She completed her list of offenses by not asking, but telling me, that she would demand that her spouse pay her attorney’s fees in this case.
We all are aware that hiring an attorney and getting a divorce is not the most inexpensive activity that you will ever engage in. There is no use in trying to deny that. This woman I was meeting with was a stay-at-home mom who had not worked in some time. On top of that her husband controlled the family finances and she had little to no access to the checking account of the family. So not only was she demanding that her spouse pay her lawyer fees out of fairness- but also out of equity.
I thought this would be an interesting and relevant topic to discuss in today’s blog post. How common is it for your soon to be ex-spouse to pay your attorney fees in a divorce case in Texas?
The impact of community property on your ability to be awarded attorney’s fees in your divorce
Houston Family Law Lawyers: When it comes to dividing up income, assets, property and debts in a divorce case, a judge would be bound by the Texas Family Code to do so in a just and right manner. This means that equity, fairness and a taking into account of all the circumstances of your case are important and relevant to that decision.
The presumption under Texas family law is that all property owned by spouses at the time of a divorce is community property. This means that it is subject to being divided up in their divorce. If you want to overcome this presumption in your own divorce you must provide clear and convincing evidence that a piece of property is rightfully part of your separate estate. Your spouse may do the same when it comes to his own property. Keep in mind that, despite what many people who come in to talk to me about their divorce case believe- it does not matter whose name is on the bank account, brokerage account or any other type of title to an asset. You can name the account or property anything you want, but ultimately it matters when the property came into your ownership as far as rights to the property are concerned.
What happens if you don’t have access to money to pay for an attorney?
The situation that I detailed about regarding our office’s potential client not having access to the money in her checking account is not uncommon. Many spouses, willingly or unwillingly, have little to no say over the finances in their home. As a result, their spouse holds the keys when it comes to where and how money is spent.
If you are in a position where you have absolutely no access to money and you cannot afford to pay the retainer for a family law attorney to represent you there is a path for you to get representation. You can request that a judge issue orders for your spouse to pay your retainer fee at the outset of your divorce if you truly do not have any money to pay for an attorney on your own.
Interim attorney fees during a temporary orders hearing
Family Law Lawyer Houston: The process of requesting interim attorneys fees, the kind that I just mentioned, would be done at a Temporary Orders hearing. Among your other requests, you can ask that your spouse pay a set amount of money towards your attorneys fees for as long as your case lasts. This would be a temporary order that both sides and their attorneys would sign.
A judge would be most apt to grant this request if you do not have access to money or have very limited access. If you are disabled, do not work or stay home to help raise your children this would encompass your situation. Even if you do work, you can be awarded interim attorney’s fees if your spouse earns significantly more than you. If you find yourself in a similar situation to the one I outlined above, fear not. A court can review the circumstances and order that your spouse sell any community property that is available for sale in order to pay for your attorney’s fees. Extra property that is not essential to their business or other ventures can be sold off in an effort to make sure that you have an attorney during your case.
Having attorney’s fees paid through mediation
A final method to work towards having your spouse pay your attorney’s fees is in mediation. You will likely attend mediation twice in your divorce case: the first time will be before a temporary orders hearing and the second time will be before a trial. You can negotiate to have your spouse pay your attorney’s fees as a part of your settlement terms. Interim attorneys fees would be a part of your temporary orders. If you have not had your spouse pay your attorney’s fees to that point, you can negotiate for a lump sum payment of fees in your either installments or a lump sum.

You can attempt to get a reimbursement for this during the divorce but it still won’t put money in your pocket when you need it at the beginning of a case. Setting up a separate account for you and your expenses is a good first move to make when preparing for a divorce
BEGIN TO USE A CALENDAR

