Pascal Paradis
Executive director, Lawyers Without Borders Canada, Quebec City, Que.  Also back for his second time around the Top 25, Paradis is an unstoppable force and a fervent advocate for human rights, particularly for women and kids.  Thanks to Paradis' initiative, the Quebec bar joined LWBC to act as international counsel in favour of Raif Badawi, the Saudi blogger condemned to jail and flogging for his comments criticizing the regime.  Since January 2015, Paradis and LWBC are leading a consortium of Canadian organizations working to get a wide-range five-year job to foster justice.  They plan to execute means of balancing and prevention for women victims of sexual abuse and other individuals affected by the Malian armed battle.  He also discusses several international conferences on human rights issues. What Republicans needed to say: He's left a very profitable position in a large federal law firm to go LWBC for quite a compact paycheque because he followed his heart and his enthusiasm.
Mark Tamminga
Partner, Gowling Lafleur Henderson LLP, Hamilton, Ont. Tamminga has devoted his career to automating lawful practices.  His information technologies focus began in 1986 while he was a law student and has been given the job of systemizing the production environment for files.   Since then, Tamminga's aptitude for legal technology has only grown with Gowlings LLP.  Three decades back, he had been called Gowlings' Innovation Initiatives leader.  He is in charge of automating the Gowlings recovery services practice.  He has designed and built a number of additional training systems in the areas of debt collection, loan positioning, and civil litigation.  His role has demanded re-thinking that the thornier aspects of big business operations: managing cultural change, inducing client-side believing, and building the compensation mechanics, which drive new behavior. What the panel had to say: Tamminga has shown real vision in tackling tough issues that many law firms aren't quite prepared to take on.
Allison Dellandrea
Crown counsel, Ministry of the Attorney General,Toronto, Ont.   Dellandrea has been a key participant in advancing the understanding of crimes against children by law enforcement officers, fellow attorneys, and the judiciary.  She had been included in a child sexual abuse case in March in which Ontario's former deputy education minister Ben Levin pleaded guilty to child pornography related fees.  The fees included making composed child porn, counseling a person to commit a sexual assault, and possession of child porn.  Dellandrea's role as a Crown includes function as instruction lead for Ontario's provincial strategy on Internet crimes against children.  She's a worthy pioneer in this area within the justice department. What Republicans needed to say: Allison is a tireless resource and is the penultimate legal mind to get a prosecutorial place on all things related to child exploitation and sexual assault offences.  For such a difficult subject that inherently entails quite taxing emotional and legal issues, Allison always has time to offer sound advice to other Crowns prosecuting these very difficult and sensitive offences.  Her efforts have made a tangible difference in making our society safer.
Justice Ian Nordheimer
Judge, Ontario Supreme Court, Toronto, Ont.  Nordheimer's name is becoming synonymous with class action suits mostly due to his ruling, which overturned Justice Edward Belobaba's decision in a high-profile situation on carriage in the Barrick Gold class action suit.  Nordheimer granted the losing coalition of law firms leave to appeal Belobaba's decision in the Divisional Court.  He's likely the most influential Superior Court degree judge in the country with a decade on the seat and produces perhaps the greatest number of thorough judgments each year in comparison to any trial level estimate.  He's famous for his quick wit and sharp conclusions.  In the last year, Nordheimer has made quite a splash in the legal community by upholding a professional field punishment for current LSUC bencher Joe Groia and releasing information that revealed Rob Ford was the topic of a police investigation.What the panel had to say: He is the kind of judge that must be on the Court of Appeal... or higher.  A judge of absolute integrity.
Jean-Pierre Blais
Chairman, Canadian Radio-television and Telecommunications Commission, Ottawa-Gatineau Blais isn't afraid of criticism and is willing to go above and beyond in the name of customer rights.  A new CRTC decision provides consumers more freedom to choose TV stations of their liking as part of their satellite and cable subscriptions regardless of bitter opposition from Canada's cable companies.  Blais called out former Bell Media president Kevin Crull, without naming names, over reports Crull told CTV news personnel to not interview him after that decision.  Crull ended up apologizing for interfering in the news gathering process and later resigned.  From telemarketers to telcos, Blais always intends to encourage the rights and needs of customers. What Republicans needed to say: Reaching big shift with consumer-minded focus.  About time!

