Significance of the POCSO Act
The POCSO Act, enacted in 2012, is gender-neutral, recognising that boys can also be victims of sexual abuse. Here's what you need to know about the Act.
The parliament passed the Protection Of Children from Sexual Offences Act in 2012 to effectively combat the increasing evil act of sexual exploitation and sexual abuse of children.
Let's get in-depth and understand the POCSO Act in its simplest form.
Why POCSO Act?
Our country has one of the world's largest populations of children, with 472 million children under the age of eighteen, according to census data from 2011.
The state's protection of children is guaranteed to Indian citizens under an expansive reading of Article 21 of the Indian Constitution and mandated by India's status as a signatory to the UN.
The following sections of the I.P.C were used to prosecute child sexual abuse earlies:
I.P.C. (1860) 375- Rape
I.P.C. (1860) 354- Outraging the modesty of a woman
I.P.C. (1860) 377- Unnatural offences
However, such a method had problems, as the I.P.C. could not adequately protect the child due to several flaws, including:
Other than "conventional" peno-vaginal intercourse, IPC 375 does not protect male victims or anybody else against sexual acts of penetration.
There is no statutory definition of "modesty" in IPC 354, and it has a light penalty and is a repeatable offence. Furthermore, it does not safeguard a male child's "modesty."
The phrase "unnatural offences" is not defined in IPC 377. It only applies to victims who have been penetrated by their attacker's sex act, and it is not intended to criminalise child sexual assault.
As a result, legislative reform was required, with a specific child protection statute, which gave birth to POSCO.
Significance of the act
The Act, passed in 2012, is gender-neutral, acknowledging that boys can also be sexual assault victims. Hence, everyone under the age of 18 is considered a child.
Boys can get sexually attacked. However, the Indian Penal Code does not recognise this, which is corrected under the Act.
The Act further broadened the definition of a sexual offence against a kid. It broadened the definition of sexual assault to cover non-penetrative and aggravated penetrative sexual assault (sections 3–10) and penalties for those in positions of trust, such as public workers, educational staff, and police officers.
Notably, the law also recognises both touch-based and non-touch-based sexual harassment of children (parts 11 and 12), such as stalking, forcing a child to expose themselves or exposing oneself to a child, etc.
Under sections 13, 14, and 15, the Act imposes severe penalties for exposing children to or using them to make child sexual abuse material (CSAM, often known as child pornography).

Section 25 of the Act
So, now the question comes what does Section 25 of the POCSO act 2012 deals with?
If the child's statement is being recorded under section 164 of the Code of Criminal Procedure, 1973, the Magistrate recording the statement shall, notwithstanding anything in the Code, record the child's testimony as spoken.
Provided that the requirements of the first provision to sub-section (1) of section 164 of the Code are as much as it allows the presence of the accused's lawyer.
Upon the police filing a final report under section 173 of the Code, the Magistrate shall provide a document copy prescribed under section 207 of the Code to the kid and his parents or representative.
Judgment disrobing Act
The court case widely discussed when discussing the act is Satish Ragde vs State of Maharashtra. In the said case, the accused was acquitted of sexual assault under sections 7 and 8 of the Act by the Bombay high court.
Even though the accused groped a kid, the court acquitted him, citing the lack of evidence to determine if the top was removed or whether the hand was inserted inside the top. The court determined that the accused's actions did not meet the definition of sexual assault because there was no proof of physical contact.
As a result, the court found the defendant guilty under sections 342 and 354 of the Indian Penal Code (1860) (outraging a woman's modesty). It sentenced him to a minimum jail time of one year, which might get extended to a five-year harsh sentence. The decision had made such a stir that the Supreme Court had to put it on hold.
To Conclude:
Children are one of society's most disadvantaged groups because of their inability to communicate their ideas and sorrows freely. Because of the victim's innate frailty and the abuser's ability to overcome it, sexual assaults against children are particularly tough.
The legislature passed the Protection of Children from Sexual Offenses Act in 2012 to the necessity to safeguard and secure these vulnerable victims.
The POCSO Act was established to protect minors and small children in particular. Since it is supposed to be their protector, the act imposes harsher punishments and other precautions.

