Adipurush Case Controversy (2022): Facts, and Similar Cases

This article on 'Case filed against Adipurush for hurting religious sentiments: Facts and Laws' was written by Monika Yadav, an intern at Legal Upanishad.

Introduction

There have been several instances that came up with the issue of hurting religious sentiments and movies are the new targets in such matters. It’s a point of discussion that are religious sentiments this much fragile that they are hurt by mere small incidents. But sometimes, it became a matter of faith when facts were manipulated and not accepted by the religious community. In this article, we were discussing a similar incident in the movie Adipurush as well as the laws related to the same.

Facts

An attorney from Lucknow named Pramod Pandey filed a lawsuit against Saif Ali Khan, Prabhas Raghav, Kriti Sanon, producer Om Raut, and Bhushan Kumar with the Chief Judicial Magistrate (CJM). According to Section 153 (3) of the Cr.P.C, he has asked that a case be brought against the performers and directors for inaccurately representing Hindu deities, especially Shri Hanuman and Shri Ram. Saif will portray the villain in Om Raut's film, Lankesh, who is modeled after Ravana. Prabhas, a popular actor from South India, will play a part that is based on Lord Ram. According to the appeal, Saif Ali Khan was cited as saying in a contentious interview on December 6 that Ravana had a right to kidnap Sita because Ram's younger brother Lakshmana injured Surpanakha's nose. It's exciting to play a demon king since there are fewer restrictions in that role, Saif added in the Mumbai Mirror interview. However, we will humanize him, raise the entertainment value, and excuse his kidnapping of Sita and fight with Ram as retaliation for what his sister Surpanakha suffered at the hands of Lakshmana, who amputated her nose. The artist issued an apology and removed his words after receiving internet backlash. The matter is being heard in the Additional Chief Judicial Magistrate's (ACJM) court and the date of the next hearing is set for December 23.

Manimekalai emphasized, stating that the documentary centers on the events that occur one evening when Goddess Kali emerges and strolls around Toronto's streets. She was charged with "hurting religious emotions through displaying Deity Kali smoking," though. Khuda Hafiz 2 Shia community members voiced worry that the song, "Haq Hussain" from the movie would offend their religious sensibilities. Makers expressed regret, adding, "Please rest assured that no member of said Shia community has been misrepresented in the movie, nor does it feature any Shias attacking others. The song was written with the purest of motives to honor Imam Hussain's greatness, and it was never intended to offend anyone's religious beliefs. However, we deliberately made the aforementioned alterations while taking into account the beliefs of the Shia sect." Tandav The most recent and critical incident included “Tandav”, which was made available on Amazon Prime on January 15 of this year. The creators of "Tandav" were charged with disparaging both the Indian Prime Minister and Hindu deities. The problem was also discussed at the ministerial level in addition to being the subject of a police FIR. The I&B ministry requested an explanation from the Amazon team. Apologies were requested and given. The scenes that offended people's feelings were taken out. A suitable boy The creators of the online series “A Suitable Boy” and Netflix have received a legal warning from the All India Shia Personal Law Board (AISPLB) for wilfully offending Shias' religious feelings by depicting the desecration of a “tazia” (a copy of Imam Husain's shrine) in one of the episodes. The online series was produced by BBC Studios and directed by Mira Nair. The Netflix OTT platform offers it. The creators must take the sequence out of the online series and apologize publicly, as the Board has asked through its notice them.