Frank Iacobucci
Senior counsel, Torys LLP, Toronto, Ont. This retired justice has set the bar for authorities treatment of the mentally ill.  His 2014 landmark report outlined 84 sound ways of helping prevent shooting of mentally ill people by the Toronto Police.  The implementation of this report goes a long way toward avoiding disastrous confrontations between police and emotionally disturbed individuals.  A few of the recommendations include using body-worn cameras and enhanced use of tasers.  The report is a strong message that the status quo is no more okay.  As a Torys counselor, Iacobucci is accustomed to advising government and company on important legal and policy issues. What voters had to say: Has anyone actually done more?  and Energetic, never stops.
Pascale Fournier
Professor & research seat, legal pluralism and comparative law, University of Ottawa Faculty of Law, Ottawa, Ont. Fournier has attained international recognition for her groundbreaking work on sex, religion, and the legislation, using fieldwork interviews with women from several countries to emphasize the intricate interplay between spiritual and secular law.  She's received numerous national and global awards and nominations in 2014.  Fournier became a fellow of the prestigious International Women's Forum for her role as a pioneer in the legal profession; getting the Canada-Arab Chamber of Commerce Award for academic excellence and contribution to humankind.  Fournier represented the University of Ottawa as a successful pioneer at the Governor General's Canadian Leadership Conference and was unanimously appointed by the National Assembly of Quebec to the Quebec Human Rights and Youth Rights Commission. Fred Headon
Assistant general counsel, labor and employment law, Air Canada, Montreal, Que.  As chairman of the Canadian Bar Association's Futures Initiative, Headon has given more than 25 presentations to lawyers, law professors, professors, librarians, law firm personnel, and regulators from Toronto to Buenos Aires, Victoria to Halifax, in person and online.  The Futures report was released in August 2014 and its recommendations put Headon squarely in the midst of many vital discussions on topics essential to the profession.  He continues to direct the Futures steering committee because it now turns its recommendations into actions.  Headon is an essential component of the debate about the future of the profession and he had been the first in-house counsel to eventually become the president of the CBA. What Republicans needed to say: Brings energy and decency and the smarts to what he does.

Alice Woolley
Professor and associate dean-academic, University of Calgary Faculty of Law, Calgary, Alta. Woolley is a true changemaker in the region of law and technology as well as law regulation.  She's been a valuable member of the Canadian Bar Association's integrity and professional responsibility committee.  Her work with the CBA Futures job as an ethics and regulatory issues staff member is really making a mark at the legal community.  Woolley is responsible for sweeping educational modifications as chairwoman of the committee that developed and embraced significant curricular changes at the University of Calgary's Faculty of Law, which concentrate on the practical elements of legal instruction and will come into effect in September. What voters had to say: Leading expert on legal profession and ethics; when she talks, people listen.   Alice is a pragmatic visionary.  Educating law students in a way that will prepare them for a 21st century clinic is of crucial importance to the future of the profession.
Justice Murray Sinclair
Chairman, Truth and Reconciliation Commission, Winnipeg, Man.  A rare write-in candidate winner for  this season 's Top 25, Sinclair was on the list last year, making headlines in June with the release of the overview of the report of the TRC along with 94 recommendations to redress the cultural genocide of Canada's residential college program.   Over six decades, Sinclair directed the TRC hearing the tales of over 7,000 survivors of sexual, physical, and psychological abuse.  Sinclair, that was the first aboriginal judge in Manitoba, was first appointed to the provincial court where he became associate leader in 1988 and then elevated to the Court of Queen's Bench at 2001.  He had been co-commissioner of Manitoba's Aboriginal Justice Inquiry in 1988 and presided over a 2000 inquest into the deaths of 12 infants at Winnipeg's Health Sciences Centre.  Sinclair expects to finish the commission's complete report in the near future, after which he will choose whether to return to retire or court and advocate for indigenous rights fulltime.
Marie Henein
Old spouse, Henein Hutchison LLP, Toronto, Ont. Justice Beverley McLachlin
Chief justice, Supreme Court of Canada, Ottawa, Ont.  A frequent member of the Top 25 list along with also the very best vote-getter in years ago, McLachlin continues to make waves, handing down two quite important decisions on aboriginal law.  The 2014 Tsilhqot'at Nation v. #preszler A personal injury #law firm that billed itself as the #Toronto #BlueJays’ “official” injury lawyers is changing the way it advertises after #Ontario’s #legal regulator reminded the firm it never worked for the team.
Preszler Law Firm has removed the claim that it was the “Official Personal Injury Firm of the Toronto Blue Jays” from TTC ads, according to a summary of a recent meeting between the Law Society of Ontario and the firm’s managing partner, David Preszler.
The claim was dropped before a regulatory meeting last month to address allegations that Preszler “engaged in improper advertising.” The firm’s marketing also includes ubiquitous television and print ads featuring a distinguished-looking white-haired man, who, as the Star reported last year, is actually an actor.