comfort without complacence
this week, i’ll be exploring the following prompt:
have any assumptions you had about the people or country become apparent to you or surprised you? have any of these assumptions proven to be wrong? what images, stereotypes or preconceived notions have been hard for you to relinquish?
i’m happy to say that i’ve been successful in my goal of getting out more! since last week, i’ve gone to quite a few cool places and met some cool people. at the same time, i’ve been going to the gym nearly every day, keeping up with my studies, and eating healthily and on-budget! in other words, i feel like i’m reaching the point of having adjusted to life here pretty well: there’s a comfortable level of consistency in my life in the way of regular activities and routines, but there’s also plenty of new things to explore and i’ve been refusing to let myself get complacent and lazy.
i think what strikes me as one of the unexpectedly hardest things about life in korea is the emphasis the society puts on doing things together. this is something that i had vague familiarity with from watching korean dramas and what-not, but i didn’t really grasp how significant a part of the culture it was until being here for a longer period of time.
personally, i do a lot of things alone, at least in the usa, like exercising, studying, and eating. that’s not to say i don’t like doing things with people, but often times it’s just hard to coordinate people’s schedules and what-not, or, in the case of studying, for instance, i just find it’s more effective for me when i study alone.
in korea, many activities that i would often do alone in the usa are almost exclusively done with others. for instance, most meals are eaten in a group. the majority of korean restaurants cater to groups of four or more, with dishes only being sold in larger servings and the cost being split among all the group. even more than eating, drinking is a completely social activity--i don’t think i’ve seen even one korean alone at a bar (although i have seen a few foreigners solo). the extent to which this tendency towards group activities permeates through society is hard to pin down. of course, it also varies from person to person. there are a few people who go to the gym i go to (snu posco center) alone, but many go in pairs. our korean teacher talked one day about how seeing someone eating (or even worse, drinking) alone makes koreans concerned that person is quite strange: “why would they eat alone? do they not have friends?”
however, to some extent that view has been changing. there are a lot of restaurants which are catered toward 혼밥 (essentially “eating alone”), and i’ve seen one advertisement for a 혼술 (“drinking alone”) place. for me, these places are great for a few reasons. for one, they still feature the insanely quick service as all other korean restaurants, so it’s easy to get a quick meal (you can even get it for takeout). for another, many allow (or require) customers to order from a touchscreen kiosk. although the menu is still in korean, it takes the pressure off of having to quickly decide and give your order to a waiter or waitress and allows you to thoroughly browse all the options. also, since pictures are included with all the food, it’s a great way to learn vocabulary. lastly, although this is a generalization, i’ve found these restaurants to generally be more cost-effective for one person dining. if you want to splurge a little bit, you should definitely get meals with friends (preferably all-you-can eat meals!), but if you’re looking for the most bang for your buck for $8 or less, eating at a 혼밥 place is definitely better than splitting a meal at a group place, in my experience.
not 혼밥, but i could’ve been! daisha and i have been checking out all the fast food places in korea (including american chains and korean ones). this one, lotteria, has wonderful friend chicken!
speaking of going it alone, i took a nice trip to a nearby park (낙성대공원, nakseongdae park) last sunday. it was wonderful, and now it’s become a personal goal to visit as many seoul parks as possible! the park featured a large empty paved area where kids rode bikes and roller skates as well as a larger traditional-style village (which was unfortunately closed at the time).
the park contained a lot of traditional 한옥 (hanok) style buildings, like this one, which happened to be a library and restroom. if you look closesly on the right side by the windchimes, you’ll see soju bottles with buddhist charms attached hanging from the trees.

on the next day, a popular kpop band shinee’s new album was set to release in the evening. personally, i don’t really know anything about shinee, but a few of the other light fellows are huge fans, and convinced me to accompany them to starfield coex mall, where shinee’s record label has a giant store, museum, and more. unfortunately, the album didn’t end up being physically released till the next day, but the mall was amazing!

the highlight of the mall is the library, which i forgot to take a picture of (somehow). it’s two stories of books wrapped around the center of the mall, with tons of comfy seats and cafes nearby. i’m sure i’ll be back, and promise i’ll get a good picture then!
on wednesday, sarah and i went to 덕수궁 (deoksugung palace) and one of three branches of seoul’s mmca (museum of modern and contemporary art). the mmca also has a branch by gyeongbokgung and one in seoul grand park, the latter of which is the biggest (and based on my visit there on spring break, best!). the mmca here was quite small and had mainly older art collections, as the current exhibit is showcasing the museum’s history. the good news was since, by sheer coincidence, we went on the last wednesday of the month, entrance to deoksugung and the museum were both free! usually it would have been 5000 won in total (although i believe students get in to the museum for free, but i’m not sure if that applies to international students like us).

