The Bench of Hon’ble Madam Justice Jyotsna Sharma J on 08.01.2024 allowed the Writ of the Petitioner and quashed the Criminal Proceeding arising out of the complaint filed under section 500 IPC by the Complainant - Dashrath Kumar Dixit.
It was held prima facie no offence under section 504 IPC is made out and therefore this is a case where this court, in exercise of powers under Article 227 of the Constitution, should interfere to prevent and nip in the bud misuse of law, hence the impugned orders are set-aside and this petition is allowed.
Background
Present petition has been filed for getting the entire criminal proceeding quashed and summoning order of the CJM U/s 504 IPC.
Facts
Dashrath Kumar Dixit – Complainant Advocate filed a complaint before District Magistrate, Varanasi on 15.05.2017 against Sangeeta J.K., Executive Director, Kiran Society and ten others under section 500 I.P.C.
The Inquiry Officer called parties to H.R.T.C. Auditorium on 19.05.2017 in connection with the Inquiry and in the presence of the parties, the complainant alleged that he was insulted with the following words "this person is mad".
The production of evidence during the inquiry was recorded by the Inquiry Officer - Rajesh Kumar Mishra.
On the basis of above allegations, the court proceeded to record the statements of Dashrath Kumar Dixit-the complainant under section 200 Cr.P.C.
And also recorded statement of witnesses namely Vinod Kumar Goswami, Anil Kumar Gupta and Santosh Kumar Pandey under section 202 Cr.P.C.
A number of documents were produced at that stage.
Summoning order were made on 24.09.2021.
By this summoning order, Sangeeta J K was summoned under section 504 I.P.C.
The accused Sangeeta J.K. preferred a revision before District Judge, Varanasi, assailing the summoning order.
Both the sides were heard, but the revisional court affirmed the order of summoning by passing an order on 31.05.2023.
Aggrieved with the summoning order passed by the Magistrate on 24.09.2021 and affirmation of the Summoning order by the Revisional Court vide its order dt. 31.05.2023 present Writ was preferred
Submission of the petitioner
The incident allegedly happened on 19.05.2017.
And the complaint has been filed more than a year therafter i.e. on 24.09.2017.
Further that the complainant in his statement under section 200 Cr.P.C. did not show anything which could have been considered as constituting an offence under section 504 I.P.C.
And even the witnesses examined under section 202 Cr.P.C. did not state any material fact which can be taken as coming within the definition of section 504 I.P.C.
It is further submitted that the complainant had filed the complaint under section 500 I.P.C., and from the evidence produced by him, no offence under section 504 I.P.C. or any other is made out.
The complaint has been filed after lapse of one year and four months from the date of incident with a view to harass him.
Another contention is that the Magistrate took cognizance by summoning the accusedpetitioner on 24.09.2021 under section 504 I.P.C.
There is nothing to suggest that the complainant was intentionally insulted or provoked intending and knowing that such act will cause him to break the public peace.

They cannot be relied upon and that they have colluded with the petitioner for initiating this malicious prosecution.

