KC Parks and Rec changes course, hoping to open 3 pools — if they can hire dozens of lifeguards
KANSAS CITY, Mo. — Here’s cool news, just in time for the ongoing summertime heatwave.
Kansas City Parks and Rec leaders hope to open three public swimming pools after all, something they’d originally ruled against during the COVID-19 pandemic.
A spokesperson for Parks and Rec told FOX4 they’ll need to hire 50 lifeguards before the pools can open.
If those workers can be hired, three pools — Gorman Park, Swope Park and Grove Park — would open, observing pandemic guidelines from the Centers for Disease Control and Prevention. 
“We don’t have enough staff right now to open the pools,” said Doug Schroder, an administrative officer with Kansas City government.
When the pandemic forced educators to close schools in March, Schroder’s recruiting efforts lost their best talent pool.
To qualify for the lifeguard positions, Schroder said applicants must be 16 years old and experienced swimmers. He said his office will train selected applicants and get them certified, if needed.
‘We’re doing recertification, and we’re also doing certification training. Right now, we’re covering all costs,” Schroder said. “We’re trying to eliminate as meant obstacles as we can and get kids in here to work.”
Kansas City’s 12 public pools are maintained by Midwest Pool Management. That company helps staff lifeguards at swimming facilities and spraygrounds. 
“A lot of high schoolers are struggling,” said Zach Adams, a returning lifeguard. “They either don’t have a job, necessarily at the restaurants that aren’t open right now. We have plenty of hours and positions to go around.”

The Future Of The Economy May Depend On An Ancient Doctrine Of The Past
Below is my column in The Hill on the legal foundation for an economic recovery in reopening businesses in the United States.  While some often seem to assume a zero tolerance approach for any risk of spread, we have no choice but to try to get this economy out of the current disastrous conditions.  Unless we want to reintroduce a barter economy, we need to stop the exponential growth of debt coupled with the perilous decline of employment.  The key may be individual choice and an ancient legal doctrine.
As pressure builds on states to open, many governors are starting to ease lockdown orders. That decision is not purely a public health matter but a public policy matter with interlaced issues of law, finance, and medicine. Congress and states must decide how legally to restart an economy in a world saturated by the coronavirus. With expensive recovery measures and a federal deficit projected at more than $30 trillion by the summer, we face a real possibility of a lost generation due to crippling debt and chronic unemployment. So this means businesses and institutions will need to operate in a way that is sustainable instead of just symbolic.
The legal challenge here is to open up the country fully when we cannot reasonably expect any vaccination program until next year, according to most experts. Thus, in the interim, our best hope may be an ancient legal doctrine that extends back to Roman law in the sixth century. “Volenti non fit injuria” means “no wrong is done to one who consents,” and it became the solid foundation for what we know today as “assumption of risk.” The doctrine encapsulates the concept of personal responsibility and choice. Thus, any economic opening precisely requires not liability but choice.
But assumption of risk, which began as a doctrine in employment liability cases in the United States, has already been on the decline in this country. Assumption was an absolute defense, but most states have now adopted an alternative “comparative negligence” approach in which jurors assign the portion of responsibility of each party in their verdict. If the plaintiff or the injured party is found to be 20 percent at fault, the award is reduced by that amount. Some states apply an additional rule that if plaintiffs are more than 50 percent at fault, then they are barred from any recovery.
The problem for businesses in this pandemic is that every case presents different arguable facts as to who is more at fault from the spread of the coronavirus. Is it the individual or the establishment? Strong defenses do exist, including factual causation where a plaintiff needs to establish that a particular location was the source. Indeed, it is difficult to imagine how someone could prevail against a business on the speculation that he or she contracted the disease from any single contact inside the business.
Yet states are adding different conditions and responsibilities that could fuel claims. There could also be a tsunami of litigation of strike lawsuits, cases brought with the intention of forcing a quick settlement, and even stronger liability lawsuits. If there will be a reliance on individual choice without the exposure to prohibitive litigation costs, then there is a need for uniform legislation on the state level and possibly the federal level.