the coolest piece on show (as of when we went) was the last room, which is a digital recreation of the different “stages” of the museum (the floor plan, architecture, then with exhibits, etc.). complete with an ambient soundtrack, the room is quite a cool experience. i took this cool aesthetic photo by complete accident.
the area between deoksugung and the museum gave me major boston/new york vibes. while sitting here, a group of elementary school girls asked me to take a photo with them. they spoke in perfect english too! kids these days
pondering something deep by the palace. the architecture and colors are essentially the same at all of these joseon-era palaces, but i personally preferred deoksugung to gyeongbokgung simply because there were far fewer people there!
after the museum, we took a trip to city hall, where they have a giant “i seoul u” sign. i’m not sure exactly what that’s supposed to mean, but it’s cute! these signs are scattered throughout the city, i believe, at major attractions; for instance, i think there’s one by the han river.
on thursday, i went to another museum with my snu language buddy. as i’m becoming more acquainted with speaking korean regularly and he’s trying to tailor his speech to my level, i feel like we’re becoming actual, well, buddies! we went to the national museum of korea, which was incredibly large and interesting. we were there for around three hours and hardly got through half of the exhibits or so before being kicked out at closing time.

the museum is easily reached on subway line 4 at the 이촌 (ichon) stop. if you follow the signs, there’s an underground passage straight from the subway to the museum’s entrance.

after getting kicked out, rain started pouring down. luckily, i brought an umbrella. 상윤 (sangyoon) and i ran to the subway station both crouched under the one umbrella laughing hysterically. moral of the story: always bring an umbrella!!
finally, yesterday i spent the evening with another friend of mine, 윤우 (yunu). she showed me some cool places in 홍대, including an all-you-can-eat pho restaurant (emoi) and a foreigner-friendly bar (“cocky pub”) where they were playing the france vs. argentina world cup match. it was filled with french people! korea is strange because day-to-day i see very few foreigners outside of the classroom. they seem to all be concentrated in little bubbles here and there.

hanging out with korean friends is definitely the 100% best way to improve your spoken fluency. whether it be a language partner or someone you meet through other means (ahem), they’ll not only be forgiving of your mistakes and willing to help you, but also simply the act of forcing yourself to speak and listen in korean outside of the pre-made sentences in class--to actually naturally use the grammar and vocabulary you’re learning in class in real-life situations--does wonders for speaking and listening ability and, more importantly (in my book, at least), for your confidence!
to that end, to future light fellows/people studying abroad, if you do have/make/meet korean friends, i would encourage you to at least try to have a good deal of your conversations in korean (or whatever language you’re learning)! both sangyoon and yunu speak far better english than i do korean, and so we can certainly have “better” conversations in english. however, when i speak to them in korean, it really feels like a completely different side of them comes out--speaking to someone in their native tongue definitely allows their full personality to come out, even when they have to speak in simpler terms to you!

Meghalaya MLA Julius Dorphang arrested on rape charges
An independent MLA from Meghalaya, Julius Dorphang, has been arrested from Guwahati on charges of raping a minor in the state.

Julius Dorphang is the sitting MLA of Mawhati constituency.

