What do you understand about a 🏡 real estate “Escrow Amendment?”
An escrow amendment refers to a modification made to the terms of a purchase agreement and contract when buying or selling a property. Once the property enters the escrow process, there are specific instructions called escrow instructions that replicate the terms of the offer within the escrow arrangement. However, negotiations often lead to changes after opening escrow, such as adjustments based on inspections, 💵 credits, repairs, or other factors. In such cases, an amendment is used. This involves either 📝 writing an amendment to the purchase agreement and contract, stating that both the buyer and seller have agreed to the initial terms and are now amending and adding or changing specific terms. Alternatively, escrow can also facilitate this process as part of their role. Once both parties verbally agree to the changes with their brokers, the amendment is prepared by escrow, signed by both parties, and becomes an official part of the revised contract within the escrow for the purpose of closing the transaction.