Negligence can be wildly difficult to define in a world after a pandemic, where businesses are not being careless but must operate in a high risk environment. Any economic recovery needs to occur at a time when the majority of customers will be neither immune nor vaccinated against the disease. Businesses cannot question every group to determine if they are all family members or what each of their personal medical conditions are.
Take my neighborhood pool in McLean in Virginia. The board has debated whether it can afford to open it this year, given the uncertainty of what the state mandates. The state cannot expect lifeguards to constantly separate people or teenage workers to constantly check temperatures. It can clean surfaces regularly and can separate tables. While there is no evidence that the coronavirus can spread through chlorinated water, children will gather in groups and people might not be honest about their symptoms. There is no method to protect against transmission and remain a functioning pool.
In deciding whether to open, businesses now must balance the possibility of coronavirus infection against the near certainty of legal exposure. One can understand if they feel like they are being set up by those politicians who often speak as if they have a zero tolerance for any transmission risk. States are creating a host of duties for businesses to manage, even those directed at customers like the requirements that they wear masks inside.
In Kansas City, there is a rule limiting many businesses to 10 customers or 10 percent of occupancy. If customers linger for over 10 minutes, stores are asked to take down their identities and contact information to allow for possible reporting to state officials. In New Mexico, hotels and other places of lodging are allowed to operate at no more than 25 percent of maximum occupancy, reduced from the previously arduous 50 percent occupancy order. Each order can be the basis for a negligence lawsuit.
Many industries are already arguing for sweeping immunity protections from lawsuits alleging the contraction of the coronavirus. However, such sweeping immunity laws can remove the incentive for businesses to take precautions. The most logical path to reopening is to keep up pressure, including liability, on those businesses like nursing homes with high risk occupants or customers. Though nursing homes are seeking immunity, incentives or disincentives for high risk businesses must be preserved.
Alternatively, states can pass laws allowing for conditional assumption defenses. Businesses could be given immunity if they post prominent warnings that customers must assume the risk of entering or engaging. Congress has passed such an immunity law, for drug companies, which has been upheld by the Supreme Court. Under the National Childhood Vaccine Injury Act, vaccine manufacturers cannot be held liable for an injury or death related to a vaccine “if the injury or death resulted from side effects that were unavoidable even though a vaccine was properly prepared and was accompanied by proper directions and warnings.”
Indeed, Congress can pass the same type of law to protect any business from lawsuits over the contraction of the coronavirus if the business was properly maintained and displayed proper directions and warnings. Many states allow hotel pools to be protected from lawsuits over drownings, for instance, if the posted warnings indicated that no lifeguards are present.
Congress can arguably not only pass such immunity for federal enclaves but condition relief on such legal measures that allow for the opening of the economy. Under such a law, businesses and institutions can resume full operations with protection, so long as they meet conditions like the cleaning of equipment, the testing of employees, and posted warnings. Regulated industries such as the airlines today are subject to new rules, like proposed use of ultraviolet lighting to kill the coronavirus on board.
Otherwise, the choice would be left to individuals on the level of risk they are willing to take. For younger people, that risk might be sufficiently low enough to venture out to bars, restaurants, or sporting events. There has been more information now readily available to the public to make such critical decisions and to take personal responsibility for their decisions.
Torts scholar Francis Bohlen once described “volenti non fit injuria” as a “terse expression of the individualistic tendency of the common law” that “naturally regards the freedom of individual action as the keystone of the whole structure.” In either common law or legislative form, our future in this country may depend precisely on the “freedom of individual action.”

Indictment: Waterslide in fatal accident was 'deadly weapon'
KANSAS CITY, Mo/March 23, 2018 (AP)(STL.News) —A Kansas waterslide hyped as the world’s highest was a “deadly weapon” that had already injured more than a dozen people before a 10-year-old boy was decapitated on it in 2016, according to a grand jury indictment unsealed Friday that charges the water park operator and an executive with involuntary manslaughter.