However, I would suggest that during a divorce your priorities should change. Going to see your doctor for a checkup should be a part of that change.
For starters, divorces are stressful. Getting an assessment at the outset of your divorce in regard to your health can either give you piece of mind that you are ready to go through the process in good health or can help you assess where you need to work on improving your state of health.
Another less frequently seen but altogether relevant consideration is to find out if you have contracted any sort of sexually transmitted disease from your spouse. This is relevant in those instances where you have reason to believe that your spouse has been unfaithful to you.
Finding out before you are divorced that you have an STD that your spouse gave to you can make a huge difference in the outcome of your case. If nothing else a court can order that your spouse pay for any medical treatment associated with the disease you contracted.
COLLECT AND ORGANIZE INFORMATION
Divorce Lawyer in Spring TX: One of the more frustrating things that clients at the Law Office of Bryan Fagan will run into once their divorce has started is that documents they wish they had access to have suddenly gone missing. It’s not that they’ve grown legs and walked away on their own.
Typically, your spouse will, after learning of the divorce, will begin to take documents that are important and either outright hide them from you or take them to a place where it’s less likely you will find them. One piece of advice that I can provide in the context of community vs. separate property: if you plan to assert that a piece of property is yours separate from the community estate be prepared to show proof of this assertion to a judge.
This means showing that the chain of ownership never included your spouse, either directly or indirectly through community funds being used to purchase the item or piece of property. Documents such as the ones listed above can be essential to meeting this burden in court.
FAIL TO PREPARE AND YOU SHOULD PREPARE TO FAIL

Realtor.com® found the best elementary schools (which received at least an 8 out of 10 ranking by education information group GreatSchools) in the largest 15 metros where buyers can find a home without breaking the bank. You’re welcome!
To compile our rankings, our economics team looked at the monthly housing costs (mortgage payments, taxes, etc.) needed to purchase a median-priced home in all of the ZIP codes in each metro. To ensure buyers were getting a deal, we factored in the median income of residents living there to ensure affordability. We also filtered out the ZIP codes with high crime and poverty rates, and for geographic diversity included only one ZIP code per metro.
“When searching for a new home, finding something affordable in a good school district with family-friendly features, such as large backyards, tops the list of home buyer priorities,” says Javier Vivas, manager of economic research for realtor.com. “These markets offer strong public schools and affordable homes, making them a great fit for home buyers with elementary school–age children.”
Aurora topped the list due to its having three top-rated elementary schools. It’s also 45% more affordable than the surrounding metro area.
“It’s absolutely family-friendly,” says local real estate broker Margaret Rowe of Coldwell Banker Residential Brokerage. She touted the myriad parks and family events held in Aurora.