Issues
From the statements given by the complainant and his witnesses, if presumed as truthful, whether offence under section 504 IPC is made out?
Whether the Magistrate applied its judicial mind to arrive at requisite satisfaction before he decided to take cognizance.
Ingredients of Section 504 IPC
intentional insult,
the insult must be such as to give provocation to the person insulted, and
the accused must intend or know that such provocation would cause another to break the public peace or to commit any other offence.
Issue No.1
Observation of the Court
Intentional insult must be such as to give provocation to the person insulted to break the public peace or to commit any other offence.
The only allegation is that in front of several others, participating in the meeting, the accused said that this person (the complainant) is mad.
This may be noted that these words were uttered when both the sides were called in connection with an inquiry which was initiated on the basis of a number of allegations made by the complainant against the accused and her society.
It was a stray statement made in a careless manner, not intending that it may provoke a person to break the public peace or commit any other offence.
Even if, for the sake of argument, uttering of such words are taken as intentional insult however in my opinion the same cannot be construed as of such degree so as to provoke any person to cause breach of peace.
Circumstances suggest that uttering of such words could be an unintended spontaneous remark made in the prevailing atmosphere in the backdrop of number of allegations, which were flown at the accused and her society.
More often than not, in informal atmosphere such remarks may be carelessly thrown and may even form part of casual conversation having no criminal element for intentional causing of breach of peace.
Any such stray statements made by any person, may be inappropriate, improper and rude, however, in my view, they do not bring the Act within the four corners of section 504 as defined in Indian Penal Code. Definitely what may be the impact of spoken words, can only be inferred from the peculiar facts and circumstances of a case.
Issue No.2
Observation of the Court
In the case in hand, the remark was inappropriate or even rude but circumstances prima facie does not establish that it was intended to provoke the person to cause breach of peace.
The courts concerned failed to apply law in correct perspective.

Review: Mirzapur (A)
Amazon Prime Video, Netflix, Hotstar seem to have changed the TV viewing habits forever. Uncensored, uncut and with a direct reach to the target consumers at extremely low distribution costs. This new mode of entertainment has at par impact, if not more and is making a lot of moolah. Most importantly, there is scope for ample creativity and opportunity for serious writers, actors and directors.
Mirzapur is one such latest series which has gripped the nation with its strong script and dialouges and can easily be called the Gang of Wasseypur of the Internet web TV or Sholay of this era. Honestly, I would rate it higher than the two.
What direction!!! What a script !! What performances!! Simply flawless. Mind-blowing. But apart all, the USP of Mirzapur is the casting of character.
The Theme and performances
The ruthless Akhandanad Tripathi (Pankaj Tripathi), popularly known as Kaleen Bhaiya – is a millionaire carpet exporter and the undisputed don, mafia king, Baahubali of Mirzapur, a small town in UP. The story of season 1 of the 9 episode series revolves around Kaleen Bhaiya who struggles to save his business empire due to unloyal employees and his unworthy, power-hungry legal heir Munna Bhaiya (Divyendu Sharma) who has his own aspirations and is ready to do anything to inherit his father’s legacy.
These two characters are the lifelines of the script and the two actors have given a power packed performance. Pankaj Tripathi is sober yet terrifying with his body language and eyes. He looks so genuine in the phases where Kaleen Bhaiya feels helpless because of his son despite being the powerful don. And Divyendu !!! He is the main villain of the script and reminds of Vinod Khanna of Mera Gaon Mera Desh. Flawless, powerful, real and designed for the role of Munna Bhaiya, Divyendu has eveloved as an actor and probably performed the best role of his life.
There are more than 18 major characters in the series and all have been performed perfectly by the aptly picked actors. I believe from hereon these actors will be remembered by their screen names.
One performance which definitely need a mention here is of Guddu Bhaiya (Ali Fazal). He is the latest find here and is simply superb. Starting from a lean looking final year engineering student in 3 idiots to a matured student in Fukrey, Ali Fazal has come a long way in Mirzapur. The way he has complimented his WWF kinda body with the out of the box performance in Mirzapur, I was forced to call him the Indian terminator and compare him with Arnold.
The Verdict
Every episode has different phases of scripts with each character getting equal importance and justice. Karan Anshuman (Director / Creator), Gurnmeet Singh (Director) and Puneet Krishna (Creator) are fabulous as a team and if I can say so, a notch above than Ram Gopal Verma and Anurag Kashyap at their peak.
So delicately crafted and smoothly woven between the stories of large number of powerful characters, the script is the mainstay of the series. It is definitely an action thriller, but the range is vast to have different shades of romance, Chanakya-niti, political set up and small town life.
Suggestion: 1) Watch it with headphones on. 2) You will watch all episodes in one go, so make sure you start only when you are free.