Operators of the Verruckt waterslide at the Schlitterbahn Waterpark in Kansas City, Kansas, also knew that the raft Caleb Schwab and two women used during the deadly accident was prone to go faster and become airborne more than others. It was removed twice in 2016 but quickly put back into circulation, the indictment says.
“The ride was never properly or fully designed to prevent rafts from going airborne,” the indictment said.
The waterpark and Tyler Austin Miles, 29, a former operations director at the park, were indicted Friday on involuntary manslaughter and several other charges in Caleb’s death. The indictment alleges that a company co-owner and the designer of the Verruckt rushed it into use and had no technical or engineering expertise related to amusement park rides.
The charges come after a 19-month investigation into the death of Schwab, the son of Kansas Rep. Scott Schwab. The raft he was in went airborne, hitting a pole and netting designed to keep riders from being thrown from the ride.
The indictment says a video shows Caleb was following all rider instructions when he died.
The death seemed like an isolated accident until whistleblowers from Schlitterbahn revealed that experts who examined the slide found evidence indicating other rafts had gone airborne and collided with the overhead hoops and netting before the fatality, according to the indictment.
The ride complied with “few, if any” longstanding safety standards established by the American Society for Testing and Materials, and corporate correspondence found that “the child’s death and the rapidly growing list of injuries were foreseeable and expected outcomes,” according to the indictment.
Investigators found 13 injuries to others during the 182 days the ride operated, including two concussions and one case where a 15-year-old girl went temporarily blind.
A spokeswoman for Schlitterbahn did not immediately return a request for comment after the indictment against the company was unsealed.
The other charges in the indictment include aggravated battery and aggravated endangering a child.
Miles was indicted on two counts of interference with law enforcement and Schlitterbahn was indicted on one count of interference with law enforcement.
The ride was created after Schlitterbahn co-owner Jeffrey Wayne Henry made a “spur of the moment” decision in 2012 to build the world’s largest water slide to impress the producers of a Travel Channel show. The indictment says Henry’s desire to “rush the project” and his and his designer’s lack of expertise caused them to “skip fundamental steps in the design process.”
The indictment also said not a single engineer was directly involved in Verruckt’s engineering or slide path design.
Miles pleaded not guilty Friday during a brief court appearance. His attorneys asked that his bond be reduced to $15,000 from $50,000 but that request was denied. A trial was scheduled for Sept. 10.
Miles allegedly avoided or delayed repairs that would take Verruckt out of commission during the active park season and the ride’s brake system failed 10 days before Caleb’s death, investigators said. He also is accused of telling a police detective that he was unaware of any complaints about the ride and of withholding “thousands” of incriminating daily reports from lead lifeguards and supervisors.
Schlitterbahn, which is based in Texas, said in a statement after charges against Miles were announced that it was “deeply disappointed to learn any individual is being personally charged for the terrible accident on Verruckt.
“Our review of the facts and circumstances of the accident has never shown any evidence of criminal conduct on the part of anyone,” spokeswoman Winter Prosapio said.
Scott Schwab and his attorney, Mike Rader, didn’t immediately respond Friday to a request for comment.
The waterslide has been closed since Caleb’s death. Schlitterbahn has said it will dismantle the ride when the investigation into the boy’s death is complete.
Caleb Schwab’s family reached settlements of nearly $20 million with Schlitterbahn and various companies associated with the design and construction of the waterslide. The two women who rode with Caleb suffered serious injuries and settled claims with Schlitterbahn for an undisclosed amount.
Before the boy’s death, Kansas law allowed parks to conduct their own annual inspections of rides.
Lawmakers last year nearly unanimously approved stricter, annual inspection requirements for amusement park rides that set qualifications for the inspectors and required parks to report injuries and deaths to the state.
But only weeks later, lawmakers passed a follow-up bill delaying the enforcement of criminal penalties for operating a ride without a state permit until this year. And this year, the Senate and a House committee have approved legislation to lessen regulation for “limited use” rides at events like county fairs and exempt some amusements, such as hay rides, from regulation.

