Official Statement From Martin Garrix Clarifies Implications Of Spinnin’ Records’ Successful Court Appeal
This week, news broke that Spinnin’ Records and MusicAllStars (MAS) management, the team that launched Martin Garrix’s career when he was just starting out, won an appeal on the lawsuit Garrix brought forth in 2015 and won in 2017. As a result of that lawsuit, Garrix was given back the rights and masters to some of his biggest hits, including the song that broke him as an artist, “Animals.”
When Your EDM was made aware of the successful appeal this week, the precise ramifications of the appeal were not made abundantly clear. In a follow up email, representatives for Spinnin’/MAS told Your EDM, “Because Garrix nullified the agreements in 2015, he had the rights on his track back again. Now the higher court decided that Garrix nullified incorrectly. Spinnin’ lost the rights and Garrix has to pay for damages which will be determined in the coming period.”
A statement from Martin Garrix management this morning further clarifies some necessary information. Firstly, Martin is still recognized as master owner/phonogram producer of all the tracks returned to him in the judgement in 2017. Secondly, the only result of the successful appeal this week is that “MAS will be compensated for some outstanding items for their work from January 2015 to July 30, 2015 (which is not special) and that Spinnin’ Records will not receive any compensation.”
“MAS and Spinnin’ did thus not gain anything with these cases except that they have incurred enormous costs for themselves and Martijn,” the statement continues. “If they had agreed back in 2015 with the reasonable requests of Martijn, this could all have been prevented.”

Firstly, it is important to understand that Martijn Garritsen started these proceedings against MusicAllStars Management (MAS) and Spinnin’ Records because in 2015 his co-management Scooter Braun Projects and his counsels did not succeed in coming to agreement about the return and future ownership of Martijn’s master-rights and his current management contract.
Martijn thus no longer had faith in a collaboration with MAS, because of Mr Van Kooten’s conflicts of interest. Mr. Van Kooten refused any reasonable cooperation which forced Martijn to unilaterally cancel the agreements with MAS and Spinnin’ and, if that did not work, to terminate them as of July 30, 2015. For that termination, Martijn’s lawyers put forward various grounds. The Court of Lelystad recognized error as the first ground for cancellation of the agreements and on that basis, the contracts were terminated. Furthermore, the Court ruled that Martijn is the phonogram producer and therefore all rights to his tracks belong to him and not to Spinnin’ Records.
The result of accepting error as grounds for termination was that Spinnin’ and MAS had to financially compensate Martijn. MAS and Spinnin’ appealed and the Court of Appeals confirmed the judgment that Martijn is the phonogram producer and all rights to his tracks belongs to him. Instead of error, the court of appeal ruled on other grounds that Martijn had put forward, that Martijn was entitled to terminate his contracts per 30 July 2015 and that they did not continue until 30 July 2017 as MAS and Spinnin’ claimed.
With the Court of Appeal’s decision, Martijn received what he wanted in the first place: to be recognized as master owner/phonogram producer and a confirmation that he did not have to serve out his contracts until 30 July 2017. The first is particularly important to him because he hopes that other young artists will realize what their (music) rights are. Already four years ago, Martijn stated that the protection of fellow musicians was an important reason for him to take up this fight, and in that sense, Martijn is pleased with the outcome.
The Court of Appeals has ruled that MAS will be compensated for some outstanding items for their work from January 2015 to July 30, 2015 (which is not special) and that Spinnin’ Records will not receive any compensation.
MAS and Spinnin’ did thus not gain anything with these cases except that they have incurred enormous costs for themselves and Martijn. If they had agreed back in 2015 with the reasonable requests of Martijn, this could all have been prevented.