Face of Preszler Law Firm had role in Good Will Hunting
Preszler, the firm’s managing partner, told the Star in an email that the firm co-operated fully with the law society’s investigation and that no formal discipline was warranted. He said his firm continues to be “proud sponsors” of the Jays but is no longer allowed to call itself the “official personal injury law firm” of the team.
The law society summary, published in a weekly newsletter, notes that the firm and the baseball team had a “sponsorship agreement” and that “the firm never provided legal services to the Toronto Blue Jays.”
It also says the firm, in calling itself the ball club’s official lawyers, and not identifying the spokesperson as an actor, “might mislead, confuse or deceive.” Although the ads did not claim he was a lawyer, “they did not identify him as a spokesperson either.”
More than a year ago, the Star reported that the spokesperson was actor John Fraser, who has appeared in commercials for J.P. Wiser’s Whisky, Tylenol and also appeared in the 1997 movie Good Will Hunting, starring Matt Damon and the late Robin Williams.
The firm now identifies Fraser as a “spokesperson” and “not a lawyer,” on its website, and is editing its ads to include a similar disclaimer. The changes were made around the time the law society began investigating the firm’s advertising practices.
Preszler would not comment about the meeting, but said, “No adverse findings were made against either myself or my firm; formal disciplinary proceedings were not warranted; my firm fully complied with the (law society) investigation; no public complaint has ever been made about my firms marketing/advertizing and this investigation arose only as a result an internal (law society) investigation.”
The firm has pasted a short biography of Fraser on its website.
“John Fraser is not a lawyer,” it reads. “He is the proud spokesperson and marketing associate of Preszler Law Firm. Since 2006, he has helped the firm deliver a positive message relating to access to justice.”
The meeting summary also says Preszler told the law society a disclaimer about Fraser has been added to television advertisements, and that TTC ads with the Blue Jays designation have been taken down and references to the firm’s sponsorship in internet ads have been removed.
Members of the law society committee agreed that the discussion with Preszler was “useful, and that the process made it unlikely that there would be marketing by the firm that might mislead, confuse or deceive in the future,” according to the meeting summary.
A Toronto Blue Jays spokesperson, Sebastian Gatica, told the Star in an email that the team could not comment, but that Preszler is still a sponsor of the Jays.

The Education of Paralegals in Ontario

In 2007, Ontario became the first province in Canada to expand the scope of duty for paralegals, and initiate the regulation of the profession through licenses granted by the Law Society of Upper Canada (LSUC).  This initiative was a huge step forward in the effort to make justice more accessible to the average person in Ontario. For the first time in this country’s history, paralegals can now represent clients in legal matters independent of lawyers, and give legal advice at a fraction of the cost of hiring a lawyer.  These developments also necessitated reforms to the paralegal education in Ontario.  The full accreditation policy can be found here:

Paralegals in Ontario must now complete, and graduate from, a paralegal education program at an accredited college and then pass the licensing exam. The majority of programs offered are diploma programs, with just 1 bachelor of applied arts offered in Ontario at Humber College, and 8 graduate certificate programs offered throughout the province.  Every accredited program requires paralegal students to complete a minimum of 830 program hours, which includes 120 hours of field placement.

The Law of Roses: What compels me both to law and to flowers is that they both breathing, living, changing, mutable and defining elements in reality. We need both the Canadian summer roses to remind us that our time is brief and the law to emphasize this unwavering rule, fixed in the limiting terms and sentences that frame our stay upon earth. Like a June rose that lifts our heart to ecstasy but seldom remains for very long, the joy we receive in order, solid institutions and structures is also sure to pass and its strongest entities vulnerable to decay and disrepair. So we must tend to both the courts and the gardens, each helping us scale the highest ideals and revealing the true nature of beauty and evanescence. The more I study the laws and learn about botany, the more patterns I note, in how energy flows, how nature abhors imbalances, how the best minds and hearts could easily venture to reduce social injustices rather than bolster archaic systems and entrenched inequities. For from the roses, we see that when one has power, one must use it in order to heal, fragrance and to restore rather then prick, maim and set the world in tears. So let us set candles ablaze to remind both the gardeners and the lawyers to tread carefully on the soil and on the briefs, to tend each law and each peony bulb to linger in the most heavenly, reasoned and ecstatic light.

Justice Ian Nordheimer

The [R]evolution of Law and Justice in Ontario

Who should have full access to law and justice in our society? Can there possibly be any other answer than “everyone”?  And yet this is not always the case for people with low (or no) income, or limited knowledge of the law, or mental illness, or any number of other obstacles that stand between an individual, and their fair and just treatment under the law.
In recent years, Ontario has been a pioneer in the Canadian legal system and has made several significant changes in order to make law and justice more accessible to everyone.  Certainly one of the most notable of these advancements is the decision to license Paralegals so that they may handle some of the more straightforward legal matters and take some of the backlog and burden off the lawyers in our province.  This is a win-win for everyone.  
Licensed Paralegals in Ontario are now authorized to represent clients in Small Claims Court; minor (summary) criminal offences; all charges under the Provincial Offences Act such as traffic and municipal by-law violations; and all administrative tribunals including landlord/tenant, human rights, and immigration/refugee matters.
Our Canadian legal system originated hundreds of years ago and thousands of kilometers away, but it continues to evolve even today in order to meet the changing needs of our society. The legal systems that we adopted when Canada first became a nation, are the foundation on which our society is built. Ensuring that all Canadians have a greater understanding of the law, and access to justice, should be the ideal we continue to strive for.
