeal No.4060/2009 and connected matters involving an identical issue, had been referred to a Five-Judge Bench. Accordingly, on 21st January 2016, these review petitions were ordered to be heard by a Five-Judge Bench. On 21st January 2016, notice was ordered to be served through substituted service and in pursuance of the said order, the necessary publication was made in two newspapers and proof thereof was filed on 15th February 2016. Thereafter, we have heard the matters. Civil Appeal No.4060/2009 and its connected matters have been heard and order has been reserved on 16th March, 2016. We have heard the counsel on either side at great length and also considered the various judgments cited by them, which include judgments cited by the non-applicants on the scope of review in Kamlesh Verma vs. Mayawati and Others (2013) 8 SCC 320, Union of India vs. Namit Sharma (2013) 10 SCC 359 and Sheonandan Paswan vs. State of Bihar and others (1987) 1 SCC 288. After giving our thoughtful and due consideration, we are of the view that the judgment delivered in Christian Medical College (supra) needs reconsideration. We do not propose to state reasons in detail at this stage so as to see that it may not prejudicially affect the hearing of the matters. For this purpose we have kept in mind the following observations appearing in the Constitution Bench judgment of this Court in Sheonandan Paswan (supra) as under "... If the Review Bench of the apex court were required to give reasons, the Review Bench would have to discuss the case fully and elaborately and expose what according to it constitutes an error in the reasoning of the Original Bench and this would inevitably result in pre-judgment of the case and prejudice its re-hearing. A reasoned order allowing a review petition and setting aside the order sought to be reviewed would, even before the re-hearing of the case, dictate the direction of the re-hearing and such direction, whether of binding or of persuasive value, would conceivably in most cases adversely affect the losing party at the re-hearing of the case. We are therefore of the view that the Review Bench in the present case could not be faulted for not giving reasons for allowing the Review Petition and directing re-hearing of the appeal. It is significant to note that all the three Judges of the Review Bench were unanimous in taking the view that "any decision on the facts and circumstances which … constitutes errors apparent on the face of record and my reasons for the findings that these facts and circumstances constitute errors apparent on the face of record resulting in the success of the review petition, may have the possibility of prejudicing the appeal which as a result of my decision has to be re-heard....”  Suffice it is to mention that the majority view has not taken into consideration some binding precedents and more particularly, we find that there was no discussion among the members of the Bench before pronouncement of the judgment. We, therefore, allow these review petitions and recall the judgment dated 18th July 2013 and direct that the matters be heard afresh. The review petitions stand disposed of as allowed. -align:just̺���!
Explanation of the above-quoted judgment is given below:                              
We (judges) feel that we should rehear the CMC case. We don't want to say any reason for that at this moment. If we say any such reason, that may affect the hearing of the pending cases. Before that verdict was given, judges didn't discuss among themselves. Thus, the review petition is allowed and the judgment which was given on 18.07.2013 is recalled and the court orders to rehear the petition.
This is the essence of the above-quoted judgment.
On earth no such judgement is given without even hearing the actual case through a review petition, without saying any legal contradiction, after the retirement of major judges who gave judgment in the base case, in different constitutional bench keeping the dissenting verdict given  judge as chief, recalled the previous judgement on contrary to all existing laws. No such injustice was given in the past, in any history book.  
 While the court notice about the review petition was not served to the respondents since 2013, the review petition is transferred to 5 judges bench and gave advertisement in news paper as an alternative to notice.  Reason for this is, justice anil R dave was about to retire on November 2016 and he wanted to give the final judgment on this case before his retirement. To be clear, he wanted to conduct NEET before his retirement. That enthusiasm of Justice anil R dave is the reason for current NEET examination.
 In a hurry, without any valid reason they avoided issuing notice to the case respondents and the case is heard under the chairmanship of same justice anil R dave are equivalent to a burial of natural justice.  
 What is natural justice?
Natural justice is the fundamental justice. No law /court in the world can overrule the natural law.
 The following two are very important natural justice rules:
 1.      Nemo judex in causa sua: No man shall be a judge in his own cause, or the deciding authority must be impartial and without bias.            
Means, no judge should hear his own case (or) judge should not be having any bias towards either parties. Further, he should not be having any prejudice to the issue.
   2. Audi Alteram Partem: To hear the other side, or both the sides must be heard, or no man should be condemned unheard, or that there must be fairness on the part of the deciding authority. 
 In review petitions, legally the judge who has given the previous verdict should hear the petition. That’s not contrary to the natural justice. Because, in a review petition, if there is any gross mistake in the previous judgment , then only the judgment will be amended/changed in the review petition.  
But, this review petition of NEET CMC case, which has to be heard and disposed off in a short period of time. Two amongst the three judges who heard the earlier were retired.  When the review petition is transferred to a new 5 judges bench, can the same judge (who gave dissenting judgment in 2013) hear the case again???? That too as the chief of 5 judges bench???  These are million dollar questions.
 Will the judge (anil R dave) hear the case without any partiality and give judgment?
This question will appear in everyone's mind.  like add oil to that fire, without hearing the review petition deeply, without pointing any legal mistakes, previous judgment (2013) was recalled with an excuse that court wants to hear the case afresh.
This is beyond the legal limitations of review petitions.
In an article, supreme court senior counsel Rajeev Dhavan had written the following…
“ Christian Medical College, Vellore and Mahatma Gandhi Institute of Medical Sciences, Wardha had their own exams.  Justice Dave said he wanted Gandhian principles to be made compulsory in admission tests but NEET would stay.”