Family Law Lawyer Houston: In my years of practicing family law, I have found that so much of the practice involves helping clients understand what reality is versus their perception of reality. For example, if you are like most people that I have spoken to about today’s blog post topic, you may believe that premarital agreements (or prenuptial agreements as they are commonly known) practically guarantees that a divorce will occur for whatever couples agree to one. After all- why sign an agreement that discussing dividing up property upon divorce if a divorce isn’t likely from the very start?
That is the widely held notion. In reality, premarital agreements are often times the smartest thing a couple can agree to prior to their marriage. It offers people peace of mind in order to be sure that they know how what will happen should a divorce occur. You are able to negotiate with a person who is about to enter into a marriage with you, instead of negotiating with a person who is eager to end your marriage. The atmosphere and stakes couldn’t be any more different. What’s more- I am not aware of anything that tells us that couples that agree to premarital agreements are any more likely to end up getting divorced.
Of course, what your personal circumstances are may vary somewhat with most people’s experiences regarding premarital agreements. With that said, let’s discuss this topic a little further in today’s blog post from the Law Office of Bryan Fagan, PLLC.
What a premarital agreement can be
A premarital agreement is not designed to be a one-stop shop for all your premarital needs. The agreement’s confines are specifically laid out in the Texas Family Code as far as what can and what cannot be included in the document.
You are able to detail the rights and obligations of you and your spouse to be for specific pieces of property- both personal and real property. This is regardless of when the property was acquired or where it is located. For instance, your or your spouse to be’s ability to sell or lease a piece of real estate can be covered by this document. Finally, how the property will be treated upon a future divorce can certainly be covered by a premarital agreement.
The key part of premarital agreements is that you and your spouse can choose how to designate a piece of property- as either community or separately owned. This can be a big deal because the law in Texas is that there is a presumption that all property owned by you and your spouse at the time of a divorce is considered to be community property. This means that if you intend to argue that a piece of property is your separate property you must ordinarily provide evidence to a court to prove this assertion of yours.
Under a premarital agreement, however, you and your spouse can set aside the laws of Texas and designate items as being either community or separate property based on your own wishes. This is a powerful tool available to you that otherwise would not be available to you in a courtroom. If your divorce case were to make it that far, a judge would be forced to apply the community property laws of Texas to your case.
On top of that, a premarital agreement can dictate the terms of how a piece of property is managed and controlled during your marriage and can specify whether or not spousal maintenance is to be paid after a divorce. When it comes to money and property these are some of the most highly contested subjects that couples encounter in a typical divorce and having them decided well in advance of the divorce can be a great way to help a divorce keep from getting bogged down if one has to be filed later on.
What doesn’t the law in Texas allow a premarital agreement to do?
Kingwood Divorce Attorney: A premarital agreement cannot contain anything that violates state criminal law or violates public policy. Importantly, you and your spouse cannot come to any sort of agreement on child support in a premarital agreement. As in, you cannot agree ahead of time that you and your spouse will not ask the other for child support- even if you have children that are already born.
The reason for this is that it is a judge’s responsibility to ensure that the best interests of your child are taken into consideration in any orders regarding support of that child. He or she will be fine with an amount of child support that you and your spouse agree to incident to a divorce but will not enforce a provision of your premarital agreement related to child support.
For example, you may have a child that requires around the clock medical attention due to physical impairment of some sort. As a result, the provision included in your premarital agreement that states no child support will be paid under any circumstances doesn’t seem to be in line with what is in your child’s best interests.
The top ways in which a premarital agreement can be determined to be unenforceable
Like any written contract, ideally, the document will be enforceable in court in the future should a divorce occur. If a judge cannot enforce the agreements made within the document then all the time, money and effort that went into negotiating and drafting the agreement was pointless and for naught.
A good question to ask yourself at this stage of your investigation into premarital agreements would be how can you and your spouse avoid putting yourself in that type of situation. Let’s go over the most likely reasons that I believe premarital agreements are determined to be unenforceable.
First of all, any agreement must be made voluntarily. As in, you and your spouse must both have shown a knowledge of the issues being agreed upon and a willingness to enter into the agreement. This means that you cannot have forced him or her to sign the agreement and vice versa. You also must not have fraudulently induced him or her to sign, or vice versa. If it can be shown that one of you relied on a promise made by your spouse and that promise turned out to be false then the contract will likely be determined to be unenforceable and not valid.
Secondly, your premarital agreement may be determined to be unenforceable if one of you are able to prove that it was unconscionable. This means that the agreement is so unfair, so one-sided that it cannot be enforced as a result. In reality, it is pretty difficult to prove this.
Years after signing the agreement if you argue that the agreement is invalid on grounds of unconscionability you would need to show more than that it is just favorable to your spouse. There is nothing necessarily unconscionable about that, per se.
The reality is that the failure to disclose pertinent information or that debts/assets/liabilities were hidden from you in negotiating the agreement is a necessity when arguing unconscionability. If both you and your spouse were represented by an attorney it becomes even more difficult to argue this point because once an attorney becomes involved it is presumed by most courts that the attorney representing you was reasonably prepared and capable of advising you in conjunction with whether or not to sign off on the agreement that you entered into.