Adipurush Case Controversy (2022): Facts, and Similar Cases Laxmmi The Akshay Kumar-starring movie Laxmmi Bomb was changed to Laxmmi when it garnered negative press. The producers started receiving a legal letter from the Shri Rajput Karni Sena of Rajasthan, which claimed that the term Laxmmi Bomb was disrespectful to Goddess Laxmi and that it offended sensibilities. PK Violence was feared and there was tremendous uproar when the Aamir Khan movie "PK" was released. People believed that the movie mocked the Hindu gods. But the government provided cinemas showing the movie with police protection as a sign of tolerance & freedom of expression in a democratic system. Brahmastra Social media users criticized a particular sequence from the Brahmastra trailer in which Ranbir Kapoor can be seen ringing a bell while wearing shoes, leading many to believe that the action took place inside a temple. On this, the filmmaker provided clarity. "We had certain folks in our community, unhappy due to one shot in the Trailer - Ranbir's role wears shoes while he rings a Bell," Ayan Mukerji wrote. As the writer of this movie and a fan, I felt compelled to apologize for what transpired. Ranbir is entering a Durga Puja Pandal in our movie, not a temple. A similar Durga Puja celebration has been held by my own family for... 75 years! One, of which I've been a part of ever since I was a young child. According to my observations, we only remove our shoes when we are directly in front of the Goddess on the stage. I feel compelled to apologize to everyone who has been offended by this image because, above everything, Brahmastra is intended to be an appreciation of and celebration of Indian history, culture, and custom. That is the main motivation behind my film, so it is crucial to me that every Indian viewing Brahmastra experiences that same sentiment. Thank God The planned movie “Thank God” starring Ajay Devgn has faced legal issues. In a Jaunpur court, a lawyer by the name of Himanshu Srivastava has filed a complaint against the movie's director Indra Kumar, alongside actors Ajay Devgn and Siddhartha Malhotra. The petitioner, whose statement would be recorded on November 18, claims that the film's trailer makes fun of religion and has offended people of faith. According to Srivastava's plea, "As the lord of karma, Chitragupta maintains a record of a person's good and negative activities. Such God representations might lead to unpleasant situations because they offend religious sensibilities." He further mentioned that Ajay Devgn, who is dressed in a suit, is seen acting the part of Chitragupta, and in one scene, he can be seen making jokes and using foul language.

Laws in hand

Most cases involving religious sentiments are registered under Sections 153A (promote enmity among various groups on basis of religion, race, place of birth, residence, language, etc.) and 295-298 (insult religion, disturb a religious assembly, trespass on graves, make statements to hurt religious feelings) of the Indian Penal Code (IPC). When it occurs in a holy place, the prison sentence can be increased to five years from the standard three-year sentence and fines. The maximum sentence for anyone convicted of insulting religion is three years in prison, no bail, and an arrest without a warrant. The subjective character of accusations is the issue with these laws. It is insufficient to claim that a comment promoted hostility. According to the judiciary, it is necessary to show a connection between whatever had been said and disorderly conduct from the perspective of a reasonable, unbiased observer. Someone else might not find offensive what you do. Therefore, a comment or action must upset a group of people to consider an insult. The deciding element is conscious intent.

Conclusion

We have discussed so many incidents along with a few remarks made by the judiciary. Laws are in place but still, these laws hold back specific criteria which need to be amended. We should look forward in this matter to what will be held by the court.

Amid the controversy surrounding Trinamool Congress MP Mahua Moitra’s remarks on a film poster which was featuring Goddess Kali, on Sunday, prime minister Narendra Modi invoked the Hindu deity. A speech at an event that has been organized by the Ramakrishna Mission triggered a fresh war of words between the TMC and BJP.

 When the prime minister was virtually addressing the centenary celebrations of the 15th president of Ramakrishna Math, Swami Atmasthananda, the prime minister said that the “blessing of Maa Kali is always with the country, which is moving ahead with a spiritual energy for the welfare of the world”.

He further added “Swami Ramakrishna Paramhansa was one such saint who had a vision of Maa Kali and had surrounded his whole being at the feet of Maa Kali. He used to say this whole world, everything is pervaded by the consciousness of Goddess Kali. This consciousness of Goddess Kali is visible in the Kali puja of Bengal. The consciousness is visible in the faith of Bengal and the country”.