News bomba per il mondo clubbing e dintorni oggi pomeriggio. La Spinnin’, Appena comperata da Warner ha appena perso in tribunale la causa intentatagli nel 2015 da Martin Garrix, che voleva riappropriarsi della sua musica e che poi, musicalmente parlando ha vinto la sua battaglia affermandosi come superstar e non solo come top dj.
Garrix fa il buono e dice che è una bella notizia non solo per lui ma per tutti gli artisti ‘maltrattati’ da Spinnin’, ma in realtà si conferma un tipo freddo & calcolatore, perché chi più di lui è stato, nei fatti, aiutato da Spinnin’? Non poteva limitarsi a cambiare label & management tanto i soldi veri li sta facendo adesso, con serate strapagate e pezzi pop come “Scared to be Lonely”? Evidentemente no.
Billboard riporta anche i conti in tasca a Garrix e Spinnin’ che il giornale olandese NU.nl ha fatto: Garrix chiede a Spinnin’ € 3.7 milioni e €650.000 a MusicAllStars (società di management legata a Spinnin’). Mica male.

De Hoge Raad heeft eindelijk uitspraak gedaan in de zaak tussen dj Martin Garrix en zijn voormalige platenlabel Spinnin' Records en management MusicAllStars (MAS). Kort gezegd ging de ruzie van partijen over de vraag of: 👉 De overeenkomsten tussen partijen op de juiste manier tot stand waren gekomen en of dj Martin Garrix van verkeerde veronderstellingen was uitgegaan door toedoen van Spinnin' en MAS; 👉 Contractsbepalingen over de royaltyvergoeding en de verlengingsmogelijkheid onredelijk bezwarend zijn op grond van het #Auteurscontractenrecht; 👉 Contractsbepalingen op grond van redelijkheid en billijkheid buiten toepassing moeten blijven, en 👉 Wie als fonogrammenproducent (= #mastereigenaar) kan worden aangemerkt en welke maatstaf daaraan ten grondslag ligt. ⚖️ De Hoge Raad (HR) stelt definitief vast dat @martingarrix mastereigenaar is en niet heeft gedwaald bij het aangaan van zijn overeenkomsten met @spinninrecords en @masmgmt. 👩⚖️ Voor de overige 2 punten (toetsingsmoment auteurscontractenrecht en redelijkheid en billijkheid) verwijst de HR de zaak terug naar @gerechtshofdenbosch. Representatives for Martin did not reply when reached out to for comment when the news of the appeal was first made known to Your EDM.

Spinnin’ Records Successfully Appeals Martin Garrix Lawsuit
Today, the Higher Court in Leeuwarden ruled on appeal that Martin Garrix had no legal right to break his agreements prematurely with Spinnin’ Records and MusicAllStars Management.
Martin Garrix announced his split from the companies in August 2015 and it wasn’t too long until it was revealed that he was lobbying a lawsuit against both parties for allegedly coercing him and his father into signing a contract that was not in his best interests. A portion of the lawsuit was withdrawn in December 2015 but the remaining allegations continued to be discussed in court until September 2017, when a judge ruled in Garrix’s favor.
At the time, judges of the Lelystad court in the Netherlands ruled that there was a conflict of interest, as Eelko van Kooten, director of Spinnin Records at the time, was also director for MusicAllStars, the company responsible for negotiating Garrix’s contract with Spinnin.
In the victory, Garrix was given back the rights and masters to some of his biggest hits, including the song that broke him as an artist, “Animals.”
This new ruling confirms that the production- and management agreements with Martin Garrix were established correctly and properly complied with, by Spinnin’ Records and MusicAllStars Management. The accusation by Garrix that agreements were unreasonable has also been rejected: “It can be concluded that Martin Garrix was not falsely led into agreements in 2012 and 2013,” the Higher Court said. According to the Higher Court, the agreements expired “in mid-2015 and not before.”
In this long running case, the Higher Court ruled in favor of the dance label and management company, which at the time were run by Eelko van Kooten, and confirms that Garrix was unwilling to live up to his agreements.
Eelko van Kooten about the ruling: “I am delighted with the ruling of the Higher Court that we made valid agreements with Martijn at the time, which should have been respected. This statement confirms that the accusation of deception or fraud was unjustified. Even though I have since sold Spinnin Records and MusicAllStars Management, those accusations were also aimed at me personally. I look back with pride on a successful collaboration with Martijn and wish him the best in his further career.”
Martin will have to pay for damages which will be determined in the coming period, based on anticipated lost revenue from the tracks. Your EDM has also reached out to representatives for Martin Garrix for comment.