Further, he quoted something from his memory,“ I reminded him in court that he had said that if he was Hitler he would impose the Bhagwad Geeta on all schools. Justice Adarsh Kumar Goel was litigantly connected with BJP and he appeared on behalf of BJP in various cases.
 Natural justice is denied to the country. Isn’t it?
  Injustice didn’t stop over there.  The judgment in which 2013 judgment was recalled didn’t give orders to union government to conduct NEET. If Justice dave instructed the government to conduct NEET in his judgment, other 4 judges might have refused to agree to it.  
 Like someone had instructed them earlier, a charitable trust named “Sankalp charitable trust" approached the supreme court again with a prayer of conducting the NEET examination for medical admission in the same academic year (2016). That writ petition was given high priority and taken up for hearing by a 3 judges bench chaired by Justice Anil. R.Dave, justice aarsh kumar goel and Justice Shiva kirti singh. Final judgment, in that case, was on 28.04.2016 (within a month).
"A quick judgment is equal to injustice.
Justice delayed in denied.”
  In this NEET case, it’s proved that the quick judgment is an injustice. Yes, the court ordered the union government to conduct NEET in same academic (2016) year.
In this petition which was filed by Sankalp charitable trust, there is a very interesting information about the respondents (respondents: opposition parties added in the case) and arguments.
 The petition filed by Sankalp charitable trust included 4 parties as respondents. But the court ordered to remove one respondent ( I don't know the name of that respondent, who could be a speed breaker to the quick justice) from the petition. After removal of that respondent
1)      The Union of India
2)      Medical Council of India (MCI)
3)      Central board of Secondary education (CBSE) were the respondents in that petition.
Do you think that MCI and CBSE put up the following counter arguments?
“Base petition is still pending in supreme court. &
At this short period of time, It’s not possible to conduct NEET”
 If you think in that way, you are an innocent! Really an innocent!! 
If someone had listened to their counter argument, their Blood pressure would rise automatically. “We have already disclosed revised NEET UG syllabus in 2015”, said by one respondent. “On 1st May, we are going to conduct AIPMT-2016.(within 3 days). The court may consider it as NEET UG-2016 (Phase I). In July 2016 we shall conduct NEET UG-2016 (Phase - II) for those students who have not applied for AIPMT” said another respondent.
When supreme court already stayed the central government from conducting NEET in 2013 till 2016, why MCI released syllabus for NEET in 2015? If any anti-Indian think and ask the above question, I am not responsible for that.
Eminent advocates like Raajiv dhavan had appeared in this case and put forth neutral arguments against NEET. Rajiv Dhavan argued, "CMC case judgment was recalled to rehear it without going into the ‘merits' of that judgment.  It doesn't overrule the previous judgment of CJI altamas kabir. So, till the final verdict is given, NEET should not be conducted.” Though advocates put forth their legal arguments properly, nothing was considered and 4 pages judgment was given to conduct NEET in the same academic year (2016).
  Usually, while changing any routine procedure which could affect gross population and further cause loss, ‘status-quo’ is given till the final verdict.
 What is status quo?
For example, local municipal corporation issues notice to you to demolish your house within 15 days, you can approach court against it. Court will give status quo (i.e it will order to continue the current status and prevent demolishing your house till final verdict). This is law, this is justice.
 But, strangely in NEET case, the court ordered the government to conduct NEET till final judgment is given in base NEET case.  If final verdict is given in future, who will bear the damages caused to the students who lost their medical admission due to NEET? Who is responsible for lost lives?
“Okay. The base CMC case on which the judgment was recalled and in which the court wanted to rehear it afresh. What is the status of it?” Some clever readers may ask this question.  Only for those clever readers, I am explaining further.
CMC review petition was transferred to a 5 judges constitutional  bench to hear together with a similar context appeal petition. That appeal case is Modern Dental College vs State Of Madhya Pradesh & Ors, Civil Appeal No.4060/2009 . The next day of AIPMT 2016, i.e 02.05.2016 final judgment was given in the civil appeal case. In that judgment, the court ordered to constitute an oversight committee (OSC) chaired by retired justice R.M. Lodha to monitor the functioning of MCI till MCI is revamped. To moniter functioning of that committee, Supreme court adjourned the case for one year.
  “Leave that case. Tell us the status of CMC Vellore rehearing date?” Some of you may ask the above question.
I can understand you hurry. According to the details available in supreme court website, CMC vellore case was taken up for hearing in may 2016.  After one and half year, on  21.11.2017 it's listed to be taken up for rehearing. From this, the proverb "delayed justice is denied" is proved.  
  “Oh god! After taking up for hearing on 21.11.2017, when the final judgment in this case will be given? By that time 3 NEET-UG will be over right? "
 But ruling BJP government planned alternatively and amended the existing Indian Medical Council act in 2016 monsoon session (on 04.08.2016) to give powers to MCI and also to make NEET (UG and PG) as a mandatory entrance test for admission to Medical courses. The amendment was assented by the president and published in gazette also.
 But the CMC case is against the gazette notifications released in 2012 only. (I have no idea whether they changed their petition to challenge the IMC 2016 amendment act)
 “so what could be the final verdict in the CMC case?”
That could be “Petition infarct us. Hence petition is dismissed.”
 What does it mean?
"The gazette notifications were already replaced by a parliamentary act. Hence your prayer of challenging the gazette notification is no more valid. Hence your petition is dismissed."
parliament to byepass it..???? In Cauvery river water issue and other issues in which case is pending in supreme court, the central government is using it as an excuse to pass any law on that context.