Weighing summer fun, finances and safety, US cities face tough choices on opening public pools
MISSION, Kan. — Public pools will look very different this summer if they open at all with the coronavirus threat still looming.
Teenage lifeguards will be tasked with maintaining social distancing and spotting COVID-19 symptoms in addition to their primary responsibility of preventing drownings.
Pools that do plan to open will take precautions, including screening temperatures on entry, requiring lifeguards to wear masks and significantly reducing the number of swimmers allowed in the water and locker rooms, said Dr. Justin Sempsrott, the medical director for the lifeguard certification program Starguard Elite and executive director of Lifeguards Without Borders, which works to reduce drownings worldwide.
“It’s definitely not going to be business as usual this season,” he said.
Amid the uncertainty, sales of inflatable pools that cost less than $150 have increased by 165% over the seven-week period that began March 15, compared with the same period last year, according to NPD Group, a data and consulting firm.
Meanwhile, most of the people who were planning to install in-ground pools in their yards before the COVID-19 shutdown caused economic havoc have decided to proceed, said Sabeena Hickman, the CEO of the Pool & Hot Tub Alliance, an industry trade group, which reached out to the country’s top 25 residential pool builders.
“It appears as if a lot of people are looking for pools and hot tubs for staycations,” she said. “We are anticipating that it will be a strong season for backyard pools.”
Walmart reported an uptick in the sales of pools and swimming gear such as foam noodles, and Bass Pro Shops said more people have been buying fishing gear and kayaks, though neither company provided specifics.
“If there is a bright spot in this horrible COVID-19 tragedy, it’s the unprecedented interest from fathers, mothers, grandparents, aunts and uncles all wanting to take their family out to enjoy nature,” said Johnny Morris, Bass Pro Shops’ founder and CEO.
Properly chlorinated pools can kill the virus, but youngsters splashing around together could be unwittingly spreading it without knowing they are infected, said Sempsrott, who is also an emergency room doctor in Boise, Idaho, who has treated COVID-19 patients.
Some pool operators have decided to delay opening or just offer lap swimming and lessons, while others have already called it quits.
The National Recreation and Park Association, a nonprofit that advocates on behalf of public parks, recreation and conservation, said 31% of agencies with pools have decided not to open them this summer and 46% were awaiting additional guidance from government and health officials before making a decision.
Of those that are opening, only 5% plan to operate fully; the other 18% will do so with truncated offerings.
Among those that have opted not to open their pools this summer is the Kansas City suburb of Mission.
In normal times, its outdoor pool is packed with kids, including a roughly 300-strong swim team, afternoon day camps and neighborhood children just looking to cool off and have fun.
City spokeswoman Emily Randel said opening this summer would have been too difficult given the added responsibilities of enforcing social distancing that would largely have fallen to teenage lifeguards. Kansas officials also have made June 8 the earliest that public pools can open.
“Putting it on our youngest staff seems like quite a burden for them,” she said.
Several of Mission’s neighboring cities, including Kansas City, have also decided to close for the summer.
Sempsrott said lifeguards will be “essential health care providers” this summer and will need to be provided with protective gear and a plan for what to do if a swimmer who arrives in apparently good health suddenly starts coughing or displaying other COVID-19 symptoms.
“The aquatic industry has been built on safety and prevention,” Sempsrott said. “If we aren’t able to safely open and reduce risk to an acceptable level, it doesn’t make sense to open in the middle of a pandemic.”
There are also financial concerns that need to be weighed. Some places have said they can’t afford to open their pools because of the decline in tax revenue caused by the coronavirus and the efforts to slow its spread. New York City, for example, estimates it will save $12 million by keeping its pools closed.
The closures will also mean the loss of many summer swim teams. USA Swimming has already canceled some high-level summer meets.
Sempsrott, meanwhile, warned that there could be more child deaths, as beginner swimmers take their chances in backyard pools without a lifeguard watching and with parents who may be distracted as they juggle working from home.