Wireless carriers step up to help with Hurricane Harvey relief efforts

When Hurricane Harvey ravaged southern Texas in late August, it was all hands on deck to assist with recovery efforts. Everyone from residents, companies, celebrities and sports organizations stepped up to help those affected by the storm.
Among those lending a helping hand were wireless carriers. The biggest names in the industry like Verizon, T-Mobile, Sprint and AT&T provided aid in the recovery by donating time, minutes, data, tower repair or a combination of all four to help their customers.
T-Mobile for example offered unlimited data to customers who weren’t currently on an unlimited plan from August 28 through September 8 so they could receive storm activity updates and keep in contact with friends and family through social media. The carrier also promoted, “Text to Give” with information on how to make $10 donations to the American Red Cross for Hurricane Harvey disaster relief, Team Rubicon’s Hurricane Harvey Relief Fund and the Convoy of Hope’s Hurricane Harvey Relief Fund. Since about 50 towers in T-Mobile’s Corpus Christi market faced service issues, it deployed new generators and equipment after the storm subsided.
“Our thoughts and prayers are with everyone in the path of this terrible storm,” T-Mobile president and chief executive officer John Legere said in a statement.
AT&T is also helping customers with their service costs. Wireless customers in affected areas will receive credits for additional data, voice, and text charges. AT&T prepaid customers will also receive credits for additional voice and text charges. The offer started on August 26 and will run through at least September 1.
The company also donated $350,000 in aid, divided between the Greater Houston Community Fund, the American Red Cross Hurricane Harvey Fund and the Coastal Bend Community Foundation in South Texas, according to CNBC.
AT&T’S wireless services in the Corpus Christi area are mostly restored while wireline services are still being affected by power outages and storm damage. In the Houston and Beaumont areas, wireline and wireless services have been affected by flooding for some customers, but technicians are working to restore service to those affected areas as quickly and safely as conditions allow, the company said in a statement.
In the meantime, AT&T has two temporary cell sites deployed in Kingwood, TX and an evacuee center in Alexandria, LA. It also has a temporary site at a staging area in Anniston, LA and is deploying an Emergency Communications Vehicle to one of its wireline facilities in Houston. AT&T also has three charging stations each at the Houston Convention Center and at NRG Stadium as well as one at the Dallas Convention Center for anyone who’s seeking shelter there.
Meanwhile, Verizon made an announcement that it would pledge $10 million to fund Hurricane Harvey relief efforts. It will work with local and state government officials to select four non-profit agencies to support that are doing work on the ground currently and in terms of long-term needs.
Verizon also relieved postpaid customers of their data, talk and text charges and gave prepaid customers an additional three gigabits (GB) that can be used for data, talk, and text from August 26 through September 15. The carrier also deployed mobile equipment like Cells on Wheels (COWs) and Cells on Light Trucks (COLTS) to provide extra service in parts of south Texas that were in need of extra network capacity.
“It is heartbreaking to witness a disaster of this magnitude; our hearts and full support go out to the communities being impacted by Hurricane Harvey, including our own customers and employees,” Verizon Chairman & CEO Lowell McAdam said in a statement. “Verizon is committed to working alongside disaster relief partners to help return a sense of normalcy to residents and restore the areas impacted by the storm. Houston and south Texas are vital to the fabric of America and we want to be on the front lines of the rebuilding efforts.”
Spring and SoftBank committed to a $2.5 million donation, which will go to the American Red Cross Hurricane Harvey Relief Fund, various community relief organizations as well as to Sprint employees in the affected areas.
The company also waived casual call and text overage fees for Sprint, Boost and Virgin Mobile Customers as well as waived data overage fees for Texas and Louisiana customers affected by the storm. Sprint employees also set up a GoFundMe campaign to help pay for recovery and restoration efforts for colleagues impacted by the hurricane

The ranking was determined by identifying ZIP codes within the top metropolitan areas in the U.S. that contained at least one public school ranked eight out of 10 or higher by GreatSchools, then calculating affordability by factoring in the ZIP code’s median income and median-priced home with monthly mortgage payment and other cost data.

Back-to-School Special: Top 10 Affordable Towns With the Best Schools

Before long the temperatures will dip, the foliage will turn red, and yellow school buses will magically reappear in the nation’s suburbs and cities, picking up and dropping off children. And many parents will again begin worry whether their kids are getting A-level educations.
The desire to live in an area with a top-notch school district, of course, is one of the forces that drive many home-buying decisions for families. And most parents will do whatever it takes to ensure a great eduction for their kids. But here’s the reality: You don’t need to drop a load of money on private schools to make sure your children are learning their ABCs. And you don’t need to move to the priciest parts of the country to get into a top-rated public school.
You could just need to head to the Chicago suburb of Aurora, IL—or any of the other places on our list of affordable towns with the best schools.
Realtor.com® found the best elementary schools (which received at least an 8 out of 10 ranking by education information group GreatSchools) in the largest 15 metros where buyers can find a home without breaking the bank. You’re welcome!
To compile our rankings, our economics team looked at the monthly housing costs (mortgage payments, taxes, etc.) needed to purchase a median-priced home in all of the ZIP codes in each metro. To ensure buyers were getting a deal, we factored in the median income of residents living there to ensure affordability. We also filtered out the ZIP codes with high crime and poverty rates, and for geographic diversity included only one ZIP code per metro.

Aurora topped the list due to its having three top-rated elementary schools. It’s also 45% more affordable than the surrounding metro area.
“It’s absolutely family-friendly,” says local real estate broker Margaret Rowe of Coldwell Banker Residential Brokerage. She touted the myriad parks and family events held in Aurora.