New Delhi [India], Dec 17 (ANI): Congress leader Sajjan Kumar was on Monday convicted in the 1984 anti-Sikh riots case and sentenced to life imprisonment by the Delhi High Court, which overturned a lower court judgement and said there appeared to be "large scale efforts to suppress cases" against him. The bench of Justices S Muralidhar and Vinod Goel asked the 73-year-old former MP to surrender before December 31 and serve the sentence for rest of his life. It also directed him that he should not leave Delhi. Kumar's lawyer said the verdict will be challenged in the Supreme Court. The verdict, which termed the "mass killings" of sikhs as a "carnage of unbelievable proportions", was welcomed by the victims and provided ammunition to the BJP to target the Congress. The High Court, which reversed the 2013 trial court judgment in which Kumar was acquitted, made stinging observations related to investigations into the 34-year-old case and the clout enjoyed by Kumar, once a heavy weight in Delhi politics. The case pertains to the murder of 5 Sikhs in the Delhi Cantonment area during the large scale violence that followed assassination of then Prime Minister Indira Gandhi on October 31, 1984. During four days of violence, about 2,700 Sikhs were killed in Delhi alone. "In the summer of 1947, during partition several people were massacred. Thirty seven years later, Delhi was the witness to a similar tragedy. The accused enjoyed political patronage and escaped trial," the court said. "It was an extraordinary case where it was going to be impossible to proceed against Sajjan Kumar in normal scheme of things as there appeared to be ongoing large-scale efforts to suppress cases against him by not even recording them," the court said. The judgement further read that "the mass killings of Sikhs between 1st and 4th November 1984 in Delhi and rest of the country, engineered by political actors with the assistance of the law enforcement agencies, answer the description of crimes against humanity." It added that what happened in the aftermath of the assassination of Gandhi by her two security guards was a "carnage of unbelievable proportions" in which over 2,700 Sikhs were murdered in Delhi alone. "Law and order clearly broke down and it was literally a free for all situation. Aftershocks of that still being felt," the court said. Slamming the way investigation was carried out into the case, the court observed, "Even if they (cases) were registered, they were not investigated properly and investigations which saw any progress were not carried to the logical end of a charge sheet actually being filed. Even defence does not dispute that as far as FIR is concerned, a closure report had been prepared." The judgment was pronounced on an appeal challenging the Congress leader's acquittal. On October 29, the Delhi High Court had reserved the order in the case after the culmination of arguments. "Remedies have not been exhausted. We respect the judgment but our right is to move to the Supreme Court as the first appeal as a matter of right or otherwise also," Kumar's counsel Anil Kumar Sharma said. "We feel that the Honourable Judge has not agreed with our point. Therefore, in order to put forth our point we will move to the next forum," Sharma told reporters here. He added that the case against Kumar was one of "no evidence." "According to us, this case was a case of no evidence because Kumar was named in the case in 2000 for the first time whereas prior to that complainant had given an affidavit before Ranganath Mishra Commission where our name was not featured and no role was assigned to us. Abruptly in 2000, our name comes. Other evidence came after 26 years and third after 28 years. We find it a good cause of appeal," he added. Earlier in 2013, the Karkardooma trial court had acquitted Kumar and convicted five others in the case. The appeal in High Court was filed by those convicted in the case, investigative agency CBI and the family of victims. The trial court had awarded life imprisonment to former Congress councilor Balram Khokhar, retired naval officer Bhagmal and Girdhari Lal. A three- year jail term was awarded to Kishan Khokhar and former MLA Mahender Yadav. "We are very thankful to the Indian judiciary," said H S Phoolka, a petitioner in the case, while commenting on the High Court judgement. The victims also hailed the verdict. "We are happy with this verdict. Other convicts must also be brought to justice. Life imprisonment to Sajjan Kumar has given us a hope of justice now," said victim Dara Singh Union Finance Minister Arun Jaitley used the judgement to attack the Congress and the Gandhi family and said a "closure" in the case will come only after other accused Kamal Nath, now Chief Minister of Madhya Pradesh, and Jagdish Tytler are also convicted. "The 1984 injustice hangs around the neck of both of the Congress party and the Gandhi family which ensured that no justice is done to the victims of 1984. Instead of ensuring punishment to the guilty and justice to the victims, the Congress government repeatedly indulged in a cover-up exercise," he told media persons here. "The injustice of 1984 needs a closure. It is only after these key Congress leaders who had perpetrated the injustice including Kamal Nath and Jagdish Tytler are convicted," he said. "For many of us who are witnesses to what happened in Delhi in 1984, it was perhaps the worst kind of genocide. Finally, the cover-ups are being defeated and the judgment of Delhi High Court is an extremely welcome development," the senior BJP leader added. Jaitley further said: "The first part of the cover-up exercise was that the truth shouldn't come out at all. So when civil liberties organisations came out with a whole report on 1984 riots, the report was banned by the Congress government in 1984-85." "Thereafter, the sitting judge of the Supreme Court was appointed and surprisingly the commission led by him didn't blame the Congress government. The judge concerned in the case was made the member of the Rajya Sabha after retirement," he added. Congress leader and former Union Minister Kapil Sibal, while refuting allegations against the Congress party, said, "Sajjan Kumar wasn't given any ticket by our party and he doesn't hold any office." Congress leader and Punjab Chief Minister Amarinder Singh welcomed the conviction of his party colleague Kumar. "The reversal, by the High Court, of the earlier acquittal of Sajjan by a trial court had once again proved that the judiciary in India continues to stand tall as a pillar of the nation's democratic system," he said. He, however, said neither the Congress party nor the Gandhi family had any role to play in the rioting. "These leaders, who included Sajjan Kumar, did not have any official party sanction and deserved to be punished for their horrendous crime", the Chief Minister said. (ANI)