He also went on saying “whenever I had the opportunity, I visited Belur Math and Dakhineshwar Kali Temple. It is natural to feel a connection. When your faith and beliefs are pure, the power she shows you the way. The limitless blessings of Maa Kali are always with India. The country is moving ahead with this spiritual energy for the world’s welfare”.

The BJP leaders took the opportunity to hit out at Trinamool Congress and its MP Mahua Moitra. Soon the TMC MP hit out at the PM and Malviya. “Would advise BJP’s troll in charge for Bengal to tell his masters to stop commenting on things they have no clue about. Didi-O-Didi got them the boot. Now, Maa-O-Maa will get them a foot on their chest,” The tweet refers to the PM’s Didi-O-Didi” jibe at Mamata Banerjee during the last year’s assembly election campaign.

Good Morning Gentle Reader…. Where ever you are on this little blue planet we call home, and I must say we have readers all over the world, and as I read the newspapers in the morning and learning about the problems or the successes I think of you,, because the news has become more personal to me since I started to write The Daily Tulip, all of a sudden, it’s like I have family or should I say an extended family all over the world….. So let’s take a look at what is happening in some of those countries….

STRICTER PUNISHMENTS FOR SPEEDING OFFENCES IN ENGLAND AND WALES…. Tougher punishments for the most serious speeding offences have come into force in England and Wales. Under new guidelines, fines for drivers caught doing 51mph in a 30mph zone or 101mph on a motorway will start from 150% of weekly income, rather than the previous level of 100%. The Sentencing Council said it wanted a "clear increase in penalty" as the seriousness of offending increases. Motoring groups have broadly welcomed the new guidelines for magistrates. The new measures follow responses to a consultation. It said previous guidelines did not properly take into account the increase in potential harm that can result as speed above the limit rises. Fines will also be increased for when motorists drive at 41mph or faster where there is a 20mph limit. However, because the maximum fines allowed by law remains the same, speeding drivers cannot be fined more than £1,000 unless the offence takes place on a motorway, where the limit is £2,500. Some 244 people were killed in crashes that occurred when a driver was breaking the speed limit on Britain's roads in 2015. AA president Edmund King said it was right that "extreme offenders" were punished "severely". He added: "Responsible drivers will welcome the changes coming into force today. "The majority of drivers who keep to the correct speed, as well as driving to the conditions, won't be affected. "It is only those who deliberately drive dangerously who will end up in court."

INDIA VISIT 'VERY PRODUCTIVE' DESPITE CONTROVERSY, SAYS SAJJAN…. Canada's Defence Minister Harjit Sajjan says his official visit to India has been "very productive" despite political tensions. Mr Sajjan says he has been able to bolster ties between India and Canada. Punjab's top elected official had accused him of sympathising with a Sikh independence movement, which he denies. Mr Sajjan also distanced himself from a recent motion passed by a Canadian provincial legislature describing 1984 anti-Sikh riots as "genocide". The Canadian minister's six-day trip is meant as an opportunity to strengthen security and defence relations between the two nations, and he has met with his Indian counterparts and business executives. But it hit turbulence when Punjab Chief Minister Amarinder Singh alleged on a television program that Mr Sajjan was "a Khalistani sympathiser". The Khalistan movement seeks to create a separate independent Sikh homeland in the Sikh-dominated northern state of Punjab. Canadian authorities have also linked Sikh separatist militants to Canada's 1985 Air India bombing, which killed 329 people. Without offering names, Mr Singh also said other members of Canadian Liberal Prime Minister Justin Trudeau's cabinet held similar sentiments. Mr Singh refused to meet Mr Sajjan. Canada has called Mr Singh's remarks "disappointing and inaccurate". The BBC's Ravinder Singh Robin in Amritsar, Punjab: It was a trip meant to strengthen bilateral ties, but with Punjab Chief Minister Amarinder Singh refusing to meet him, Mr Sajjan's visit hit a sour note. mMr Singh insisted that he had "concrete information" that Mr Sajjan was "a Khalistani sympathiser, just as his father Kundan Sajjan, a board member of the World Sikh Organization", but failed to provide any proof. It's a charge Mr Sajjan - and the Canadian embassy in India - has denied. Mr Singh's political rivals have accused him of playing petty politics and humiliating the Sikh diaspora by not meeting Mr Sajjan. The chief minister's refusal to meet the Canadian minister has baffled many. Mr Singh had resigned from the Congress party in protest in 1984 after the Indian security forces entered the Golden Temple at Amritsar, leading to some suggestion that he, too, had some sympathy with the separatists. Also, a couple of years ago, he was photographed sharing a stage with senior Khalistani separatist leaders during a visit to Canada. And that's why there has been some suggestion that his current stand is motivated more by personal reasons - last year, the Canadian government did not allow him to hold political rallies in Toronto and Vancouver to raise funds for his election campaign.