The kids are going to slip away into the backyard pool because you are on a Zoom meeting,” said Sempsrott. “Before, they would have been in preschool.”
Similar concerns were raised by the American Canoe Association, which also promotes kayaking and rafting. Beth Spilman, the interim executive director of the group, said it is hearing that boating could be at an all-time high this summer and is considering a social media campaign to promote safety.
“We know that there are concerns in the paddling community that there will be an influx of beginner or armature paddlers who are perhaps getting on the water without adequate instruction and that will cause an issue for local safety and rescue and perhaps for the Coast Guard,” she said.

The Mustang Date Night Project
In the run-up to high school graduation, kids are often asked “what do you want to do with your life?” and consider whether to go to college, trade school, or just go be a ski bum or lifeguard for a few years until something comes to them. But for Adam and Tabetha Hammer, the choice was pretty clear.
Both were self-described “car guys” with a history of working on cars (in Tabetha’s case, she and her father liked to restore old tractors), and after some searching each learned that McPherson College in Kansas was available as an outlet to turn their passion into a career. Tabetha said, “It’s the only university that has a four-year degree in automotive restoration.” McPherson’s website adds, “We stand alone as the only school to provide a bachelor’s degree in Restoration Technology. Our program provides students with many advantages including internships with national museums and restoration shops, in-depth learning and dedicated instructors who will personalize your experience.”

It was at McPherson that Adam and Tabetha met each other, and this 1966 Mustang is one of the things that brought them closer together. Adam said, “My grandfather Herman Hammer bought this Mustang new off of the dealer’s lot. Somebody else had ordered it so he got a deal on it.”
The Mustang served as Herman’s daily driver for several years and then his son Chris (Adam’s father) and his daughters used it on and off for high school and college transportation until Chris finally stuck it in the garage and forgot about it. Adam didn’t even know the car was there, until he was ready to head off to McPherson and his dad thought, “The Mustang might make a good project to restore.”
The 289 is original and rebuilt.
So off Adam went to school with the Mustang, and the rest is history. Tabetha said, “There were a lot of Friday night date nights in college restoring the car.” The pair restored almost everything, including the original 289 engine, automatic transmission, suspension, and especially the body. Adam said, “The car was pretty clean to start with for a well-used car. There were the typical rust areas that we fixed but we didn’t want to go overboard—we restored the car so we could drive it.” They stayed with the unique original color, Sahara Beige, and the black vinyl top is original and unrestored, as is the interior. Tabetha said, “We didn’t really want to restore it if it didn’t have to be restored, just to keep that originality and little features from the family.
The restoration of the Mustang not only brought them closer together but it also cemented Adam’s passion for automotive restoration, so upon graduation the couple opened Hammer & Dolly Automotive Restoration in Traverse City, Michigan (HammerAndDolly.com). Tabetha also works for Hagerty Insurance, the collector car insurance giant also based in Traverse City, which is how Mustang Monthly met her, while in town to shoot company owner McKeel Hagerty’s 1967 G.T. 500.
Surprisingly, the interior is all original as is the black vinyl top.
They found this Superman in the car when they tore it down for the restoration and have no idea its history with the car or family, but it remains a presence, hanging from the rearview mirror.
The final piece to the puzzle was when the Mustang played a key role in Adam and Tabetha’s wedding. The original plan was to get married next to the water in Grand Traverse Bay (part of Lake Michigan) in 2013, but Northern Michigan’s finicky weather dashed those plans when it snowed on the wedding day in mid-May, so they moved it into the restoration shop. Tabetha was driven down the aisle in a 1925 Packard and the Mustang was used as the “getaway car” for the newlyweds. Tabetha said, “It worked out quite well to be inside the shop with cars surrounding us for two car nuts. It wasn’t exactly what a woman dreams her wedding to be, but it worked out really well.”
The Hammers are a story of young adults with a passion for cars, then each other, that led them down the road to running their own restoration business working with cars. In a world filled with un-employable college degrees and mountains of student loan debt, this is one example of education and enthusiasm put to good use.