Mr. Johri, who was forced to go on leave three weeks ago, can now resume office, even as one member of the three-member probe panel recommended ldquo;gender sensitivity counsellingrdquo; for him. While CoA Chairman Vinod Rai approved of Mr. Johri resuming office, Diana Edulji demanded his resignation on the basis of some recommendations, including counselling. The three-member probe panel comprised Justice (Retd) Rakesh Sharma, former Delhi Commission of Women chairperson Barkha Singh, and lawyer-activist Veena Gowda, who recommended counselling for Mr. Johri. ldquo;The complainants have failed to provide their cases as set up by them...The allegations of sexual harassment in the office or elsewhere are false, baseless and have been fabricated and manufactured with an ulterior motive to harm Mr. Rahul Johri and throw him out of BCCI..,rdquo; Justice Sharma, who headed the probe committee, stated in his findings. ldquo;No adverse action need to be taken against Mr. Rahul Johri, CEO, BCCI, on the basis of these mischievous, false, fabricated, unsubstantiated complaints, e-mails, tweets etc on social media,rdquo; he added. 'Not guilty of sexual harassment'Ms. Gowda concluded that Mr. Johrirsquo;s behaviour was ldquo;unprofessional and inappropriaterdquo; on one occasion but ldquo;she has not found him guilty of sexual harassmentldquo;. ldquo;In view of his conduct at Birmingham as well as keeping in mind the allegations made by Ms. X and his conduct before this Committee with respect to the photographs submitted, it is essential that Mr. Johri undergo some form of gender sensitivity counselling/training,rdquo; Ms. Gowda observed. Ms. Singh felt that the other side of such ldquo;fabricated allegationsrdquo; should also be looked at where opportunities for women at workplace may dwindle. ldquo;In my opinion, such kind of motivated and fabricated allegations will diminish the status of women and the job opportunity for them. Such complaints will also have an adverse effect on the fight for equality for women,rdquo; Ms. Singh stated. ldquo;Setting such precedents will only make it more difficult for achieving equality and equal opportunity for women,rdquo; she added. Edulji differsThe committee, which was formed on October 25, was given 15 days to complete the probe by the CoA. Its report would also be submitted to the Supreme Court. Ms. Edulji didnrsquo;t want the report to be published on Wednesday and demanded that she be given at least a few days to study it. However, Mr. Rai opened the report in the presence of the panel members as well as BCCIrsquo;s legal team during the day. In fact, Ms. Edulji was against the formation of the panel and wanted Mr. Johri to be sacked on the basis of the allegations, while Mr. Rai felt that ldquo;principles of natural justicerdquo; demanded an investigation before any action. Rai said following this report, Johri can now be permitted to resume his job but Edulji said since it was a ldquo;split verdictrdquo; of 2:1 the CEO should resign having ldquo;tarnished the reputation of the organisationldquo;. ldquo;Ms. Eduji said that she does not agree with the conclusions of Justice Rakesh Sharma (Retd.) and Barkha Singh,rdquo; the CoA documentation stated. Manga is blessed with a shafa (God’s blessing) for he could cure anybody who