KATY PERRY TROLLED BY INDIANS FOR GODDESS KALI POST ON INSTAGRAM…. Pop star Katy Perry is facing the wrath of Indians online after uploading an image of the Hindu goddess Kali with the caption "current mood". "Ma Kali", as she is popularly known, is the Hindu goddess of destruction. Since it was uploaded a day ago, the Instagram post has received more than 11,000 comments, most of them abusive and by Indians. Many called for her to take down the picture. Perry has not responded to the comments and has left the image as is. The image she has used is commonly found on calendars and posters in India. Although some of her fans have tried jumping to her defence, they are far outnumbered by angry and emotional Indians.

A girl of eight who survived when the car she was in sank in Australia, killing three family members, has described her desperate struggle to raise the alarm. Chloe Kabealo said she had unbuckled her seatbelt and tried to "go up for air", then "just kept floating up out". She said of her lost family members: "They were all loved and they'll never be forgotten." Her father, who was not in the car, said he was "shattered" by the loss. "I'm not holding up," Matt Kabealo said. "I'm just being strong for my daughter." Chloe and her mother, sister and brother were in a car in the small town of Tumbulgum in New South Wales when it slid off a muddy road into a flooded river earlier this month. Chloe escaped and ran to a farmhouse to raise the alarm. Stephanie King, 43, died trying to save her children.

WHY ROME SENDS TRAINS FILLED WITH RUBBISH TO AUSTRIA…. Rome's rubbish is helping to power Austrian homes - and it gets to Austria by train. Rome has been struggling to cope with a rubbish crisis and Austria has spare capacity at a waste-to-energy plant near Vienna. So a deal has been struck. The Italians are paying Austrian company EVN to dispose of up to 70,000 tonnes of Roman household refuse this year. The waste is transported by train through northern Italy, over the Alps and ends up at the EVN thermal waste utilisation plant at Zwentendorf on the Danube. Up to three trains a week arrive at the Zwentendorf plant. Each carries airtight containers loaded with around 700 tonnes of Roman household waste. The refuse is incinerated and converted into hot flue gas, which generates steam. The steam is delivered to a neighbouring power station, where it is converted into electricity, which is used to power 170,000 houses in the province of Lower Austria.

BRAZIL GOALKEEPER BRUNO FERNANDES FACES NEW ARREST OVER GIRLFRIEND MURDER…. Brazil's chief prosecutor has requested the arrest of a football player released from jail after serving only part of a lengthy murder sentence. Bruno Fernandes played as goalkeeper for Brazil's most popular football club, Flamengo, until 2010. He was sentenced in 2013 to 22 years in jail for ordering the murder of his former girlfriend, Eliza Samudio. The Supreme Court will meet on Tuesday to rule on prosecutor Rodrigo Janot's request. The court ordered his temporary release in February on the grounds that he was appealing against the murder sentence. Fernandes, 32, signed a contract with second division club Boa Esporte last month and has since played several matches. He has served less than a third of his sentence, taking into the account the time he spend in prison before his trial. His early release has angered many in Brazil, including campaigners to end violence against women.