A focus on foreign-sourced steel only caused steel imports to increase

The arrival of a new presidential administration caused many to think that it would crack down on certain types of imported steel. Tough talk led steel imports to spike, and lack of action has helped to maintain recent levels of import activity.
With a tough-talking candidate taking residence in the White House in January 2017, no one expected steel imports to increase this year.
Steel imports and steel prices have behaved in an odd fashion this year. That’s why steel buyers need to consider both history and politics to truly understand the market forces at play.
In 2014 foreign steel imports flooded the U.S. market. That increased rate of imports continued into the first half of 2015, at which time the domestic steel mills filed antidumping (AD) and countervailing duty (CVD) cases on coated steels, cold-rolled, and hot-rolled steels. The U.S. Department of Commerce investigation found most of the accused countries guilty of dumping, and duties were assigned to curb or eliminate imports from those countries into the U.S.
In 2014 total steel imports of all products averaged 3,694,837 net tons per month, with the biggest importers being the domestic steel mills themselves. U.S. steel mills brought in 866,061 net tons of semifinished steel monthly on average (mostly slabs with some billets). Domestic steel mills also were responsible for a portion of the hot-rolled that was imported, which can be traced to mills like USS/POSCO, Steelscape, and CSN.
As seen in Figure 1, OCTG (oil country tubular goods) averaged 332,024 net tons per month, hot-rolled 358,663 tons, cold-rolled 214,660 tons, galvanized 276,105 tons, Galvalume and aluminized 85,076 tons, and plate coils and lengths a combined 331,463 tons.
The U.S. did see total imports decline in 2016 when the monthly average dropped below 3 million tons/month, coming in at 2,751,789 net tons. OCTG dropped to 94,747 net tons, hot-rolled to 239,797 net tons, cold-rolled to 183,509 net tons, galvanized to 258,171 net tons, and plates (coils and sheet) to 207,048 net tons/month, on average. Products designated “other metallic,” which is the U.S. Department of Commerce designation for Galvalume and aluminized steels, did not decline; they averaged 86,138 net tons per month during 2016.
When 2017 began, the 2016 import trend continued into January and February. Those two months averaged 2,768,059 net tons of total foreign steel imports.
Then President Trump announced he had charged Commerce Secretary Wilbur Ross with investigating whether a healthy domestic steel industry is essential to U.S. national security. The belief by most in the steel community was that the results were “fixed,” and that Section 232 trade actions against foreign steel imports were inevitable. The prospect of losing access to foreign suppliers did not move steel buyers to buy more domestic steel, however, but just the opposite. The amount of foreign steel being imported into the U.S. once again jumped close to the 2014 pre-AD/CVD levels. The months of March, April, May, June, July, August, and September averaged 3,443,274 net tons of imported foreign steel.
As seen in Figure 1, imports of foreign cold-rolled steel are averaging 224,655 net tons, which is approximately 10,000 tons more per month more than the pre-AD/CVD year of 2014. Galvanized steel imports also are above 2014 levels, now averaging 293,914 net tons. Steel Market Update (SMU) also is seeing the “other metallic” steel, mostly Galvalume, averaging 105,467 net tons/month, which is considerably more than the 2014 average of 85,076 net tons.
SMU expects foreign steel tonnages to drop in the coming months, not so much because of further government trade actions, but because of ordinary market forces. Foreign steel prices have been rising. The areas where we expect foreign imports to continue to win market share from domestic mills is in cold-rolled and coated steels. These are the products for which the domestic mills raised the traditional spread between their base prices and that of hot-rolled coil. What was once a $100 to $120 per ton spread was pushed to $200/ton. The SMU Steel Index reported hot-rolled as averaging $600/ton during the week of Nov. 6; cold-rolled base pricing $185/ton higher; galvanized $170/ton higher; and Galvalume $200/ton higher than the hot-rolled average base.
As many of you know, the administration has put off a decision on Section 232 until after tax reform legislation has been completed. The report from Ross is due to the president in mid-January, after which he has 90 days to act on it. At this point, most governmental observers believe that if anything is to happen, it won’t occur until mid to late Q1 2018. And it no longer seems like a slam dunk that the steel industry will reap any benefits from Section 232. SMU has been hearing from steel mill executives who say they never asked for 232, have no expectations, and are now concentrating their efforts on traditional AD/CVD trade remedies.

A Word About Service Center Inventories
Previously I have spoken about the new proprietary analysis SMU has been working on to measure the number of months of inventory flat-rolled steel distributors are carrying on their floors at the end of each month. As of mid-November, we have just completed our analysis, and the months of supply of flat-rolled on service center floors in the U.S. at the end of October is essentially the same as what we recorded at the end of September. With 90 percent of the registered service centers reporting, inventories stood at 2.86 months of supply at the end of October compared to 2.89 months at the end of September. (Note: As we add service centers, we revise previous months of supply as new data becomes available.)
Looking at the data a little closer (see Figure 2), 50 percent of responding companies reported their inventories as shrinking compared to the previous month. The changes were mostly subtle (2.90 down to 2.88 months of supply, for example). Of those reporting a decline in the number of months of supply, only four companies reported a change of half of a month or greater, because of mill orders being late or stronger sales than anticipated in October.
Forty percent of the responding companies reported their inventories as rising. Much the same as those who reported a decline, the spread between October and September was very narrow. Only one company reported a change greater than half of a month of supply. That company reported that all its inventory is sold, and it has no spot inventory available to sell. Of those reporting growing inventories, we heard reports of companies receiving large shipments of foreign material or building stock to protect margins on steel that was already sold.
Ten percent of the companies reported their number of months of supply as being the same as the prior month. No one expressed any comments or concerns about having too much or too little inventory.
At the beginning of November, we asked service centers if their inventories were balanced or at a level where they needed to consider buying more inventory. We noticed a small change in the percentage of service centers that reported they were either building inventory now or would be shortly. At the beginning of October, only 6 percent of the respondents reported building or soon to be building inventory. The percentage of service centers reporting a need to build inventory either now or soon grew to 14 percent as of the beginning of November.