Once Manga cures Mark Daniels, a powerful British officer, who often suffered
from backache, he is awarded a job of an orderly in the police force as his orderly.
Manga is now confident that Sargi’s dada ji (a staunch Gandhi ji’s supporter),
who always disliked Manga, will now agree for Manga and Sargi’s marriage, as

Inderveer Singh announces to the villagers that they would have to vacate the
village and would be given a new land. The villagers oppose this decision. Laala ji
also threatens the king with severe legal consequences if the decision is not
taken back. That’s where Manga steps in and assures them that he would sort
this out with the help of his Mark saab.
Manga complains to Mark who, in turn, scolds Inderveer Singh for such a cruel
and illegal decision. Inderveer Singh apologizes. Manga is elated. Inderveer
Singh asks Manga to invite all the Naku Gudians to his palace for a party where he
would apologize to each one of them.
The villagers happily agree. They go the palace where Inderveer Singh offers
them drinks, laced with a drug.
Next morning the villagers wake up only to realize that Inderveer Singh has
taken their thumbprints on the sale-deed. They are thrown out of their own
village. They get furious, as they doubt Manga for having done that. Now the
whole village, including Sargi, hates Manga.
Will Manga be able to win Sargi’s love and Naku Guda back? Will Shyamali Devi
marry Mark? Will Manga be called a traitor forever… or…

Grandfather of Sargi, a revolutionary old man, who follows Gandhi Ji during Indian freedom struggle. Honesty, Justice and bravery is his main virtues. As the eldest in the family his decision are strong and firm. Not only this he is respected in the village and nobody goes against his words.

New Delhi (India), Dec 17 (ANI): Congress leader Sajjan Kumar will challenge the order of the Delhi High Court, which on Monday convicted and sentenced him to life in the 1984 anti-Sikh riots case, in the Supreme Court, his counsel Anil Kumar Sharma said. "Remedies have not been exhausted. We respect the judgment but our right is to move to the Supreme Court as the first appeal as a matter of right or otherwise also. We feel that the Honourable Judge has not agreed with our point. Therefore, in order to put forth our point we will move to the next forum," Sharma told reporters here. He further said that the case against Kumar was one of "no evidence." "According to us, this case was a case of no evidence because Kumar was named in the case in 2000 for the first time whereas prior to that complainant had given an affidavit before Ranganath Mishra Commission where our name was not featured and no role was assigned to us. Abruptly in 2000, our name comes. Other evidence came after 26 years and third after 28 years. We find it a good cause of appeal," he added. The Delhi High Court on Monday reversed the trial court's acquittal of Kumar in the 1984 anti-Sikh riots. The bench of Justices S Muralidhar and Vinod Goel sentenced Kumar to life imprisonment for the rest of his life and asked him to surrender by December 31. He was also directed not to leave Delhi. The case relates to the riots that took place in the aftermath of the assassination of then Prime Minister Indira Gandhi on October 31, 1984. (ANI)
